Hi all... I know someone, a naturalized US citizen, who wants to bring their family here. The only problem or issue is that this person came to the US a long time ago as SINGLE when really was not. Will this person have a problem applying for K3 now after lying on his application/petition for green card about 15 years ago? What should be done to ensure approval of K3 visa?

hi guys...

this is going to be a repeat, sort of...

suppose you were issued a green card 20 years ago but you lied, sort of, about your marital status. in an effort to speed up your application and avoid complications, you said you were single (but was really married). years later, you become a US citizen. now, you decide that you want to bring your spouse and family here, you want to petition/apply for K3/K4.

what kinds of issues will you be facing? is the USCIS going to care about this "white lie" that was told some 20 years ago? should you even worry about this when applying for K3/K4?

this is the type of situation my friend is in. i want to help my friend.

has anyone of you had this situation and how did you get around it or what did the USCIS do?

can't you get or apply for AP (advance parole)? it's going to cost you a few hundred dollars but at least you won't have any problems with the USCIS. good luck!

our visa was delivered in 5 days after our interview and we live in Dipolog (a city in northwestern tip of Mindanao island). if your wife has relatives/friends in Manila, why not just stay there for a week or so until the visa is delivered. at least you can be sure you get it. you never know what will happen to it when someone else has it.

tax documents are not notarized as per the actual affidavit instructions. I did not have to have my tax documents/transcripts notarized. as a matter of fact... my I-134 was not collected by the person at the embassy (my wife still has the document and all). they did take my UNnotarized tax documents and W2s. if you get tax transcipts, then you will not need "notarization" since it comes from IRS.

8.) Pictures of our family cruise trip (with my parents and sisters' families), family parties, outtings with her co-workers.

9.) Check for $625 (application fee and 2 biometrics)

10.) Cellphone bills - highlight our phone calls and also note her number on the statements.

11.) Beneficiary Designation forms - to show that my spouse is the beneficiary to my death benefits and pension funds in the event of my death. This is employer-provided.

12.) 401K benefits - to show that my spouse is the assigned beneficiary to accept the funds in the event of my death.

13.) Travel Documents - we went on a cruise with the whole family.

You are supposed to file I751 within the 90 days before the expiry date of your greencard. It doesn't matter when within this timeframe you file. We are a legit couple, in fact we have a son together. I'm just worried because we don't think about this kind of stuff so there is no need for us to know specifics about each other. She gets upset with me for not knowing much about what she likes to do, eat, drink, etc... But you're right, we are legit and should not worry about the interview.

Hi all!

How are you? It's been a while since I checked in.

Anyway, I'm in the process of filing I-751 with my spouse and child. The expiration date is December 29, 2007-in a few weeks. I plan to submit the application on December 1 and pay extra to make sure it gets there ASAP. I know this may be a stupid question - As long as they receive the application before Dec 29 I should not worry about not receiving a receipt letter from USCIS before Dec 29, right? If they cashed the check, then that means they have received and I have officially filed.

Also, please anyone confirm this - during interviews couples are interviewed in separate rooms. and after the interviews, their answers to the questions are compared to verify that they are not lying.

I am a bit nervous... I don't know why!

PLEASE INCLUDE A COPY OF THIS RECEIPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may include, but not limited to the following items:

- Lease of joint tenancy or joint ownership of assets
- Joint mortgage agreement or property deed
- Tax returns
- Birth Certificates of children born from the marriage
- Joint policies of life, medical and car insurance."

This is not an RFE, right? This is just a reminder. I will still bring to biometrics what we submitted originally.

Hamburgapples is correct. Your Green Card is for US entry only. You will need to ask your travel agent or the cruise customer service for the answer. When we went on our cruise for the first time, we had the same questions. The cruise company took care of everything including temporary entry to the countries we visited. As long as you have sufficient identification, you will be ok. Read more about this on your cruise's website or call them and ask.

Looking at the timelines started by eau_xplain, VSC normally takes over four months. The USCIS website says that as of Dec 14, VSC is processing I-751's received March 1, 2007. This is a ten-month lag.

Look at your greencard... it has on it "Resident Since mm/dd/yyyy" that is the date you need to work from.... so you are eligiable for Citizenship 3 years from that date... the earliest you can apply is 90 days before the 3rd anniversary of your Resident since date.... I have my 3rd wedding anniversary in April 2008 but I am not eligiable for Citizenship until Nov 11 2008 and the earliest I can apply is Aug 11 2008....

Anybody in same situation? I checked out the processing time and it said December 20, 2007 - and mine was received December 17, 2007. USCIS did not even send anything saying that they are aware that the one-year extension expired and this is what's going to happen next or it's been extended for one more year. I have to go back and read the letter again - it might have said "valid for 12 months or when application is approved"?

What should I do now?

Also, USCIS customer service is no help. I can't seem to get a person to talk to me... I press 0 and it hangs up. Any advise?

Yes. Just bring all documents required by the 6-point verification system plus your old green card and extension letter. If after one year you still have not received your permanent green card, have your passport stamped with I-551 to prove your status as green card holder.

MVC did not give us a hard time.

Nothing to worry about but for documentation purposes better to get an I-551 stamp on your passport. Make sure your passport is not expired or expiring. That stamp is useful for renewing drivers license and other documentation requirements. Also, on the 13th month after filing send a letter to the ombudsman. find one of my posts under DNALERI, it has info on how to reach ombudsman. I got my green card after writing to the ombudsman for help. We waited 16 months.

Hello guys... we submitted our application to remove conditional status back in December 2007 but have not received a decision - it's been 16 months.

We went to USCIS Newark to get the stamp on the passport to prove legal status. We got that... but no one there could tell us what is going on.

In January 2009, we received a fingerprint request for our son - 12 months after submission of application. Our son is only 5 years old so I don't think they'd need to do FBI background check on him. I think the delay was because they did not have our son's fingerprint. I hope it won't take another 12 months from January 2009.

Anyway, the officer there told us that my wife can apply for citizenship even if she doesn't have her permanent green card. The only problem with this is that it will further delay the green card process. Of course, if she gets the citizenship then they'll save money on not having to produce her green card, so they want the green card to wait for citizenship result.

Should I contact my senator? How do you do this?

Anyone here know about derivatives? Do derivatives (children included in application) have separate biometrics appointment than the principal applicant? My wife, principal applicant, received the appointment and had the biometrics done this weekend. I asked the person there about my son and he said that my son will receive his own appointment. Is this true? Can anyone confirm? Thank you!

It looks like VSC is the only that takes over a month from biometrics to approval. VSC is taking over four months.

but i told my wife to bring everything... birth certificates... medical records... even the stuff that were required for the interview... everything that was asked for in the packet.

the pregnancy does not affect your chances at all... but i think if you have a child with the petitioner, it increases your chances, even slightly, especially if you can prove the child is his... (birth certificate) this was our case and i also think this because of the LIFE Act which roughly says that families should not be separated due to process of immigration.

i thought it helped my wife's case. and you know what's funny? the interviewer ask questions about our son more than she asked my wife about us. how old is he? what do you feed him that made him a big baby? where is your dad? to which my son answered "jiosey" (New Jersey).

i'm no expert on this but should the baby be born before the interview... all you need to do is sign the BC acknowledging paternity and all will be well... it would probably help your case even more since you two have a baby together... as far as the K1 petition... you should inform USCIS that you want to add a dependent beneficiary (your child) to the petition. it will not cost more to add the kid. worry about his citizenship when they are here.

if the US Embassy in a country with high rates of fraud approved our case, then there is no reason why yours won't get approve in her country, assuming it does not have a high rate of fraud. As i have written in another thread... i believe my son helped the process... having a son together proves your love (not always) in this context to the interviewer... but then again... i could have just been lucky or blessed by God for the speedy processing and approval of everything.

you have to include her children on the I-129F. in one of the forms that you or she will get, you/she will be asked which of the listed children are actually going to travel on K2. i'm sure you know this already.
