K-1 Fiance(e) Visa Process & ProceduresNo, you CANNOT file a I-129F and marry while waiting.

I will probably be tarred and feathered for this one, but so be it.

It seems that people have two motivations for asking this question: a) the wait is just KILLING them and b)they want their fiance's family at the celebration, and this'd be impossible to make happen in the US.

I can totally understand the latter, and this is why we chose to marry in Santa Fe, just the two of us, so the civil ceremony wouldn't be lopsided with all my peeps. And well, Santa Fe is much cooler than Rhode Island. Of course, we both feel terrible about not having something special with the fam and friends, but we're not a normal couple who can plan weddings at their leisure for family members that can travel. We'll survive by doing something special in Cancun for our first anniversary so his family can be there.

It's the former reason I mentioned that gets my knickers all in a twist. I guess I was just different in that I wasn't positively DYING to be with homeboy during the K1 approval process. We even waited longer than necessary to go for his interview to get our ducks all in a row. I guess what I don't understand is why a couple of months wait for the petition to be approved, sent to the consulate, and interview date set is just so terribly long and arduous that people simply must marry before their NOA2. Yeah, the waiting is painful and it is exciting to share these emotions of nervousness, anticipation, and where the heck is my approval with fellow VJers.

But really, the plan is to be with this dude for the next 60 or so years...what's a couple of months apart in the scheme of things?

I'm going to guess that you're probably not of religious/traditionally minded families AND expecting a son who's racing to pop out of his mom's uterus faster than the bureaucrats in St. Albans, Vermont are doing (i.e. should be doing) their job. If you were, would you still feel the same?

I don't know about that individual, but for me I'd feel even more strongly about this. If I have a kid about ready to pop, then I wouldn't get married in the middle of my fiance visa since it would invalidate it and make me have to wait even longer. There is a big difference between getting married and having a wedding. People who ask if they can get married during the K1 are just stupid and clearly can't read. I dont know why they want to do something so stupid and add that much extra time to their wait. If you want to have a wedding before entering, just be careful and make sure nothing you do is considered a legal marriage.

K-1 Fiance(e) Visa Process & Proceduresmy fiance will arrive in US this november w/ fiance visa. but he also has a petition from his mom. is there anything special we need to do?

hi! my fiance will arrive in the US on nov 16 with fiance visa. his mom petitioned him too. i know that we need to get married and apply for adjustment of status after but what do we need to do with his mom's petition? i'd appreciate your input

What do you mean his mom petitioned him? Or are you saying he wants to petition for his mom? If second is true, then if I'm not mistaken, he cannot yet until he has received his citizenship. I don't believe you as the USC can petition for her at all, it has to be him. But I'm sure someone else will come along and correct me if I'm wrong.

K-1 Fiance(e) Visa Process & ProceduresWedding Plans (Cancel?)

This sounds potentially problematic when you have to start explaining to the CO that you only had a symbolic wedding and not a legal marriage. If they suspect you have gotten married, which has happened to others from what I have read here, they may reject the application. I would just suggest to postpone your plans, wait until you get the visa and then first have a civil wedding performed in order to fulfill the visa requirements and then plan your religious/spiritual wedding celebration since then you will have plenty of time to plan that.

K-1 Fiance(e) Visa Process & Proceduresdenied k1 visa

thx a lot....how long you think we have to wait to start this process???

The small amount of visits could have been the red flags. I think you can get married in the States. However, he cannot stay and AOS there. He has to go back to Haiti. Some people have gotten married on a Work/Visitor visa and stayed in the States to adjust their status, but it is not legal and comes with lots of headaches. And since he already had a denial for the K1, I would recommend doing everything the legal way

K-1 Fiance(e) Visa Process & ProceduresWhen is earliest possible to set up an interview?

^^^ K-1'ers don't work like CR-1'ers do. K-1'ers have a different process.

K-1'ers have to schedule the interview themselves. Once they get their MNL case number from the NVC, they pay the visa application at BPI, and then they schedule the interview either online or by phone.

but an indicator that you were denied entry into Singapore.i hope somebody here can give you more answer to your query.

K-1 Fiance(e) Visa Process & ProceduresSingapore Police Clearance??? For K1 Visa in Philippines

Our K-1 interview is April 16th at the Embassy in Manila. My fiancée worked in Singapore for 6 months in 2010/2011. I know that Singapore doesn't issue police clearances for non-Singaporean citizens, and I know that they refer to the "Statutory Declaration". I also know that you CAN obtain a Singapore police clearance, if you submit the application with a "form letter" from the "requesting/processing office".

A good friend of mine just got his fiancée (who also worked in SG) through the US K1 visa process from the Philippines by simply having a print out of the notice off of the Singapore Police website stating that "they don't provide police certs to non-Singaporean citizens". Maybe he was lucky, and unfortunately I had planned for that...now I'm second guessing this approach.

SOoooo...based on the group's experience, was a "Statutory Declaration" requested and accepted in your interview for evidence of no police record in Singapore? How do you go about obtaining one while living in the Philippines??

OR, was an actual COC from Singapore requested? How do you go about obtaining a "form letter" from the "requesting/processing office"? Who do you contact for this request and how long does it take to get??

Any help is appreciated...but not pointing to the web pages (below)...actual experience and knowledge in being asked for, AND/or obtaining these documents.

Chris

Hi! I worked in Singapore for more than 2yrs..I send my documents with the Request letter to my previous employer she then go to SPF to submit my documents, for the request letter i went to US embassy Manila at window 38 to to ask for it personally...I email the SPF yesterday and they already send my COC last April 3 to
US embassy Manila. The processing for COC take 10 working days.this is the Email Add SPF_CID_COC@spf.gov.sg
try to email or call 006564358275 to ask if they process COC if your fiance was there only for 6 months.
your interview is coming soon, you don't have much time to process the COC but your fiance was there for 6 months
only,i'm not sure if the consul will give excuse for it...Goodluck! and God bless!

I have a question about "residency last 5 years" on form g-325a. My fiance came over to the U.S. on a work and holiday visa from July 2010 to July 2011. Does he need to write this in his residency section, or is that still considered just a visit? And if he has to write it in there, will he need police records from here during the consulate step of the process? How would he get them?

hi guys i have a question for you...

on the DS-156 form it says that "evidence of engagement" must be attached to this form?

What does that mean exactly? he asked my father to marry me and then we were just kind of engaged after that... my grandmother game me her ring to wear. i always wanted her ring and that was one thing we didn’t need to come up with money for (cuz this process is exspencive)

What evidence of engagement do we need?

The status isnt necessarily reliable and you may find the 'Initial Review' may never change... this can happen long after people have been approved - so while its addictive to check the status, you can't rely on it. It is more helpful to check other peoples' timelines that are similar to yours to see how the general trend is going.

.. and yes it can be really really tough - we are on 'round 2' and it appears they may have lost our petition but have our check. It is a work 'in progress'. Just try and keep busy on other things and know that you are not alone (F)

Thank you so much....... I will be praying for you guys.... Sometimes i jus need to vent you know? =) Good luck ... and again thank you...

K-1 Fiance(e) Visa Process & Proceduresk-1 visa
It has now been exactly 5 month since we filed for our k-1 fiancé visa. Every day it says it’s in the initial stages on the web site, and when I call it says the same thing. I guess there are just some days when I get so irritated that it takes so much time to do this, not irritated at my fiancé or our relationship, just at the process.

I was told by our lawyer that this process would take about 9 months total, but at this rate I don’t see it happening anytime soon. I real don’t want to be a pessimist, because that not how I am at all, but there are some days when I just want to cry! I just want wait to be his wife and for us to start our life together.

Does anyone else feel like there life is kind of on hold right now? Like you are waiting for it to start kind of?

K-1 Fiance(e) Visa Process & ProceduresEvidence of ongoing relationship

Hello all!

I am about to send out the I-129f (excited!) but I had one last question. I have plenty of evidence of having met my fiancee (pictures, passport stamps, itineraries), but what kind of proof they need to prove it is an ONGOING relationship. I included my itinerary for my next trip to Peru (which will be tomorrow), surely this should be sufficient no?
If anyone has any ideas, please let me know :)

you can copy and paste your skype records and send them in with it... they will need a lot of proff... our packet had like 300 sheets of paper in it hehe... phone records, skype records, pictures, cards sent back and forth, a letter from your family members approving your engagement, we got a letter from our pastor saying we were getting married at our church.

good luck

K-1 Fiance(e) Visa Process & ProceduresInterview

I’m preparing the documents and everything else my fiancé will need for his interview. I will be mailing via FedEx this huge packet of documentation to him. What is the best way to organize the documents? What should I put the forms and evidence of an ongoing relationship in? I already have the original packet of the I-129F organized in the same manner that I sent with the visa application. I want to make sure that the forms he needs to turn in at the interview are readily available for him. Does anybody have any suggestions?

Hi...
I just sent the paperwork i needed to send to my fiancé yesterday via FedEx ($152.00 dollars’ worth of paperwork) I went and bought an accordion plastic file folder and started in the back of it without proof of relationship paperwork. In each separate file I put our phone record’s, then our Skype records, then our emails, exc... then i made sure i had the affidavit of support paperwork in one file, then a file for miscellaneous stuff in another, one for our pictures (dated and where we’re at)

Basically I just tried to make everything easy for him... i also bought sticky notes and stuck them on everything say what this file was, and I sent him 2 black pens just in case he couldn’t find his, and i sent an extra sticky note pack in case he need that for some reason...

Like you I wanted him to be able to pull everything out of the back and take it right to the office... but I found that the accordion file worked great for us...
Good Luck and you sound like you have everything under control….
Just today I was second guessing myself, did I sent enough stuff? What else could I of sent him? Was everything right? Oh my gosh some days I feel like I’m going to pull my hair out hehe…

K-1 Fiance(e) Visa Process & ProceduresEvidence of ongoing relationship

So my fiance and I have almost finished putting together our K-1 visa petition package together. However there is a slight problem. We need evidence of an ongoing relationship and we do have emails, but few phone records (because I didn't keep most of them :( ). We do have some evidence of chatting online together, but we don't have much evidence of that either. How important is the evidence of an ongoing relationship? Does anyone have any experience with this? Should I include a letter explaining the lack of evidence?

Thanks in advance

Hi Kevin...

Are you able to go back and print phone records? I have Sprint and they keep all of our records so I just went back and printed them out...

Evidence of an ongoing relationship is very important... well at least that’s what my lawyer said to us... I would advise you to see a lawyer, even if you have to pay a bit to get some advice from him/her...

I was lucky i had a friend go through this so i kind of know what to do in the beginning, but on average who saves that kind of stuff? Not me... I’m the like you i never would of thought to save this stuff... Also try to get letters from family or close friends who approve of what you’re doing as evidence too... I got a letter from a good friend, my parents, my pastor ec...

Good luck... we are in the second stage of this process and it’s going to be a stressful time but totally worth it in the end!!!!!!!!!

K-1 Fiance(e) Visa Process & ProceduresAppt Date but no packets in the mail

This same thing happened to us (but in Chile)! We're trying to contact the embassy regularly (through phone and email... in Chile email seems to be the most reliable way, India may be different). My fiance was also able to get a medical exam, and we're printing off the required forms from the internet, just in case he doesn't receive the packet in time. I also saw another person mention that their fiance was able to pick up the packets in person when they weren't received through the mail. This hasn't been offered to us yet, but we're looking into it and it may be an option for you as well.

One good thing about email is that I have documentation of us notifying the embassy that the packets have not been received. I hope that this helps at his interview, just in case the forms we find online are outdated or similar.

Good luck! Let me know if you have an epiphany on how to solve this :).

Thank you so much for this... i feel like we are not the only ones that this is happening too.. now i will tell him to print out the emails that i have sent them so there is a paper trail for us...

good luck too =) .... and i will for sure let you know if we figure this out =)

K-1 Fiance(e) Visa Process & ProceduresPolice background checks!

Hi guys, I'm Australian and I lived in the UK for 2 years and also Canada for 2 years on Working Holiday Visa's and now I am applying for the K-1 visa and I will now need Police Criminal Background checks in both countries for the NOA2. I'm based in Australia at the moment and while Canada is pretty straight forward in getting the background check (I can get my finger prints taken in Australia at a local police station and mail them to Canada) the UK is almost impossible to get any information on which department you send it to or application forms...If anyone has gone through that process I would love the help! Cheers!

I will help you with this one!!! We just got a police report from the UK ...

I don’t know if you will have this problem from where you are but the problem I had was we couldn’t find any bank that would transfer dollars to pounds... You have to send a UK postal order, UK check, or a Bankers Draft (cashiers check from the bank) but what the police report doesn’t tell you is that you can also do a bank transfer from your bank to the police station. It is a lot cheaper is you have a friend who lives in the UK and they will transfer funds for you then you send them the funds. The Bank transfer from the UK to the UK is free where from the US it was very expensive to transfer funds!!! Very very expensive!!!!

But really the report is pretty self-explanatory… Here is the email address of the lady I was speaking with at the police station she is very nice and super helpful… and the UK will email you back no matter what time you email them… it great actually…

Good luck =)
