If filing jointly, and your spouse has an ITIN (Taxpayer ID Number) neither of you can get the stimulus package payment.

Nope, we haven't been transferred. We haven't even been touched since the I130 was recieved on March 14th.

Is that only for the beneficiary or for the beneficiary and the petitioner?

Apply for a Tax Payer ID # for your husband. You can use that in place of a SSN for taxes until he recieves his SSN. Or if you have applied for a SSN, it might be just as easy to wait for that.

I have no reason to lie.
Last Monday I called USEM to see if there was an interview date scheduled. I was told by USEM that THEY do not set the interview dates for immigrant visas, it is done by NVC. USEM sets the dates for non-immigrant VISAS. So on Tuesday, I called NVC and got the interview date.
Yesterday, I received the appointment letter from NVC, not USEM, stating that the interview is on March 25.

My case closed on Feb 6th. Try calling the NVC. I wouldnt have known if we didnt call that number that our friends here advised. Try following it up.

There is no rule that you have to have seen your wife in the last two years. Thats only for K1 couples such as yourself YMR.

Rick, just relax. You're ok. Just file your I-130 as soon as possible. Just make sure you meet the poverty guideline. If not, get a co-sponsor.


Thank you. The I-130 is filed, the NOA1 is in hand, and I am now back to close to what I was making before I left (well above the poverty line), so all of that is taken care of.

Hello, I have a question about something that I have seen mentioned once or twice. Is there a rule that I have to have visited my wife in the past 2 years, and if there is, and I have not, will it count against me in the visa process?

A little background:

We met on the internet in June 2004. I went to the Philippines in November of 2004 for a 10 day visit to meet her in person for the first time. I decided then that I wanted to marry this woman and be with her. So, in January of 2005, after giving a 1 month notice, I left my job, and moved to the Philippines on Feb 2, 2004. She had found an apartment for us, and was waiting for me. After getting there, I received my retirement disbursement, not a lot, but I figured it should be enough to last us for at least a year. I thought I would be bringing her back with me. (How little I knew). I paid one years rent on the apartment, 1 year on the cable TV and the cable internet. We were married on May 25, 2005.

It was about that time that I found this site. I knew absolutely nothing about the visa process. I learned about the affidavit of support, and knew that I would need to be working when I filed for the visa. So, September 28th, 2005, I kissed my wife at the airport, and with tears in my eyes, watched her ride away as I walked into the terminal, and the flight back to the US.

I figured with 10 years at my old job, and leaving on very good terms, I would come back here and go right back to work. I was wrong (again). There were no openings there, so no way they could hire me back right away. I applied for jobs at other places within my field, and while waiting for those, just to have some money coming in, I took a job at a fast food restaurant making a little over minimum wage. So I was nowhere near the 125% above the poverty level line. I decided after 2 months (this was around Christmas time 2005) that I would put in for training as an Asst Manager there, as no one in my field was hiring at Christmas time, and it would mean a couple of extra dollars.

Now, while this was going on here, my wife was in school there, so I was still her only means of support. Well, to make a long story short (ok, maybe not short, just not as long) it was September 2006 before I finally got my old job back. The only catch was, I had to start as a new employee, making the new employee rate. So far, at this point in the story, it has been 1 year since I left, and no return trip yet. We were talking on Yahoo everyday, from the time I got home until time for one of us to sleep. The computers and web cams were never off.

As you can guess, I have had to build my vacation time back up, and I am finally getting close to what I was making before I left. But, in that time, prices for everything else have also gone way up, including air fares. Every time I think I have saved up enough to finally go visit her again, something else comes up, and there goes that money. It is very frustrating for both of us. I have also been trying to save enough so that when she gets here, we can find our own apartment, buy furniture and all those other things we need for day to day living. Plus all the costs that are associated with the visa process.

I plan to be there for her interview, and then she will just fly here, and I will meet her at the POA. So we are looking at around $2500 -$3000 for those flights alone.

So, the basic question is: is it going to hurt us that I have not been back yet? Or, should I just bite the bullet and go? I really do miss her, and seeing her everyday on Yahoo just makes me miss her more. Believe me, I wish I could visit her on all my days off, or at least at Christmas and her birthdays.

I wasn't too sure if I've created this thread in a right forum but Moderators, feel free to move if you must

Mike came in to the US in the beginning of Dec last year with K-1 and we got married last part of the month. I've added him to my work benefits but I have not made changes on my W-4s. It's my first marriage and I've never filled out any of it so I have no idea how to populate the lines. It's more complicated than I initially thought. I'll have my taxes done next weekend, I could ask my tax lady to help me with the form but I could use few tips here in VJ as well.

Few questions here (some could be common sense but I just want to make sure)

On the Federal Form Item A Enter "1" for yourself if no one else can claim you as dependent. Do I put "1" here since I've always used "0" here. (I could be doing this all wrong all these years :blush: )

Item B Enter "1" if You are married, have only one job and your spouse does not work. Since he's not authorized to work yet, then he's unemployed. Enter "1" here as well?

Item C Enter "1" for your spouse. But you may choose to enter "0." if you are married and have either working spouse or more than one job. (Entering "0" may help you avoid having too little tax withheld. Do I enter "1" here or "0" if I may choose?

Line 3 there's option of Single, Married, and Married but withhold at higher Single rate. Also right under it there's a Note: If married but legally separated or spouse is a nonresident alien, check Single box. Does this statement applies to us since we're still in the process of AOS and have only completed Biometrics just last week.

For California Form:

For Filing Status Withholding Allowance, do I choose Single or Married (since Mike's still not technically a resident of the state yet)

Do I claim myself and my spouse here as well? So enter "1" on both?

Also on a side note, he only got SSN.

I work in HR and deal with W-4 questions all the time. You can put whatever you want on your W4's... all it does it determine how much taxes will be withheld from your check. You will still have the same tax liability at the end of the year and depending on how much was withheld and what your status is when filing taxes, you will either owe or receive a refund. There is a calculator the IRS provides to help you figure out how many allowances you can enter without having to owe back at the end of the year. Hope this helps. You shouldn't worry about the status of your spounse now, but what he will be when you are actually going to file taxes. Use that information in the calculator and is will tell you what you should enter on the W-4 so you won't owe anything at the end of the year. If you like getting a refund, enter a little bit lower number.

Hi fellow VJ members. My fiance just received the hard copy of NOA1.He said that the in the portion of benefiary the country of birth is unknown hence I checked my biographic data that I submitted and my country of birth is written as a matter of it is completely filled up.

I want to ask to those who received the hard copy of NOA1 if it is just normal to put unknown in the beneficiary's country of birth/plaace of birth.


Mine said the same thing about my fiance. Since I know I turned in the G-325a for both me and my fiance, I assumed it was normal.... would like confirmation on this as well though!

Thanks everyone for the advice. After much discussion with my fiance and both our families, continuous research and hitting brick walls, we have decided to go forth with our original plan. We will persue the K1, and make the transition back to Jamaica after getting his 10 year GC. We will be able to work everything out with my daughter in the mean time and hopefully save enought to make the transition back a smooth process.

Thanks everyone for the advice. So I'm seeing now that going through with the entire K1 process is pretty much useless in the long-run. Getting married in Jamaica and moving there is the easiest and cheapest route. I am just really concerned about getting my daughter citizenship if he is not her biological father. How can this work? When I look on the Embassy of Jamaica site, it shows biological children, spouses, and adopted childeren as options, but it says nothing of step-children! I sent them an email inquiring about that, so hopefully I hear back from them soon.

Hello,

After much discussion with my fiance, we have decided that we would like to move back to Jamaica (if possible) after getting married in the US on his K1 visa. There are many reasons why we need him to come here first... he wants to adopt my daughter (I don't believe this is possible to do out of the country) and I will need help in the moving process (selling belongings, etc.) as I work full time, go to school full time, and I'm the sole caregiver to my daughter with no family for 500 miles. What we are visioning right now is that he will come here, we will get married and file for AOS, then work on the adoption process for my daughter, try to work on me and my daughter's citizenship for Jamaica and in the process start selling things and get ready for the move... I'm not sure how long all of this will take. Will it be possible for us to move back to Jamaica after getting married and filing AOS Or does he need to stay in the US? What parts of this process can be done outside of the US, if any, and what parts will we need to return to the US, if any? I still want to go through the complete K1 process so he can travel with us when we come back to the states with no problems. Any advice or guidance to where I can find these things out will be greatly appriciated!

man i thought after sending the package that the stress would be over, i swear i feels like the stress as just began, i keep checking my email to see if i can an email from uscis about no1, im so nervous

 

And once you get your NOA1 you'll be constantly checking Igor's list to see what dates they are approving!!  I'm an Igor's list junkie!! rolleyes.gif

Ugh! I did the same thing!!  I'm leaning more towards send the forms again, but don't just white out and resend, actually send new originals.... I thinking about sending copies of my passport as well since I didn't include this in my original and only itenerary of trips... I have seen people get RFE's for this as well....  The last thing I want is another month or two tacked on till our approval due to an RFE... it can't hurt right!  I wonder though if anyone has written K1 visa instead of I-129F and didn't get an RFE??

No.  You have your interview at the Consulate in Kingston.  The USCIS office has nothing to do with that part of the process.  I believe you would use only use that field office if filing from abroad.  Good Luck!

Hello Visa Journey Members..I would like to know if anyone here has been granted visa(K1) and then fiance did not want him or her to come to the states due to her financial status and then asked the visa to be cancelled? I would like to know and thanks very much for any help.The said Visa will expired on the 18th of June and the Fiancee said she will called the NVC and USCIS so that the visa should be cancelled.Thanks

wow,i did not even look at mine..I just placed it at a nice place till my final day of departing..I am loving it here in NC and moreover,God is so much wonderful because in Ghana,before it will be 6;00pm,the sun totally set but here in Greensboro NC,when its 8:00pm,the sun is still up.wow and also when i arrived at JFK and i was inside the terminal,i never knew that,it was that so much cold outside and when i got outside ,i nearly rushed back inside the terminal as it was soooo much cold..I have to wait for some mins for my brothers to pick me up because my fiancee was preparing the home for me .There was one airport security female that assisted me by giving to me her cell phone to call my brother when i got to the outside of the terminal where my brother suppose to be to picked me up as i was delayed inside due to alot of people arrival.I will advice everyone who will be going to the states for the first time not to come during weekend especially when their POE is JFK because JFK is always busy and if u are on trasit,u may missed ur flight to ur final destination..I spent over 3 hours in the queue waiting to be checked out and another thing is that,The airline which i board(Royal Air Maroc) did not give me the form I-94 in the airplane as suggested but gave me another form which also delayed me as i have to be given the form I-94 to be filled at the airport..Another experience was that,after my brothers picked me from the airport,we went to my elderly brother's house whom is living in Bronx for them to welcome me to America and after spending some hours with him and his wife,my second brother and his wife starts our journey from Bronx NYC to Greensboro NC.It took us even more that from Ghana to New York to get to North Carolina because my brother and his wife drove me by road and it took us 12 hours to get to Greensboro,NC.I love it here and i am using to the atmosphere and their culure..That is my side of the stories to my lovely other african..Air Maroc is very cheap but their final destination is JFK and its also departs in Accra early around 5:55am and their check-in starts 01:00AM till 03:30AM.Thank u and i wish all of u the best.And that remains me..Those of u who will be travelling with Royal Air Maroc have to be very alert because when u rich Cassablanca,they did not speak English and u have to ask other passengers to show u where is JFK passengers are.It will be at the same gate 20-21.Thanks
