K-1 Fiance(e) Visa Case Filing and Progress ReportsNew to the whole process... any advice?

my fiancee who is from Canada just got done with her interview Wednesday ( jan 21st) and received her K1 visa on Friday ( Jan.23), so now we have a date set. It is a long process but the wait is worth it kicking.gif . Things to remember that the K1 visa is good for only for one time, meaning that if you want to go back to England to visit family you may have a hard time coming back to the US, we just found that out and all the research I did never came across anything about it. So once she enter the US on the K1 visa she will set start the process for the Green Card. which can take up to 12-16 months.

To answer your question you could visit on a tourist visa while you application is being process. When you travel back with him it would most likely be best that you both pass custom separately. Why? so that you won't get hassle about your visit into the country, they will make you feel that you are coming and try to get married and stay. It happen to us the first time she came across and she had a passport. So every time she came across she said that she was staying for only 10 days. Your boyfriend can not go inside with you during the interview, he wait outside for you. My fiancee interview was in Montreal while she went inside I wait across the street at a coffee house. Since my fiancee doesn't drive I will be driving up to Windsor Ontario to pick her up and drive back with her, that will be next weekend. I think the best person to answer that question for you is an Immigration attorney. I am sure you can find one and usually the intial consult is free. In my opinion depending how much time as past by and seeing that he has not had any other charges since that one, I don't think it would be a problem. I still think that you should consult an Immigration Attorney and get his professional opinion.
Good luck with you process. My fiancee and I got the K1 visa she will entering the US next week, then we start with the Adjustment Of Status process.
