Hi everyone,

My husband and I have finally assembled our I-130 packet.
I have put it together with his US money order, evidence, etc. and will be mailing it here, from Canada.
Since its going to a P.O. Box, which is the best way to send through Canada Post? I would like to be able to track the envelope and make sure it arrived.

My POE officer told me that it is the entire file for them to review...it is their descretion whether they actually grant you entry into the US, even though USCIS already approved your visa. USCIS grants it on the validity of the situation and your history etc...but it Homeland Security deems you as an unfit entrant at time of POE, they can deny you entry.

You should have seen my face? I was all excited when I got it thinking it was a done deal...I had no idea that until u actually crossed....there were no guarantees!

What I don't like about crossing over into the US , at least the guards that I have encountered, is that they are talking to you like you are lying, hiding something, going there to do something illegal, etc.
Asking a question then a few questions later asking the same question again to see if you give the same answer. I know they do that to actually catch a person who is lying but it just takes forever and it makes me soo nervous. wacko.gif

-MMR
-Varicella or verbal declaration of chicken pox
(and perhaps Gardasil if you are within that age range)

I wrote the toronto office asking if I needed the blood titres test or if written proof was enough and this is the reply I got:


" You DO NOT require Hep B. Written confirmation of all vaccine dates is acceptable OR the anti body blood titres.
You must provide dates of at least 3 TDP in your life with one of them within the past 10 years
Dates of 2 MMR in your life. "

We had his father be our co-sponser and submitted papers from his job that he has and his pay stubs from prison to explain why he has not filed taxes and why we need a co-sponsor. Everything was so clear to them!
Our case does not fall under the Adam Walsh Act. His crime has nothing to do with sex, sex with minors, homicide or drugs, he is in prison for a non-violent crime.
If I have to wait another 2 years and then apply again, then that is what we have to do, but we are definitely going to look into appealing or trying to find a waiver that fits our case.

I have never been denied at the border, nor has my husband. I have never been arrested, do not have a criminal record, do not take drugs and am in perfect health.
The lady who interviewed me was very vague about why she thought that if she gave me the visa it would be denied at the border. She just wouldn't tell me and she was not answering any of my questions! :angry:
Okay let me tell you why I think we are running into these problems....my husband has quite a criminal history. He is in prison right now and will not be released for another 2 years. Since the initial petition, we made it very clear that he is incarcerated, from all the documents we submitted, to the pictures of us together visiting in the prison! I mean, it couldn't have been any clearer! I know that this information might come as a shock to you and the lady who interviewed me bascially said that they have never processed a case like this. Thats why she said she has to do some 'legal research', but she never told me research into what. I contacted 3 lawyers before we even submitted the petition and all of them said that there is no law written that an inmate cannot petition for a spouse.
I think that we will have to wait until his release and try again at that point :crying:
I don't know why the USCIS and the NVC would let us pay all this money, go through this heart wrenching process and then deny us at the very end. It is just so cruel.

Yes, the paper says we are in AP. She gave me my passport back and was basically getting on like our case was denied.

Well, my husband said that when we hear back from Montreal in however long that will take, that we will go to a lawyer and see what can be done. We are husband and wife, we are a family...how can they do this to us? I just don't understand it.

Hey Everyone,

I wasn't sure if I should even post this topic because my case and circumstances does not really apply to everyone else, but I just thought I would say what happened if you were wondering.
I got to the consulate before 7am and got the letter 'A'. Everything was pretty quick, I was having my interview at around 9:30am.
I brought lots of pictures, phone logs, letters, and email print-outs but she would not look at my husbands phone records because I did not bring something showing that the number he was calling was mine, like my cellphone bill. Then I couldn't pass her the letters because she said she could not look at anything in an envelope. Okay whatever, she looked at the emails and the many photographs I had of me and my husband and me and my husband's family and she seemed satisfied with that. I gave her receipts and car rental stuff from each time I visited. She seemed satisfied with that as well. She said she is going to scan the photos and copy the receipts and come back.
She is gone for what seemed like forever and then she comes back and tells me that she cannot approve the visa. She got really impatient with me at that point and just wanted me out of there. I am in administrative processing because she has to do some 'legal research'. She gives me a little orange coupon and tells me to come back at 3pm. Right then I knew that I am going to be denied.
There are some complex things to our case that none of you here are having to deal with so I am not going to even mention it, but what really upsets me is that those facts were very clear from the start of our petition! Why have us waste all this time and money just to deny us at the very end? Kind of cruel.
Anyways, I am crying all over Montreal until I have to go back at 3pm and when I do I am standing and waiting at window 12 for her for a long time. She finally comes to the window and says she still does not have an answer. That she will get back to me in 2 days. I get her name and ask if I can email the consulate and find out whats going on at that time. She then says it will probably be more like 2-3 weeks. Whatever.
She was not answering any of my questions, I think 3pm is the finish of their workday so she bascially just wanted to get rid of me. I told her that this visa is to reunite families and she said it is but that she does not want to issue a visa that will not be honored at the border. I got my passport back which I am assuming is a bad sign.

I want to hope that I will get an approval, but I know that it probably won't happen.

lol yep. We are both floored.
Since my interview he has been at the law library every night looking up waivers and cases where the petitioner has had a lengthy criminal history and have been approved. In the face of pretty much being denied, he never gave up hope and always had belief in us :)
