Sorry for sharing this happy news so late with you all, as I just didnt get a chance to get on the net.. at all.

For those interested: here are the Interview details

My husband had his interview on May 24th at the New Delhi Embassy. I flew to india to join him. We spent one day before the Interview shopping and dining to destress ourselves. I had 200 printed questions, and we both went over them together (the questions are really easy and intuitive if you already know everything about your spouse, so we didnt need any preparation) We left our hotel room at 6:30 am and reached the embassy at 7:00 am. They were quite a lot of people waiting outside and sitting on the grass and pavements.... As we had another 45 minutes before we went in, we went to a nearby shop to have some morning tea. We came back to the Embassy at 7:40 and stood in line. There were about 100 people in line. slowly slowly the line moved and we went in. We were the first CR1-interview couple in line and also the first one to interview. We handed over the interview letter to the "Consular assistant" and went and sat in the waiting room. After about 20 minutes, my hubby's name was called. We took all our documents to Window # 15. An indian guy started giving us all our documents back that we had submitted to the VFS. He was pretty cool and friendly.

Questions he asked:
1. what is your marriage date?
2. is this is your first marriage?
3. do you have the medical report?
4. do you have any other documents like (school certificates) where you Date of Birth is listed?

(My hubby is punjabi but was born and raised in Karnataka, he is very fluent in Kannada + punjabi + hindi + english) The guy who was quering us was very impressed with how many languages my husband could converse in. Then he handed back all the documents and told us to go back and wait until our name is called again.

We waited for about 90 minutes until our name was called again at window # 15. This time it was the FINAL INTERVIEW.

We went to the window and saw a very young white guy sitting. He greeted us with a great smile and said "Good morning, how are you?" "Is that your wife?". My hubby said, "YES".

questions he asked:
1. when did you get married?
2. was it an arranged or love marriage?
3. what will be your occupation in USA?

He only asked 3 questions and said,
"its that easy, you are approved" :lol: :lol:

He told us that we dont have to pay any fees and the visa will be mailed to us.
we left the embassy in another 5 minutes and started calling everyone to share the good news.

The next day, I called the VFS to confirm if they received the passport with stamped VISA and they said - YES.

sO, here's the final story....... God has really helped us and we both thank him for EVERYTHING.

I don't know about a K1 visa, but me and my husband came on vacation to he USA while applying for his spouse visa. He got asked a few questions at the POE (what did you come here for, who did you come with, how long are you staying, etc etc) he brought a letter from his company stating that they were expecting him back and had his return ticket at hand... No problems at the time of letting him in.


I think it is hit or miss...my fiance's interviewer for her tourist visa was an a$$...he wanted proof of everything, then he still denied her, he did feel bad and you could see the expression on his face, however what I am getting at is I beleive it honestly depends on the embassy that you apply at and the POE officer that you draw.

Thanks, so after reading all of this, there really is nothing to do here except wait until the NVC sends it to the consulate. I have most of the other stuff already as we just applied for the tourist visa...so I probably should just use those documents.

Practice? I don't really want to practice...I want to try and get my ducks in a row for hte next step, to make it as easy and quick as possible...besides it is for K1 not k3 or is there really no difference as far as the NVC is concerned.

Your visa is good for 6 months...so you have 6 months to decide if you really want to move to the United States basically....upon entry into the United States, you then have 90 days (3 months) to get married....Yes... a rush...but look how long all of us have waited TO be married! :blush:

Hmm1, The same thing happened with me, due to classification and that it was too soon, I couldnt get orders... But I went to my 1st Sergeant, told him the situation, and he typed up an official letter stating that I am deploying during such and such months in support of OIF/OEF. The commander endorsed it. And the expedite was approved. It was that simple. USCIS doesnt need to see orders, per se, they just need undeniable proof that you are deploying in support of OIF/OEF. Im pretty sure they understand that orders cant be obtained so far out from deployment.

Also i think it is completely unnecessary to involve a senator or congressman. That is definetely breaking the military chain of command. A First sergeant's sole job is to help, use it.


I understand...if I worked for or was below a 1SG I would use it...I am going to see if my BN XO will type up one...and get the BN CDR to sign it...I didn't know you could do such like that...my Rep. told me that they needed military orders...thanks Matt

I think your chances for an expedite are very good if you have deployment orders to Iraq.

Also, the consulate in Manila has a very steady track record for expediting based on deployment orders.



Yeah, I think mine was turned down...we are on a two week deployment notice(a prepare to deploy), luckily they extended the tour of OEF/OIF boots on ground, now I do not have to go for sure until mid 2008...hopefully CSC will have my NOA2 by then...just make sure you get a copy of the orders for the unit and a copy of the orders assigning him to the unit, it is too early in the game for him to have his name on a manifest order yet...that are the two biggest pieces of paper that you need...do the expeidte process and get your congressman involved...best of luck.

How can you tell that they are on Feb??? When I look at the dates on the USCIS website for the California Service Center, it shows the date as October '06. Maybe there is a different place that I should be looking?

1.) Is the Missouri Center processing visa applications or are they doing other things???
2.) Does the Texas and Nebraska ceters do any work or is california getting over in some way??
3.) I am in the Army and I am preparing a K1 visa packet. Would my W2's be good enough or do I need my 1040's??
4.) In the Support Affidavit, do they look at the GROSS or NET salary?? I am in the army, so some monetary benefits are not counted on my W2's, but are on my earning statements. For example housing allowances.

I totaled my benefits together and used them on the 134 form...take LES's with you to your interview to show the descrepancy with the W2 and the 134 form.

I once asked the us intrest section in Havana why the pettitions were approved to quickly and there risponse was that its because there appointments take 4 months to schdule from the time the case is complete at NVC so they approve the pettitions quicker to that people dont excide a waiting time of 12 months. they also said that because you never know with the cuban goverment they like to work as fast as they can because one day fidel might wake up and say ok no ones getting outta here visa or no visa.



I'm guessing it has more to do with broader political issues than the 4 month interview appointment delay since other Embassies have 6-8 month delays. Or there's the Dominican Republic with a 2 year backlog.

Conspiracy theory time...

My husband was due to deploy in November last year, so his commander wrote a letter explaining the situation to USCIS, as he didnt have any orders. It did seem to speed things up as I got my interview for November 06, and my friend in the same situation has still not received hers. Nanusia & Lukaszek you may not think it is fair that some military get their case expedited, but I merely wanted to spend time with my husband before he deployed ,as there is always a chance that he may not come back. I think that military should have their case expedited as the possibility of deployment is always there.

Nope, it didn't help with me...but there are plenty of other benefits to it...don't worry about the flamers...fools smack fools who call them fools...if you can't kill them with kindness...well that is something else...

JAG can not help and usually will not. Just make sure your paper work is in order and send it in then do the waiting game...

We do have birthday and Valentine's Day cards we've given each other throughout the years as well but were not included in the package. I read numerous site and comments where initially USCIS only wants to see that you've been together for 2 years. The embassy is the one that will want to see that you have had an ongoing relationship and is where you can show boarding passes, emails, letters, etc..

Hello everyone! I started this forum for people that will be looking into and filing a I-129F application for their same sex partners. I have to say that VisaJourney.com is an extremely helpful website to gather information on how to create and arrange your K-1 package. I used this website's Step by Step guide to create my package, http://www.visajourn...content/k1guide. I decided to take on this venture on my own after being turned away by a local Immigration Lawyer. Another awesome website is ImmigrationEquality.com. These guys have poured their souls into fighting for same sex rights. I am extremely grateful that they fought without giving up and in huge part we are here because of their help. I have emailed them with questions about this process and they do reply back with any questions I have. They might take a few days to reply, but I can only imagine what their inbox looks like, so it's understandable. They also work with and train lawyers all over the country about same sex immigration. They can refer you to lawyers, unfortunately no lawyers in my local area participate. 

 

I have been with my fiance for 10 years, 10 wonderful years. I can't say it hasn't been tough, but I think I have had it easy compared to other people. I live in El Paso, TX, which is just a border hop to Ciudad Juarez, Mexico, where my fiance lives. Jumping back and forth on a daily basis has been hard, but I would do it all over again in a heartbeat if I had to. The day section 3 of DOMA was demolished I was with my fiance. I sat staring at the TV in disbelief. I was scared, excited, happy, and nervous all at the same time. I started working on the I-129F application that same day.

 

I filled out the I-129F application, making sure to fill in every question. Please read through the application's instructions a few times so that you feel comfortable filling it out. I created my 1-129F Cover letter, and our letters of intent to marry from the templates on this website. I only changed one thing on the letter of intent to marry letters, and that was to include that we had every intent to marry within 90 days of entry into the United States in a state where it is lawful. As far as evidence of our relationship, I knew I only had to send 3-5 pictures, but I sent 26. I included pictures documenting the 10 years we have been together. I figured what more evidence can I send to prove we've been together in an ongoing relationship than pictures that document our aging together. I did not send letters or anything more. I am not saying you should not send, every situation is different. I did go to my bank and requested a temp check to pay for the application fee. This way I would be able to see the day USCIS cashed my check.

 

I think I must have checked my package about 50 times before I placed it in an Express Mail package and sealed it. I did not buy a fancy folder, nor did I include fancy cover letters for every section of the package. I made things easy for whomever was going to open the package. I paid for Express Mail to have peace of mind, and to get it their faster. It turned out it wasn't going to be as fast as I wanted. I went to the post office on July 19th, a Friday. The USPS employee told me it would not be delivered Saturday because of course U.S. Government buildings are not open on Saturdays. He did assure me that delivery was guaranteed and they would deliver Monday, July 22nd. Sure enough, I checked on Monday and it had been signed for and delivered. I was not expecting USCIS to send me and NOA1 or even cash my check until maybe a week or two after. I checked my bank app on July 25th in the morning and saw that USCIS had cashed my check. A few hours later I received an email from USCIS stating they had accepted my package, NOA1. I was completely extatic! I know NOA1 is not a big deal, but still this was very exciting for me and my fiance. I did not think I would be getting more notifications until 5 months or so, but on July 30th I got another notification stating that my Alien Registration Number had changed relating to my I-129F, Petition for Fiance. 

 

I know my journey has just started, and I still have a long wait ahead of me, but I hope this information is useful for someone else. I hope people use this forum to also document their same sex K-1 journey. I will continue to update this forum as time progresses. I really do hope I am helping someone else out with this forum. I created my package using the instructions on this website. As evidence I sent about 26 pictures ranging from 2003-2013. I knew I only needed 3-5 pictures of us together, but I figured what more evidence do they need if they can see for themselves that we've been together for 10 years. I did not include anything more. I used all the templates for letters on this website as well. I did make a change to the letter of intent. I made sure the letter of intent said we would marry within 90 days in a state where it is allowed by law.

Hello, I know you must feel as excited and nervous as I feel about this process. I have been with my partner for 10 years and FINALLY will be able to bring her to the U.S.! I have found this website to be extremely helpful. Everyone here is very nice and provide a huge amount of experience and information that will give you a bit of ease of mind. The day DOMA was demolished I wanted to file immediately. I decided to consult with an immigration lawyer about the situation which was a humongous mistake. I walked into his office and within 5-10 I was out the door because he refused to help me. I have taken on this venture on my own with the help of visajourney.com. I followed the websites instructions on what I needed and how to arrange my package. I shipped out my package on 07/19/2013, USCIS received the package on 07/22/2013 and received my NOA1 on 07/25/2013, and received a status update last night indicating that my Alien Registration Number had changed. I am going to document my progress on this website as well, because I think this will be very helpful information for people that are in the same boat as I. I don't think the embassy that you received your email from is very well informed, plus unfortunately we have to deal with ignorant people that simply do not like the fact that we have been awarded rights that we so rightfully deserve and waited for for such a LONG time. As far as your address, just use your parents address and as soon as you have your own you can do a change of address. Happens all the time. I wish you the best of luck on your journey!

What i am just confused about is where to pay the fee for filing the petition? My boyfriend never applied for any visa to someone before and never been out of the USA, it was actually his first time to come in Asia and will be his 2nd time this November but in Hong kong this time but yes with me.. hehehe

I have read in the USCIS that Yes we are now allowed to and my cousin's fiance is a US Consul and according to her, her husband had received a memo about it and it is not allowed. Well, as of 9:15 pm this evening (Oct 30) we officially got electronic notice of our NOA2 (approved!) after submitting our RFE response!!!
 
They acknowledged receipt of our RFE response on Oct 3, so it took them 27 days to approve it... not the best turn around time but we're thrilled we are moving on to the next step!!
 
For those of you who have been asking about whether to revise one letter or two letters of intent (i.e. which state you intend to marry in), I made the decision to just send one (mine, the petitioner). The RFE was addressed to me as the petitioner and asked (me) to declare which state we are marrying in, so I didn't see any reason to re-send both... just gave them what they requested, and finally moving forward again!

We got an RFE for same reason and we sent letters of intent again specifying in what city and state we would marry. They only need the state but I included the city as well. Got NOA2 a few days after they received RFE.

I'm seeing more and more same-sex K-1 applications getting approved really quickly. Based on the last seven same-sex K-1 applications I've seen, the I-129F's were approved in about 60 days (average) from the NOA1 date.

Our petition was just APPROVED! I got the NOA2 email!
AWESOME news! Congratulations! Woo-hoo!
My fiance lives in Georgia, and gay marriage is not legal there, but we did not receive an RFE! YAY!
