K-1 Fiance(e) Visa Process & ProceduresIs tax transcripts sufficient proof of income?
Are you sure about that because I only submitted the IRS tax transcript for 2010 (I had 1040s and W2s for 2011 and 2012) and NVC accepted that with no problems. Not sure about at the embassy level but I was told that official tax transcripts were fine. My lawyer is the one who submitted the paperwork.

Sorry I tried to reply wtih the quote!! Not true. I changed my address successfully through the USCIS website after I received NOA2 hardcopy and NVC received the case. I received confirmation in the mail that the address on my case had been changed.

Since you got NOA2, your fiance cant change it through USCIS. However, if your file is at NVC, then you can change to new address. If your file left NVC, you need to contact Embassy to change it. That is what I did.

K-1 Fiance(e) Visa Process & ProceduresDenied visitor visa - considering K-1 (Nigeria)
My concern is that so many people seem to be rushing into these visas without taking the time necessary to properly get to know their partners. And by that I mean actually spending a lot of in person time. I know its expensive to fly to some of these countries. Hell I am 18000 dollars in debt from trips to Jamaica. But I wanted to take my time and get to know my husband to be confident that he was the one for me and that his intentions were genuine. Getting engaged to someone you've never met and thinking about filing for someone you've never met is crazy. You are just setting up yourself for heartbreak. And it bothers me when people talk about just meeting in person to fulfill a requirement. Marriage is a lot of work not something to be treated lightly. Sorry I'll stop lecturing now Lol.

K-1 Fiance(e) Visa Process & ProceduresDenied visitor visa - considering K-1 (Nigeria)
Yeah I think you are jumping the gun a little bit by talking about marrying someone you have never met in person. How do you know you are really compatible with one another if you've never spent face to face time with one another? I waited 9 1/2 months before I married my husband- and I visited him 8 times for two weeks at a time before we got married. I understand that may not be possible in your case, but please take it slow and make sure you really know the person before you jump into engagement or marriage. I hope you are not offended by my advice because I really want to make sure you don't get hurt. I know several people who went through the process, not from Nigeria, but from Jamaica, that were essentially used for a visa and greencard. So please be careful and like others have said take it SLOW.

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice Certificate and I-130 mistakes (split topic)

Okay i have a couple of questions not sure if its the right place to post ,but i can`t find clear answer to most questions sad.png

So do i need my Police Records for the NVC stage or the interview ? it seems to me like i need it for the Interview but i read that i need it for the NVC stage aswell ? i have no clue how long the Moroccan certificate is valid for ...and since i have duel citizenship and two different names I'm not sure if  will get in trouble for that,my husband did mention that i have 2 different names in a letter while applying for the I130, in Morocco my name is I.LXXXXXX while in my German papers its NXXXXXX.I. LXXXXXX ,story was that my parents had to chose an extra  name at the German Embassy to register my birth cause they could not tell if i was a female or male from my name???headbonk.gif  Anyways my Passport and Birth certificate will have my German name on it and all other documents but my Police certificate will have the Moroccan one,i thought I'll just bring all my papers and let them decide sad.png

Also while looking at our I130 for Errors we did find a few mistakes ...my husband left some answers Blank instead of N/A and he also left questions 22. all blank and now we know that  we should put in the Embassy that i will have my interview at in that section .

My last question is do we send a letter to the CSC with an updated I130 or just wait for an RFE ? i have been told just to wait for an RFE but when my husband called and asked they said to send a letter in but that was when it was a the NBC now its at the CSC hmm ,also my husband will be visiting me in 2 weeks for 10 days that should not be a problem right? i assume nothing will happen meanwhile and it will take a over a month just to get to the NVC ?

Sorry about all these questions ,but I'm quite lost with all the different answers .

Thank you all for being so supportive and helpful ,not sure what i would do without VJ !

IR-1 / CR-1 Spouse Visa Process & ProceduresChecklist for Moroccan PCC.

I should have quoted the post above me.

The NVC website may say to leave parts of the I-864 blank but the wiki's on VJ say not to.

Also regarding your PCC,   http://travel.state....country/MO.html  and http://travel.state.... Casablanca.pdf

I do not know how long the Casablanca embassy considers the PCC to be valid for (it's their opinion on how long it's valid that matters.)  If all else fails, you get a new one before interview and bring it with you.  Your current one will be fine for the NVC more likely than not.

That is sad :s when we called the NVC they said this is a new rule... but i know that people have had checklists for leaving blank since at least 2012, my husband is contacting a congresswomen about that she seems very interested, since some get checklists for this some do not and also cause we got only one form checklisted while the other I-864 from our co-sponsor did not, weird.

Yeah i will be getting all documents again for the interview i was just worried about the NVC .

Thanks for the Info !

The NVC website may say that but every wiki on VJ says otherwise due to experience.

I haven't read anything on the Wiki, what does the Wiki say ?:S, I mean my PCC is less than 3 month old at the moment, if they take up to 3 months to get my CC then it is their fault .

IR-1 / CR-1 Spouse Visa Process & ProceduresChecklist for Moroccan PCC.

We got a checklist because we left the "Place of Residence" section of the I-864A blank. The NVC website specifically instructs you to leave things that don't apply blank. My husband spoke to a supervisor named Liam - he was pleasant, but in the end quite unhelpful. we asked him why we are required to write n/a in those fields when the instructions specifically say to leave such things blank. He said that is a requirement of the embassies (by which he meant the State Dept.) - they informed NVC that everything should be filled in. we asked why the website hadn't been updated to reflect this, since it will surely affect most applicants. He said he didn't know why. I asked how long the State Department changed this requirement. He said he didn't remember when, but it has "been some time" and this is not the first time this has happened :( now i am really worried of getting a checklist cause of some unwritten rule!

IR-1 / CR-1 Spouse Visa Process & ProceduresChecklist for Moroccan PCC.

Hello Everyone, Happy July 4th!

So my husband and i have been at the NVC since April 8th, and i am a bit worried about my PCC cause the expiration date, it says they are valid until July 22,2014... but with the NVC giving ridiculous checklists these days you never know !, on the immigrant Visa Checklist Consular Section,U.S. Consulate Casablanca it says Police certificates are valid for one (1) year from the date they were issued. Has anyone ever gotten a checklist for expired (Moroccan)PCC ? i had gotten my PCC back when my NOA1 got approved but since they took so long it expired (3 months) no i am now very worried about this one getting expired and getting another checklist for the IV package after getting the most unfair AOS checklist ever last week...

Thanks in Advance,

Izzy.

IR-1 / CR-1 Spouse Visa Process & ProceduresDual Citizen with two Different names, please help !

Bring all your documentation with you for proof from Morocco and Germany.  You have your birth certificate to show that you are who you say you are, and many people have different aliases for whatever reason, that's why USCIS has a spot for it on their forms!   When I was married in Morocco, we had to put my maiden name on all marriage documentation (Moroccan rules, they go by birth certificate), however I had never changed my name after divorce here in the states from 3 years earlier.  So our marriage certificate said one name while I still was going by my married name.  No one ever questioned it.

Will do ! thanks a lot .

I have a questions for you, when you Husband went to the Medical did he have to show his Passport and his Moroccan Id cart or just the Passport ? we are really trying to avoid any kind of problem that might happen :( we got a checklist already and that delayed us by 45 days, and yeah i worry way to much :D

IR-1 / CR-1 Spouse Visa Process & ProceduresDual Citizen with two Different names, please help !

I don't think you would have any problems At the medical just show the passport and the letter you should be fine. the embassy will have the name you used   through out the process (German) my opinion.

best of luck hope you get case complete soon.

I have read that at the Medical they ask for Passport + copy of the biographic data page and Carte d'identite national + copy, on my Carte D'identite i have my Moroccan name and my first name on my Care D'identite  is the Middle name of my German Passport Info if that makes any sense ? I called Doctor Fihri to ask questions about this, she wouldn't even speak to me without an interview date... so yeah :D very confusing .

IR-1 / CR-1 Spouse Visa Process & ProceduresDual Citizen with two Different names, please help !

Question for people who have more than one name, or have changed their names in the past.
My name is slightly different in Morocco than it is on my German Birth Certificates. as i have dual citizenship. When i was born, I was named for example "Anne Smith", which was entered on my Moroccan documentation. However, when my parents went to the German embassy to register my birth , they insisted that must have an unambiguously female name, so I was named for example "Judy Anne Smith" in my German documentation.

We explained this to the USCIS and NVC, and also explained that i will be having documents from both countries at the interview and that some documents will have my Alias name one them .So now i am worried that when my interview comes and i go to the Medical that they wont let me in, cause my Id card has a different name than my passport, in my understanding at the Moroccan Medical you have to show ID card and Passport and your interview letter, and i was wondering if it is possible to ask the NVC to add my Alias name on the interview letter once i get Case Completed? just in case they give me trouble about it .

My interview will take place in Morocco, but i will be using my German Passport cause we got Married in the US under my German name, very confusing i know... but i have entered the US using VWP in the past and in one of the visits we got married, but now i am waiting for my interview in Morocco.

Thanks in Advance

Izzy

Hi everyone,

I just saw that i made a silly mistake in DS-260, we have checked multiple times before submitting, yet still failed to find it ! my husbands name has an extra E in his first name...

I have already been given an interview date and my case it as the Embassy.

What's the best way to correct this?

Shall I wait until the interview or try to contact them Embassy? I read that i should just bring the paper version (DS-230) and point out the mistake .

Thanks in advance !

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 / AOS questions - rouding income to nearest dollar and joint income of co-sponsors

Hi everyone, I have a couple questions about form I-864 for the AOS packet:

First, I have seen some people getting checklists from the NVC because they have rounded their annual income amounts for the last three years to the nearest dollar (Part 6, Numbers 13a-13c).  I presume in those cases, they must have sent in tax forms with W-2s instead of the tax transcripts?  I have the transcripts, and they are all automatically rounded to the nearest dollar, so I can't see how we can be expected to be any more exact than that.

Also, the current individual annual income (Part 5, Number 5) is also inherently an estimation - do they really require cents to be indicated for that as well?  I can't be more precise than within a few hundred dollars (there may be overtime, I may have to take a bit of leave without pay to go to Morocco for the interview, etc.), much less down to the last cent.

My other issue is that my parents are filing as joint sponsors.  They live in the same house as me, so they have each filled out an I-864a (though I am not their dependent for tax purposes).  Their income and assets are all held jointly, and they file their taxes jointly as a married couple.  So each I-864a lists their full joint income and assets.  On my I-864, i have listed them both in the section for other household members (Part 6, Numbers 6a-6c and 7a-7c).  I put their joint income under my father's name in 6c, and under my mother's name in 7c, I wrote "same as 6c".  I also included a brief explanation in my cover letter, indicating that they have joint income and assets.  Is there anything about the way I did it that might trigger a checklist, or has someone else in a similar situation found a better way?

Thanks!

-Jamie

K-1 Fiance(e) Visa Process & ProceduresDo I need to translate my Fiance's family book?

Hello everyone,

I am currently filing for a K1-129f fiance - and I need to know if I have to translate my fiance's family booklet?

I have translated our engagement document, certificate of single status, and her birth certificate. Also is the family booklet necessary to send in?

she is from Laos if this helps out.

thanks, any help from the community would be greatly appreciated.

I don`t think you need to translate that, her BC is enough if her Parents name are on it too.

K-1 Fiance(e) Visa Process & ProceduresPicking K1 or IR/CR1

Hi, I also met my Fiance while working on Cruise Ships...I decided to take the K-1 Route, only because we were not assigned to the same ship so I resigned and went home to wait the process out. If we had been together, we would have gotten married and filed the CR1, definitely!
I think the big question is, after she gets the Visa...do you plan on returning to ships? If not, I would definitely get married as you were planning and then file the CR1...if the interview can coordinate with her next vacation, great...but if not, she can just go home when its inerview time.
The thing to remember is, once you get your second notice of approval, you do have a certain amount of time to work with in which to schedule your interview...so even if you plan on staying on ships, you may be able to schedule the interview within a vacation. As long as you will be together during the process, might as well go the less expensive route that allows her to work right away after entering the country!
One more thing, I researched it alot before making our decision...its definitely not possible to adjust status from a C1D Visa.
Good luck!!
:)

Congrats to you guys, dare I ask which line you work(ed) for?

I'm leaning towards the K1 right now... my contract is only 4 months, and we'd be a month into it before we could even file for the CR-1. Even given best-case processing, it would mean 6 months after the end of our contracts where we're separated.

If I file K1 right now, when I join her on the ship in November, that'll be right around the time of NOA2... I'll be with her to help her get her end of things organized (and she brought pretty much everything she's going to need for NOA2 onboard with her). We can then work to time it out so that her medical and consular interview will happen back in Indonesia in late March or early April, leaving us apart only for about a month... Sure, then we'll have to do the AOS and all of that, but it realistically shouldn't cramp our style too much... if we go back to ship, it wouldn't be until the next winter anyhow - plenty of time to get the AOS taken care of.

Anything sound unrealistic or uninformed there? I'm looking for people to punch holes in my (admittedly weak) understanding of the process.

K-1 Fiance(e) Visa Process & ProceduresPicking K1 or IR/CR1

I did think of a possible problem with the K1, however... we are intent on having our wedding this Winter while together on ship for reasons well outside of visa considerations - it has significance to us. If we're in the middle of the K1 approval process (say, we're at the stage where we're waiting for the consular appointment), and we get married - do we have to start over for the CR-1 track, or is there a way for them to roll with it? I suppose ultimately we can always do a ceremony together on ship, and do the "legal" wedding after she enters the US as a workaround.

Scratch that, answered my own question in the FAQ... no legal wedding during the K1 process :)

K-1 Fiance(e) Visa Process & ProceduresPicking K1 or IR/CR1

Approval for the K-1 should take around 6 months, which would be around November if you applied now. She would need to be available to get a medical and have an interview at the embassy in the country she resides in after November. Would this be possible?

First off, your avatar is awesome. Awesome-O in fact.

No, she wouldn't be able to do the medical or the consular appointment until March of 2013, but am I wrong in assuming that while we can't speed things up, we certainly can slow them down? Like, if she's offered an appointment in January, we can ask them to postpone to March?

K-1 Fiance(e) Visa Process & ProceduresPicking K1 or IR/CR1

I am assuming she has C1/D visa for working on onboard, that's what most of the crew members have.
With that visa she CANNOT adjust status in USA, so that is not an option for you.

Discovered this last night, so it looks like we're back to deciding between K1 and CR-1... As the consular interview is the last step in either process, I'm now starting to lean back towards K1 (even though is is more expensive), as we could get the ball rolling now, as opposed to having to wait until November.

Also on a side note, getting the 10 days vacation in USA is entirely in the hands of the immigration officer when she signs off. I never got more than 24 hours to get my butt to the airport and out of USA no matter how much I smiled to the immigration officers. Especially in the port of Miami they are tough!
Will the crew office schedule her a later flight out of USA?

Hmm, that's interesting... this will be at Port Everglades. We arrange this through our crew officer - we ask for a flight deviation, then they book the flights. I'm assuming they wouldn't allow us to do that if there was some question as to whether immigration would allow it, but it's good food for thought and I'll be sure to look into that. Thank you so much for your insight!
