Just FYI, Canadians are not part of the VWP. We have a completely different status, which is basically just "visitor". Because no visa is required for us to enter, what's the waive?

To OP, get married now and apply for AOS! Don't wait until the TN expires, because it may not be renewed, or he may get laid off in the interirm, given the economy lately and the number of people on another immigrant website I frequent, quite a lot are being forced back to Canda after they lose their jobs, and re-entry can be a bit of a trick.

Check the processing timelines for AOS in your state, and make sure you apply for EAD with the AOS because if the AOS application processing takes longer than expected and the TN runs out, he can no longer work. If he gets the EAD (generally granted within 3 months of application, and hey, its included in the price anyway) he can keep working without any break in authoriztion.

Canada DOES do the K1 visa. I got one myself and I'm Canadian! The K1 uses the I-134, which is similar to the 864 but not the same. The 864 is for spouses. Later when you've entered the states and seek to adjust status you will use the 864. The checklist Montreal gives you is a little confusing because it lists things that spouses bring as well, but a K1 does not bring everything that a spouse brings. Check out the link in my signature, it's an extremely helpful guide for K1s going through Montreal. Any other Montreal specific questions you should post in the Canada regional forum because 99% of Canadians go through there and have a lot of experience with it (myself included.)

Yes, you have to send in 2 colour photos along with the photocopy of the bio page. I sent mine with xpresspost, it gets there in a couple days and gets signed by someone and only costs about $15.

The non-US citizen/the one who will receive a visa is supposed to receive packet 3 from Montreal. It is not unusual for Montreal to screw up and send packet 3 to the USC instead, though.

The non-USC is the one who needs to sign up for DHL/Loomis and sign up on the CSC website.

The US does not really care about dual citizenship, however I would check out what Indonesia's laws regarding dual citizenship are. http://en.wikipedia....ian_citizenship This is just wikipedia which is an unreliable source, but I would urge your fiancee to do some research on Indonesian nationality law. There are a few countries, such as Japan, that do not allow for dual citizenship or have very strict requirements for it. Indonesia might be such a country and obtaining American citizenship might be cause for them to revoke her Indonesian citizenship. Again this is just from unofficial sources, I could be totally wrong- which is why she should check Indonesia's official government website or some other reliable source.

I'm not sure if I'm interpreting this right, but I -think- if you've been residing in your current country of residence for more than 6 months then you must provide a certificate for that country. If you've previously resided in any other countries for a year or more then you must present a certificate from that country as well. If my interpretation is correct then you wouldn't need a certificate from England.

But I'm not entirely sure- your best bet is to e-mail Montreal.

Hi All - I want to say thank you to everyone who posts on this site. The information provided is priceless and has helped me work through this process over the last year.

I have my interview scheduled at the Montreal Consulate on December 3rd and am just trying to put the finishing touches on everything.

I have two questions:

When I sent in Packet 3 I included the signed and sealed copy of my Criminal Record Check. I kept a photocopy for myself but see it on the list of documents to bring to the interview as well. Do you think that I need to get another copy from the police that is also sealed? Will they have my packet 3 there with the original?

Second question - for the Packet 3 it indicated that I needed police certificate for any country that I lived for more then 1 year. On the interview appointment confirmation list it doesn't list the 1 year part, it just says for any country I have lived since age 16. In 2002, I lived in England for 9 months.....do you know how I would find out if I need this forsure. It takes a bit of time to get the police certificate from England and I worry that I can't have it in time for my interview.

Thoughts??


Seconding Bsd's suggestion to e-mail Montreal. Make sure to include your case number and keep your question brief for a quicker response.

It does look contradictory, but that page of packet 4 might be addressing immigrant visa applicants/spouses (K1 is not an immigrant visa) so you might be safe? I'm basing that on the fact that it lists the I-864 right after it, which is not required for K1s (scroll down further in packet 4 and it'll says K1s bring the I-134).

A fingerprint check is not necessary so long as you don't have a criminal record. So long as your certificate indicates that your name and date of birth was searched in the national records repository or CPIC and you don't have a criminal record your certificate should be fine.

I used white out, and then photo copied them and put the correct information in.
But that was one of the old forms the consulate sent and I couldn't get a new one off the website.

hmm, a date thing is kinda weird to change..

but if you really are set against just downloading a new form online and re-filling it out, I'd do the cancel out thing, enter the new date and initial that spot.

I put both my 19yr old and my 23yr old on the application, it asks for children's names.
My packet 3 included the 19yr old, but I just emailed them, then told them again at the interview, she was not coming with me. There wasn't a hold up or any problems.

Edit: Missed the last few posts blink.gif I wondered the same thing, do you put them down or not, if they aren't coming. *shrug*... everything worked out fine the way I did it smile.gif

I just got back a few days ago from visting my SO in the States. I have travelled back and forth quite a bit, to go see him, I fly out of Syracuse, and to just go and look at the stores :blush: in Watertown.
I was prepared this time, because I had given them my passport number. This time I used my driver's license and BC. Said I was going to Syracuse, flying to LIT, to see my boyfriend. How did you meet, 8 yrs ago on the internet, blah blah blah. This Officer had pulled at least three people immediately in front of me and I was sure he was going to pull me. ( I get random checks all the time :wacko: ) He just asked to see my itiniary (sp) and told me to have a good time. He did ask " before I put your name in here is there anything you need to tell me?" YIKES, I said no, cause I hadn't done anything illegal.
I cross at the same POE all the time, some of the officers even recognize me, some of them tell me if I'm quiet they'll tell me how to get somewhere :whistle: :lol:
I'm not going to try again, my honey is coming up in a couple months, and hopefully we'll have heard about the visa interview by then.
Less said the better.
All the officers where I enter are great, I have more problems trying to get back into Canada :crying:


OH, I have never gotten a stamp and the times I get pulled in, I always ask if I can have one of those I -94's, they always just give me a funny look and say NO :unsure:

What does your fiance like to do? Does bright lights, big city sound exciting? Interested in going to shows? Broadway or the Vegas Strip might be fun. What about outdoor activities like riding and hiking? Honeymoon on a ranch that offers trail rides. Go to a mountain lodge and rockclimb. Go to a national park and rough it in a tent with a canoe. Disney offers lots of entertainment and fantasy, as well as amusement park rides while also being close to some amazing nature preserves. Why not go on "safari" instead of a cruise?

I'm planning my honeymoon before the wedding, as we aren't sure when we're going to get to do that. We're going to Cancun and plan to act like honeymooners the whole time we're there! As to getting away after the wedding... well, as long as I'm with him, I won't care where we are, even if it's just home!

But yeah, the Grand Canyon is on my to do list for a future trip...

Actually, according to the Act of 1952 and the reform act of 1965. It is a RIGHT to bring in your fiance, spouse, and children to the USA to live with you. The condition is, the person is not involved in, has in the past, or is now actively pursuing subversive activities against the US government or other like aligned governments with the USA. Any person who has come to the US and is considered "subversive" can be deported. However, the INA, USCIS, and DHS have been allowed to determine the "allowable" time frame for processing. The ACT of 1952 which is the basis for the USCIS today placed a priority on family first. Since then the 1% of all applications has been attacked, reformed, and slammed upon. there have been amendments, marriage broker revisions, checks mandated, etc. Many things to make the finace, and spousal visa more thorough. Due to these reforms, the original inceptions has been "muddied" and lost. I am hoping my senator will take this up. my senator has already promised an inquiry to the Service Center. but also the Secretary for DHS is from my State. So i have a senator who has sponsored many, many reform bills for immigration reform, plus the Secretary of DHS is from my state. If someone does not hear my cry and those of you who I have heard on here. it is not for lack of trying. I have not only asked my senator for assistance in my case, but assistance from the senate in ALL k1/k3 visa cases at the Service Centers. If a bill can be introduced to mandate immediate family first with application processed in 4 weeks with a maximum 8 weeks or less. the problem the Service centers do not realize is I am from Arizona, Secretary of DHS was the governor of Arizona. the senator doing the inquiry is one of the foremost leaders in the senate for immigration reform plus the senate minority whip from my state. I also worked in DC for many government Bureaus. I was not the person the Service Center wanted to ignore or do a "silent" refusal to expedite on. I am the one who no matter how beat up I am, I will continue until there is reform now. If they had approved my expedite request, I would have gone away silently. The longer I wait, the more I learn. In government, an educated voter who knows and works within the system is what they fear the most.

@Thea: there's no way we will cancel our petition. once im there im sure it will be way better than here. he meets more than 125% poverty level but as i said 2 rents, 2 rows of taxes, everything divided to 2 makes a big difference compared to 1. giving up would kill us. we know eachother for more than 6 years if we dont do it now we'll never do it. we couldnt take the process all over again from the beggining
i needed some medical assistance yesterday. seems i got an iron deficency anemia thats why i dont have any energy. so now sam's trying to stuff me with fruits and vegetables. i scared grandma saying sam's coming here so she backed off instantly. she knows how mad he gets


I know you won't cancel hon, I'm just saying that no way should the government, or people on here for that matter, say that because he can't pay two rents etc that he shouldn't be able to still support you once you get there, and in your case, love aside, it will be much much better for you once you get there.

I'm really glad you went to see the doctor. Given your nutritional deficiencies, it's likely that the anemia is from poor diet, and you should start feeling better. I hope they suggested you take a supplement. I also hope that they looked at other causes for anemia and ruled them out, that will look good when you get your physical for the visa.

as to grandma... I'm glad she's backed off, but try to still keep her and Sam away from each other as much as you can so there won't be any fights. One day in the future, you might resent him if he gets into it with family, even on your behalf, it's a weird thing that we humans do given enough time. We start to lessen the faults of others, especially family, and one day when you're in the US, you'll get a call saying grandma is gone, and you might feel warm to her and get mad at Sam for stepping in. Better you only have your own regrets, and not have him share in them. When you do get to the US, try your best to mend things with grandma as best you can for this same reason, regrets are never a nice thing, especially when you're so far from home.

As to the expedite, and putting it on hold, I think I'd feel the same as you do, and be worried it would mess things up. Better to wait the few months we have left and not risk it, especially as it seems you're in a better place now than you were when you sent the first post.

Hon, I'm so sorry to hear about the crazy stuff you're having to put up with right now. I think it's great that Sam is going to work overtime to try to help you, but I don't believe that if he can't help financially that your visa shouldn't still go through. What does the government expect us to do if someone gets laid off and we fall below the poverty line anyway, say, I'm sorry, but I never would have been allowed over here with your finances so low, so I'm going home now? I also think that at your age, it's obvious that you're at the bottom of your earning potential, and things won't always be so dire. Best to let you be together so that you can make a proper go of it. As to the expedite, I'm not sure that you'll have proper evidence for them to grant it, for the reasons stated above.

I'm mostly concerned with your health and well-being though, you said that you're tired all the time and not eating, that your having to rest etc... Have you been to a clinic to be tested? Better to know ahead of time if you have some kind of communicable disease like Tuberculosis and start treatment before your medical exam, you wouldn't want to be denied for something like that, not that they would necessarily deny you either... I'm wondering as well about shelters, soup kitchens, even youth hostels, there must be somewhere more affordable for you. Do they have charity groups or welfare available to you?

Also, you said that your mom and grandmother stole your money from you, and are asking for more? Is this extortion? Or do they feel that you owe them for food and shelter and took by force your money? I'd be worried about them continuing to take from you as it gets closer to interview time, as you will need that money for your medical, police check and the interview itself. Can Sam cover all those things online? I'd look into it, as well as having him pay for any rent or bills he's said he's gonna pay for online. If you don't have any cash in person, no one can steal it, right?
