No my case is not unique at all...as soon as they found out I was married to a US Citizen it had to be done like this and its a lot less stressful...

ohhh you know maybe I know why...when i was first married the lawyer had said we could just do an adjustment of status and the border guys told me that was illegal to do,and gave me lots of info on doing things properly....but they still said with the petition my status changed something about what kind of immigrant I was now, so I dont know.........

This isn't necessary at all, is there something about your case that is unique? Plenty of IR1/CR1 have crossed to visit their US spouses multiple times during the VISA process without issue. The OP should be fine with presenting ties but as always it is not a right but a priviledge, Cdns are not guaranteed for any of us.

Hm.. Do you have to go through the RCMP then? I went to the police station to get my police check.. Had a tick box for immigration, would be a bit annoying to find out I paid for the wrong thing (though it wasn't that expensive).

No you dont have to go thru RCMP thats all we have around here no city police...both are fine it just said go to local police dept or RCMP and it asked for a check either with CPIC data base or national criminal records repository

Police check I had done at local RCMP they do it in the CPIC data base which is there own, the check is local and canada wide. Recieved it within 3 days and its free.

Shots I went to the health clinic and they won't just give shots if you dont need them so she sent me to the doctor for blood tests to check what i was immune to and got those results back in a week and I didnt need any....hope that helps

I'm not doing a K1 visa but I live in BC and work in Alberta. I have been across at Sweetgrass twice and I am going across again on Sunday thru BC this time. What I do is call the border ahead of time and talk to the Chief and they Ok my visits then I get paroled into the states...it costs $71 american its the only way I am allowed to enter because of the petition. They have access to your file so they can see the petition and then I just have to show a letter from my employer....It may be different for you because your not married but you could always call and talk to the chief and see,I am sure its the same procedure if I was flying would just call the airport instead....

Hey all!

I am sure this has been answered before, but I always like to get fresh insight.

My husband and I are planning to visit his parents for a few days at the end of June. They live in Florida. He has block leave from the Army then (he is stationed in TN) and will be driving in and I will be flying in from Canada. We have not as of yet submitted our I-130 application so we have no impending visa stuff on the books. I will be flying back ( have a return ticket and my airline taxi already paid for which I can show) and I will have our hotel room reservation information available.

I don't have a great deal of financial ties in terms of a lease, etc (I live at home and pay my father rent but I don't have an actual rental agreement). However I do have established credit cards, debit cars, cell phone, school loan currently being paid back and a job here.

What else is there that I can bring with me should U.S. customs be concerned that I am not coming back? Having not seen my husband since January I really do not want to mess anything up in terms of being denied entry or anything that could increase my chances of such. From your experience, what exactly should I tell the customs agents? I am visting family? I have no intention whatsoever in lying I have just always experienced that you shouldn't offer up too much to anyone unless asked as it looks rather suspicious.

As mentioned I would take the employment letter that was what I always needed....yes just say family if they ask...maybe go a little early incase they take you aside for more information...you may not get any questions asked at all, its just good to be prepared. Enjoy your trip.

Call the dhl location that you will be picking it up at and see if they hold packages ... then if yes, after the interview wait for the email from them and then call and request they hold it for you....

You have to put bio appointment # on uscis website to track your case.NOA # does not  work. :)

Oh thank you :) says its still in initial review. That's what I expected, the file not found was a little shocking :)

So weird that they would include that little clause on the letters for people who it will not apply to. Imagine being a non-native English speaker? It would 10x as confusing.

Reviewed my copied file of the original I-751 and documents from before I sent it in.  Since I copied and arranged each page individually, and I have the copy of the "missing" page with no original anywhere, I can conclude that yes - USCIS may just have made a paper airplane out of my page 3 and then asked for a new one... "oh, and while you're at it could you re-sign page 5?"  LOL!  :whistle:

It doesn't say how to get the letter, just that we would need to send supporting documents... which I sent with the original application. I'm not too worried, but it's bizarre, 

They will send the letter in 1 to 2 weeks.

Hey, here's another question.  They made a mark on the first page of the actual application.  Should I re-do the whole thing, or just add the missing page?

No just add the missing page mine had marks and staples and they had it binded together at the top with a special clip...the only thing I added was the letter they sent me , it said to include it on top.

If they just stamped the back for deposit , its okay you can send it back. I had my whole package sent back because I sent it 2 days too early , they already had it binded in their little binders and the cheque was stamped. I just sent the whole thing back the way it was and it was fine.

If your husband is currently living in the US, then he of course doesn't need to prove domicile as he's already in the US! Proving domicile is only needed when the petitioner is living abroad with the beneficiary.

TY so much for your reply but that did not help me one bit to read the last 20 posts of that topic. My husband is a US citizen and has never lived anywhere but the US... they already have all his info but at the bottom of the immigrant visa checklist it asks for copies of documents proving petitioners US domicile. So exactly what do they want? Maybe i need a knock on the head but i just dont get it :bonk:

Glad you caught that error!

Well, even though your lawyer did everything, did you still get emails from NVC? You can always go by the date you got that initial information package with the date your case number was assigned. Then, for EP, NVC frequently emails you now when they receive your packages and will review them shortly (not an auto-response, an actual email). Just use those dates for the dates you sent out the packages. You can also try asking your lawyer and see if they kept any kind of documentation for specific dates.



I didnt get any emails from nvc until today. I had to get the case number from her and she filed my document package after I filed the ds-260 thats all i know that she did....i can maybe email her and get the dates if they have them

OMG!!!!! I was freaking out because I hurried and filled out that DS-260 and then i read your common rfe's and one was those darn dates of where u live and i know they didnt match to one of the other forms ugh thank you God

I have no idea of the dates things got sent because that lawyer just does stuff and I find out later....so how we gonna fill my timeline out

Ok so I filed the DS-260 last week and the lawyer sent the rest of the documents and I got this letter this morning

Dear Sir/Madam:

All documentation necessary to complete the National Visa Center's processing of your case has been received. As soon as an interview date has been scheduled, the applicant, petitioner and attorney (if applicable) will be notified.
The applicant should NOT make any travel arrangements, sell property, or give up employment until the US Embassy or Consulate General has issued a visa.
The US Embassy or Consulate General may require additional documentation at the time of the interview.

Do I just wait now?
