It says US citizens do not have to file AR-11

My fiancee is not a US citizen. She is in the Philippines. I am simply taking care of her change of address for her. The OP's fiancee is also not in the US. I know what it says online about changing an address for a non US citizen. It says to notify the USCIS by calling the number and to also file AR-11 (which can be done online now). I have tried this. But how can you answer the POE questions on the AR-11 form if she's not in the US? Also, when I called the USCIS, as it states to do online, they could not give me a straight answer, but finally told me to mail a letter as I did.

You wait until you get your NOA-1. Then you call USCIS customer service at 1-800-375-5283. You tell them who you are what your applying for and that you need to make a change in address. If need be explain the Beneficiary moved one month after you sent packet off.

Calling them isn't good enough. When I called, I got conflicting information. First they said to file AR-11, but I explained why I didn't think that was correct because my fiancee in not in the US. Then they said I only need to mail a letter to my local service center. They certainly wouldn't do anything on the phone for me.

In their advice, they stated they gave proof that she moved by showing copies of the plane tickets. I wasn't told to do that, so I just sent a letter along with a copy of our NOA1 letter. I also didn't have to change the consulate like they did because we knew about the change of address to come in the future, and put the correct consulate when I filed I-129F.

I had the same question when my fiancee finished her contract in Taiwan and moved back to the Philippines 1.5 months after I filed. Everyone kept saying to file the AR-11 form for change of address, but the form kept asking for her POE. She wasn't here yet, so how could she have a POE. I believe that form is for a non-US citizen that is in the US, but I'm still confused on this and haven't been able to get a good answer.

I then called the USCIS and talked to someone. Wow. It took about an hour trying to explain what seems so simple. First the guy I talked to also said I should file AR-11 and he couldn't give me advise on filling out the form, I should seek a lawyer. Finally, after explaining that she is not in the US, for the 10th time, and my petition is still pending, he put me on hold to talk to ask someone else. He then came back and told me to send a letter to my local service center in Portland, Oregon, telling them of the change of address. I don't know where yours local service center would be.

I wrote the letter and just received a reply form them today. Here is what they said:

Thank you for correspondence received on 12/21/2010.
The California Service Center has been informed, via e-mail, of the updated address for [beneficiaries name].

If you have any further questions, please call the National Customer Service Center at the 1-800-375-5283.


After that, there was more that said the following:

Please remember: By law, every person who is not a U.S. citizen and who is over the age of 14 must submit Form AR-11 AND notify this office of their change of address, within 10 days from when they move (persons in "A" or "G" nonimmigrant status are exempt from this requirement). To notify this office of a move, visit our website at: www.uscis.gov or call the National Customer Service Center at 1-800-375-5283. The Form AR-11 can be downloaded from our website or you can call the National Customer Service Center at 1-800-375-5283 and we can order one for you. Instructions for filing the Form AR-11, including mailing instructions, are included on the Form.


This last part again makes me think we should have filed the AR-11 form. I'm still confused. I don't know how to answer the POE questions if we are supposed to file that form. When filling out the PDF form, there is a pull-down answer for these questions, and NA is not an option, nor do any of the other choices fit our circumstances. Plus, it's been way more than 10 days now. Why should they care if she has moved more than 10 days ago when her petition is still being processed. I wish I knew the right answer here.

I am concerned about my petition now after reading this thread. I sent in copies of my own and my SO's divorce decree. They are photocopies of certified copies, because no where in the VJ guide or I-129F instructions mentioned "certified divorce decree."

The VJ k-1 guide says, "Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married."

If being "certified" is that critical, perhaps we need to mention that in the guide so that newbies like me won't be misled.

I was under the impression that all documents can be copies of the originals.

I am also very surprised that USCIS will flat out reject or deny a petition instead of issuing an RFE asking for the "certified copy" of the divorce decree.

So, will I be getting a denial or an RFE?

I did not send in a certified copy either. I did get my copy from the clerk's office, but I didn't pay extra for it to be certified because the guides and directions didn't say it needed to be. I planeed to give a certified copy to my fiancee for her interview. After sending in my I-129F, I read posts about the possible need to have the decree certified and I became very worried. I posted a few time about the concern and several people told me that it shouldn't be a problem as long as it had a stamp showing when it was filed. I looked at the copy I send, and it did have this stamp.

So, not I'm wondering if I'm going to get an RFE and have problems too. I certainly hope not. Does anyone know if you can send in a certified copy before getting the NOA2? I filed in Sept and believe we might be about 4 wks away from NOA2. I do not want anything to slow down our process. The waiting is so painful as it is.

I had to do the same thing for Marina. I called the helpline and they informed me to send in a letter with a copy of my I-797C (NOA1) to the address on the back of the NOA1 (your specific service center). They also said that I should send an email, once approved, to the consulate referring to the case #. We probably will also call the consulate once we get approval.

We have the same situation, we were just going to wait until NOA2 and change the address with NVC and London.

I've heard several times you can just wait until NOA2. I mailed a letter to USCIS because I didn't want to wait if I can change it now.

NO. This is for non US citizens living inside the US. The beneficiary that moved does not live inside the US. Every time this question comes up, someone posts these links to the USCIS website. This confuses everyone. Read the other posts and see what people have done and quit waisting time on these links for people living outside the US.

Why are you quoting something for US citiezens when the beneficiary that moved is a non US citizen living outside the US?

The same thing is happening to me and I was told by a couple members who have already gone through this same situation to try to catch it at the NVC phase or if that was too small a window to call the consulate as soon as possible once it has reached there. I'm sorry, I forgot to look what country you were filing for but if you have a country with an unreliable mail service like we do it was recommended that we don't bother changing it since I will get a copy of the same packet 3 here in the states and everything else we can do online. (And at that time his address/phone will be changing to the US anyway!) People, please correct me if I'm wrong but I don't think it is against the rules to not change the beneficiary's address when they are living abroad, only the petitioner and the beneficiary turned alien living in the US are required by law to notify using the AR-11.

You can actually catch it while it's processing, I did just this. After multiple phonecalls, I found out the only way to change the form is to send a formal request letter to USCIS. I didn't send a whole copy as John and Mari said, but that couldn't hurt. Send a written letter formally requesting the change. Be sure to include your DOB, NOA1#, the beneficiary's name and DOB, as well as both the old and new address.

I know they received this letter and that it worked, the address was modified and you will see a "touch" on the website about a week after you send it. This is the one and only way to modify this information on the form. You cannot use any of the other address change forms as these are for US address only.

In addition catch it at the embassy and they will be much more available to contact about your case as soon as you get an NVC#

Yes. This is what I did. It took a long time on the phone to get the correct info. I sent the letter and I know they received it because they sent me a confirmation letter. I did not see a touch for my case online. I've been looking for it, but the date has not changed since NOA1. It's been over a month now. I will be sure to contact the embassy after the petition is approved.

You need to have the divorce decree with the judges signature and stamp showing that it was filed with the courts. That's what mine looks like, even though it was not certified. If your copy does not have the judges signature, the court house records department should be able to get you a certified copy. That should have the judges signature. If not, hopefully being certified is good enough, but I don't know. You should only have to send a copy of the certified copy for your I-129F and then send the original certified copy to the beneficiary for the interview.

Sorry to hear about your RFE. I think you should have kept your original copy of the RFE and sent them a copy instead. They shouldn't need the original, but maybe I'm wrong. I do not think it will matter though. Good luck at getting your NOA2 very soon.

I called the NVC today to check on our case. They received it yesterday but have the wrong case # assigned. They assigned a Taiwan case number instead of a Philippines number.

Just as I figured, my fiancee's address was not changed by the USCIS even though they sent me a confirmation letter saying they received my letter and forwarded the request to CSC.

Several months ago my fiancee moved back home after finishing her work contract in Taiwan. I knew she would be doing this when I filed her petition, so I put the Manila for her embassy. When I received our NOA2, it also said Manila. I wonder why someone would take it upon themselves to change it to Taiwan. I suppose I should not have used her Taiwan address when I filed, but I didn't want to be dishonest about anything, especially since her g-325a showed her living there.

Why is it that the USCIS can't even get something as simple as an address change correct. I am very diappointed with the whole process through them. Good thing I called the NVC before they forwarded our case to Taiwan. After talking to them on the phone, sending them an email, and receiving a confirmation email, I hope things are taken care of correctly. I even called them again and they assured me they haven't sent the case yet and things would get corrected. However, they couldn't tell me how long it will take before they send the case to Manila.

You should look at the recent timelines to see this for yourself.

Go to Immigration Timelines at the top of your page. Then go to the middle left under Visa Display Options. There you can select what Visa you are doing. Now you have a list of VJ member timelines. You can make the list longer by clicking on the button at the bottom to make 50 rows. You can choose your country and click Find to see only timelines for your country. You can then click the little arrows at the top of any column to sort the timelines by the particular event you are currious about. You can also select at the top right for an Advanced View with more columns of data. Good luck.

My husband and I were debating on filing our I130 whether to get a lawyer or not. I found this site and read all the guidelines and decided to just do it ourselves.

We just got our petition approved and NO RFE. We just simply follow the guidelines. I'm glad we did it without a lawyer's help since I've read a lot of bad experiences dealing with them in the forum, hiring one is also expensive.

Yep. I can't believe some of the things I've read people say their lawyers did or said. VJ is the way to go. I've had two attorneys in my life, not for immigration, and neither of them were worth the money. They do nothing but slow everything down, and do very low quality work. They don't read carefully, write carefully, and can't seem to remember any specifics that are told to them. I think they do this so you will call to harrass them and repeat what you told them last time, then they make even more money.

If they find out, you will get denied. You will also have a difficult time getting your wife here once they realized you lied. It's called fraud. Why not file CR1 instead? You don't want to risk never having your wife here do you? Besides, what do you have to gain from this? I belive CR1 is just as fast and cheaper.

No need to change it. If you do, and it works, great. But many times it doesn't. I tried to change my fiancee's address and even received confirmation from USCIS that it would be changed. They still didn't change it. You just need to let the NVC know when you call then to get your case number, after it gets there. If not then, you can change it at the Embassy later. No need to waste your time hoping USCIS will change it. They don't really care what her address is.

Out of 500,000 applications a month, they only get 5,000. the CSC is behind by nearly 10,000 applications. VSC by 11,000, TSC, by nearly 1,000. These number grew in the last part of the year due to budget cuts. They cut people in the 1% section. K-1 visa is just another business unit to the USCIS. I understand that. But treating this section as another business unit when doing regular I-129 in 2 months. the regular I-129 is about 10% of the monthly. (and if you add up, I129, I 130, and N-400 you have 35% of the monthly applications) It is just sad we who are the 1% get treated like the 1% in a normal business.

I couldn't send an original for the W-2 since I only recieved PDF file from my company. I don't think it matters for this. As for the 1040s, it is best to get a tax transcripts and send those. You can request them from the IRS online. I received mine for 2008 and 2009 in less than a week. For 2010 taxes, I had just filed them, so I just included a copy of the 1040 from my PDF files, and copies of the supporting documents.

My wife's daughter came with her, so I can't really answer your questions from experience. I think the documents would be the same ones as required if the child came with you, and no CFO stamp is needed. See the guides on VJ. However, I just wanted to say that I know someone recently with problems bringing a K-2 child to the US to follow because they won't let the child leave without an adult, or maybe even a parent. I think they have to fly back to Manila to get the child. Are you planning on doing this as well? If not, maybe there's another way. I don't know. If you don't know, you should research it. I would hate for this same thing to happen to you.

FYI ROC isn't needed for an IR1 only a CR1.  So if you are married for 2 or more years at the POE you get a 10 year green card. 


Let's not forget the cost of travel.

 

Both the K1 visa and CR-1 routes require a one-way (or round-trip if cheaper) ticket for the fiance/wife to come to the states. For me, this was about $1200.

 

If you have already met your fiance, but have not married, the CR-1 route will cost an additional round-trip ticket for the US citizen, the cost of hotels, and the cost for getting married. In my case, a round trip ticket to the Philippines is about $1400. Oh, and don't forget the cost of vacation time from work while you're gone.

 

I think in the end, this makes the K1 route the cheapest in most cases where you have already met your fiance but did not marry her.

#1 no, you will file the I-134 later during the interview. After your fiancee is here and married you file to adjust status, then you file the I-864, and yes, more fees.

#2 Kind of. You have to pay the I-129f filing fee. Later you pay more fees before or during the interview.

#3. Sometimes someone will get a CBP officer that doesn't know how to process a visa. 99% of the time there are no problems.

#1 - you do not have to submit the Affidativ of support now - it is required at the interview stage and it is mandatory ! For the AOS you will need another affidativ of support different than I 134.
#2 - yes, there are two separate fees - first with the I129F for the amount of $340 and a second fee at the interview

I have a couple questions and have found different answers or not complete explanations. If anyone could shed some light, I would be greatly appreciated. My fiance lives in Canada and we are just getting all our information together to send off the I-129F petition. We only live a few hours apart so i will be going to his interview with him when we get approval and then we will be traveling back here together.

#1 Does an Affidavit of support have to be filed with the original I-129F petition? Have seen where it is said to send, hold on to it until the interview in Vancouver, and have seen where it was stated that it was not needed for the Fiance K-1 visa and just for the adjustment of status after we are married.

#2 Are there 2 different fees for the fiance visa? I will be sending $340 with my petition, but I have also seen stated that there is a fee at the embassy, at the time of interview of $350.

#3 Has anyone had experience in crossing a land border by car with the fiance visa? Any problems or special procedures we should be preparing ourselves for?

I am just trying to get a good outline of everything so we have our ducks in a row and have an idea what to expect. Yes, I am a worrier! lol

We have mailed off our petition for the fiance visa. I was just wondering if it is possible to start getting the next documents ready for the next stage while waiting for the NOA2. I have been reading that sometimes it takes a couple months or so to get the police records that are needed. I am making another trip up to see my fiance in July and I am sure we wont have the NOA2 by then, but thought maybe we could work on getting things ready together while I am there. Any tips would be greatly appreciated. Thanks :)

Relax...you dont have any red flags that you can question right? Not a criminal. You know your Fiance/fiancee is your Fiance/fiance and you filed for the correct Visa. ie K1 for the spouse. :whistle:

Your fiance(ee) when the time comes can converse in English and answer to the best of his/her abilities the questions of the Officer(s).

What is the freak out? Panic? Hope he/she wont do that if/when they makes it to POE. :blink:

We have no red flags at all, other than they may question our age difference. He can answer any questions they ask.. Think I started to panic a bit because we have been through the "denying entry" at a POE before because they could tell we were in a relationship and the was "high risk for illegally immigrating". Not only are the accusations embarrassing and not done in private, but makes you feel like "tell the truth and do everything right and ya still get screwed" :P

That's what worries me. If this is all a wind-up, poor pity the other K1's coming along who will read this, and worry, when most of the time that extra stress is not necessary.

I am one of those K1's that just mailed off my petition. To be honest, this freaks me out a little bit. My fiance and I have talked about it and we were almost in a panic when I first read it. Now not only do we have the worry and stress of just getting to the interview and having the visa approved, we have to worry about actually getting him across the border. Guess there is no sigh of relief until he is in the states.

Wow this is terrible! I had no idea that a K-1 visa holder could be denied entry (with the K-1 in hand of course) unless the border officer found fraud or they were travelling with something that was not allowed into the US.

There is a difference between disability and welfare. Social Security Disability is for workers that have become unable to physically or mentally work. It is a process to qualify and doctors back them with evidence. As a US citizen, we pay into the Social Security fund out of our wages. Welfare on the other hand is a government program for people that do not work and have no income so the government gives them a check if they find them eligible. You shouldn't have anything to worry about with her being on disability. Good luck!
