Is 3 month wait like what we are having now is normal, with the fact that we're not even sent RFE yet? Indeed we provided plenty evidences yet the lawyer returned most of them!

If what the lawyer did submit is not enough evidence, you will get an RFE. No big deal really, just submit what the lawyer didn't submit to begin with.

When I submitted my petition, I only provided some photos, copy of my finacee's and my passport showing entry and exit stamps when we traveled together, some phone bills, Western Union receipts and a two page letter detailing how we met.

The bulk of our evidence of relationship I sent to her to take to the interview.

Hi Jesse, I plan to send him my boarding passes ( when i visited him in states) And some old tickets (when we had trip together), plus my stamped passport ticket, then add lodge receipt during his stays when he was here, do you think it'll be adequate evidence?

All he included as primary evidence of meeting was the passport stamps? (pictures are secondary evidence) .. That seems a little weak but probably still ok. If you do get RFE'ed it is much more likely to be for more evidence of meeting than evidence of relationship.

Of course, some RFE's just seem random... Do ya feel lucky?

Don't worry about it. Worst case scenario means you have to straighten out an RFE. No point even stressing about that possibility now (easier said than done, I know).

As for the letters of intent.. Do carry updated ones for the interview, just in case, they want to see them. The CO did not even see mine at the interview..

My case is not at NVC yet. So, we are in the same boat. You know for a fact that they got their NOA2 AFTER you? Are they on visajourney? I don't think their petition could have been forwarded to NVC without others that were approved before. It just doesn't make any sense. It sounds like we all need luck.

As stated above, you will want to have a new original letter of intent dated sometime after the NOA2 to have available for the interview.

The case is held up because CSC holds newly approved petitions until there are enough to send a large shipment. If you look around VJ you'll find people who have waited more than 60 days!

They probably do attempt to process close to the order they're received but can you imagine processing the amount of files they get by month, date, year and making sure they're processed EXACTLY in order? You certainly can't base your expectations or emotions on that statement.

The fact that you know for sure that other couples approved at the same time you were is a plus. It's very possible your file was just under that other couple's and that you'll be getting the info you need soon. Try to be patient just a little while longer. smile.gif

I read threads about letter of intent. our lawyer did not send in that letter anyways. we got an approval last march 19th for our I-129F petition. its been more than 2 weeks and i was shocked to know that our file was still in CSC. They said it would take maximum a month to process before forwarding it to NVC, do you guys think its caused the absence of letter of intent to marry? Any other guess, could u pls analyse?

hi let me share you about filling with the lawyer. at first i almost hired this lawyer to file a I29-F but when i aske her how much its going to cost me and she stop for a minute and think and said with everything will cost me about $2500 i mumbled staired at her and said forget you. so i found this another lawyer that charge me $750 for everything good lawyer here in california. now all im waiting for is the time of interview of my fiance. hope this would give you a little idea how much will it cost you for a lawyer gud luck with your case

This is the option I was hoping to use. If after the visa is approved and a traditional marriage is completed without any paperwork how would the officer at the POE know if the couple is coming as fiancee or married? I hope someone on here can answer this.


They won't know until you show your occasion's pictures. I do not think it's a big deal wink.gif Although you should be careful with this matter. It varies from different countries. As to where I live, ceremony won't be considered legal until it is brought up to religious affair department where paperwork is signed.

Doing so would cause misrepresentation at the port of entry. Misrepresentation, if uncovered by USCIS, means deportation by ICE and a ban for life.


I am talking about a traditional ceremony, which is not necessary religious and not "official" in Malaysia.
They are ceremonies to introduce the couples to relatives and friends of the family. i.e. for Chinese Malaysian, it's the "tea ceremony". Whereas religious ceremony perform by a pastor, imam, priest, monk can be "official" if they are also marriage registrars who qualified to register marriages.

I do think it's ok to have a traditional ceremony, you don't have to tell all this at the POE and if ask whether you were married, just answer "No", because you are not married under Malaysian law.

(Before 1982, traditional ceremonies or public declaration of marriage are considered binding and official in Malaysia.)

Thanks for clarifying that. A tea ceremony and banquet after visa is in hand is not a problem but it is also not a "wedding" per se. Are there other Malaysian "traditional ceremonies" that would be similarly benign.



Before the compulsory registration of marriages come into effect in 1982, a public declaration of marriage through a banquet, a tea ceremony, a temple ceremony, an ancestor worship ceremony, ... are considered binding at times of dispute.

Currently, registration of marriages is different for Muslims and Non Muslims. Muslims according to Syariah law and non Muslims under the civil law.

The Muslims wedding usually have two parts: the Angkat Nikah(signing of the marriage contract) and the kenduri (a banquet). The angkat nikah can be perform by a religious figure or the bride or groom's father. The angkat nikah is binding, the kenduri is not.

For Non Muslims, traditional or religious ceremonies are not binding, until you sign the papers with a marriage registrar.

i.e. the Christian wedding. The "church ceremony" or solemnization is not binding, unless the pastor or priest is also marriage registrar (not all are) and have you sign the papers.

i.e. the Taoist's "ancestor worship ceremony" is not binding, unless it's done at a temple with a marriage registrar and you sign the papers.

For Non Muslims, most people just register their marriages at the civil office, some will have traditional or religious ceremonies before or after the registration, some will not have any ceremonies at all.

In another word, you marriages are only "official" under Malaysian law if you sign the papers.

No, and HELL NO! Married people don't qualify for K1 visas. If you get married anywhere but the USA within 90 days of entry using the K1 visa, you'll be starting over again filing an I-130 petition for a spouse visa.


I mean, Indonesian marriage certificate or what they call as marriage report certificate, after marriage is done overseas. I read that it needs to be done only for those who intend to stay in Indonesia (after living some time overseas), yet there's a notion that says that this report certificate is still needed even though the couple does not have intention to live in Indonesia. The implication is that this report certificate is going to make it easier for the couple if they intend to buy property in Indonesia in the future. Also, if the kid will decide later to be Indonesian citizen, it will be legally recognized for the marriage has been reported to Indonesian government; otherwise, the kid will be considered born out of wedlock.

I got my NOA1 on October 23, 2006. Checked my email today and saw an NOA2 for November 1, 2006. Vermont SC took 8 days to process my case. I am amazed.

Don't hate me. I'm not bragging, but just getting some hope out there to those who at least may be sending to VSC. They are on top of their game there.

I add that I feel as if I assembled my packet pretty well and included the extra information like the birth certificate of the beneficiary (and translation), name change documentation, and my passport AND BC (scanned color copies). I leaned to the "extra information" side of the debate within the forum of whether less is more. I sent them everything that I could get a hold of. My fiance's mother was very helpful in retrieving extra docuements for me from her local govt. office, so I was lucky in a sense. I also organized it with color-coded paper clips and color coded tabs at the bottom of the pages. Maybe my quick approval had nothing to do with this and I was just lucky! Regardless, still have the second part to deal with, so the "journey" is not over.

All righty then... Been in limbo since receiving our NOA2 hard copy in snail mail October 19th, officially approved according to that document October 13th... Since then nothing. Zip. Nada... Wondering where the heck is our packet? Nothing in the mail from NVC... Hmmmmmm where can it be?

Today got the set of SIX (6) count 'em, SIX (6) emails, two (2) from USCIS-CSSO, and four (4) from CRIS... All the same, all saying:

Today my fiancee had her interview in the caracas consulate. It was pretty easy in fact only one question was asked and it was, how many times I've visted her and also they didnt ask for evidences of an ongoing relationship and no good behavior letter or police certificate were asked. She was told to pay the fee at domesa and that was it. Thnks God.

I want to add too, the help you guys gave me and it was pretty value. Thanks guys now i'm going to play her arrival to the states.:D:D

So, just thought I'd let people know. I was approved 10/12/06, not by email or web check at USCIS. I was told last week that my case had already been through NVC and was forwarded to the embassy. Yesterday, I was notified by email, 5 times, that my case was approved on 11/2/06 and I was sent the NOA2, again I guess they meant to say. Anyone else received anything like this?? Just wondering and glad to see CSC is as efficient as ever. :-)

PS Congrats to the newly approved.

It was a difficult 130-day wait, but we know that other couples had to wait twice as much, so we are thankful to God for the wonderful gift He has just offered us.
