I did not know that Jobster!!! i do not have that problem though, I have double nationality (venezuelan/american), the problem I have is the fortune I am spending each time i go. Are they really asking for the visa when you get to Venezuela? I have seen several american just present their passport and go...In any case, yes, that is the problem with nasty international politics..

Hi Ivasquez. As far as I know you don't need a tourist visa to get into Venezuela. My problem was that since I've been in Venezuela so long waiting for my husband's visa, I've used up the amount of days I'm allowed to be in Venezuela as a tourist (which is 180 days). I got an extension while I was here, so I can stay 270 days, but that is running out quickly. If I leave to visit home for a couple of weeks and try to get back into Venezuela they'll deny me entry because I can't enter as a tourist again. I'd have to enter on visa de transeunte. The problem is that I can't get that visa anywhere, even though that is my right by being married to a Venezuelan citizen. I even tried to go through the Venezuelan consulate in Brazil and in New York City and they both said that they couldn't give it to me either!

Anyway, since you're a Venezuelan citizen too, are you going to apply for your fiancee's immigrant visa, once you're married, directly at the US embassy in Caracas? This is another reason I've been trying to get my visa de transeunte. If you can prove your US citizenship and your Venezuelan residency you can apply for the I-130 directly at the embassy and it only takes two months to get the immigrant visa, where as if you are planning on applying for Adjustment of Status in the US, I think it's approximately a 6 month wait.

What part of Venezuela are you from?

I will not file an immigrant visa, she will come here with the k-1 and we will get married in the US (at least that is the plan...). I was told that the k-1 was the better option, with this whole IMBRA fiasco i agree with you that the I-130 sounds like a better idea. At this point I have no choice but to wait for the K-1 approval....

I am from Caracas...

USCIS Service CentersAre you pissed off at USCIS?
I agree, I think it's time to do something. At least if it appears on TV for at least a minute, it will scare the s**t of the service center directors and they might get their act together.

Another idea, we could send the same letter we sent our congressman/woman to Larry King with the timelines we have from VJ as proof.

LETS DO IT i am sick of waiting without doing nothing...

US Embassy and Consulate DiscussionAffidavit of support
Finally I am able to pose questions and not b**ich on why has CSC not approved my petition yet...

So, for the affidavit of support: What needs to be notarized? is it the actual affidavit form, bank statements, pay stubs, IRS transcripts, or all of the above??

Also, any tips while assembling this?

Thanks,
lvasquezNot TellingVenezuela2006-09-05 18:23:00
US Embassy and Consulate DiscussionTax transcripts, what is needed?
Here is another question: the affidavit says you have to provide "in duplicate, eveidence of resources and income". Does this mean that i have to provide 2 original documents for each requirement or can I provide one original and just make a copy?

Thanks,
lvasquezNot TellingVenezuela2006-09-10 14:01:00
US Embassy and Consulate DiscussionTax transcripts, what is needed?
I am confused about the tax transcripts needed for the I-134. On the IRS site you can ask for "Copies"of your tax return (form 4506) or "transcripts" of your tax returns (form 4506-T). Which one is the right one??

Also, once I have this, do I have to notarize the "transcript" or "copy"?

Thanks,
lvasquezNot TellingVenezuela2006-09-10 13:21:00
US Embassy and Consulate DiscussionCertified Tax Return
My understanding also is that they require a tax transcript not the copy. I would call and find out, in any case embassies can pretty much do what they want and require what they please, so defenitely listen to them...

I have no criminal record, I started this "process" (it seems more like they throw the files in the air, pick one, flip a coin and ...well you get the picture) on March 27th and I am still waiting for the damn NOA2. The worse thing is, I am pretty sure nobody has even bothered to open the file at this time.

K-1 Fiance(e) Visa Process & ProceduresB2 visa or K1 visa
Is B2 a tourist visa? I have talked to two lawayers and they tell me that if she stays in the US for 60 days after she came in and she can prove that she came to visit and changed her mind, she can just apply to a change of status and get it over with.

I know a case that went like this. He came to the US on a tourist visa, got married with his ameriacan fiancee and lived happily ever after... (I wish I had known this before filing the damn k-1)

Don't take my word on it though, ask a lawyer , but if you can avoid the hassle of the k-1 thing good for you...

K-1 Fiance(e) Visa Process & ProceduresHere is the latest from USCIS regarding processing times...read it
I would wait the 180 days before complaining. This way you have a valid point. They said 180 days, its day 181 and they haven't touched the thing, I'd say that a congressman should be able to do more once that 180 day mark is passed.

K-1 Fiance(e) Visa Process & ProceduresHere is the latest from USCIS regarding processing times...read it
This is the latest info the USCIS website regarding processing times. In a nutshell: we are still incompetent and unable to provide a better service. Thus from now on, we will just give the maximum procesing time so we don't complain for six months, once you do complain they will just change the times as they please. Again, unbelievable!!!!!

Improved Procedure for Reporting USCIS Processing Time
of Immigration Benefit Applications on the USCIS Website

U.S. Citizenship and Immigration Services (USCIS) has improved the reporting procedure for processing times of immigration benefit applications located at the USCIS website: www.uscis.gov. In the past, USCIS benefit processing reports indicated the specific type of applications or petitions that were being processed and the date the cases were received. However, the date the case was received did not provide a clear indication of when USCIS expected to complete the case, nor did it provide a clear indication of USCIS’ commitment to process cases within a certain cycle time. It also did not align with the processing times and cycle times the agency reports in other contexts.
This improved reporting procedure is an effort to give our customers more accurate information that better reflects current processing time and USCIS service level commitments. Effective immediately, when we are completing applications and petitions within our service goal levels we will report that as the processing time. For example, when our service level goal is to process a particular kind of case within six months, then if our processing time is six months or less, we will show a processing time consistent with our service level goal because that reflects our commitment. Similarly, where our service level goal is 3 month processing, we will show a processing time reflecting that commitment if we are meeting that service level goal.
When we are not meeting our service level goal, the date posted will reflect the filing date of cases that are being completed. It should be noted that while in some instances reported processing dates may appear to have regressed due to this change, they do not reflect a lengthening of USCIS processing times, but simply the change in reporting. Our goal is to provide accurate projections and thus give customers clear expectations as to what they can expect as a processing time.

Also, if you are going there, save plane tickets and take a few pictures with you her and her family. This will help you prove you have met in the last two years.

K-1 Fiance(e) Visa Process & ProceduresBoooo!!!!!!!!
I am really frustrated too at this point (CSC march 27th, IMBRA RFE july17th). I cannot believe that we are being subjected to this while there are 1000 jumping the border everyday. For me it's basic logic: if people are trying to do things legally chances are they are honest about the relationship (hence the reason you do not see many denials), if we were really croked (a terrorist, thief, whatever) why bother?? just go to mexico, pay a couple of bucks and sure enough you'll be here in no time!!!
It seems to me that the whole process is ridiculous, from start to finish given the reality of immigration in the USA at this time.
Why prove we have met? honestly who cares? is that their business? do we as tax payers really want to spend money in finding out if two people met or not? do a background check on both applicant and benificiary and get it over with...Proof on intent? are you kidding me I have been waiting for 150+ days and they still doubt my "intent".

Sorry for venting but this honestly is RIDICULOUS!!!!

also, it would be nice to have the approval list of those that filed after the whole IMBRA mess, it would show how fast they are approving the post Imbra applications and the unfairness of it all...
