Hi!
This is my first time posting, I've lurked and looked for some time . . . My questions is about a woman that I met on the net who lives in the Philippines. She seems like a fine, upstanding and honest woman who made a mistake about 10 years ago. I'll call her 'Jane' for now . ... .She's the youngest in a family of 9 sibiings, with 6 of them being step sisters and brothers. Unable to secure a position using her math degree, Jane become involved in a marriage to a Japanese fellow. They were married in the Philppines. He initiated the divorce after 2 years in Japan, 3 years after that she was laid off when economy started to sour. She was doing some kind of QA in a LCD factory . . .. She now believes that she is not divorced, and is unable to remarry without an anullment. She was not arrested, deported or caught up in a sting. She has been living in limbo for 5 or 6 years, unable to move forward because of her current marital status. An american friend of mine who lives in the philippines said his fillipino wife is 100% sure she must get her marriage annulled because Japan and the Philippino Goverment exchange update each other on marriage statuses or something to that effect. Some of her friends who did this had to get annullment. From reading this forum (thanks!) and others, it appears that are at least two ways out of this mess - with the first being the most likely:

1) Jane was married in the Philippines, and divorced in Japan. Her husband initiated the divorce, the english translation of the divorce says he initiated it. There is a section in the Family code that says that if this is the case, she is free to remarry. I've read here that there is a necessary court document that must be file that essentially demands the NSO to issue a CENOMAR - or something to that effect.

2) Since the US recognizes Philippine Marriage AND Japanese divorce, a K1 fiance visa can be issued to her. The K3 visa cannot be issued, because obviously she can't get remarried in the RP if #1 is not true. No CENOMAR issued or needed. I've read mixed results on this tact, and it appears to be heavily dependent on the 'luck of the draw' as to how the issue handled at the embassy.

How will the interview process proceed around this issue, what disclosures are required?
Does anyone have the number of a good family attorney in manilla that we could seek some advice on this matter?

Even if we don't hit it off, which I hope we will . . . she is very ashamed of what she did . . . . I'd hate to see this stunningly beautiful and intelligent woman not accomplish what she dreams of. I'd love to just get her started in the right direction, and find some kind of relief her situation . . . .
I'm visiting the Philippines in a week, and visiting her and others as well . . . I'd sure like to give her some good news . . . but she seems to be prepared for the worst . . .

Any ideas? Suggestions? Contacts? Send me a private message if you feel that's the best way.

Ok, my take on this is that your information is correct in that the US will honor a legal divorce from Japan, the question would be: does she have documents to support the divorce or can she get such documents? After you spend some time with her in real life if she turns out as special as you think she may be, it might be best talking to a lawyer, that would be a lawyer in the USA, who knows US Immigration law... Hello, well I am biased because most of my life I have lived in Oregon, but I have lived in Vermont and Georgia as well. I like to go camping and hunting and explore new places and Oregon is difficult to beat. We have mountain ski resorts for playing in the snow and beautiful ocean beaches and coastal areas to explore. My favorite part of Oregon is the vast desert of Eastern Oregon! You will find the cost of living a little higher here mainly due to the housing being more expensive than mid-west, however it's not crazy expensive like California and parts of Washington. Yes, it rains a lot in western Oregon in winter and spring, but it's easy to deal with compared to snow and Ice. Our Summer and Fall here in Oregon are tough to beat, warm days, but refreshing at night. When you visit here, check out the coastline, the Mt. Hood wilderness area and beautiful Bend in Central Oregon. Good Luck!!

Hello,

I have been to the Philippines 3 times already but never needed to bring large amounts of cash so never bothered with traveler's checks. If I ran out of funds I used my ATM and all was good.

This time, I am going there to bring my fiancée back to the USA with me and we will have need of a larger amount of cash. I don't want to carry more than 1000 USD with me for obvious reasons. I wouldn't do that if I were traveling to Boise, Idaho either.

Has anyone used American Express Traveler's Cheques or something else? I want to protect my money as well as have it accessible when I need it. I will be in 3 different provinces and do not want to carry the cash to any of them. ATM's are out due to high transaction fees with low maximum withdrawal limits.

Can I just cash a travelers cheque into pesos at a BPI, BDO or China Bank branch for any reasonable amount? (Not more than 2000 USD maximum)

I used travelers checks before I used an ATM/debit card, I can live with the ATM fee, it's just so much easier than the "monkey business" of using travelers check..

PhilippinesCheap/Reasonable Flights

Hi! I was wondering if anyone know cheap or reasonable flights from the US to the Philippines, roundtrip? My fiance is planning to visit sometime in May-June and we're trying to look for a cheap ticket. Would it be advisable to book this advanced? Lay-overs are okay, as long as it doesn't last for a long time.

My favorite is Hawaiian Airlines, they are the lowest price I could find, the only down side is on your way to the Philippines you will have an over night in Hawaii. Your return is only a small layover. You can book direct with Hawaiian air, you don't need a broker like price line or expedia.. I hope this helps.. Lee

So basically the VSC and the CSC would conitue to function however the NVC would not. Right?

Unfortunately no, the Federal Employees at VSC and CSC as well as the NVC will all be home twittering their thumbs next week with the exception of critical personnel which includes some managers, security staff, etc.. Now the Embassy workers in most cases are considered "critical" so in all likelihood, they will continue working as usual. Sorry for the bad news it sucks! I hate (HATE MIND YOU) my future happiness in the hands of the government, good grief!!! :angry:

PhilippinesSt Lukes Medical Exam Companion week of June 13

Hi Guys. My first post on here. Very Grateful for all the info that everyone has shared on here!

We don't have our K1 interview date just yet, but our NOA2 / NVC letter is done and package is in the US Embassy in Manila.

My fiance lives in Makati and she is planning to get her Advance Medical Exam at ST LUKES on Monday or Tuesday June 13/14 or sometime that week. She would feel more comfortable if she could have a companion that day, who is also going to the exam, to meet there ahead of time. Perhaps if there is another VJ member who is also going to have their medical exam that day - they can meet up.

If anyone is interested please let me know and you can exchange emails/contact info with her.

we had are interview on june 22. they deny her because they feel that she was not intending to get married. then the officer tells her she needs to convince them that she is. they never looked at her pictures, never read the ym chat logs. only looked at the phone bill and said a 5 min phone call is not prove a relationship. I really don't understand them. anyone else ever get this kind of result and were they able to convince them they intend to get married. :help:

Hi,

What is the best way to book my fiancee's flight to the states? I am planning to go to Manila and get them. The travel agent I talked to says they can not book flight for non-us passport holders.


We looked at Philippines travel agencies, also Hawaiian air (my favorite) many many places and ended up getting Jenie Bee's flight through expedia. I wanted her POE to be Portland, that was a requirement. The price was good and no baggage fee from MNL to USA through Delta. So we are happy. When I go to the Philippines, Hawaiian air usually has the best rates but you have a 24 hour layover in Honolulu, no biggy for me..

I know my plan was to revel in our recent visa approval until next week, however I am puzzled by something. What is the advantage of the beneficiary obtaining a SSN between POE and the wedding? Once the wedding arrives you have to go back and change names for the SSN so why not wait until after the wedding? I keep reading that you should wait 10 days after POE then get the SSN? Maybe some places require a SSN for a marriage license? Beats me.. :bonk: Just curious..

"Front loading" your I-129F seems like a bad idea to me, provide what they require and nothing more. Just think if you are the person to open and process the packet, looking for the required information but you have to keep together a bunch of "mumbo jumbo" as you look for what is required. Keep it simple, organized and as easy to get through as possible. Take this with a grain of salt, I am waiting for NOA#2 hahahahaha

Hello Everyone! My fiance and I are now working on our papers and almost done with all the k1 requirements. We hired a paralegal (working in INS Orlando) and she helps us put together everything. I have been reading lots of articles, comments, etc related to K1 for the past months so somehow i know the basic. My concern is this: the paralegal lady told us to submit our papers via "installment" instead of submitting them all at once. She said it is better that way and it's alright to receive the RFE. After getting RFEs, submit what they need and add one more form. Wait for the next RFE and submit another form and so on. Personally, i don't think this is wise and im afraid that if we follow her advice, the more time we will be wasting. For those who are in same situation, please give me your ideas. Do you think it's good move to follow her or i go with my plan of submitting all the requirements altogether at once?

Sorry but your "paralegal" is a "para-idiot" :bonk: I do not believe it's best to "front load" the I-129f however, it's not difficult to give the supporting evidence for what is required. Just think, each RFE has the ability to add a month or more to the process, it's bad enough to get just one. In fact The USCIS may just return it to you for being incomplete. Please just spend some time here at VJ obviously your paralegal does not.. Good luck and godspeed!

I do not get how you all are supposed to be adults. Everyday I read a new topic about someone who is waiting. Most are whining like little babies about how long you have to wait and it is your right to get processed right away etc etc. Some people even start crying after only 2-3 months.

I don't think the staff at the service centers are working slow on purpose. Most likely there have been a lot of applications coming in and we have the the straight up fact that Americas economy is very bad right now. So I don't think they are putting their last bucks on hiring more staff to help our love lives.

It's a few months of your lives and then you will hopefully spend the rest of your lives together. Relax and just remember what you are fighting for.

Well good news and bad news. I received a text this morning indicating an RFE was sent to me. I sorta expected this, but the good news is that this shows my case is being worked on and will process quickly here on out. I am a November filer. Seems VSC is processing super fast now in the past week or so.


I received a RFE last week, it was kind of stressful waiting for the hard copy to arrive so that I would know what they wanted :blink: turned out to be that I sent the wrong document for my divorce, no big deal. But waiting 5 days, not knowing, wow that sucked!!

My advise to you is to get serious. You are dealing with the US Government. I had this illusion that because we filed our K-1 in Early December (mailed it in November) that we could plan for a wedding July 9th, sounds good right? WRONG!!!!!! And my friend, we are assigned the California service center, I pity those from VSC. After NOA #2 your case can bumble for a month just getting from USCIS through NVC to the Embassy and even then your interview appointment is a month out. The people who go from NOA #1 to POE in 7 months are just plain old lucky but I sure hope you will be one of them, that would be wonderful. Godspeed to you guys!!

Ok, confession time, I am cold busted! The truth is I have only German Sausage, eggs, milk, 2 week old pizza (with green stuff growing) not much. :bonk:
I am both excited about meeting Jenie Bee at the POE and nervous. I have not seen her in real life since 9/14/2010. To be honest I will have the master bedroom all made up for her arrival, and the guest room all made up for me. I didn't really think of having food ready, I will reevaluate the situation.. :help:

Hopefully that NOA2 appears soon. We haven't attempted to call yet because I'm the beneficiary and my fiance works a lot of crazy hours with no breaks in between. We figured we'd give them the 60 days they said it would take when they got our RFE. 60 days is a ridiculous amount of time for what is essentially one missed checkbox. But then, an entire month is a ridiculous amount of time for a checkbox too. Maybe I'll try calling after 30 days is through, which is coming up very soon now. But I suspect they will just tell me to wait the full 60 days. It's all so dumb. :(

Please don't wait 60 days to call. When I called the NVC to check as our case was overdue, the lady told me please call back in 2 weeks. What? 2 weeks? :protest: I was very polite, said "have a good day and I will talk to you tomorrow."

I'm one of the few Decemberites still waiting for their NOA2 so I wish I was making plans to go in for my medical or interview. Instead I'm still waiting to see if my petition fell behind the fridge in the lunchroom or something. We got an RFE acknowledgement from VSC in mid May. In a few days, it'll be one full month since they acknowledged that they got our RFE response. We missed one checkbox on our forms. I'm really sad that one silly mistake sets us back a month and probably more because Vermont is not approving RFEs at any sort of logical pace. And I am always afraid that they have forgotten about us and will never approve us. I guess that's a lesson learned for us to always check and recheck our paperwork until our eyes bleed because it is a really crappy feeling to be left behind.

Are any other Decemberites waiting on RFE responses still checking this thread? Or Decemberites who haven't heard anything regarding their petition yet?

Tim and Mav got their NOA#2 last week I think so, you may be the "lone ranger" so to speak of the Decemberites. I am sorry this is taking so long but it has to be any day now, hopefully today. Have you called and bugged them I hope? The day that I received NOA #2 I had called to check the status at about 10:00 AM, then at 4:30 PM the same day I received the text and email. Coincidence? Hmmmm :idea:

Good Morning everyone,

I am double checking everything, like I always do! I think if I could have opened our sealed petition, and sealed packet 3 to check one more time I would have! I tell you, this process makes temporary crazy people out of us :wacko:

My question of the day is for Question 11 on the I-134 form did you all follow the example forms and leave the boxes blank (I intend, do not intend) and in the line below type in N/A K1 visa process for permanent residence.[b]I noted on other threads people checked intend and below wrote comments such as 'fully support so the beneficiary will not become a public charge'.

I bought a sturdy accordian type file and have everything neatly labeled and placed so documents are at my fingertips if the consulate officer asks.This will also come in handy for AOS.

Well, I decided to put what I thought they wanted to hear which is I answered: yes, and said that I would provide room & board, clothing, transportation and a cash amount weekly for misc. & entertainment. This is of course all true. My hope is that my fiancee will not have to answer 20 million financial and "how will you be supported?" questions. She will be my wife, of course I will support her. I will do some more research before AOS that is a little more binding and specific I think? :blink:

This is my 10th day at NVC. I called NVC last night and they have not sent my case over to the consulate.

I had no luck with the NVC until I received a letter from them stating that my case had been forwarded to the Embassy. Make sure if you call NVC talk to a real person not the automated system that seems to not work very well.. Good luck!!!

Hi Guys! I have been wondering in the desert of Eastern Oregon for a week with my 15 year old son, seriously we had great fun! Also we have managed to book Jenie Bee's interview for July 6th, later than I hoped for but at least we have a date to look forward to. Now she just has to survive the medical exam and all should be good! Okay, now I am off to research how to schedule the medical exam!!

It's funny I remember a few months ago coming to our thread like 100 times a day, also checking Igor's list, visiting the portal page etc.. Now everything is moving so quickly, seems like I barely have time!!! Does anyone else feel this way?? It's so exciting!!! :dance:

Called NVC today and spoke to a real person. I called last week and a real person said our case had arrived the day before (May 18) and received the NVC number LNDxxxxxxx. I have called umpteen billion times the automated number, and to this day "no record" our USCIS or NVC numbers. Finally called to speak to a real person again today....and found out our case was sent to the Embassy May 19, the day after it was received. Called the automated portion again to check.....it still says "no record" of either of our receipt/case numbers!! So lesson learned - speak to a real person. Of course I've seen other posts here where you *did* speak to someone who told you one thing....then you receive an email or usps letter saying different. I personally think it's all completely FUBAR. Anyway, based on DHL tracking, London consulate signed for our case yesterday, May 23. So hopefully Byron will receive the Packet 3 soon. He already has everything ready to go, including a medical booked June 8. Fingers crossed, for ALL of you as well as us....

Well. I found my case. It's still at USCIS - VSC.

The officer said it's bouncing from cart to cart. My heart broke when I heard it. It hasn't even made it out the door yet. They put in a service request, and i emailed a copy of I-797 to NVC so they can inquire as well.

Dizzy, bouncing from cart to cart?? I am suspicious of the accuracy of that information, hmmm. I am sure it will get worked out soon. It is confusing for sure.

Has anyone heard from Mari since yesterday morning? She seemed a little "at wits end" contrary to the organized girl who has helped us all along this journey and some of us more than once, ok, some of us several more times than once. I hope all is well for you Mari. I was feeling a little guilty because I am one of the lucky ones who can open my cell phone and call my Fiancee anytime and I do so each day. What a luxury!

DOES ANYONE KNOW WHAT HAPPENED TO OUR THREAD THIS MORNING?

Someone put a post up about being removed from Dizzy's list because the relationship dissolved and then an administrator put up a post about not following the rules of VJ and being banned from further access yadda yadda yadda. Now both of those posts are gone like nothing ever happened.

I'm not sure if the two posts were connected or not, but something fishy has happened in our thread and I DON'T LIKE IT. It's especially weird if the administrator did remove the first post because it didn't seem at all offensive, just an honest request to update the list we keep. I just feel kind of funny about this whole censorship thing in general and then to find all traces of the censorship removed...well, it feels a little like 1984 (the book, not the year). Hmmmmmm...maybe I was dreaming.

Well, I'm off to destroy newspapers thereby removing all traces of history while Big Brother watches(a little 1984 humor). :rofl:

Now I have decided that today is a really odd, strange and weird day! :wacko:

Ok, here is my mystery of the day, called the NVC and was told by alive human, no record of your case give it 2 more weeks and call back. Ok fine!! :protest: So I am at my work and I go to the mail box at lunch time and there is a letter to me at my work address from NVC stating my case was received and will be forwarded to the Manila Embassy within a week. And it has a MNL case number.
So why didn't they tell me on the phone? :ph34r: and why was it mailed to my work address? :blink:

Weird!!

Can we talk about proof of ongoing relationship? Not proof of having met in the last 2 years for the I-129F I am talking proof of ongoing relationship that the beneficiary brings to the interview. You see being ignorant and brain dead to the ways of the K-1 visa process, I thought Jenie Bee would arrive here by late May early June, so for financial reasons and also she would have difficulty getting leave from work I scrubbed my March trip to the Philippines.
:bonk: Now we have limited proof of an ongoing relationship, here is what we have: phone records of our daily phone calls (I call her each day at 5:00 PM) we have engagement ring receipt and of course she has the ring. We have 40 million emails, also a letter from the pastor who will marry us (in the event she actually arrives here someday) and I have a deposit slip for the chapel. Oh, and she has a visa debit card that I sent in November we use that rather than Western Union. We chat on YM each Saturday but I have no clue as to how to get a transcript of that? We have not been together since September 14th :( Is this enough evidence or should I start job searching in Manila again? :wacko:

Hey guys. Just an update on my RFE situation. The RFE was acknowledged by VSC on May 16th, so you can probably add that to our Decemberite timeline, DizzyLox. We're in RFE Response Review limbo now. It's kind of frustrating to have to wait what could be an additional month or more before VSC looks at our RFE. Oh well, I'm trying to be patient and give them the 60 days they say it'll take. :lol:

What was your RFE for? Probably something silly!

Hay Dizzy, we are good! Just waiting on my bank statement letter (bank employee required "remotivation" on Friday but the Branch Manager was cool!) then I can send Sweet Pea the packet.

I am kind of wishing Tim & Mav and some of our other friends would get NOA # 2 it makes me want to call some one and give them the :protest: well, you know what I mean...

Yea, I got that story this morning, the person tried to tell me I should wait 15 days, yea right!!! They get 3 and I call back. :protest:

Sorry to hear this. I agree with others don't cancel out your petition yet, the approval may change her feelings. I have been amazed at the emotional roller coaster this has been so far, and I have not done as well as I would have liked dealing with it. So I can certainly understand, but when the NOA #2 arrives and it will, things will improve. I wish you and her the very best!!
