Hi all,

very very quick question. My case is currently at the NVC and we have reached the stage where both bills ( 184 and the 230) have been generated and paid by us.

I have been checking on the Automated voice system but it doesn't seem to be providing any updates since 27th Aug? < i called yesterday again and same message>

We sent in the payment for the 184 on the 22nd of Aug. I called and spoke to an agent on the 10th Sept and they have confirmed that the 184 payment was received on the 7th Sept. So why haven't they updated the phone system? Is this normal to wait close to 2 weeks before the fee is inputted into their system?

How do i know if the forms have been generated by the NVC?

I am thinking of trying James shortcuts. THis waiting is driving me nutty!..lol..

Hi all,

I just discoverd that my husband put down the wrong mailing address for me ( the beneficairy) on his i 864 form! What do i do now??

I have sent in my DS 230 form already but it looks like packet 4 address will be sent to the address listed in his 864?

Sigh, i'm feeling really really really down about the VSC right now. I have had no touches since April 26th and it has been a whole month :( while others who are in the same batch as i am seem to at least have their files looked at.

Is there any logic to how they process the files?

My biggest fear is that someone looked at it and it fell behind the desk/box to a dusty, hidden corner somewhere and is now covered with spider webs or is nesting material for mice at the VSC!!..lol..

I look at my USCIS account with hope, but turn away dissapointed every darn time! Its happening until i am dreading even going to the site..

Does anyone who submitted in Mar to Vermont have ANY good news that they are still alive and not waiting for the immigration reforms to take place before they work on the files!

DARN IT VERMONT!! TOuch ME ALREADY!!!!!...grrrr...

Oh dear! i am sorry to hear about the messup! They seem to be doing that A LOT recently. I have not had a touch since April 27th so i am also really worried that they have misplaced my file or that it has been lost somewhere!

Even more frustration when i see other people who have filed after me getting approved. Don't get me wrong - I'm VERY happy for them! But it just causes me to wonder even more if something has gone wrong with my application..

Should i call VSC and see if there is an RFE or something?

Hi everyone,

I'm just checking to see if i am practically the only one on VJ for a K3 visa via Vermont that hasn't received an approval or an RFE or a touch yet? I received my NOA1's in early mar.

Arrggghh! its just soo frustrating! I submitted in Feb. My last touch was in mid April when my I I29f got transferred from MVC to VSC, and until now its been dead in the water. I see many who submitted in end April/May who have got their NOA2's.

Heck, even an RFE would be nice ( touch wood!) but at least i know someone is looking at my file! Ironic that the seasons are a changing ( from winter when we submitted, spring and now summer) but my file seems to be frozen solid at the USCIS ice kingdom :unsure: .

Anyone feeling left out on the sidelines?

Pushbrk/Urge to race, we were some of the few that was caught in the DCF mess in the early part of the year and were unable to file for DCF as a result. Our intention was definately to file for the CR1 with DCF which would have given both the time advantage as well as the 'less paperwork advantage". However the change in DCF occurred and we had to weigh our next options.

The original I 130 process via the USCIS was supposed to take a lot longer than the 129F(k3) . Hence we decided to do both the petitions and see which gets to the USCIS finish line first. Right now, it seems that both are coming in as a tie - which possibly means 2 things 1) processing of 130's are now faster than previously OR 2) that the 129Fs are processing slower than previously.

I would still prefer the CR1 over the K3 anytime but NOT if it takes me 2 years to be with my husband. If the CR1 processing is 1 - 2months more than the K3, that is still tolerable and will still be preferred over the K3 visa.

Are you saying that i no longer have an option to go CR1? or that the CR1 process will still be a lot longer than the K3 and i should go with K3 instead?

We finally got out approvals for both the 130 and 129F on the same day! Thanks be to God! :dance: So i'm really estatic that we can now move on to the next stage of the process to the NVC!! i can't stop pinchin myself to make sure its real!!..lol..

I wanted to get some clarity on what happens next. Do both of my applications get sent to the NVC together? or will USCIS (Vermont) retain the 130 and send the 129F instead?

Ideally i would like to go with the 130 ( for the CR1 visa) as that will take out the hassle of the additional paperwork for the AOS but will go with the 129F if that gets me to my husband quicker.Anyone know what is the trend for USCIS so far -sending both the 130/129F or do they retain the 130?

hopefully i will be changing my nick to 'finallyinME" soon!

USCIS Announces Transfer of Form I-129F (K-3-spouse of U.S. Citizens only),
Petition for Alien Fiancé
Beginning October 23, 2006, U.S. Citizenship and Immigration Services (USCIS) National Benefits Center (NBC) began transferring Form I-129F, Petition for Alien Fiancé(e), (petitions for K-3-spouses of U.S. citizens only), to the California Service Center (CSC) and the Vermont Service Center (VSC), depending on the location of the related Form I-130, Petition for Alien Relative. This transfer is being implemented in preparation for Phase 3 of the USCIS initiative to use centralized filing and bi-specialized adjudication. Through this Bi-Specialization effort, USCIS continues to align similar workloads between two “sister” service centers, CSC and VSC, to better manage cases and improve customer service.
USCIS will continue to forward approved Form I-129F (K-3) petitions to the National Visa Center (NVC) for consular processing. However, it will retain approved Form I-130 petitions, based upon a mutual agreement with the Department of State. USCIS will retain all approved Forms I-130 for retrieval upon the beneficiary’s eventual application for adjustment of status (Form I-485), unless the petitioner clearly indicates on Form I-130 that the beneficiary will use the consular process. USCIS will store approved Form I-130 petitions at its National Record Center (NRC).
USCIS has implemented this process change because most K-3 beneficiaries apply for lawful permanent residence by filing Form I-485, Application to Register Permanent Residence or Adjust Status, following their arrival in the United States, as opposed to using their approved Form I-130 petition to apply for an immigrant visa abroad. By retaining the approved Form I-130 petition at the NRC, USCIS will reduce unnecessary file movement and eliminate applicable costs and fees associated with immigrant visa processing.
If the beneficiary should later elect to consular process instead of applying for adjustment of status, Form I-824, Application for Action on an Approved Application or Petition, must be filed with the USCIS office that approved Form I-130. Upon favorable action on Form I-824, USCIS will send Form I-130 to the NVC.
This internal transfer of work does not alter the existing filing instructions for any of the forms. Accordingly, USCIS customers who file Forms I-130, I-129F (K-3-spouses of U.S. citizens only), and I-485 should continue to follow the current filing instructions on these forms. Customers affected by this transfer will receive a receipt notice from the NBC notifying them of the location to which their Form I-129F has been transferred.
USCIS customers can utilize the following methods to obtain case status information about their pending applications and petitions:
• Calling the National Customer Service Call Center at 1-800-375-5283
• Using the USCIS web-based Case Status Online located at www.uscis.gov

**consular processing**?? I am a K3 petitioner but I indicated on my 130 form that i will apply for my visa in my home country and not in the US. Is this similar to a request for consular processing?

I posted about a similar issue a month or so ago and I just wanted to update everyone..

We had both the 130 and 129F approved as well. We received a letter from the NVC confirming that they have got our 129F file and assigned us a case number. My husband then called them to ask if they have received the 130 file and they confirmed that they did as well. They gave him the case number over the phone. Hopefully we will get a letter from the NVC about the 130 soon.

My forms like scorpio was filled in for section 22 for consular processing too. So it looks like they are forwarding some cases to the NVC (esp if section 22 is filled in?)

i have nothing- nada, zip, no touches, not a tickle since april and i filed in Feb! its very very very frustrating especially since quite a few of our VJ members have got their NOA2s already and some filed after me!

I'm happy for them but wondering what the heck is going on with my file??!!

We filed in mid feb for the IR1/CR1. I just went to the USCIS Vermont website which was just updated (Mar 15th) and was miserably dissapointed when the I130 date hasn't even moved a day from Mar 12 2006!! what is going on?!

K1 visas seems to be processed fairly quickly and while i am happy for them, its really unfair that the spouses have to be apart so so much longer :crying:

Do we go on a different production line and that production line is broke??? cos it don't seem to be getting anywhere!!! :angry:

I have filed for my K3 (more out of necessity to get to my hubby asap) so there is some hope at the end of the tunnel as that seems to be moving. But my preference was definately for the IR1. Just seems that they are preferring to collect the extra $$ for the next step and that seems kinda underhanded.

Anyone who filed in Feb for the I 130 for vermont with good news?

I just wanted to ask what happens next when our case get completed? My hubby got a letter from the NVC ( he's the petitioner) saying that case has been completed and to wait until our priority date is reached. Is this the magic packet 3 that everyone is talking about?

So i should be waiting for packet 4 to be sent to me ( the beneficiary) from the embassy? Is this when they will set the interview date as well as instructions for medical etc etc? I don't know what to do next sad.gif

I think it depends on how you fill in the forms, esp on where the interview is to be conducted ( i can't remember which question it is on the forms now - both 129F & 130) . I filed the 129F and the I30 as well. The 129F got approved first, followed by the 130.

I waited a couple of weeks to see the progress of the cases . When i checked with NVC, i found that they had received the 130 and were processing the case. Apparently the 129F had already been forwarded to the embassy. Sure enough, i received a letter from the embassy saying that they had the documents for my 129F ready and that i could come in for an interview.

Because i knew that the NVC was processing my 130, i decided not to go for the 129F interview as we had decided to go for the CR1 instead. Hubby and I did not fill in any other paperwork or request to cancel the 129F.

A few months later, my 130 at the NVC was completed. It was subsequently sent to the embassy and i was scheduled an interview in Dec. Visa obtained 1 week later. (Thank you God!)

The CR1 definately took a couple more months than the K3 visa - 4 months longer to be exact but that worked out well for us because of our plans.

I am not sure if there is still process issues at the USCIS in implementing the new procedure and some cases were still being sent through during my timeline. My Visa journey began in early 2007, just a few months after the notice came out.

I just know that i was VERY relieved that the 130 had been received and processed at the NVC because i had seen the same link as well. I believe it really depends on how the question re: place of interview is to be done. We had the same location for both i.e Malaysia.

Hi Mike,

The K1 visa is only valid for a fiancee entry into the US. You will need to get married within 90 days.

In the days of the DCF ( direct consular Filing), i probably would have suggested getting married first in Malaysia, if your fiancee wanted to do the ceremony with their friends and family. But now that is no longer possible.

My husband and i had initially considered either the K1 ( i.e coming in as a fiancee) or the IR1 (spousal visa via the Malaysian embassy).We had decided on the IR1 via DCF because it was supposed to be quicker. Got married in Malaysia, prepared our paperwork, police certs etc etc only to find that they had officially stopped DCF on the Monday, the day we registered.

We have been apart for close to 4 years now and to have this ray of hope extinguished just like that was heartbreaking for me. But no use crying over spilt milk, so we continued on with the formal wedding ceremony. We had a beautiful church wedding + the dinner with close family and friends :D

I would suggest the K1, especially if you want to be together as soon as possible.
