Including 3 years of ITRs is great, you are only required to include the most recent years ITR.  The income I reported was the Total Income earned.  If my memory serves me correctly it was the first line that I was required to list income on my ITR and I only included the most recent years ITR.  It doesn't matter which 1040 form you filed just the total income you earned and listed on the ITR.  I hope others will share their experience...

I believe the form you are going to need is the I-864 for a co-sponsor.  Again, just my opinion, since your "significant other" lives in a high risk country for visa denials, it might be in your best interest to get a co-sponsor that is part of your immediate family.  For some reason find a co-sponsor that is part of the family has helped.  Please don't let anyone tell you that co-sponsors are either not accepted or petitioners that have co-sponsors will be denied.  Just do what you have to do, prepare the petition correctly, and hope for the best.  But, I am not a rocket scientist like some people on this forum claim to be.

My reply may or may not apply to your situation.  My gal, a filipina, then an OFW in Hong Kong needed her USCIS interview letter/email in order to get her "Police Report," from the HK police for her K1 interview.  But, I will add that she also had to get "police reports" from Shaghai (sp?), China and Taipei, Taiwan and no interview letter/email was needed.  But to be honest, you may or may not be able to get away with the NOA1 for a "police report.

Did you check the link? One simply checks the reciprocity tables and a Police certificate is not issued to non-residents and thus is not required.

 

I stand corrected...  Such a detailed "Country Reciprocity Schedule" did not exist back in 2008 when my gal did her K1.  Also, she was able to get her police certificates/reports by having a friend that was still living in the country, not UAE, and that did not offer the reports by mail or to a person no longer residing in the country, to get the report for her.

Yes, she is going to need a police report from Dubai.  Someone want to correct me if my info. is incorrect, but anyone over the age of 16 that has resided outside their home  country for more than 6 months is required to submit a police clearance/report, according to the USCIS.  For example, my gal had to submit police reports for all the countries she was an OFW in prior to immigrating to the US.

Whether she is still residing in Dubai or not she should still be able to get a police clearance report.  She should contact the Dubai embassy/consulate in the Phil. to find out how to do it.

You might also include an explanation for the differences in income for the previous year.

You will need a letter of explanation for why you didn't file tax returns for the last 3 years or an income tax return for each of the last 3 years.

Anyways, you will need to provide the USCIS proof that you meet the minimum sponsor requirements. The easiest way for you to do this is to include a "co-sponsor."

When you book your flight you will need to have your valid Phil. passport with the US visa in it to show the airline. To board a flight in the Phil. bound for the USA the only thing NAIA and the airline is concerned about is that you have valid entry into the USA and won't be denied entry and the airline would have to pay for your return flight to the Phil. You "envelope" will be taken by Customs/Immigration at the Atlanta airport. My gals POE was Atlanta and it is a very simple and smooth process. Just be prepared, the Atlanta airport is a very big airport and where you get off the plane and where you retrieve your baggage are very far apart - you will either ride an underground airport train from customs to the baggage area or walk the distance.

You just need to keep the children's last name spelling the way that it is used everyday. This should be the spelling any documentation you might have to include will use. This is a common subject with filipino naming conventions. The US Embassy in Manila is very well aware of the different name spellings for the same person that can be common in the Philippines.

Ok here goes. My fiancé and myself have begun to seek help to acquire a K1 visa. A mutual friend of ours contacted a lawyer in California. Ok this guy is claiming that the wait time for a K is now 1 Year to 18 Months?? He suggested that I fly to Australia and we marry there. Then I return to the US and send for her with a K3? Please any advice or help would be appreciated. We have known each other on line 12 years and have talked many times on the phone. She has made one trip to the US this last May and spent 2 weeks with me. I popped the question and she accepted :dance:



Sorry to hear you hired an attorney. The attorney may add an additional layer, and cost, to help your application be complete, but the attorney also offers the additional layer to make mistakes that can cause you problems and delays. Even with an attorney, you and your gal will still do all the work. All the attorney does is check your completed paperwork, assemble it, sign your name to it and mail it. And, by the time it is done you will wonder why you didn't do the process yourself without an attorney. The current processing time for K1 and I130 visas are running around 6 - 8 months from approval to interview. Reference, yahoo group, MAG-ANAK.
I considered hiring an attorney for the K1 process for my gal and my gal told me not to and I saved the $1800 fee he wanted and probably saved 2 or 3 months processing time between the attorney, USCIS, and me.

I see the average time between interview and getting the visa is a month. I assuming most at 30 days got a 221 of some sorts. On the timelines visa received is it the day of issue or the day in hand? Seeing if we could expected an answer this week, if 30 days. At what delay 2 month, 3 month should we start to worry about the delay? I am thinking we got the interview before Manila could process the paper work.

I see what you are saying. I understand. Really, I do, but this is trivializing the situation. When I say it looks "better", I only mean it paints part of the whole picture. This is not a job interview. This is not an interview for any type of loan, credit offer, or mortgage. This is proving you have income that meets the requirement at the present time of the interview. That's it for this one step. All situations vary, but the end result is the same. Prove you make more than 125% of the poverty guideline. Thanks. I will not dispute your experience. However, in the context that I used this example, I do in fact believe it helps as others have mentioned so. In any case, I don't see how being a student "does not have a good plan for the future"? On the contrary, people go to school with future goals and employment in mind. Hence, the OP went to school, is a CNA, and makes the money they need to qualify for 125% guideline. The previous year's income is not the requirement, yet OP being a student paints a picture as to why he/she didn't work a full-time job and/or make more than $17,000. I am only trying to provide clarity for OP's concern rather than trivialize it. In fact, I am in school myself. I work full-time, and I am only in school for personal growth. This is besides the point, but it is not good to think that students don't have a good plan for the future. Nothing could be further from the truth in most cases.


Ok, I will try and offer this. You are looking to purchase a new/used car and are about to graduate from college with a degree, in high demand, in the marketplace and have many job offers... You offer overwhelming documentation/evidence that you can "walk on water" in regards to your education and future employment prospects. Do you think the car company is going to be willing to sell/loan you money for a car without verifiable current income? Personal example, I have a BBA in Accounting, a BBA in Information Systems, an MBA, and 2/3rds of a MS in computer science. I get lots of pats on my back, "good job," but no guarantee of current, let alone, future income.
I will also add that you provide excellent info.
I also don't think much of "senior" members that are not willing to sign their posts - a personal peve of mine...

Ok, that helps me to have some confidence and peace of mind then, thank you so much! I can absolutely show my income for this entire year and show them I'm more than able to take care of myself and my fiance, and I do have my mother for a co-sponsor, but it's regrettable that the US Embassy of Manila don't accept co-sponsors for K1's.

Will they need evidence or transcripts of my schooling if I say I was in university last year? I just want to get all the required documents ready now if they will need them. Also, how many years of taxes will they want to look at?



Here I go again, having a co-sponsor is not a problem. I offer the following from this VJ site:

It doesn't. Taxes show stability over time, and if you were working the same job for a couple of years, the CO would have a more accurate idea of your current income estimate based on what you made for the previous year. It does not disqualify you one bit not making enough last year. Since you were a student, you have an even BETTER excuse as to why your income was low in 2011. If you make enough now, and your income is hourly, multiply that by your hours worked per week multiplied by 52 weeks for a current estimate to put on your I-134. You should have no problem providing pay stubs, letters from employers, maybe even bank statements showing your payroll deposits from January on up. Prove you are making enough now and tell them you were a student in 2011. You should be fine.



This poster offer great info. The economy and ability to earn in the US is subject to very many variables. Based on what the OP has stated, as long as he currently meets the minimum income level for the USCIS there should not be any problems. Once the OP, gal, gets to the AOS stage more "current" financial info. will be needed. Also, I will disagree, based on my education and knowledge of the immigration process that being a student offers a "BETTER excuse," because a student, typically, does not have a good plan for the future. Hence, the student status, working on a better education and change to gain better employment. Just my opinion based on my education and knowledge of the immigration process.

i received my NOA2 text Aug 7 that i am approved and now i am preparing for the next steps, gathering documents that i will be sending to her in the Philippines, but i have a few questions about this Affidavit of Support and couple things.

Affidavit of Support--- year 2011 i only worked for 7 months and made &13,760, and that shows on my tax, the rest of the year i was in Philippines from Aug 2011- Jan 2012, but NOW i have a full time job and a part time job where i make more than the poverty that is required, do i need to have a co- sponsor? or my CURRENT jobs will fullfil this problem?

Employment Letter--- i know it has to have a SALARY, FULL-TIME/PART-TIME, HOW LONG HAVE BEEN WORKING, ANYTHing else? and how far back this have to be from the interview?

Pay stubs---already have this since jan until present

Proof of ON-GOING Relationship--- we have skype pictures, chats from skypes, and facebooks, yahoo mails, and money remetance from western union

Letter of Intent---updating one where i have to put USEM address and signing it, how far back this have to be?

anything else i'm missing? please let me know, i really appreacite u guys help and i hope u guys dont get tired,, thanks a lot vj friends,,


You offer a lot of info. Try to resubmit your question and only one itemt at a time, ask one thing at a time.
Just based on what you have stated above, as long as you currently earn/make at least the minimum required by the USCIS, have paystubs, and a letter from your employer you should be ok.But, I have reason to believe that you haven't told everything for me or anyone else to provide you with a good answer.

I know it's bad to think of negative things but at the same time, I wanna be prepared for the worst.

What will be our options if ever the interview doesn't go well and my fiancée's visa gets denied? For K1 visas, do we get a chance to reapply? Do we wait for a couple of months and have another interview scheduled (just like waiting for another 6 months if you get denied with a tourist visa)? Do we start all over again on the K1process? Can I marry her and get a spouse visa instead?

Thanks all for your helpful suggestions. My fiancee's interview is next week so I'm crossing my fingers that's don't even have to reconsider all these options.


It is my personal knowledge and experience that the visa application and interview is a win/lose process. You can always reapply and do the process all over again. What is your concern? I will assume that you have provided all of the required documentation/evidence required, right? What is your concern?

Just speaking from my experience... Since you have already applied for a visa (K1?), it is going to be next to impossible for your fiance to get a visitors visa. You can try... After all, it is only money you have to spend and lose. Once your fiance appears for the visa interview s/he will know immediately whether or not the visa is approved before leaving the interview. My advice, save your money and spend it when your fiance gets to the US.

You might try a local governmental official to find out what can be done to determine their birth dates. If this is a common problem in Yemen there should be a process to help determine the birth date. Try to find out if there are any school documentation, church documentation, baptism dates and documents, and so on. This will help.

When you answer N/A it either means it's not applicable, or info is not available. Your info IS available, and your info is relevant. And that way the embassy won't hae a hard time matching the name up with the one on her birth cert., and the background check is probably also not going to come up with anything unforseen. You ALWAYS use the legal name on any paperwork submitted to official agencies.

You go by the name that's in her passport or on original birth certificate. If that name has non-roman letters in. you type is in the box. If she has changed her name, she'll be required to show proof of legal name change a embassy stage.


The above is very good information. Include all of your gals names...
