I think there's a lot of great advice here. Yes, OP, you could get lucky but the chances are very slim. Lying or "misrepresenting" things is not a good idea. You could get a denial for those reasons, which will make things a LOT more complicated than moving your wedding date OR applying for a CR-1 after your marriage. I wish you the best of luck, but please don't be naive about this and at least consider the advice you've been given. This can and will affect the rest of your life together.

I asked for an extension to prepare requirements for my interview by emailing the consulate (in my case: Vancouver) directly. They advised me that the NOA2 is automatically extended if your interview date falls after the NOA2 expiry date. You should verify this with your consulate though because they may all be different.

There's no "certainty" with immigration. As long as you can prove your current income (letter from employer, current pay stubs) exceeds the poverty guidelines, you shouldn't have a problem.

It's doubtful they would deny you outright for that reason, they would make you get a co-sponsor if they were worried about income.

Your fiancee will need 3 years worth of W2's and proof of income for her interview. Have your employer write a letter stating your position, wage, hours per week. It also helps if they write about your prospects for advancement within the company. I would advise sending some current paystubs as well. As long as you currently make above the poverty level for your household size and you have proof of that, it should be fine.

When you file the I-485 (after marriage), you will need tax returns, proof of income (paystubs), and a letter from your employer doesn't hurt either. We got an RFE to get a letter from my husband's employer and to provide 6 months worth of paystubs.

Be advised that for the I-864 (submitted with the I-485) you need to show that you make 125% of the poverty guidelines for your household size.

I think you could get the vaccinations done anywhere, as long as you provide the proof of vaccination. However, the vaccination has to be verified by a civil surgeon for AOS. Most places I looked into wouldn't verify my vaccines without doing a complete medical (300$+). You could contact civil surgeons near you to see how much they would charge.

1. With our wedding being targeted for March 2014, would January be to early to begin the application process? From what I can work out we would be processes at VSC and I see they have big delays at the moment.

It's really impossible to suggest a time frame. Your petition could be approved in 30 days or it could be approved in 9 months+. It's better to do a legal wedding at the courthouse and THEN plan the big wedding for family and friends. No one here can really answer that with certainty because their processing times vary and so do different cases. You can slow down the process to a certain extent by sending in packages slowly but there's only so much you can do.

2. Let's say we are approved and my visa is issued by the beginning of nov. I know there is a 6 month validity on the K1. Does that mean we have to be married within that 6 month or just that I have to have entered the country?

You must enter the US within 6 months of your visa approval. You must marry your fiance(e) within 90 days of your entry. For example, my visa was approved in October 2011. I entered the US on Feb 18. The expiry date on my visa was April 10. We got married April 13.

3.we are not booking anything until we have the visa, wedding or travel related. Would people who have gone through the process before recommend booking a return flight as they seem to work out cheaper? Also does anyone recommend a removals method from the UK for all my belongings.

You can book whatever flight you want. Obviously cheaper is better. I can't answer the second part.


We filed the petition in February 2011. Petition approved May 30, 2011. Interview/Visa in hand October 2011. Entered the US in Feb 2012. Total time = 1 year.

I would just do the POE with the original address then mail in the Change of Address form within 10 days of your move. It's really not hard, you just fill out 1 page and mail it in.

When I tried filling the Change of Address form online, it won't let you fill in the spaces appropriately for K1 visas. I called the information line and was very rudely told to "JUST PRINT IT OUT!!!!" so if the form still denies you from answering appropriately for a K1 just print it and mail it in.

I missed my flight to the US while I was being interrogated in secondary. Once I was approved to travel, the airline put me on a series of flights that eventually got me to where I was going. I didn't pay anything more. Not exactly the same situation, but I'm assuming most airlines would do something similar if you had a return ticket.

The I-129F asks for both the petitioner and the beneficiary's marital status. If you marked single/divorced when you weren't, you may have some problems.

People have been denied for applying for being a few days from being "free to marry" (even if they are already divorced), so chances are your visa will be denied.

Canadians do not have to submit "proof of eligibility to marry"... I believe that the Phillipines has something called CENOMAR - but someone else can answer that better than I can.

Basically you need to BOTH write letters stating that you are free and willing to marry within 90 days of entering the united states. This is called Letter of Intent. You can find an example here:

Ours said initial review until it said Approved. Relax. It has been taking a lot of people longer than 5 months lately. They won't do much for you unless you're outside normal processing times, which you are not.

Just wait it out. If you can't wait a few more months I doubt your marriage will last. Things are still stressful even when you are together - months of not being able to work, stress of filing AOS and the never-ending wait for that to get approved, not to mention the stresses of everyday life.

 

As others have said, you are close to the end. Generally once your paperwork gets to the consulate you only have a few months left.

I agree with the advice given here. Find someone else or move home and sponsor her yourself. As others have mentioned the I-864 is a legal document, which you will need to have for AOS. If you are having difficulty finding someone for the I134 you will have a more difficult time finding someone for the I-864.

Same thing happened to me. My original documents were not returned to me at the time of my interview at the embassy. They were sealed in the "Do-Not-Open" envelope. I didn't ask for it at POE. After I arrived in the US I filed a Form G-884 to have the documents returned and I got them all back.  Instructions are in the link.

Welcome! My fiance is also from Canada and we filed our K-1 last month... Oh how I remember the "waiting for his passport photos"! Took his 9 days to get here, but I got them and sent off my petition the very next day. :)


9 days, yikes. I just got confirmation from my neighbor that the envelope with the photo just arrived...with a big US Customs sticker on it. LOL So it took 4 days to get here. Guess I shouldn't complain.

I now have another timeline to watch! I'm so glad we have other Canadian to follow.

Also, be sure to change your filing location when you get the first notice of action. It will list where it was forwarded to. Once you change it, you will get a more accurate estimated timeline to expect NOA2. It is confusing because we initially send it to Texas, but this is not where it will be adjudicated. Vermont or California will be the place.


Oh, okay, I was wondering why some said California when I'm instructed to send it to Texas. That makes sense. I live in California so I'm assuming that what they will assign me.

We went to get our passports photos done at Walmart as well. Their photo printer was down, so they just gave us the digital copy and sent us to another store to have them printed. It would probably be faster to have him get a digital copy, email it down, and you take it to the store to be printed.


What was upsetting is that we were done and ready to send the packages. I know a few more days isn't going to make a difference overall but it seems to now. He asked at 3 different drug stores for the digital file (I already confirmed that Costco would print it properly for me) and they all said they couldn't do it. Really??? Very hard to believe and very frustrating, especially with today's technology. Worse case is I'll bring one back with me and we'll send the package then. I just hate to lose a whole week.
