I am not defending nor accussing anyone. not even those people who work at VSC. I STRONGLY i agree with what "antiwaiting" says, is nobody fault how slow is the process and the differences in between different persons applications, yeah most of the time a few get lucky and the process goes flying. The people that work at Service Centers are getting really poor paid so that is a huge thing, if you have the staff unhappy you'll get really bad processing times. That is it.

Maybe people that already got the NOA2 got and email from USCIS notifying that you were approved in the case you had an user name at USCIS website and checked to notify you. I would like to know the email address that was sent that notification so i could put a filter in gmail coming from that mail so i don't have to check my spam folder because sometimes you can get important mails there. I'm done with school i graduated October 2008, i'm waiting for my diploma maybe i can go to school and get something stating that my diploma is in process and i have to get in person. Yeah it's really true about the mood of the agent a year ago when i went to the US the agent treated me like sh*t and a criminal was really rude, my POE was in Houston,TX.

What i find kind stupid is why would stay if is really evident that we are trying to follow the law doing the whole process of I-130. Would be the stupidest thing that you can ever do is over stay while you I-130 is pending and you are half way or less to get approved.

That's it i have dual citizenship Argentine/Spanish so i'm planning visiting my wife in March. That would affect my process? I've been reading that a lot of people visited their spouses while I-130 pending under Visa Waiver Program and you should show sometimes evidence at the POE to the immigration officer that you're going back. I have the lease of my apartment as an evidence also the NOA1 letter. I'm employed right now but i will quit to be able to go in march so i won't have a letter of my employer.
Well i would like some advice, thanks in advance.

I want to say, thanks to every single person that posted a reply trying to help.
We decided that next week when the translation of the marriage certificate is done we'll apply from Oregon where al the paper work it's is. We will send it to the chicago PO BOX, and then they forward that to the CSV? That's what i understand.
Another doubt...we will send The i-130 form, the two g-325 forms, photochopies of all the pages of the pettitioner passport, marriage certificate translated, the pictures type passport and the doubt is do i have to send the payment of the $355 with this package?

Typically to do DCF the US citizen needs to be "resident" in the counselor district for approx 6 months, some consulates will accept less, others want to see proof of foreign residency, some dont.

Yes, After you get the receipt for the proof of receiving the I-130, then you send in the I-129F if you decide to.

And you are very lucky to be going through the Embassy in Buenos Aires, they are very good. And if she lives in Oregon, you will ise the California Service Center which is also very good for you.

I would apply for the K3, just because they process the K3's faster than the CR1's. Then when they get approved, they approve both at the same time. If you want the CR1, you just ignore the K3 stuff from then on.

Or what we did was continue to follow both paths. K3 and CR1. This got my wife her CR1 interview about 6 weeks sooner than just following the CR1. She had her K3 interview scheduled for August 14th. Her CR1 was complete before that and the interview was changed to a CR1 interview. Wheile they scheduled her CR1 interview for September 23rd. So she has been here since August 19th on her CR1. As opposed to September 23rd if we had just followed the CR1.

And no, you do not need a lawyer. All of the information you need is here.

It took us 102 days from the Day I sent in the paperwork to the CR1 interview. But i admit, that is much faster than normal.

Filing for a K-3 requires that the US citizen FIRST file an I-130 package for a CR-1 visa and then AFTER getting I-130 NOA1 "Receipt" letter they then file I-129F to the service center noted on the I-130 NOA1 letter.

Note: for most countries K-3 is not much quicker to process than CR-1, NVC has streamlined their process a bit on CR-1 so that in most cases K-3 wont save much time. Also K-3 is NOT work authorized CR-1 IS, I see many complaints of K-3's about not being able to work until at least 90 days after entering the USA while they wait for an EAD or AOS to generate a green-card.

Compare VJ timelines for K-3 and CR-1.

If you enter the USA on CR-1 visa, then NO AOS needed. CR-1 has the advantage of GREEN-CARD on entry to the USA, and can imediatly take a JOB, get SSN, and apply for a driver's licenence after getting SSN. K-3 CANNOT take a JOB, get SSN, or apply for driver's license until after getting EAD or Green-card. EAD can take 90 days or more.

K-3:
I-130: $355
I-129F: NONE
Consulate: $131
AOS: $1010

CR-1
I-130: $355
NVC I-864: $70
NVC Visa fee: $400 ($355+$45)

HI everyone, i'm new in this forum and i found it looking for information about I-130 form because my girlfriend Shannon (north american) now my wife and I Gabriel (Argentine) just got married on September 5th of this year here in Argentina, she is living here since May 20th and in the beginning of the next year she'll go back to the US. We want to apply for the I-130 and we decided that is better to do the whole process and me waiting here in Argentina instead than me going there with K3 visa because is so much paper work and then you have to Adjust Status and cost like a Thousand dollars but i will be able to go sooner with the K3 and when I'm there i have to ask for a permisson of work so we decided to wait for the CR-1 because once i enter the US i can work but i think i so much longer the process. So we don't know what now because today arrived to Oregon, US all the paper work (I-130 form, and the two g-325 forms) and now all the papers are in my wife's mom house waiting for us to tell her what to do with the papers. We also read that if you apply in the embassy is more expedite the process so we are waiting for that. What should we do?? wait for CR-1 ? go with the K3 visa?? Please help, this forum is great, formed by very helpfull and friendly people. Saludos!

Congratulations my friend....we are in the same boat. Yesterday my wife called NVC but they don't have or package yet and the operator was very rude to her saying "do not bother trying to call us again, we will contact you once we have it"
Anyway we got the hard copy of the NOA2 on Monday so we will wait a few days to call again NVC.

I just found out today the igor's list that show you the filers of each month, i think is very helpful to see where are the approvals taking action and even you can see how many people is before you but is not a hundred percent reliable because the data is based on timelines and some could be outdated. You're not alone. We filled at CSC on October 10th and get the NOA1 on October 20th. How is going the waiting?? I'm being really positive about it and i'm hoping in 1 or 2 months get the NOA2 but who knows!! GOOD LUCK!
