IR-1 / CR-1 Spouse Visa Process & ProceduresA question for those who ask to expedite I-130
Yes,

A touch was generated but only after they decided to go ahead with my expedite. They dont physically pull your case until you have sent over the supporting documentation and it's reviewed and accepted. Only my opinion...... I filed an expedite, got the Inquiry #, then the next day I was touched then approved.

K-1 Fiance(e) Visa Process & ProceduresK1/K2 No one gets left behind!!!
Once the U.S. Embassy or Consulate where you, the foreign-citizen fiancé(e), will apply receives the petition from NVC, it will provide you with specific instructions, including where to go for the required medical examination. During your interview, ink-free, digital fingerprint scans will be taken. Some visa applications require further administrative processing, which takes additional time after the visa applicants interview by a Consular Officer.

Eligible children of K-1 visa applicants may apply for K-2 visas. Separate applications must be submitted for each K visa applicant, and each K visa applicant must pay the visa application fee.

If you don't already have a DS-230 in the system you should do the DS-260 if you are doing it now. Call the NVC AND ASK FOR YOUR INVOICE NUMBER. The fee will say exempt when you log in to fill out the form

K-1 Fiance(e) Visa Process & ProceduresDS-260 for K-1 Visa?
The DS260 replaces all DS230 as of 9/3/2013 and this includes all K1 unless you have completed DS230 before the cut off date. Most of the embassy's have not updated their site.

K-1 Fiance(e) Visa Process & ProceduresHELP PLEASE!
My fiance currently lives / works in Canada. She is not a citizen of Canada, but of the Philippines. Her work visa expires in Canada on 11/15 of this year. What address should be placed on the 129-F form, her current address in Canada or in the Philippines? I am worried that with processing times they may not reach her in time and she will have moved back to the Philippines possibly by the time they wish to do an interview or what not in Canada. I am so confused and need help please :D.

Thank you.

One more question I hope you can all answer, for Question #20, Your fiance will apply for a visa abroad at the American Embassy or Consulate at:

City and Country...

So is that where she will be wanting to go for the interview and such, or is this left blank and they determine this upon acceptance?

K-1 Fiance(e) Visa Process & ProceduresI-129F File expired

No need to worry. USCIS just hasn't updated the form yet.

http://www.uscis.gov...00045f3d6a1RCRD

If you look on their site with the link above, they also accept the forms from 06/14/10 and 02/19/10. Government forms always have an expiration date, but it doesn't mean they don't accept old versions.

Thanks both for your reply, a big relief :D.

K-1 Fiance(e) Visa Process & ProceduresI-864 Question

Based on what I've heard, but subject to your verification, is that what they care about is current income.

Sorry for the late response and thank you for yours! I think I am in the same boat and at my fiance's interview will have her present this past years worth of financials, and get a cosponsor later if need be for the AoS.

At least this is my plan in case they don't accept my financials for the AoS.

K-1 Fiance(e) Visa Process & ProceduresI-864 Question
The last 2 years, my income has been realtively low, below poverty guidelines. This past year, I have acquired a job that has put me well above the poverty guidelines to take care of both my fiance and myself. Will this be an issue when I present my last 3 years worth of taxes and they are well under the poverty guidelines, but now have a job that is well above it? I obviously will provide a current employment letter, paycheck stubs, etc. I was hoping that this will not be an issue due to the past, but now everything is fine. Someone please advise :)

K-1 Fiance(e) Visa Process & ProceduresLetter of Intent to Marry
I would like to highlight that during our petition process, my fiancee moved back to her home country. We had to mail them to inform them of this as they/we were plotting to have our interview and processing at the embassy she was currently at. I was advised by the USCIS / a consul that we could send it in highlighting what it was for, including the reciept # of the petition, etc. It was never lost and applied perfectly to the account.

I would recommend if you construct your letter well and appropriately, it may just in fact get to the right location. No need to wait for an RFE, just send it. Worse comes to worse, you have the paperwork ready to send when in fact you do get the RFE (if you do) and can send it later.

God bless and good luck!

K-1 Fiance(e) Visa Process & ProceduresPolice Clerance Question for K-1

What do you mean by "denied again?"

Without knowing anything about the "denial," I would say that the applicant should attend the interview. If the consular officer won't accept the police clearance, the consular officer will issue the applicant a 221g which will tell them that they have to submit an updated police report before a visa can be issued.

I mean denied again as in sending the police cleareance(again) meeting the same requirements and getting a letter stating we are returning your information for "X" reasons. We did everything they asked and have no idea why they are returning it to us as we have not recieved the letter yet, but the interivew is less than 30 days away at this point.

K-1 Fiance(e) Visa Process & ProceduresPolice Clerance Question for K-1
Question, My fiancee has an expired police clearance from Canada as she lived / worked there earlier this year. She sent off to get her police clearance again as the prior one is expired now. Can she take the expired clearance to the interview @ the Manila embassy, or will they require a current clearance as they are only good for 6 months...and we obviously know with this process it can be dragged out longer than that.

If she needs a new one, can soemone direct me to what we actually need to do. We followed to the T what the RCMP requested, and our request was sent back with a letter stating what was wrong...and now this may delay our interview until we can get it if the expired one is not accepted....

Please HELP...

I don't want to get denied again and continue waiting as we have already SOOOOO long...

May I add the letter indicating what was wrong / the request hasnt' been recieved yet by her....So we have no idea what was missed / wrong.

Regardless of what happens, make sure above all that you support her and give her the support she needs. If you have to leave her side please do, but never leave her because of waiting...(which I hope is what you meant after reading yoru post)

I wish you 2 the best and patience is quite a virtue. I know it's hard, but love is worth it! Especially if that person if the woman / man of your dreams.

Prayers for her father. God bless.

K-1 Fiance(e) Visa Process & ProceduresI-134 Supporting Documentation
Sorry, it's earlier than I'm used to being up with a corporate transition. I meant Co-sponsors in regards to affidavits of support. My apologies.
BenedictionMalePhilippines2013-01-31 08:53:00
K-1 Fiance(e) Visa Process & ProceduresI-134 Supporting Documentation
If you meet poverty Guidelines within the last year, you don't need a person to assist in the fiancials. Just provide your most recent 1040 and w-2's.

You can highlight to the CO via documentation your fiancee will provide that you are a university student, and while you meet the guidelines you will be making more upon graduation.

CO's tend to grown on Affidavits at the K-1 level due to the fact the document is not legally binding and the intending immigrant can still possibly become a burden on society.

Sorry for the run around, but with that being said, if you are making enough, just say one year and you should be fine honestly. The 2-3 year deal is overkill and is not needed if you can substansiate via w-2's, paystubs, 1040, etc.

Good luck on your Journey and remain positive!

Good luck and God bless in your patience. Trust me, we all know how it is. Just take it one day at a time and keep yourself busy. Follow up as you have to making sure you don't get lost along the way, but as long as you are in the right location that is a big plus. Trust me, it could always be worse.

The Canada comment someone mentioned is correct, although to get into the USA you will need a passport as a Drivers Licsence will not suffice.

K-1 Fiance(e) Visa Process & ProceduresNew here need advice

Each Embassy has different things it requires with general items you should expect to bring with you.  The finiancial documentation will be looked at during this stage and you should have it I-134 with verifyable paycheck stubs, tax returns(should you have them), employment letters etc.  Police clearances will be needed if she traveled / worked for a period of 6 months in any other country.

I would highly recommend visiting the embassy website or calling to figure out what exactly that embassy in particular will be looking for.

Good luck on your interview.

K-1 Fiance(e) Visa Process & ProceduresI34 question!help!

Hey, when I filed for my wife(then fiance), I could not give a year to date total.  What I did was give them a letter from my employer stating my hourly wage, that I was not temporary and full time.  I also included my most recent paycheck stubs to show them what I was earning as well as bank statements.  My year to date at that time was only a couple of thousand above poverty as I got hired in June.  This worked for me, hope that gives you an idea for you guys.

K-1 Fiance(e) Visa Process & ProceduresNeed advice on I-134 and DS-160

From my understanding, the US embassy Manila does not accept supporters for the i-134.  This particular embassy when rendering  a judgement can choose as they please, as opposed to filing for a spouse where the NBC makes the decision in which both operately differently.

I would recommend having a letter from your supporter too just briefly indicating you are a student and he/she plans on supporting you while you are here.  While I have seen many denials, I have seen a few approvals too.

Good luck and I hope you guys are approved!!  I know what it's like to miss the person you love tremendously.

K-1 Fiance(e) Visa Process & Proceduresk1 visa -- affidavit of support (fiance from philippines) please help :(

Hey Shane, you will have to show verifiable proof of income.  Being paid by cash cannot be verified.  I mean you could show bank statement's showing deposits and indicate you are an indepdent contractor, but you would still need a letter from an employer stating as such.

Last years tax return is going to help, but the embassy wants to see that you are making above the poverty guidelines moreso currently than in the past.

Manila typically does not accept a Co-Sponsor at the k1 level.  If it is a family member, I would suggest them writing a letter indicating such and getting them to fill out an i-134 as well in conjunction to yours.

I'm sorry but the burden of proof is on you, and without substaniating income it is going to be difficult.

K-1 Fiance(e) Visa Process & ProceduresVSC vs CSC
I have been patiently waiting for NOA2 for almost two and half month now and there is no response and not even a touch indicated . I have looked at and compared the application processing speed between VSC and CSC, the difference are dramatical. It usually take VSC 1 month or less to get approved. I know all of you aware of this, but did anybody ever questioned why?????????? my cases was transfered from TSC to CSC, if the USCIS considered to merge the cases from TSC and NSC to the other two for whatever reason they think that's beneficial, should they at least do it with a GOOD plan, do they ever consider balancing the work between the two offices, or have noticed that the huge delay and paper piling up in CSC office. CAN'T THEY SEE THE AT LEAST 2 MONTHs OF GAP BETWEEN THE TWO OFFICE??????

this is torture toward many of us who wanted to be with our fiance , husbands/wives so badly. did anybody ever try to complain about this to USCIS, or anybody have any idea how can we fire some actions and make them notice of this?
