I don't know much about the petition you are sending, but for the K-1, AOS, EAD and AP that I petitioned for, I sent in copies. And they weren't certified. You can write anything you want on copies.

Police certificates - RCMP only

Work history - Tax returns - he can probably get copies

where he lived - only has to be town and province, month and year, so hopefully that will help

It is brutal having to wait to be together. I was one of the lucky ones who had to wait a relatively short time. Some wait years.

We used VOIP phones, which made the ability to talk a lot easier and cheaper.

What about your 2005 tax return? Will that show that you're over the poverty line now? It may be worth waiting to file with the latest tax return.

Also, consider going to the UK. They rarely get much snow!

K-1 Fiance(e) Visa Process & ProceduresAtlanta Immigration
I too also believe you should file your k-1 petition as early as you planned.

You cannot predict how long USCIS will take to process your petition and the time apart is heartbreaking enough, without having to lengthen it.

As someone else said, it is valid for 6 months, so even if you did get it early, you can hold onto it.

If you wait to file k-1, that will extend the time for when you will not be able to visit without further hassles. Someone will correct me, but as far as I know they do track the names of people they hassle at the POE.

You did nothing wrong, you came to the US legally, with no ill intent. Some people arrive with the intent to just visit, get married and stay and then just petition to Adjust Status without getting in trouble. You will not be faulted for filing now.

;) oh yeah, don't come back through Atlanta!

K-1 Fiance(e) Visa Process & ProceduresGoing ahead and getting married???
It depends partly on which province Dan lives in and whether you want to get married in the US or Canada. Also, if you check here on VJ at the different steps in each of the processes, as well as the timeline for your service centre, that will help you decide which method is faster.

My k-1 took 5 months, but if we'd gotten married and then filed, it would have taken longer but I could have arrived here and then worked right away, which is much easier for the long-run stress.

K-1 Fiance(e) Visa Process & ProceduresI ready to just plain go crazy!!!! Need help and advice
I can see you are devastated at the thought of this affecting your pending marriage.

I have no experience with this type of situation, and of course I'm no lawyer, but from reading VJ for over a year, the impression I get is that this shouldn't affect your petition. If your fiancee had been charged with a crime that would have an impact, but not you.

Consulting with a lawyer is a good idea; some lawyers will do a consultation for a token fee, but be careful of those who won't give you info without you agreeing to hire them. I came across 2 immigration lawyers, one consulted for an hour for $50 and another charged us $300 and said we could contact him for questions for quite a while. We came to VJ and didn't need him. However, he was quite prepared to charge me $5000 to complete the whole process to the bitter end of the AOS, and I must say, we're doing just fine without him, as well as not being in debt $5000.

All the best as you tackle this.

K-1 Fiance(e) Visa Process & Proceduresis changing the address difficult
Changing your address in the middle of a petition is brutal. For some reason the USCIS seems to f##k up.

Can your fiancee use someone's address on the petition until the k1 is done?

I can't remember how many times USCIS will mail here something. There's the NOA1 and NOA2, but not sure if there's one more.

K-1 Fiance(e) Visa Process & Procedureskeerrchiinnggg!! The price of moving to the US!??
You cannot get your CPP if you do not live in Canada. This is one of the reasons the Canadian Snowbirds don't live in the US for more than 6 months. (that and the US VWP and insurance which only will cover them for 6 months)

This law changed about 10 years ago. My mom had moved back to the UK and was collecting the CPP. However, they moved back to Canada in order to get the CPP because of the 6 month rule. (it could be 6 months minus a day - whatever, it's about 6 months)

And yes, I can collect my work pension. However, I haven't contributed to ANY pension since I quit to come here in June. So already I'm down 1 year of not contributing to a pension. Add in the fact that I cannot get and will never get the kind of salary and pension here, that I was getting there, and you can start to comprehend the huge $$ amount lost. Also, I won't have worked here long enough to get a decent social security. I'm already 40. Yup. Screwed. And broke for the rest of my life. Ain't life great.

Add in the lost pension from your home country. I can't collect my Canadian pension that I paid into for 20 years. While I will get something from my work pension, it's not much since I stopped working after "only" 12 years on the job. I'm already at 2 years with no pensionable job here.

Add in the costs of the fact that I would have had a comfortable old age now I'm gonna be a broke ol lady....

why can't you collect your pension?

Um, yeah? It's my understanding that as a Canadian citizen you can collect your work pension(s), as well as CPP (when you're old enough) while living in the US. You're just taxed the 25% non-resident tax off the top.

Or is it some stipulation on your specific pension plan?

and don't forget the costs of shipping any personal items you decide to keep and bring with you.... I pared down considerably and it still cost me $3000 + (USD)

Amen. $2700 US for mine and that was discounted from the normal rate by 60%. That's a 4.5 hour drive south and I pared down as well. !!!

Yes, go to the commissionaire's office. I went to one in Scarborough that was about 5 minutes off the 401. Very convenient! If I remember correctly it was about $20 and I got the little yellow card in less than 2 weeks.

Up to you which route you go and how long you wait.

Mine took about 10 days. No problems. I went for the fast check after sound advice from people here a year ago. I'm in the US with no problems.

daisy...looking at the rcmp site, they only do checks w/ finger prints. even doing it today i'll not get them until the end of july :( which would hope would be way after any interview.

<sigh>

guess my employer gets their wish of me staying here longer.

K-1 Fiance(e) Visa Process & ProceduresThe RCMP don't really take 150 days, do they?
NO! You DON'T need prints unless you've had some kind of charges/convictions. Not sure which. Most ppl only need the quick check. Also, they only want the RCMP report. It covers the whole country no matter where you've lived. Getting it from the local or provincial coppers is pointless.

Order the LFBC and RCMP check as soon as possible so that they don't hold up the packet 3. It is unfortunate that the OP didn't know that earlier.

I had my prints done in feb 2005, had them back in may, so less than 150 days, but they have it posted all over the place tht it does take that long...when i asked the officer who was printing me why that long, he said it because ottawa handles it and they have to handle them for all over canada (so it doesnt matter what detachment you go to)....i had no convictions or arrests tho...but I think the turnaround time is the same regardless of that...
The long form birth certificate is the actual papers your parents filled out at the hospital when you were born, not the cute little blue wallet sied certificae thingie we are used to producing when asked for it....
I had problems with getting my papers together also because of the hold up with the prints and birth certificate, I simply called the consulae in montreal and explained and they granted me an extention.
You will have to get a new passport, I dont believe Canada issues renewals, you gotta start from scratch as if it were a new one...pain in the @$$ ...zi had the same thing happen, but it was the least of my concerns as it came in within like 6 weeks.
good luck

so you need prints done regardless of past? like i said earlier, i'm a civilian member of my local so the only time i've been printed was for them to check. should i be finding and visiting my local rcmp office? which use to be at the airport, but isn't anymore i don't think....

k

K-1 Fiance(e) Visa Process & ProceduresThe RCMP don't really take 150 days, do they?
I don't know whether you need the full check or not. Most people get the fast one not the 5 month one you are talking about.

I went to the commissionaire's office in scarborough, it took me 10 min and then I got the report 2 weeks later.

Another thing, you don't have to HAVE all the stuff before sending back packet 3, just have to have it by your interview. Of course it's a crapshoot. You mess up your interview if you don't have your stuff by the time of your interview.

And get your LFBC ordered ASAP. Everyone has been getting it faster by ordering online.

K-1 Fiance(e) Visa Process & ProceduresChild Support-Please help
First off, I know absolutely nothing about child support issues, however, I'm going to throw in my advice anyway :D

This is such an emotional time for you, and the ex is playing hardball, both things are causing you a great deal of stress. From the sounds of it, it will be good for your guy to get far away from her!

If he misses a couple of months, big deal. He sounds like the type of guy who follows through on his commitments and would never shirk his duty to his kids ( a definite keeper  ) She's not going to go through the HUGE expense of suing him in another country just over a couple of late payments. Even if she did get the ball rolling, by the time it even saw court he'll be here working and will have sent her money, so the court/lawyers would have a non issue. She's just trying to get her last bit of attention while she has him around. She's a blowhard, shooting her mouth off about stuff she knows little, trying to get him to pay attention to her, even if it's him angry at her.

Try not to worry, he'll be here soon. He'll get a job after a few months and you two will get back on stable ground financially, and then he'll makeup/continue his financial obligations to his child. It could be a relief to know that his child won't suffer because the ex is well off.

hugs

K-1 Fiance(e) Visa Process & ProceduresQUESTIONS?!
Think it through carefully!

My US citizenship interview is next month and we're in the middle of moving to Canada. After me being in the US for 6 years, we believe that overall our life will be better in Canada.

A lot of people think our countries are the same or very similar. We've found that that isn't the case. Although the people in both countries are great,

Consider:

- cost of living
- work/life balance
- cost of immigration
- health care
- social security/retirement
- politics
- civil liberties
etc.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 question - address where you want green card mailed...
Thanks for the reply, thats what I'll do also.

My wifes mom is a USC but her dad is a Canadian citizen - both lived in Canada for the last 15-20 years. My wife got her citizenship through her USC mom but still lived in Canada. So she got her citizenship but we've never lived there...yet.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 question - address where you want green card mailed...
Hey everyone,

I have two quick questions about the DS-230 form

1) on the DS-230 form - you have to list every entrance and exit into the US...my USC wife and I both grew up in Canada near Niagara Falls - this is right on the border to Niagara Falls NY...in turn we've been across hundreds of times to visit family or to vacation (never more than 1-2 weeks at a time), Buffalo Bills games, concerts, etc. Do you think its ok to just put "various crossings for family visits and vacations"? or would we actually have to try to remember and list the last hundred times we've crossed back and forth?

2) On the DS-230 form there is a section that asks for our address in the US. We both live in Canada and neither of us have ever lived in the US so we don't have an address to provide (yet...we plan to move once the visa is approved) - so I wrote that in that section of the form as per Montreals instructions. Than next to that box is another box asking what address in the US we want the green card mailed to...again we don't have a US address - but obviously it needs to be mailed somewhere. Could we put our parents address in Canada? If it needs to be a US address could we use a family member or friends address in the US? How long after the interview approval does the green card take to be delivered?

Any guidance on these two issues would be greatly appreciated

Thanks

Darryl

IR-1 / CR-1 Spouse Visa Process & ProceduresAre the blogs always helpful?????
Here is an idea...if you don't like what people post...don't read it. No one is forcing you to read these posts and no one is asking you to moderate the posts. This forum is for people to offer their own stories and information at their own good will - no one here should be judged by you or anyone one else because you don't value what they have to say. Some of it is helpful to your situation some is not, you have to read through and see what is of value to you...the rest may not be valuable to you, but may be to someone else.

Before you start judging people and singling them out - recall all the valuable information you've gotten from the wealth of knowledge on this board and realize none of it would be here if everyone was as obnoxious and negative as you are.

Get a life, let people post whatever they want and leave them alone.
