Any evidence you have I would send with in reason I dont think you need every thing, but make it clear that you do have a realtionship on going or are married or what ever you are trying to prove. I have 100s of photos I dont think they want to see them all. On the other hand save evert thing you can think of that proves you are in a relationship you never know when you might need it

I emailed the DS-3032 for may wife a week and a half ago and the CR-1 guide says it takes about a week. How long should I expect this to take before I get the Invoice for the DS-230?

I called NVC but it was pretty much useless. How would one know if they even actually recieved it or do I just sit and wait before I relaize that it never even happened?

She has had 2 USC babies (unless she had them at home and the babies have no record) so what makes you think she will not be on US Immigrations radar? I imagine t is already only a matter of time that she will get a deportation letter for a hearing to send her home. Fortunately US government is very slow at this.

It is unfortunate that US law would sepperate a family under these circumstances. I would think that your best bet is to see a lawyer ( a good one do not go to the first one you meet). If he has no good news I suggest you wait for Obama to hand out his amnesty( which I think he will). I have a friend who was caught by immigration for being here illegally and her deportation hearing date was 2 years out. Like she was going to be there for them to come and get her in two years. They found her out when she applied for a drivers license as in washington state you can get one even though being illegal.

Dont you think that going to a hospital and having a baby hasnt already put her on the deportaion radar?

I have always wondered what an illegal is to do when they do find a mate or have childeren here because they cant stay. They get married and not only cant they stay they are band from the US. Dosent make for a good family and rips apart the relationship of the USC.

Good luck this aint gonna be easy for either of you as Immigation dont give a ####### about you her or your family they only see that she is illegal. This system is sooooooooooo screwed up its un freaking believable.

Just know that as you go through this there is a good chance you will be seperated for a very long time or for the rest of your lives you will have to fight long and hard and in the end you might have to live in mexico if you want to be together.

My friend will have to leave the USA and her child is 5 years old and is a USC the fact is she has to leave but the child does not and if she cant afford to fly him home with her the US will not and she will have to leave him here award of the state.

That is our system and what a system it is. No concern for families for relationships for true love for the very thing that is most important to us as humans.

Sorry for the harsh reality you maybe able to pull this off but like I said its not going to be easy

I got married in peru on Sept. 19th 2008 my wife entered the USA on May 19th 2009 on a CR-1 Visa. ( a couple of weeks ago)

I didnt file until november 2008 because it takes time to get all the information together. Most of the time it takes to get it done is info collection. If you want to get it done fast then start right now and the day she is able to get married file the papers (for a K-1). I would do the CR-1 though if it were me. Its cheapr and takes about the same time. The process for us took 6 months and 5 days after filing( 6 months to the day if you dont count DHL).

When one enters on the CR-1 you will be able to work, get a SS#, get a drivers licence and travel out of the country. None of which is possible on a K-1 until you adjust status and that costs more money. I think the #1 complaint I hear on VJ is my wife is bored she is not happy she wants to go home becasue she cant work drive or do any thing on her own due to the K-1 visa.

If you want to get married in Peru start that process now also. You need to get things together and letters and so on. You will defninately have to wait untill the divorce is final as they as for proof of single status. Do fact finding now what it takes and where to do it. In Peru each municipality is different in their requierements we found one in Arequipa that had the least amount of requirements and went there.

Just a side note. I found this out after I had gotten married ( no one said any thing to us about it). In peru to get married you have to sign a paper(some kind of form) that allows you to sign documents in peru IE marraige licence.
I did not do this I guess becasue of that my status of marraige could be contested but she is here now. This document also would allow you in the future to buy property, rent an appartment buy a car and so on if you ever decided to live in peru.

If you are an average person and can fill out the 1040A tax form or other government forms with out too much problems then you can do it.

As for writing errors on this site I see them all the time and these people are doing it. I filled mine out had no RFE's asked very few questions and all was approved with out any hitch. So yes most people can do it thier selves . If you have leagal problems I would sugegest at least consulting a lawyer.

What I have seen with the lawyers is they charge you ( alot of money) to fill out the forms make the same or worse errors and you have to pay for it. THey charge you for some thing that you can do mostly your self. Most of the forms can be filled out in the matter of minutes. Its the info gathering that takes the time.

I didnt need my birth certificate Im the USC, but it never hurts to be prepared. We did take it with us to the interview but was never asked for it. They should have a copy of it in all the previous papers you filed. Take all the evidence you can with you, you just never know what they will ask for.

Yes you can go to the interview withe her. I thought it was intersting that I was asked more questions than my Peruvian wife but all went well. Many people had their significant others there with them in the interview.

Just a thought. Although you will have an interview time appointment go early like 630 or 7 am, the line builds fast and even if you have an appt time they take first come fisrt serve. We were out of the building before our interview time even came up. If you have a late interview time and you wait to go untill the time you could be there a very long time.

Make VJ your best friend during this process ask alot of questions most are very happy to answer and dont genrally lead you astray. The forms are ( CR-1) I-130 filled out by the USC I-864 filled out by the USC or co sponser it goes through USCIS then to the NVC then to the Lima consolate from there the beneficiary gets get the DS230 which the beneficiary fills out some where in there is the DS3032 which is to be sent in by the beneficiay but it can be emailed and if done properly can be doen by the USC. I USC filled out the DS230 for my wife ( with her information) and then emailed it to her. Its all in english so it was easier for me to do then she signed it.

As soon as the NVC gave us notice that her file had been sent on thoe the consolate she started the procedure of getting the police reports whcih you can only get in Lima. If you do your home work you will know what is going to happen before it happens and is asked for and can speed up the process significantly.

Also just so you know only the US citizen can do the application for the immigration papers. Although you can have a say and help fill out the forms ultimately its the USC that signs and sends in the forms. Its only later in the process that the beneficiary is involved in thier part of the form filling.

Did you get married in Peru or in the United states? IF you got married in Peru and went through that process on you own then you shouldnt have any problem doing the immigration papers on your own.

My wife and I did the CR-1 visa. It took 6 months to that day. We didnt use a lawyer. In fact I called several lawyers most wanted my money any where from $1500 to $2500. Then I talked to this one he says to me you dont need a lawyer if you dont have any legal problems. He was right. We got no RFE's had no delays.

You will have to read the guides to be sure what is best for you. Unless the K-3 process has gotten faster the CR-1 times will be about the same. If the beneficiary enters on a CR-1 it will be cheaper in the long run. Also upon entry the beneficiary will be able to work and get a drivers licence and a social security card and bank accounts ect....

If you can fill out basic government forms (ie.. taxes ect) by your self then you shouldnt have any problems doing the immigration forms. Most of it is what is your address where do you live where have you worked blah blah blah. You would have to give that info to the lawyer any way. Why not just put it in the proper place on the paper your self and save a few thousand and use th money to go visit your spouse or go to the interview ( a much better spending of your money in my opinion). Showing up for the interview would do you much more god than a lawyer would do you ( unless you have some kind of legal immigration problems)

The best thing you can do to make the process work well is be thourough check every thing several times make sure it is right and that you are doing it the way they are asking for it. Prepare for the next step ahead of time dont wait to work on the next step when you get the go ahead. When you do get the go ahead you can immediately send it in because you have already filled out the forms and collected the information and evidence that you need.

I found that the most time consuming part of the entire process was the information gathering and making sure it was correct. The actal filling out of the forms and sending it in took very little time.

Like the guides say make 3 or 4 copies of every thing dont send originals unless they are specifically asked for.
So when you are ready to send every thing in you will have say 3 or 4 stacks of exactly what you are sending make copies of checks and every thing. If some thing gets lost you will have it readily available to send it in that day and not have to go searching for the info all over again.

I was at the interview for my wife. WE were always together. Funny thing was I was the one they asked all the questions. Asked very little to my wife. I think that she would have been approved any way but after seeing the process I believe that it would be in your best intrest to attend the interview. IF things start to go bad there would be more oppertunity to resolve them.

If you are getting married soon the you will have to file after you get married. At that point you wont need the afidavit of being single or the letter of intent.

If you want your futre wife to be able to work and drive when she gets here file for the CR-1 its a (final paper wise) cheaper way to go and she will be able to drive and work when she gets to the USA. It doesnt really take any longer to do the CR-1. You cant file until you are married.Or if you do the K-1 you file first and then she comes to the USA and then you get married. Personally I think the CR-1 is a better way togo.

IF you have all your ducks in a row you can file ASAP after getting married. IT took us 6 months to the day. If you are doing direct consulate filling I hear it takes a little les time.

You have to get the police report in Lima and it takes about 3 or 4 days. Lima is the only place you can ge them. That is for reports for peru for the US you dont need them .

I have some questions regarding the Lima interview process . I was hoping that some one could help us. My wife has her interview on the 12 th of May. I want to make sure I have this all straight.

She just recieved her packet a couple and I dont know exactly whats in it or what it says and she is kind of confused about what is going to happen and what to do. My wife has her medical examination on the 6th of May


#1... Do we have to pay more money at the time of the interview?

#2... I heard some where that you had to pay DHL for shippijng the passport prior to going to the
interview and that you have to bring a prepaid envelope or some thing to the interview. If this
is true how does one go about doing that?

#3...What paper work or additional forms need to be filled out?

#4...What paper work or papers or evidence should we bring with us to the interview?

#5... Is there any thing you think we should know about this process to help things along?

I hope I am not missing any thing else and thank you for you help.

You should get your passport renewed. You will most likely need it again in the near future. It will be much easier and cheaper to get in Peru. My wife got hers in just a day or 2. For example to drive in the state of washington where my wife will be living she needs 2 proofs of ID a passport being one of them but they will not accept an expired passport. A current passport is a good form of ID here in the US but it will be worthless if expired

It states in the instructions that the certifiacates can either be in english or in the language of the country. The lady at the emabassy was complaining to me that we had them translated and that it just makes the pile of papers larger and dificult to go through.

Pretty much all the interviewers at the Lima embassy speak both languages so I dont see why you would need it any way. Save your money

Yes you will have to answer yes for the arrest if you dont they will find you out and send you home. The report will read that you were arrested for solicitation of prostitution but that you plead it down.

I have been out at 4 in the morning I didnt get arrested for any thing oh wait I didnt do any thing. To say that the police are just out to put people in jail for the fun of it is a mockery of our judicial system and our country.

I hope that you get sent bck as we dont need this in our country. Sorry but I have no compassion for this kind of trash

just because one gets cited does not constitue breaking the law. Being dismissed says you didnt. Many people get arrested or cited falsely but when its dismissed then that means as far as the court system goes you didnt do it. there is a difference.

I will agree that it should be listed but it will bring a up a red flag, but to say one gets cited and that is a guilty convivtion is no right. There is no difference than going to court and proving your inocence or going to court and having it dismissed it is one in the same and one would be free and as inocent as if it had never happened

I think for a trafic citation its not that big a deal I dont think they care. If it was such a concern then this would be something you would ask immigration.

It would definately bring up a red flag so you would need to be prepared to cover it. Traficcitations are more considered infractions al though it says citation I dont believe its thought of as so.

For example you were cited for a misdemenor amount of marijuana that is a citation

Even if you got arrested and it was dismissed you souhldnt have to say any thing. Having it dismissed is like saying well we were wrong and we should have never arrested you so it doesnt count.

In your case it says its dissmissed and sorry we should have never given you a citation. Even if you did it they couldnt prove it and there for in their minds it never happened

First off you can not be found guilty until you go to court on the matter. So make the court date for a later time. Tell them that you have an emergency and you can absolutly not make the court date until after such and such a date. Generally they will make it for a month or so later. That would mean that although you did it before the actual conviction would be done after. You are not guilt y of a crime until you are found guilty or plead guilty. So they cant really say that you are a criminal becuase it hasnt been in the court yet.

Secondly although you may have been going 20 over the chances that you are actually conviceted of reckless driving are low. Now if you had alot previous tickets then I might worry. In my state (Washington) they have the 20 mile an hour rule. I have been cought for that before more than once but have never actually been charged with reckless driving. Usually it would have to be combined with some other stupid mistake for them to actually enforce it although states may differ on that point.

THird ly because its your first offence if you plead an cry alot (lol) what ever works and swear never to do it again and show that you have never done it before then there is a good chance that it will or can be plead down to some thing much less or even forgiven.

Look into your state we have here in this state a program that you can "defer" your ticket and if you dont get any more for a period of time its thrown out dismissed and never goes on your record and only court costs apply

Agreed I know we are suppose to carry it around but at the cost of replacing it and the hassel. If you have a photo copy its not like they are going to deport you when you can supply them with the real one. I suppose if we lieved in an area where they would do immigration raids or got into situations that would be questionable then I would want my wife to carry it but we dont.
When we travel far from home she carries it with her

If they want the real one then we would give them the real one. the photo copy my wife carries is laminated. we wrote on it photo copy original upon request
