IR-1 / CR-1 Spouse Visa Process & ProceduresCase transfer

Today, we checked our case status on the USCIS website and we found an update that our case was transfered to another service office and it was in California service center. This was the message "On October 3, 2012, we transferred this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to another office for processing because they now have jurisdiction over the case. We sent you a notice of this transfer. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283." But we didn't get anything on our email inbox that explains anything. And i'm sure they have our email address cause we got the notice of receipt on it earlier so please anyone tell me what does this mean that our case was transfered and why we didn't get anything like how they said on the email? And please tell me what I should expect and what I should do for not getting any notice about that on my email.

He is saying that the birth certificate for the beneficiary is not a requirement any more but all of these local offices are using old information to adjudicate the petition and asking for the birth certificate. It is frustrating because it takes time to get the RFE and get the BC and then send it in and wait for them to say yes and approve it.

Ok I understand now. You are right because when you send in your information it never mention BC for spouse at this point in time. Its only ask for USC birth certificate with the I-130.

Adjudicator Martinez is wrong. Thanks for posting the letter.

Apparently West Palm Beach is not using the same adjudicators manual as CSC and VSC.

@#$@$@$@$@#$@%%%$@@@ and @#$ .

But you got to send in what they asked for, regardless.

What do you mean he is wrong. I dont understand what you are talking about.

Aghh!! Is anyone notifying USCIS that they should change the information on their webpage if this is now the case. I am really worried that this is going to happen to me. Did you receive notification of the RFE through email as well (assuming you signed up for electronic notification.)

No I didnt and even my case status online still says initial review. Yes I signed up for email notification. Maybe because its at a local office (i am assuming) you know how that goes when you assume.

Well its simple I got a RFE for my husband birth certificate. Its is being process at a local office. So NBC dont have my case. I will send his BC out tomorrow certified mail. So the VJ timeline is on point. So maybe if I wasnt needed the BC it would have been approved.(my oppinion) It was dated on Dec. 4th. I will be taking care of that first thing in the morning. Thought I would let you all know whats going on.

If you don't send in enough proof that your relationship is genuine they will assume that it is fake or fraud. Its beeter to be over prepared than under prepared where you get a RFE. In the end then that will certainly hold up your case. The burden of proof is on you.

IR-1 / CR-1 Spouse Visa Process & ProceduresJoint Sponsor Question
Both of you need to fill out form I-864 and not I-864A. I-864A would only be needed if your mom and dad combined their own income together to meet the income level requirement. But since they file together that would mean that I-864 is only needed. You need to fill one out too because you is the primary petitioner income or not.

Yes you can get everything ready but dont put a date on it. Have him sign it but you can put the date on it. I have all my husband papers sign by him already and I told him dont put a date on it. DS-230 have him sign the first part but not the second page. (Dont put a date on it)

That wouldnt be a wise decision not to take all that proof with. I advise you to take every piece of photo, chats history, call log, etc. with you. If you dont and they ask you for it then that most certainly going to hold you up and then you will have to get another appointment to bring all those things back with you. So dont play russian roulette with that interview.

Send them in together and make complete identical copy of everything that you send from page 1 through page 1000 or however many pages you got. That duplicate copy will be yours just in case some of the papers some how magically got up and walk away from your file. When ever you get your I-864 package from them.

Hi,

I am collecting all the requirements for the I130 and filing all the documents.

On the I130 application and the G325, Do we put my wifes (beneficiary) maiden name or her married name? You can hyphenate maiden-married name.

All her supporting documents, such as birth certificate, passport, etc, are in her maiden name. Thank you. Yes you can still use them, birth certificate will never have to be change but her passport will eventually need to be change to reflect married name.

So your wife is the petitioner. They probally just want to verify some information that she sent in for you. She must take what info she has to the interview. Its just probally a routine interview to approve the I-130.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhere will i130 go if i file today

Hi Guys,

I am about to submit all my requirements. Just about done, but Im afraid that I am missing just one more, and it wont be ready till Monday. If I submit everything by next week to the Phoenix lock box, by next week, and I am from San diego, California, Will my I130 be forwarded to CSC? Will it be forwarded to some other office? Will it be forwarded to a local office here in San Diego, maybe the sandiego office or the chula vista office? I know there is nothing certain, but maybe you guys know the chances of these things, and I heard as of this moment CSC isnt taking any I130s. And Do you guys know this would affect my timeline?

A small note: My request is a single I130 petition for my wife. (NO I485)You would not need I-485. Because once your wife comes over on CR-1 Visa she would be a conditional resident for two years.

I am also a US citizen.

More power to VJ!

The only thing is for her to get that current police record and give it to them then that would be all. If thats all they want it shouldnt be anymore issues. With no problems.

You need tax transcript from IRS. Its less pages that you have to send in. You only need your house if you are going to use it assets to make you reach the income level. So if you make enough you don't have to use your house.

Employment Letter: You need to collect a proof of current employment or self employment to send with I-864.
IRS transcripts: You can request your tax return transcripts for previous 3 years for free from the IRS. There is no charge for the transcript and you should receive it in 10 business days from your request received at IRS.
Call (800) 829-1040 and follow below steps as per prompt in the recorded message to request tax return transcript. This documents will be mailed to the address where you last filed your tax return.

DS-230: - part 1 and 2 (remember do NOT sign part 2).
