Bajan, it seems like the only answer you are going to get is when you actually go to the embassy. I think you should try to use your father but have your godmother's info as back up. Fill out two different forms and carry them with you. If you present your father's and they say no quickly say, well I have another sponsor and give them her information. It seems like its entirely up to the CO as to what they want, but at least this way you are prepared. Try to put it in writing what you were told all three times you called and present that too.. Is this correct? We filed the CR-1 and we were told we would have to pay the new $350 visa application fee and also the finger-printing fee and any other fees at the window BEFORE his interview. I would like to know which is correct also for the ones who did file CR-1. Maybe the fees are for the Fiance visa's???

please understand, that just because it was 'accepted' at NVC, it doesn't mean the Consular Officer at the Immigration Unit inside of the US Embassy/Consulate will NOT find problems with it, ah ? Also, don't forget that an approved petition means the foreign spouse is ALLOWED to apply for a visa. Never means 'all is well' - IMO - 'all is well' on interview day - when the ConOff says 'yer approved - Welcome to USA'

Many times, I-864 is some issue, things strange on the DS-230 - NVC ONLY CHECKS for completeness and 'dollar amount' - and that's it. A ConOff knows how to sniff out problems - and the casefile always in hand prior to interview day - time is made for 'eyeball review', as well - so if any perceived ISSUES with the 'totality of the casefile' - notes are made in the casefile, prior to interview day.

The Interviewing Officer sees those notes, as well, and 'makes the interview' go a certain way, based on the notes.

Also - is different 'approach' as well, based on which US Embassy/Consulate it is.

Although your question is 'general' in nature, the answer is 'specific' in scope - it depends on where the interview is, as well.

Please review the I-130 instructions, review the 6 types of evidence, review your Consular Reviews - then LET US KNOW if you feel you should prep a package for your foreign spouse, for this 'bonafide relationship evidence' - or not ?

WHAT POSSIBLY COULD BE A REASON IN ONE MONTH FOR NOW THAT HE IS DENIED FOR VISA??

Mandy it sounds like you are a cr-1 visa, if that's the case you are supposed to get it shortly within arriving in the states. The other posters are K-1's like myself and we applied 2 weeks, 2 days after his arrival and we got it in about 2 weeks.

We filed more than two months before you and got approved two and a half weeks ago... Really, I don't think there is any reason to freak out before everyone who filed around the same date as you gets approved and you get left behind, which happened to us. I was very patient until that happened, but THEN I really started to worry. Fortunately, we have a great congresswoman, whose caseworker was willing to call USCIS every week even though we hadn't hit six months yet...

Now I already have my interview date set for July 27, less than a month after approval. You see, things can go very fast once you are approved. Hang in there. I know it sucks.



In addition to that, each of our cases have different circumstances involved with them so that could be the reason why also. For example my SO and I have no records (police), no children involved, no previous marriage, etc. That might enable our case to go through quicker than someone else who may have other issues going on. Keep that in mind too...

I am a February filer and our case just got approved at the end of June. I won't tell you to be patient, but just be mindful that everything happens for a reason. What I will say is have faith. The other advice that I will give you is that if you are not "satisfied" with what the first operator told you at USCIS or even if something doesn't sound right, keep calling! Maybe the next person will tell you something different. Its just like if you need major surgery and you don't like what the first doctor told you, get a second opinion! I went into the first process thinking it would take six months from the date I filed until the 2nd NOA and it doing so, imagine my surprise and joy when it came in 4 months... Keep the faith. You are not alone...

You will get a letter from the NVC which will give you the consulate case number and will state when they received your petition. The letter will then say that it will be forwarded to the consulate "within a week". Typically about the time you receive the NOA2 in the mail, the NVC has your petition. It can be in and out of NVC within a week or take up to 8 weeks, depending on if they need to do additional processing. When the case clears NVC they send you the letter.

VJ members typically fill in their timeline after they get this letter which can make it appear as if everything happens very fast, it does not always but then people back-date the timeline when they get the information

I didn't have original copies, except for the I29F. Whenever I needed my fiance to sign something, I emailed and he signed and faxed back. I ask USCIS specifically that question about faxed copies. I have the agents name and id # just, the date and time of the call. She wasn't sure either. I haven't had an RFE. Im at the interview stage. I don't suggest everyone go this route but it worked for me.

I understand what you are saying, but this is what the instruction sheet says, that she received with her forms, and I quote, including their bolded words...

First: Complete and return immediately to this office the enclosed Form DS 230 part I, DS 156(both copies) and Form DS 156k.

Second: Obtain the following documents on this checklist, which pertain to you. Do NOT send the documents to this office.

The Affidavit of Support is on that list of documents. So they make a very strong point of NOT including any documents with those forms. It's just that Form 156k requests a few of those documents.

In my opinion, you did the right thing by emailing AND including a copy of the transcript. That's all you can do for the moment. The 21st is not that far away. Make sure you fiance has SEVERAL copies of the needed documents. Don't give them a reason to not accept it. Take a white sheet of paper and a black marker and label what the form is and the name of it and paperclip like maybe 3 copies to it..

I think you may be going a tad overboard with the letter. I didn't put physical addresses on the letters. I wrote both letters for myself and my fiance but worded them slightly different and gave them just a brief summary of how we met. I started the letter off with a date and "To Whom It May Concern" Since its part of the I-129F I felt as though it didn't need a "Physical" address typed on it. I emailed my fiance his copy, he signed it and he faxed it back. They accepted it. Good luck to you.

I didn't talk to the Chief of the USCIS, We talked to the Chief at the Border.

It is very sad that it has happened this way, and now that they think I want to move, I don't think I can even try to enter. They took my fingerprints, and I believe I may have been flagged as a "person attempting to live in the USA".

The reason why we didn't apply for the K-1, was because we wished to get married in this month. We also had people flying in from other states in the USA.

I didn't have a lot of my personal belongings with me. I had clothes for a week time, plus a lot of decorations I was going to work on and prepare while having the visit.

I did have proof that I was going to return, but every time we spoke, it was almost as if they had their mind set.

The ceremony of our wedding was to be held in Ontario. I had paperwork, invitations, and deposit information for the hall and the reception. I also still have a bank account, and my dress still in Canada as well. I don't know if it is useful ties (probably not) but I definitely was going to come back.

There is no way we would even attempt to try this crossing if it wasn't okay'd in the first place. The 4+ times my fiancee has called the USCIS, all the stories and replies weer the same, same with the call to the Embassy in Toronto. We would have definitely done our plans differently earlier this year if we were told the truth from the start.

I know it's no use explaining myself on here, but I just wanted to say whats on my mind. I'm still in shock for whats happened. The Border had stated though they sent out an urgent message to someone higher up than them for a reply, to figure out how we can visit, or at least for me to come for a visit for our wedding day and a few weeks afterwords.

I will look into more information here, and post the same thing on the Canadian board when I have a chance. I am glad we have found this website now.
Before we didn't want to use Non-Government websites, thinking that anything else could have been false or out-dated. We went straight to the source, and we got bummed.

I beg to differ. It's really GOOD that you can express yourself on here. Obviously you are frustrated because you feel cheated and lied to. Not to mention all the preperation and planning you put into your wedding. my thoughts to you is seek help in the Canadian form and research cases on this sight where someone might have had similiar circumstances as you. Follow the guidelines here and please DON'T purchase anything else or go futher until you've followed the guides here. I hope this eases your mind somewhat. I know your upset but its time to put that aside and do what you need to do to be with your loved one... heart.gif

In theory...no. I strongly recommend USC's to attend interviews if at all possible for the moral support of the SO. Some consulates will not let you in the door. Send in your passport as evidence you are there. Some will let you in but not into the interview area, so be it. Others will de-facto require you to be there (as mentioned Ecuador). At any rate I considered my presence to be for Alla, not for the consulate.


Unfortunately, I was a case where I didn't go with my SO. (Jamaica Consulate). But he is a strong determined, straightforward kinda guy and he did a GREAT job without me! It can be done depending on the consulate...

You both need your own G-325A's to fill out.... If you are doing the paperwork, the forms should be sent to you - signed meaning she should sign her own and you sign your own.

So this feels like the end but hope is a good thing (as Shawshank would say). I am giving her time.

so what to do.

I have more or less everything i need for the interview but dont have the heart to do it. I dont want to stop the process because if she changes her mind i cant go through this again. Its 8 months of real heartache.

I want to cancel the meeting and go to the bottom of the queue, maybe 2 - 3 months later , where we can see where we are.

Is this the best idea. How do i do it? I see no numbers and they say in writing? People must get ill an not make these interviews. What happens?

Are you in a position to come over and use the 90 days as further confirmation whether to go forward or go home? Like it was stated before you have 6 months before you have to use the visa and 90 days before you would have to wed, can you use this time to see where the two of you are then? I know it wouldn't be easy to come here and then have to go home, but if you are in a position to see, then I would recommend going to the interview.

The instructions for the I-129F specifically say to use black ink, but I've never heard of anyone getting an RFE for using blue ink on the form. I doubt USCIS cares much what color ink you use, as long as they can tell that the signatures are original.


Sorry I posted in the wrong spot earlier. I called USCIS about the very thing discussed here and according to one of the agents she said it doesn't specify it. We sent copies and we are at the interview stage. No RFE's thus far in the process.
