I 'm in the same boat with you. I have submitted everything they needed and they told me I should be expecting response within 60 days but 60 days has passed now. Let me know how things go for you.

That is embassy specific, sometimes yes and sometimes no.

I don't understand the high fees of $ 3000. What exactly was the fee for ? Form filing fees or did they use a service to help them file ?


To my understanding or knowledge, I was told each one of them paid $755 (4 people). Got to find out more on this fees, to me it sounds ridicuolus also.

I have a family of 4 who just had their DV (lottery) interview last week but were all denied because they (husband & wife) added the husband's son from previous marriage to the petition after the fact (after the lady won), the son wasn't included in the initial application when she played. Nevertheless the embassy took the interview fees from this poor family ($3000+ ($755 a piece) to my knowledge). Is there any remedy to this craziness, any appeal? This might be against the rules, policy or whatsoever, some might say they broke the rule, I think refund them some of the money and just take the interview fees i.e like the $100 that they normally take for visiting interview. Or give the ones that are qualified. Just my 2 cent. Any advice will be appreciated so I can pass it on to them.

You can contact the member...."jamyleandkhadijah" if you like. The member was denied K-1 and when through the i-130 route and everything is working fine for them. 'm just saying this just in case you dont want to file a waiver. They even did K-3 after the filed I-130.

That is bad advise. They cannot just do a K-3 when their K-1 is still in the system.


This is not a bad advice to file for waiver when the consular said he can file one. I also said ask for things that the embassy wants, whenever you satisfied their requirements they sometimes approve the visa. And when I say you should go the I-130 route, I never mentioned the K-3 because I know all these K petitions comes with all kind of issues and it doesn't serve its purpose when you start running into trouble "which is to speed up the process." Whenever you file the I-130, it will cancel the K-1 but I will say you should try and withdraw it yourself before you file. If you decide to file, dont do the K-3. I 'm talking from the stand point of someone who had filed I-130 and K-3, k-3 wasn't approved because I was a student at a time and the embassy didnt allow me to use additional financial support which I later found out that was wrong. The K-3 remained open till now buT my wife end up using the I-130. Now when I filed K-1 I-129f, it took 9-10 months from NOA1 to get it approved and I did alot of reseach during this time. So if you file any other petition keep all the other paper work for this K-1 they might ask.

NVC has sent my case ( K1 PETITION) to Lagos Nigeria more than a month now and my fiance has not received packet 3 & 4, will she need to go to the embassy and pick it up or wait till they send it? I just emailed them as well.

For my part, I have tried calling NVC both Friday and Today and can not get thru (will try again later tonight), hoping CSC has forwarded our petition by now...it has been over a month since USCIS approved our case and we still have not received the hard copy of NOA2. I called about getting another copy and was told I would need to file a I-824 which can take 6 months to process and seems to carry a nice $340 filing fee...so now I need to do a bit of research and see exactly what we need the hard copy of the NOA2 for, if anything.

Other than that I've been sitting here, quietly staring out the window...trying to figure out how an ordinary person could collect $340 for doing something that takes 20 seconds...armed robbery is the only thing that has come to mind.

I had this same issue before with USCIS, they wont forward my approve petition to NVC and I called called and called, wrote them letters but they didnt do anything even with congress intervention until I had to file I-824 Notice of action on approved petition. I spent almost 2 years dealing with this issue. Wish you good luck.

Hello everyone,

I haven't been here in a minute since I 'm still dealing with the "Notice of Intention to Deny" I already replied with the requested documents and evidence, hoping for the best. The mail is slow around this period but I hope they will get my response before Jan 7 which is the deadline for reponse. I asked if she could give me any guideline of timescale at all and she said well if all goes through smoothly with no glitches could be through in a week or 2 but if there are any glitches could take months.

Think I'm just going to call every couple of days.

I'm breathing better and the tears of sadness now tears of joy.

I spoke to this rep at CSC last week but she just gave me a general reply answer about my case status that they wont get to my case till march next year that they are still working on April which I know its a general answer she is giving me so I wont bother them again. But today I spoke with a guy there, at 1st he said my case is still in their file storage room and then he said again let me double check and when he did, he said my case is being reviewed now, so hopefully if there is no RFE I should be kicking.gif ing soon. I 'll pray with you too for no RFE. I haven't been touched yet but I 'm hoping for approval soon by the end of the week. We both actually have same date for our NOA1 approval or notice, so our timelines might be close to each other.

Ok guys, I just had the most bizarre conversation with USCIS ever! I was like, no I believe it goes to NVC for a new case number and they forward it to the embassy. She told me to hang on for a minute, I could hear her clicking away on the computer and she starts asking me a million form questions about my and my fiance, am I a US citizen intending to marry a foreign fiance, are we both free to marry, where is my fiance now, are there any children involved, are we intending to marry within 90 days of entry, etc etc etc.....totally weird. then she says she has looked up the processing guidelines for the I129F Petition for Fiance and tells me that it is not in the processing guidelines for these cases to be sent to the NVC, rather after they are cleared and do not need any further security checks or processing they are sent straight from the servicing center to the corresponding embassy.....#######????? I asked her is she was sure this is how it works, she said yes. I asked her if this was a new policy she said no. She then recommended I call the London Embassy to inquire if they had received it yet because there is no way for her to have further information on its whereabouts once it is approved and has left there system.......once again #######??? so I said, alright worse case scenario it does not show up at NVC or the embassy, like ever, how is it tracked and found and she said they have no way of tracking them once they are approved and are done with the servicing center.

I say once again #######?????


I am sure she is wrong, but my head is spinning a little! wacko.gif blink.gif


Some petitions actually DO get hung up at NVC for further checks. Its rare but it does happen.

All I will say is that everyone should do thorough follow up. I had filed I- 130 before and got missing after being approved between USCIS & NVC, no trace whatsoever , I called USCIS and NVC many times, wrote senators but they still wont come up with my application . NVC didnt get it and USCIS didnt have it, this went on for almost 2 year and I finally had to file I-864 cost me some ($$$) before they could do something. My whole point is dont wait till you hear from NVC just keep tracking 'cos I waited since they told me to wait that it would get to NVC but never did. A lot of this customer service dont know much about immigration issue they just go by what pops up on their screen. Just my 2 cents. blink.gif

just wanted to say that as long as your divorce was final before they received your application it should be fine. I had similiar questions because while my ex and I had lived apart for more than a year and had been separated a long time, we did not get around to filing until for a while, so my final divorce date is only a week before CSC received my K1 application. I consulted an immigration attorney and they told me it would not matter as its not the adjudicating officer's job to judge the timing of my relationship but rather the validity! sooooo, don't stress and hope for more july approvals SOON!!!!!!



Thanks, I won't stress as you said. I 'm very optimistic as one of july filers. I 'm on this site almost every minute its crazy cos each approval keeps my hope alive.

it's possibly a training file! I heard they sometimes pull some out of order to train new adjudicators. Not entirly fair but really lucky. Anyway on the brightside....if this is the case at least we know more people joining the ranks


I was getting ready to comment on this shortest timeline. I am happy for those guys, hope the rest of us can get a lesser wait too.

The first thing you must realize is that your petition sits in a box until an adjudicator starts to work on it. If everything is OK, you will have your approval 15 minutes later without a touch ever being registered or the approval following so closely that you never see the touch on the website.

On the other hand, if your petition gets taken out of the box and then is set aside without a decision you will see a touch.

The reason you see some people with touches is usually because they have called USCIS and had a discussion about their case. When this happens a touch is registered but it does not indicate that there has been any adjudication activity on the petition.

As far as I know they do not send email notifications of touches.

There are probably occasional exceptions to the above, but they are not frequent. There is no reason to be concerned about touches at this point. It will unfortunately be a long time before July petitions start coming out of their boxes.

We're neighbors! I'm from NJ.
Does anyone know whether you can send additional information in after NOA1. I didn't think we could, however on RFE masterlist someone a few months ago recommended to try it. Not sure what happened.
In my case my lawyer sent just the identification page of my passport and copy of my birth certificate. This was after I told him to use the passport-which I had copied every page and in front of him put my name on each page. He at the time I saw him told me that u need front and back of birth certificate. The front page of my birth certificate is complete, but the back was blank. ANyhow, I just copied the front of the bc and the passport in entirety-both of which I gave to him. I was soo ticked when I found out what he did, but my fiance wouldn't let me fire him. BG wants to keep the lawyer as he has lots of experience for the AOS portion.
When I asked the lawyer about the above and what's stipulated in the instructions, he told me that the birth certificate should be ok. ranting33va.gif I doubt it. BG and I are pretty much expecting a possible RFE. At the time we didn't think k1 would take this long and decided to wait until we got it. Now I'm wondering since it's taking too long whether I should submit the correct documents. Or should I not bother cuz VSC might have to go through the trouble of brooming the dust around the applications and might misplace the additional papers.


The back of Jesse's birth certificate was blank too. I told him to copy it anyway but he said it just looked like a blank piece of paper (no outline showed up from scanning) so, it probably makes no difference whether you send it or not.
I didn't copy every page of my passport, just the one's that were relevant to the process. I can't see how they can verify the pages actually belong to the same passport without looking at the real thing. I figured that the boarding passes and financial proof of visiting were probably better evidence of being there and of course I had the relevant page of the passport copied to back that up.
I think it depends on who is approving the petition (in straight-forward cases) as to whether they RFE you or not. So, don't worry smile.gif

How is everyone especially the july filers. I 'm still dealing with NOTICE OF INTENT TO DENY. CSC promised to make a decision on my case within 60 days after I returned the requested documents for NOID (IMBRA) but 60 days passed no decision. One rep said its security check, the other said its background check, another indefinite waiting game. I was put under IMBRA which in no way I should have been. I didnt meet fiance through no broker, and I had filed K-3 before and no prior K-1. There was a thread of how some guys waiting 1 yr and 9 months on similar issue and still waiting but I dont want to send up like that. Anyway if anyone have any suggestion or input on what to do I will ike to hear from you.

kicking.gifI filed I-129F in july 2007 but now my fiancee just went for her interview today 19th November 2008 and passed. She was asked to come for her visa in few days. Thank God Thank God Thank God thats all I can say. Thanks for your support regardless of who you are and how you have supported our journey thru this visa process. She didn't have a tough time but I figure it was based on the fact that I work for similar gov Agency. Big wedding in Dec in Lagos Nigeria everyone is invited.

For everyone else who is still waiting, please hang in there and God will make it happen. Do not quit!!!!!!!!!!!!!!!!!!!!
