K-1 Fiance(e) Visa Process & ProceduresForiegn fiance is on welfare, problems?

That's because in the US many people believe that "support from the government" is a euphemism for "support from the taxpayers". The government in the US doesn't have any money they didn't take from a taxpayer or borrow from a bond holder. The same is true in most countries that aren't socialist (i.e., where the government isn't getting revenue from nationalized industries), but many people don't make the mental connection between the government's money and where the government got that money.

I'm not belittling the social support structure they have in Australia, especially if most Australians are happy with it. I'm saying that, to a large degree, people in America don't feel the same way. Most people in America believe that unearned public benefits should be reserved for those who are either permanently incapable of supporting themselves (the disabled), or are temporarily down on their luck. What might be surprising is that this belief is the strongest in America's working class. The people who believe that America should have a social support structure resembling the one in Australia or much of Europe are at opposite ends of the income spectrum - those at the bottom who would directly benefit from a strong social support system, and wealthy liberals who would happily contribute a chunk of their own wealth if the government forced everyone else to do the same. The people in between don't like it because they're the ones who would mostly be paying for it.

Immigration law is crafted to appease the majority of American who feel this way. Americans, for the most part, expect the costs of family immigration to be paid for by the families and immigrants, and that there should be protections in place to ensure that Americans aren't left holding the bill for immigrants who can't support themselves.

K-1 Fiance(e) Visa Process & ProceduresK1 - will get married on the last 2days stay in US, is it ok?

strongly not recommended. you will have to file for adjustment of status BEFORE your K1 visa expired. If you got married 2 days before your visa is expired, you will have to at least 3 days until your marriage is recorded and you can order a certified marriage certificate to be attached to your i485 application, and the application needs to be accepted by USCIS before your visa expired.

As for SSN, better apply now when your visa is still valid, and later after you got married you can report for name change. later after you received your greencard, you need to report your new status too. good luck !

This is not correct :bonk: the K-1 visa was invalid after the POE and you can file your AOS at any time after the wedding!!!!!!

Please read the Guides!!!!

You need to meet WITHIN the last 2 years. So if you file in August, you need to have seen him in person between August 2010 and August 2012. That is all you need to do for that requirement.

K-1 Fiance(e) Visa Process & ProceduresA Little Confused

No no. He won't need the NOA 2 for the interview, he'll need it for AOS later on (after you get married).. so keep it safe when it arrives because USCIS charges about $500 for a copy of that document.. so you be persistent and make sure they send it to you... BUT don't worry about him, he won't need it at all.

CONGRATULATIONS! Posted Image

K-1 Fiance(e) Visa Process & ProceduresPacket 3
The fee is $ 350.- plus the cost for the medical and vaccinations

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
1.A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

2.Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

3.Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).

4.I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

5.You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.

6.A copy of the NOA2 that you received in the mail.

7.Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

K-1 Fiance(e) Visa Process & ProceduresDo not plan wedding?
If there is a delay of any kind then you setting dates will be in throuble, I took another 3 months after receiving my K-1 Visa to sell my house and quit my job and my wife arranged the wedding in the US.
You can take the gamble but you do this at your own risk, the Consulate does not take any responsibility.

K-1 Fiance(e) Visa Process & ProceduresProvided my Girl with instructions, then suddenly a new form pops up

So, with the help of this forum, I provided my longtime girlfriend with a decently detailed step-by-step explanation of how we are going to do this marriage-->resident--->citizen thing. I then get on the phone with her and she starts talking to me about a G-325A. Does she have to do that? If so, how soon and why wasn't it listed on the UStravel.gov website? Am I right in assuming that the first step is still my filling out the I-129f? Any help would be appreciated. Thanks.
