QUOTE (k1lover @ Jan 20 2009, 11:38 PM) <{POST_SNAPBACK}>
the proof of income is needed for the interview which could be a few months from now (realistically speaking) and this should give you enough time to get your stuff together. I just got a letter from my employer stating how much I make and how long Ive been working there and 2006/07 tax returns. If you already filed both I-129F and I-130 then you have done a lot more work than it takes to do a I-134 so stop being lazy!! LOL

now as for moving back to DR..we all come here to progress because that is more difficult (or nearly impossible) for some of us to do in countries because of the lack of opportunities so what the heck would you do there???? especially if your life is already established here, you think you are going to move there and live out of love?? like the bible says (and I'm not religious at all) "man can not live on bread alone" so just keep your hopes up or move there temporarily at least just to get a feel for what it would be like rather than take the drastic step of moving permanently, just my two cents (and yes, I konw its easier said than done smile.gif

Well I wouldn't move there for ever, just until my husband can come over here, hopefully.

It's probably not the correct forum to write about this but o well.

Now I know that it probably sounds like something crazy but I just don't feel like waiting until who knows when to be with my husband. I never thought this would turn out to be SOOO hard.

Now I know that in order to get him over here I need to show proof that I'm working here but I just don't feel like going through this whole process.

They will most probably drop / deny our case when they get to it, huh? Unless through some miracle with a good affidavit they approve it.

Your feedback, encouragements and comments will be greatly appreciated.

Mexico, Latin & South AmericaAre there special considerations for DR filers with respect to K3 or CR1 case timelines?
QUOTE (Mononoke28 @ Jan 13 2009, 12:02 PM) <{POST_SNAPBACK}>
Ilana,

Try to do a little bit more research and find out how long the US embassy in the DR is taking to approve CR1 visas. Yes, it's true that K3 visas can take just as long as CR1s for most people and are more expensive, but the DR is a special case since I've heard that CR1 visas can take over 3 years for some people. This is due to the amount of people waiting for an interview at the embassy.

Try to see if you can contact the US embassy there to find out an estimate of how long it may be for each visa (CR1 or K3) and then make your decision based on that.

Diana

Thanks Diana, I will try to call them tomorrow. So your saying to call the US embassy in DR directly? Will I even get to speak to someone you think?

There isn't a separate filing fee for the I-129f with a K3 - So why not file it - If your I-130 is approved before the K1, then they will follow the CR/ IR route - It can't hurt, and if being together fast is what is important, I would try whichever way you think will work

Yeah there isn't a fee to file the k-3 but they tell me that in the long run it'll be a little more expensive. So I don't know we'll see. Thank you though!

I am at the stage where I have submitted the I-130 and rec'd my NOA1. Now I'm still debating whether or not to send the 1-129f for my husband who's in the Dominican Republic. Many people are telling me that it'll be more expensive and not to waste my time with the K-3 because they are getting approved at the same time. But others are telling me that to get an interview it will probably be a longer wait if I go just the I-130 route.

I would just like to be with my husband soon. I've heard crazy stories of people waiting for years. Do you think that'll be the case now a days?

Please I need advise and help on this matter. I would like to hear more from my fellow VJ members whos spouses are in DR as well. But i'm open to advise from anyone.

Save your money, if I remember right it's like 1000 bucks or more so just stick with the I-130. From a prospective of which one is faster, your talking a matter of 30 days or so and a cost savings of over 1 grand. Plus your husband will be able to travel, work and be naturalized sooner then with a K3. This forum is a good resource to ask questions and no question is to stupid. This will help you speed your I-130 right through the NVC by having all your paperwork in order. Good luck in what your descission is.

Thank you for the advise I just want to make sure I do things right. And we just want to be together, I'm sure you know how hard that is being away from your other half . So your saying that really the only difference is like 30 days or so. It's not that bad. Although it'll feel like for ever.

I don't know I've heard so many horror stories about how slows the process of the I-130 is and that minimum it'll probably take him to get here is like 2+ years. Thats cookoo. unsure.gif

Process in general are running faster now here at the Consulate.

So do you know if there is still a long waiting list to get an interview in DR?? If so how do you know?

The cost savings is about $600, since the actual visa fees are higher for CR1 than K3.

However, there are Dominican Republic specific issues to check out before deciding. Do check in the appropriate regional forum.

No where do I go to view that. I did go into the DR portals. Is that what it is?? Where else can I get more specific info on DR specific issues?

It may not delay it, if VSC gets caught up and no longer transfers the applications to CSC. However, a K-3, at least the history of this past year, will NOT get approved faster. They have been approving them both together at the same time, always.

Just to clarify. The initial petitions may be approved at the same time but the I-130 will slow down when it gets to the NVC. I-129F will end up at your embassy sooner than the I-130.
The length of time it takes the I-130 to get to your embassy depends on how good a job you do submitting the paperwork involved.

SO if I do a good job in submitting the paperwork and getting what they ask for back to them quick enough that will make the process somewhat smoother ans quicker for the I-130??

And so are you saying that it's not a bad idea to submit the I-129f because he can get here quicker since the I-130 slows down at the NVC?

Nothing to do with the country. Many of us wish we never did the 129-F because it only delayed our approvals.
If you're filing with VSC, they take WAY LONGER than CSC. Since they are so backlogged, they were transferring applications for I-130 alone, to CSC. Those people were getting approved MUCH faster than the rest of us that had I-130 and I-129F together - who were stuck at VSC for the duration. Also, they are always approving both at the same time. So many people chose the I-130 because it gives the spouse the GC, whereas the K-3 is just a visa and later you have to adjust status, get employment authorization, etc. So many of the applicants felt the I-129F was useless, because it doesn't get approved faster.

So do you think that it's just a better way to go if I just stick to the I-130 and don't even bother with the I-129F? I just thought that if I put both of them in who knows which one can get my husband here somewhat quicker. Is it for sure that putting both apps in will only delay the process and therefore the approvals?

Now I'm getting everything together to send the K-3 petition but I'm not sure if I need to sent a copy of both my NOA1 and a transfer notice or if just with the NOA1 it's ok?!?!? I just want to double check but technically the instructions for the I-129F state the following:

B. Form I-129F Filing Locations for K-3 Spouse
If you are filing an I-129F petition for your spouse, mail your petition to the Service Center where the underlying I-130 petition is currently pending. Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129F.

Notice is says: receipt notice OR transfer notice

Which means that it's one or the other. But the Step-by-Step Guide on How to File for a K-3 Visa for your Foreign Spouse on this site says you need both.

Can anyone confirm this for me???

Thanks,
Ilana

It's "or". For the most part, transfer notices are a thing of the past.

Now, are your absolutely sure you want to send that I-129F for spouse? Have you been reading here about all the people who wish they hadn't? I don't recall whether the unique circumstances in the DR resolve this question with a yes or a no but I seem to recall they do resolve it pretty definitely. If so, maybe it needs to be repeated here.

No I haven't read about it. Is it not a good idea because of the country (DR)? Please explain if possible??

K-3 Spouse Visa Process & ProceduresK3 Visa Questions and Clarification
QUOTE (sdhiman @ Jan 14 2009, 10:34 PM) <{POST_SNAPBACK}>
Hello everyone

After several hours of searching on the internet, I have finally found a forum where I believe someone can answer my questions.

I am a Permanent Resident of Canada, getting married to a US citizen in Canada on March 12, 2009. I believe the quickest way for me to join my spouse in US is through K3 Visa. I have also read the guide for K3 Visa on the internet but I am not 100% clear on all the steps. We want to finish as much paperwork as possible before the wedding so we can cut the wait time, if possible. I know that the first petition to be filed is I-130 but when I was checking for supported documents to prove the marriage, I noticed they are looking for bank accounts, lease etc. If we just got married and I haven't even moved to US, isnt it a little hard to have joint bank accounts? We can put my name on the lease but I wasnt sure if this is enough.

Also lets say we get married in a third country (not US, Canada), will I have to stay in that country for the time it takes to get the K3 Visa?

I am sure I will have more questions as I start filling out forms, but will appreciate some responses and help from senior members so we can do this right from day 1.

Thanks a lot

No, the I-130 instructions say that if you have any of those things you can submit that as additional information with you application to show proof of bona fide marriage.

See below taken from the instructions:

NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:
E. Documentation showing joint ownership or property; or
F. A lease showing joint tenancy of a common residence; or
G. Documentation showing co-mingling of financial resources; or
H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or
I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
J. Any other relevant documentation to establish that there is an ongoing marital union.

So it's if you have it if not then it's ok.

K-3 Spouse Visa Process & ProceduresWe know waiting is a b*tch...but what are you grateful for?
I'm grateful for our wonderful Savior Jesus Christ. I'm grateful for the fact that he didn't think it twice to die for each and everyone of us on that cross that Friday afternoon. I'm grateful that because of his marvalous sacrifice we are forgiven of all our sins if we just accept our wrong doings, ask him for forgiveness and accept Him most importantly.

I'm grateful for the strength that he gives me each and everyday.

I'm sorry, I just really had to say all this, after all we are supposed to talk about what we are grateful for.

1. Make sure Dominican Republic processes DCF for US citizens there - and which are the residency requirements.
2. guides6ly.gif and visit the Direct Consular Filing forum.
3. Line up a co-sponsor --even if you will always remain the primary sponsor (a lot of DCF filers forget this!)

What's DCF?

Direct Consular Filing. This is open to USCitizens who reside abroad with their spouses. It results in a CR-1 or IR-1 immigrant visa; bypasses the whole NVC cr@p; and it is usually waaaay faster.

O so I probably wouldn't qualify for it. I just submitted the k-3 petition. sad.gif

You will still need to complete an affidavit of support, as you would still be the primary sponsor, even without income.

That's correct. The address, however, could be an arrangement to live temporarily with parents, other family etc.

Yeah, so the address I would put would be my current address. So It would be ok for me to go ahead and do this provided I have a good co-sponcer?

It supposed to signify anytime your case is "touched" by a worker at the service center.
but, touches can mean anything...they moved your file from one box to another, that they tied the 129f to the underlying 130..or an approval.
They are exciting at first, because it means SOMETHING is happening with your petitions.

Good luck

O really, that was the exact question that I wanted to ask because I see that on everyones timeline.
So when I check my status on USCIS it'll literately say "touched"? Would it say it like above the date of when your NOA1 was sent?

It's horrible to be away... it's been almost 8 months for my husband and I, and we've only seen each other 1 week this time when I was finally able to take a few days off of my new job.... I hit rock bottom about 2 months being away.... it gets easier. I think it just becomes more routine to feel like your life is on hold and feel crummy most of the time apart. Now.. his interview is in 1 week (!!!!!!!!!!!), and we hope so much that he will be here in2 weeks.... we'll move into a new apartment I just found... finally get on with our lives together!!!

Only you can decide what is best for your family. Will staying in US, working, possibly saving money... will this be better for you both in the long-run? Would it be just as easy to live in the Dominican for a while and do DCF when able?

Spend some time on visajourney thoughout the process... it's helpful to be connected (even if you don't write anything!) to others going through it and who understand what this feels like. It will be over someday, and I actually believe that it may help the relationship in the long-run.

I know, many people have told me that ithis can be looked at as sort of a test to our love. To see how strong it is and how much it can take. And in a way it's true but to be totoally honest I care to find out. I just got married and I would really like to build a good foundation for us to have a family on. And to think that I have to wait til who know when to do that to then have a family. I mean I don't want to have a child when I'm like 30, lol, but i would like to enjoy my marriage before I have a baby. and this way it's just going to take so much longer.

I just get mad at the fact that people have to put their hopes and dreams basically on hold until USCIS and who ever else decides to aprove a piece of paper so one can be with their loved one. I just don't feel like I want to do that.

Sorry, I'm just venting over here. LOL.

US Embassy and Consulate DiscussionI've filed for a K-3 visa for my Husband but...

IR-1 / CR-1 Spouse Visa Process & ProceduresPrinting my Document Cover Sheet
Hey Everyone,

I'm trying to to print the Document Cover Sheet to send both my AOS and IV packets but when I'm about to print them they appear with the right side cut off so the document isn't complete. I've tried pretty much everything and nothing seems to change it.

Has anyone had this problem? Any suggestions?

Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresG-325A check boxes at bottom next to signature

Need help please!!

Hi, I'm about to submit my I-130 petition for CR-1 Spouse Visa and I've had conflicting information about my wife's (foreign spouse) forms concerning the check boxes at the bottom of the pages next to the signature block. I read somewhere that for my petition she should check "Status as Permanent Resident." Is this correct or should she check "Other" and put in CR-1 Visa as I did on my form??

Please, any help would be greatly appreciated!!

Thanks in advance,
Andy

Yes, you should check other and write "I-130" on the line next to the box.

Many people are saying that the I-130 is the way to go because of many good reasons and that it's only taking about 30 days more than the K-3 route but the key question is: Does that time period apply for any/ to every country????? I think not because from what I've heard in some countries(like my hubbies) there is a waiting list and it could take a long time for one to get an interview with the consulate.

What do you all think?

You are correct that scheduling the interview can be longer for some countries than others.
However, all of the marriage visas, K1, K3, and CR/1 require an interview.
So, I think that would not impact the decision to go cr/1 vs k3.

In some countries, the wait for a CR1 interview and a K3 interview are vastly different. The DR is one of those countries. Western Canada is another anomaly. These issue do get Consulate specific, so be careful making general statements.

You're right, all marriage visas do require an interview BUT you might get a quicker interview for a K-3 petition than for an I-130 petition. right?

KEYSERand ME

In my experience
we fought in the beginning then it went away and now we fight again some time stress gets a hold of yo
for us right now it's we barely get to talk to each other 20 min a day and it takes 21 hours plus between these
not something we where use to before
so its hard to adapt
we spend the 1st year of our relationship together in Aruba
then he had to go back and so that was hard
then i spend 2 months with him to set up where we will live, where our apartment is now he is there alone
i miss being home, that is my home
then 1/2 into process we got into a stress situation again a turnaround
then it went back to ok
now we are at it again because of the hours of work and now with getting the NOA2 the stress of not really having time to make sure we have all our ducks in a row
for the paperwork
Talk it out that is all i can say, Good luck

Thank you for the advise! Like many people on this site this long distance relationship thing is really hard. I never really thought of how difficult it would be to be away from you other half. I just pray to God that he helps us with our process and relationship so that we can be together soon and have a successful and happy marriage, like he intends it to be!

Ok, so this might be a bit off topic, but are any of you struggling the way we are? Our entire relationship was long distance and it was always a struggle. I thought after we got married n got the papers rollin that things would get better. For like a month after we got married we were doing great but now its back to fighting all the time. It is purely stress from living apart, its not that we dont love eachother or get along, but when ur so far, even if u do trust ur spouse, theres a feeling of insecurity. We probably have at least a year of this and I neeeeed advise???

Well, This is exactly how I feel and more or less what is going on with us as well.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Process
Hey all,

I'm needing some help and I'm hoping I can find it here.

1. a. My employer made me a letter today verifying my employment with them BUT for the part of my income they were not able to but my annual salary because I work for a staffing agency and my current position is on a temp to hire bases so they put my hourly rate since my assignment can finish at anytime (is what my employer explained to me). Do you think NVC would accept that?
1. b. So now there is my second concern, Will NVC care if I'm working through a staffing agency? I make well over the 125% poverty guideline which is $18,212 this year I believe.

2. Now for the AOS part, if I was to need a co-sponser does it matter if they live in another state? (ex. I live in Mass, co-sponser lives in Georgia).

These are my main concerns right now, thank you all in advance for your responses.
