I think we covered this pretty well in the other thread, but here we go again.

Every Russian I know that was issued a US Tourist visa had:

1) Over USD 2,000 in monthly income
2) Was married
3) Had already been outside of Russia on many occasions
4) Was over 30 years old.

Satisfy these conditions and you will probably be okay. Otherwise, meeting in Jamaica, Egypt, or possibly Greece (this is an EU visa that is not impossible to get - also allows for travel in the rest of Westen Europe).

There are no concrete numbers, it is up to the judgement of the CO at the embassy. By law, he must assume the applicant has immigrant intent until they (alone) can prove otherwise to his satisfaction. On the 28th, Ngan and I went to Saigon to get her medical out of the way. During that trip, a friend of mine hooked us up with a service to help Ngan get her papers in order and such, he noticed our I-134 amounting to $14,000 and said, no, theres no way they'll take this little. Ngan pointed to the Co-sponsor form that my mother filled out. He looked at us and shook his head, saying that the consulate hasnt taken a co-sponsor since 2005. By the way, the whole time our lawyer knew the dire need for a co-sponsor and even a few months ago I confronted him on that, he told me that the consulate had no choice, if they deny her because of that, that's where he steps in to fight for us. Well, after we heard that news, I shot an email off to the chief consular in Hanoi, who happens to be a good friend of a family member of mine, he replied confirming the services story. Though, he said that if I had a sum of money and a couple prospective employment letters for Ngan that I could show the officer, that should be acceptable. To further confirm, I met with an expat friend of mine for coffee. Along with him he brought his friend, a woman who works as a foreign minister inside the consulate. We talked for an hour about our situation, she confirmed everything and advised we refile for a co1 visa. We came too far to not fight this. Being the genius that I am, I asked my father to fill out a 1099 misc. tax form, stating he employed me in 2006 for the amount of $8,500. My 2006 w-2 from my current/past employer was for $9,500, so combined I now have a total annual income for 2006 of $18,000. Though, I did have to pay $954 dollars in income tax on that. Now, I have a brand new I-134 with a 2006 income which is suffice to the federal poverty line and her and I are now just hoping and praying that the officer will accept it without difficulty. I also have a couple prospective employment letters for her that are in the mist of being fedexed now. I'm also planning on attaching a letter explaining in detail why my 2006 income from my current/past employer was low for the year. The reason being that I was in Viet Nam with my fiancee for 6 months out of it. I still can't help but be nervous as hell. If the lawyer would have known anything about immigration, he would have informed us 7 months ago so we could have just done a co1. If all fails, I'm moving here full time to teach english. ###### America.

Thats an interesting situation. Every embassy is b inernational law considered to be on the soil of the country it represents. So would a baby born in an American Embassy situated in another country be a US citizen having been born on US soil?

Go to the US Embassy web page. Pick the couyntry you are coming from and they should have a section for appointments. If you look in that area after a couple of weeks it should list your appointment date

Police reports are needed from every place lived at 12 months or more since age 16.

Russian police certificate should take no more than 30 days to get.

Russian law (MVD Order no. 965, dated November 1, 2001) mandates that the Ministry of Internal Affairs (MVD) provide police certificates both to Russian citizens and to foreigners who have lived or are living in Russia. The law states that in Russia, MVD offices must provide the certificate within 30 days. Those residing outside of Russia, both Russian citizens and non-citizens, may either delegate a Power-of-Attorney to apply for the certificate on their behalf in Russia, or apply directly to the Russian Consulate. Police certificates should note all names that the person has used in Russia, and should note the MVD branches in all locations that were queried.

Well I finished at the NVC and i flew to guatemala for my interview. When I arrived I called to see if my papers were in and of course there was a holiday than there was no one at the embassy to accept my papers so it took forever. After they arrived I called to get my dates like my email said i could when i was imformed that i had go to the embassy in person (two hours in a bus to get there) when i arrived i waited 4 hours to see a women about my dates. The women told me Jan 20th. I than spoke up and told her that I had lots of help from my senetor to get my papers to guatemala befour my baby was born here and that the date was to late i needed a date in december. She looked at me like I can not belive you are talking to me. She went and talked to her boss and came back and said no airline would fly us at 8 month pregnate. I told her I already talked to Delta and they are OK with it. She made me leave the embassy run down the street and print my email from Delta and run it back to her. After that she informed me Nov 30th so wish me luck.

Sasha's interview has been scheduled for 8:30 am on Thursday the 30th! She is so excited and nervous! I'm just happy that I can be here with her for everything :)
Although, for those of you going through the consulate here in Kiev, don't expect much help if you try to phone them for information. They are rude to me, and VERY rude to Sasha, and they always just direct us to read the instructions on the website.
Despite that, we are hoping for the ultimate good news by the end of the week! Wish us luck!

Having gone to college myself I know there are many weeks when i was not occupied with school. That excuse would never fly with Immigrations. You have had three summers, at least, to go see him.

If you arre erious then this summer go see him and start over. Assuming no problems you are probably looking at 4 month delay between filing and getting an interview date if you really want one.

Most people submit a photocopy of important personal documents, such as birth and divorce certificates, with their petitions. But an immigration or consular officer can request to see the 'original' at any time, to verify the photocopy, and because the visa interview (and later on the adjustment interview for a K visa) is a convenient time to spot check such documentation it is a good idea for the visa applicant to have the originals available for inspection. Odds are excellent that at least 1 document will be asked for.

Keep in mind also that from time to time documents go missing from the file and may need to be replaced even though previously submitted. It's good to be prepared for the possibility - not your fault, but you pay the price if you're not prepared.

Once the K-1 petition is approved it is then forwarded to NVC who then forwards a package to the respective Embassy. My question. Those the package sent to the U.S. Embassy include all of the documents which the petitioner submitted with the I-129F? My fiance is nerveous and has consulted with a lawyer in China. He is feeding her some information and is telling her that she needs documents such as my divorce decree etc which is already included in my package with I submitted with my I-129.


So if I am the US citizen, and I'm divorced, I have to mail the original divorce certificate to my fiance abroad? I'm afraid it would be lost in the mail.

That seems to make more sense to me than what the other person was telling me. I'm going to file the papers in March or April and will file my taxes early so that hopefully a transcript will be on file for me to order by then. The consistent income is not a problem considering I've been there for over 9 years and don't plan on changing jobs anytime in the near future because I want to show them that I'm stable as well as can meet the requirements. How long before the 2006 transcripts will available does anyone know? I usually file at the end of january to get it over with.

If you have a job and you earn enough to meet the guidelines, then you meet the guidelines. Because you did not meet the minimums last year is a moot point. Your task with I-134 is to prove that you have consistent income and that you meet the minimums. If the past earnings was being used, I am certain the Consulates could go back far enough on all of us and no one would ever get a Visa.

By the time that you file in March or April 2007, you will have a 2006 tax return that is at or near the minimum. Your current pay is the important part. Everything else shows your growth. You will have a letter from your employer on company letterhead verifying your salary is above the minimums. You will have pay stubs. When you apply in 2007 with a verified salary greater than the minimums in the guideline, you will be fine. They cannot penalize for the 2006 year before you filed the application. Don't make this confusing. You make more than the minimums. Show that to the Consulate. That is what I am saying.

Yes, that is pretty common so you'll just have to wait now. Aditional processing time in these cases can take 1-6 months.
I don't think they'll give your visa right there and then, they'll keep your passport and tell you you'll receive it later through the mail (with or without the visa in it), meaning they'll decide whether to approve you or not.

1. I will not be able to make the interview, since I am a Teacher, and can not get down to Colombia until March, during Spring Break. Is it going to hurt her in the interview? should I try to make emergency arrangemanets to be there?

2. Does her Daughter have to attend the interview? she is 3 years -old. Does she attend the Medical exams as well?

It is not necessaryfor you to attend the interview. Many here do not nad many embassies will not allow you into the interview so you will jujst sitin the reception room and wait.

Hello my fiancé just received her annulment and we will be beginning the K-1 process as soon as she gets her court decree. My question is twofold concerning financial support.

A: I am self-employed and make enough money to show support but have many deductions so my net is below the requirements. Do they look at net or gross profits?

B: If it is net they look at, is it then possible to have a co-sponsor for the K-1? And if so does anyone have any info on this such as required forms needed? I've had a difficult time finding out anything on this in my research.

They look at net income. Gross income means nothing if it is all eaten up by deductions. Yes, sponsor `can be from out of household.

You can walk across the Rainbow Bridge at Niagara Falls. It's a tourist area ... no trucks. The Peace Bridge is in Buffalo ... it's a commercial crossing, lots of trucks.

I don't know how a pedestrian would clear Canadian customs, though. It would seem odd he didn't have a car parked someplace, wouldn't it?


I guess it may raise some eyebrows. I crossed over at Niagara. We got asked nothing....I mean nothing when we entered into the Canadian side. She looked at my id, my friends id and said have a good day....that was it. We got grilled supremely when we walked back over to the American side. It was my most fearful border crossing that's for sure. But thats a whole other story. On the American side they did ask why we walked over etc and where our car was. It was parked on the American side in their parking area.
When I travel from the Buffalo airport myself I guess I travel via the Peace Bridge (I can never keep the bridge names straight!). I was sure I couldn't remember a sidewalk.




I would think his bigger problem would be getting on the plane in Ga. The first thing Homeland security looks for is one way tickets.

I got an email on November 8th saying they scheduled my interview for December 6 and have yet to receive my packet 4. I call the consulate using the 235 extention cause I email with no response as well, and the woman tells me she doesnt deal with fiance visas and cant tell me anything! I know I have called this number before and got an answer when I wanted to see when Packet 3 was sent out now this! I am just freaking out cause I cant believe how difficult it is to get a straight answer! Has anyone else used this extention lately? Have you spoken to someone who deals with these cases? thanks

Yes, I had a US divorce prior to my current marriage; the 'certificate' they require is the decree you have, ensure you have the notarized version (the one with the embossed stamp.)

What they require is a certified copy from the court of an absdolute decree of divorce. If he goes to the court which granted the divorce and tell the clerk what he needs it for they will issue what he needs.

My mom is really getting on my back about this.
I know within Manitoba at least, if you aaply, you can get a 3-month out of province coverage when you move for healthcare, although it doesn't really cover that much.

I have NO idea where to look in the US as far as health plans go. Rob isn't working right now, so neither of us would have any coverage.
Can anyone suggest a kinad cheap insurance provider that can cover us til we get a job?

Orrr would a few months of travel insurance work as a temporary fix?



What type of insurance, plans and the cost is usually controlled by the state in which you live. I gather in this instance Colorado. So goggle, or whatever "colorado health insurance". All the plans available to you will showup somewhere at that point. Since you are fairly young the p[rices should not be outrageous. If maternity benefits are required then the cost will be greater.

And you will need your marriage certificate to file. I've heard of some people taking the signed license directly to the clerk or whomever is the registrar of marriages for the locality and being able to get their official certificate the same day if the judge lets them bring it themselves. Hope this helps!

Why can't a person fly into JFK from a point of entry airport and go to the international terminal and ask for the EAD stamp from them? Does anyone know of this having been tried and the consequences?

Big problem here--most airports (not just in US) disallow passenger (or other) entry into customs from the WRONG direction (not funnelled in from incoming flight). You may remember a CBC reporter got in trouble for actually doing this in 1985 (to show SECURITY loopholes at Canuck airports--and proved "no good deed goes unpunished").



I see no reason why she could not fly to bermuda for a vacation and then on to JFK. The stasmp she gets there would be god for 90 days. If she got married right away and filed for the card she might haveit before to 90 days expires.

Is there a plan that ONLY covers 'emergency' visits, as in the event of a car accident, injury requiring stitches, etc? Does that count as 'catastrophic' coverage? I have no need for regular doctor's visits or non-emergency care. The only 'regular' prescription I need is birth control pills, and they certainly would be cheaper to buy outright than to pay $400/mo for!
