We got married last year in the US and then moved to Canada in June. We got a one year visitor's visa for my wife which is going to expire on June 9th.

We're applying to have it extended, but here is the interesting part. We have since received our interview date in Montreal for June 17th and of course will have to move to the US by the end of the year.

However, we don't want/can't move at or before the expiration of the visitor visa date and that's why we need to extend it. We were going to write that the reason for the extension needed is exactly that, that we have changed our minds on where we plan to live permanently but since we cannot move before the visitor's visa expires we need that extension.

Will this be frowned upon and might we be denied strictly on the fact that we're now going to move to the US.

Any advice would be appreciated.

Yep I'm between 18 and 65, I'm going to the Medisys clinic in Montreal about 10 days before my interview.

Thanks for that link, I think I'm all good to go but I'll probably stop by the travel clinic before we go if there are any that I need, or at least see if they think I need anymore.

I got my record of immunizations from Manitoba where I grew up and I'm getting a list from Alberta where I currently reside.

Now when I was looking at the list of required shots there looks to be about 16 of them on there. I'm just a little confused that you would need to have all of those. If that is the case then is it better to get those done ahead of time or can they do them at the medical that I have already scheduled in Montreal?

So by full copy they're looking for every piece of paper involved in the tax return? And do they want originals? The reason I ask that is because obviously we're going back to Alberta after the interview and I'd think that my father in law would like to hold on to his tax information.

I've noticed a lot of people mentioning that there are some tax forms that are asked for at the interview. Is this the originals of the copies that were sent in with the affidavit of support?

The reason I'm asking is because when I got my letter from the consulate and I went through the list of documents it said that everything was in order. Also since my father in law is the sponsor, does that mean I have to bring the originals of his tax documents or just my wife's even though she is not really "the sponsor"?

I'm just a wee bit confused after reading some other threads so hopefully someone understands my confusion and can point me in the right direction, thanks!

Do you mean zero income or she only had Canadian income? If she only had Canadian income and she did file a U.S. return then yes, take her U.S. return too.


She did not have any income from the time we got married. There was some when she worked in the US prior to moving to Canada with me.

CanadaInterview Checklist
We are leaving this Friday morning for our big trip out to Montreal and the interview on June 17th. I just wanted to run a few things past the brilliant minds here at VJ to make sure that my brilliant mind headbonk.gif is not missing anything.

What I'm looking specifically for is to make sure that I'm bringing along all the required papers, here is what I have

1. All receipts from our mailings and payment of fees
2. Copies of mailed in documents, I-130 etc
3. Interview Letter
4. Items for the medical, passport photos, immunization records, etc


Then when I get to my in-laws place before the interview I'm going to get a copy of my father in law's most recent tax return to bring along.

I went through the checklist that NVC sends out stating which documents they have and which ones they need. I went through the whole list carefully a number of times and it says they have everything that they need, no call for originals on anything. Which should be the case because they have the original criminal record check, birth certificate, and marriage license.

Of course I will have with my the required passport photos for the interview, and my passport. All my paperwork is in manila envelopes, no buttons or metal, no cell phones or other non-essential items will be brought along.

Can you guys think of anything that I'm missing or that you would recommend?

When I went there I parked just a bit further down the street at the valet parking in the next building. I forgot the name of the hotel, maybe someone else can recall what it is. It cost me $9 since I was there for an hour and a half but the maximum is $12 for the day, not bad I think.



I looked it up and the name of the hotel is the Four Points Sheraton. While I was there I did look for street parking but after 20 mins gave up on that and just used the valet.

CanadaVisa denied in Montreal, must show domicile
This happened to us just two months ago. What we have done is put together a rental agreement with her parents, got a letter of employment from someone we know saying that my wife will work there when she returns, and then we also are sending in a moving quote from U-pack.

We have not sent anything in just yet since we're waiting for our condo to sell first so I can't tell you if that stuff will work, but it should to the best of my knowledge.

That's a long time. I guess it doesn't matter if people need their passports for work travel or any other reason.



I know eh? I was concerned because if we did not receive the visa in the mail by Christmas to where we could move then we were going to fly back for the holidays. I talked with a friend of mine who is a border officer to see if there was anyway to cross. He said that if I had a photocopy of it and some proof showing why the US government had my passport then I should be fine to cross. I guess I'll never know for sure since I now have it again but that was my plan if need be.

Yes, I do think it might make a difference. I would muster every scrap of information you can get to prove reestablishing domicile. I would state this very clearly in the cover letter - the reestablishing part - I would also state in the cover letter each piece of information. If explanation is needed for an item, I would state this in the letter and perhaps even follow that up with a post it on the document.

While I don't know that you can find out for sure what they want I think the guidelines can point you in the right direction. If you read what they want and it is an item you can't get, maybe try to think of where they were going with that particular item and what you could provide that would amount to the same kind of proof.

For instance, one of the items is enrolling your children in school. If you don't have any children, are you or your wife thinking of taking a class? Perhaps her enrollment in a class for January would make a difference.

It probably can't hurt to contact the Senator at this part and if he can get clarification for you - more power to him good.gif



Yea I think we'll wait until later this week when my wife can call the senator before we mail anything in. I just hope that he will be able to get some specific answers and not just the same general "We need further proof of domicile" #######!

You decided, ok, you don't like our 'temporary' type proof - then we will show you our proof for 'reestablishing' domicile. So you knew that and I know that - but did they know that?

Yep that makes sense, the only problem I have is how do I know that? I wish there was a way to get a clear answer as to what they're looking for. At the same time I just pulled up my cover letter and can see where I may have caused confusion with them.

As you can see from the above cover letter I responded to the request for proof of domicile, when in reality it was my wife the USC that they wanted the information from. Do you think that if we sent in all the same information with a slightly different cover letter that is very specific as to what we're proving would that make a difference?

At the same time is there a way to find out for sure what they want? I'm still planning on having my wife call her Senator and make an inquiry to see if that can clarify anything.

I think the hang up with all of these denials is that time living in Canada. This particular CO has decided to take a hard line on it.

When you sent back the proof the second time - lease etc - was there an understanding there from Montreal's side. Were they (or the CO specifically) 100% clear that you were proving 'reestablishing' domicile as opposed to the 'temporarily leaving the U.S.' proof?

I guess i'm asking if you established this with him during or after the interview while talking to him or in a cover letter with your additional proof?

As for the proof, he really was not specific in what he was asking for at the interview. What he did mention was that my wife would HAVE to move back before we could prove domicile. Of course the obvious problem with this is that their own paperwork that he gave us says otherwise. Like I said in previous posts, we've gone at it from both directions, firstly saying that my wife never "left" the US permanently and then secondly saying that if in their minds she had, then here is how we are showing she will reestablish domicile.

Yes, it was what Trailmix had used, it was a letter from her folks stating that we had agreed upon a rental arrangement and it would be ready when we arrived. Oh right I forgot about the visitor's visa. How long has she been in Canada again?


At this point its been almost a year and a half, but thats due to US immigration taking so long to get our paperwork done.

I don't mean to flood the forum with my personal story but I did mention this on a few other threads.

At this point I'm really not sure on what our next step should be so I'll do a quick recap of our story and hopefully someone can point us in the right direction.

We were in Montreal for our interview in June. Everything went fine up until the end when the CO said that we needed to provide more proof of domicile and in order to do that my wife would have to move back to the US, buy a house, get a job, and enroll in school.

He gave us that sheet that specifically states that the USC DOES NOT need to reside in the US to prove domicile and there were steps that could be taken to show that you intend to reestablish domicile.

We sent in the following paperwork about a month ago, papers that show a job offer for my wife the USC, a rental agreement with her folks where we would live, voter's registration card, and a moving quote for moving from here to there.

In addition to that, originally we had sent in bank statements, car insurance, and credit card accounts that showed my wife had not moved up here "permanently".

What are we supposed to do now?!!? We've sent in everything they ask for and then are sent a letter asking for the same things we just sent? headbonk.gif

Should we at this point be calling our Senator and get them involved? I'm not sure what else to do.

Last I got was an e-mail on Saturday saying they are reviewing the file and will get back to me in 2-6 weeks.
