IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 - Income Below Poverty Line
QUOTE (Bobby_Umit @ Aug 8 2009, 09:49 AM) <{POST_SNAPBACK}>
If you can prove your current income is above the poverty level, in addition to the tax transcripts of 2008, and you include assets, you should be good to go doing it yourself.

(btw - it's 3x for spouses)

But your current income should be sufficient. I would also include 2006/2007 to show you have a history of steady income

Thanks for help bobby

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 - Income Below Poverty Line
Hello everybody,
This is my first post ever, please excuse if I am not clear on things.

I need to file I-864 for my spouse for IR-1, but my income for 2008 is less then poverty line (Around $8000.00 short). I only worked 6 months in 2008 and stayed 6 months with my wife. My income in this year is good enough and above poverty line.

I have enough assets to cover the difference ($8000*5).

My sister living in same house, her income is above poverty line (above enough to cover all 3 of us) but we file seperate Tax Returns.

Please tell me if it is better to use my Assets or Family member income.

Which one gets approved easily. I dont want to delay things with NYC.

Thanks

Yes but you CAN get notorized copies and that is good. Right? that would certify as it is a true copy.

I dont think they accept Notorized copies. They only want original or certified copies. Certified Copies are same as original, they are issued by same authority who issued originals.

Waivers (I-601 and I-212) and Administrative Processes (221g)2nd 129F Petition

Strange - he couldn't cancel the "petition" - as it wasn't his to cancel. The only thing he could do is remove his application for the visa.

From where your coming from - I have seen AP waits that long. You will just have to wait and see.

I did a poor job explaining -- at the CO suggestion he wrote an email to USCIS saying the realtionship had ended, and he added that the petition should be 'cancelled'. (his words) This happened after it was revoked at the embassy so if USCIS cared about what he wrote or not I do not know. I am just fishing in the dark for why we are still in AP... but I suppose it is just because he is a young Pakistani male and sometimes it just takes a long time.

Thank you for your reply

Waivers (I-601 and I-212) and Administrative Processes (221g)2nd 129F Petition
Hello All,

I am the 2nd person to Petition for my fiance'. Two years before me he had been the beneficiary of another woman that abandoned their relationship. However my fiance' did not notify anyone and went to his interview very unprepared to see what it was like and if there was still any chance of getting to the USA. He answered the CO honestlty about the failed relationship and the petition was revoked for lack of evidence of an ongoing relationship. At the CO's suggestion he wrote to USCIS to 'cancel' the petition.

Since this is his 2nd time I imagine that doesn't look good for us. We have been in AP almost 16 months which seems longer than normal. I understand each case is unique but I am wondering if there are others that have a similar experience and if they also had a long wait on AP.

Are we just unlucky or are we under heavier scrutany because it is his 2nd time?

Asia: SouthI have some questions regarding getting married
Jenn, I can't say that I have seen all of your posts but I have read a few. Getting a visa to Pakistan from US is very easy. Getting married in Pakistan would also be easy if that is what you choose to do. And since you have already met in person with your fiance' you could also start your paperwork for a K1 now if you are not going to choose to marry now. I have been engaged to my Pakistani finace' since July of 2008, and our K1 visa petition was approved in August of 2008, been in AP since Dec 2008. Each case is different, I know, but the likelihood that a Pakistani male will be in Administrative processing for a year or more is great. Don't waste time.. if you two are committed get your process started ASAP. K1 or K3, if he is a straight up guy there is nothing to fear... he will get here eventually.

US Embassy and Consulate DiscussionAdministrative Processing
My experience was once we reached the Administrative Processing (after the interview at the Embassy in Islamabad) the Officer told my Fiance' that they had everything they needed. So during this time we were not concerned that something might be missing. I have been waiting for my Fiance' in AP for 2 years... but I have seen that women's AP is much shorter. Even our 2 years seems excessive compared to others. It is extremely frustrating to not be able to get answers during AP. But the more you dig into it and the more you try to get answers the more you will be frustrated. I feel like I tried so much and got no where, emails, letters, phone calls, using my Congressman... and I am sure others before me have also tried "everything". Just keep checking periodically, but don't obsess... it will just frustrate you more.

Hello everyone.

i filed a petition to bring my fiance from pakistan to california in mid july of last year. my family and i are working with an immigration lawyer as well.

Here is what has happened:
-all the necessary paperwork were filled out and were sent to the islamabad embassy.
-The petition was approved on dec 31, 2008...he (my fiance) then got a packet in the mail with info he needs to fill out and return to the embassy in order to get an interview. Again, our lawyer filled it out and sent it.
-He got the interview date on may 4th, 2009.
-The agent said that he needed to turn in a police report and to fill out the ds forms again b/c the ones that the lawyer sent did not have the barcodes on them.
-He filled out the forms and turned in the police clearance/report on may 23 and got confirmation that the embassy got them on may 25. they kept his passport and have it until this day.

we havent heard from the embassy since may25th. we were tolled by our lawyer that it takes about a month to process everything. it has now been OVER two months and still havent heard anything. I called the Washington DC office about 2-3 weeks ago to get the status and the lady said Administrative processing.

What is taking sooo long? i knwo people from the same country whose fiance has came from within 6 months of filling the petition, without a lawyer. We are paying a lot of money for them to help us, but looks like it isnt doing any good.

i have called the lawyer and basically was frustrated. He said it is weird it is taking so long but if there was an issue they would not have still have his passport.

i am going to call the DC office again tomorrow and see whats up. its pissing me off.

please help me...im going nuts.

Let's try that again....
I am also waiting for a fiance' from Pakistan. Our petition was approved on Aug 08, Interviewed in Dec 08 and placed in AP since. All beginnings of the proces went very well, now just waiting in AP for 9 months. His brother who had come to the USA on a K1 visa in Feb 08 was only in AP for 6 weeks. There is no way to know how long it will take or anyway to make it go faster. Be patient and enjoy the life you have now while waiting for him. Getting obsessed with the timing of AP can really make for some miserable days, weeks, months.

My fiance' interviewed in Islamabad in Dec 08. We have been in AP ever since. Almost hitting the 9 month marker. His brother had his interview in Dec 07 and was out of AP in 6 weeks. I don't try to figure it out any more. We just do the most we can for each other from this distance and pray that it will end soon. My advice is just make the most you can out of each day and do not obsess about it. (you'll just be frustrated)

K-1 Fiance(e) Visa Case Filing and Progress ReportsAre you still engaged phone call?
My fiance and I have been waiting in AP for 15 months and this week he received a phone call from the Islamabad embassy to verify he is still engaged and waiting on a Visa. The few questions he tried to ask in return the caller had no information to offer him. We haven't heard anything except 'your on AP will let you know when your not' since it all began. So this phone call seems like really good news, but before I start bouncing off the walls with excitment I thought I would ask if any others have had similar experiences and if your phone call to turn in your passport for the visa came soon after. Please reply if you have had a similar experience as mine from Islamabad.

Thank you!

IR-1 / CR-1 Spouse Visa Process & ProceduresWHO SHOULD REALLY BE PUT ON AP
I do agree that racial profiling is in "theory" not correct, but unfortunaly that is the world we live in today. Threats and bad people can come from anywhere, and I agree that using basic intel to isolate areas where these threats are most prevalent is used in every aspect of todays world. A cop does not sit on a dead end street hoping to catch speeders nor troll the retirement homes looking for cocaine dealers... They go to busy streets for speeders and bad neighborhoods for dealers... Same concept. Sucks for those good people caught up in it, but a necessary step...

I APPRECIATED THIS EXAMPLE.. I THINK IT WAS VERY WELL PUT... SO THANK YOU. I AM WAITING IN AP FOR MY FIANCE AND I HAVE ALWAYS UNDERSTOOD ITS BENEFITS TO KEEPING ALL US CITIZENS SAFE... BUT I DO BELIEVE IT COULD BE DONE MORE EFFICIENTLY. I AM ON MY 11TH MONTH WAITING AND IT FEELS ABOUT 5 MONTHS TOO LONG.

you can email pakivquery@state.gov or you can call the State Department at 202-663-1225. In both cases you will most likely be told that your case is currently under administrative processing and you will be contacted when it is completed. That is what I have been told anyway. My fiance was interviewed in Islamabad in Dec 08. AP truly has no limits. My future brother-in-law was completed 6 weeks after his interview and we are still waiting. The good and bad news is that he can be called to return his passport for the visa any day... or not.

K-1 Fiance(e) Visa Process & Procedures2nd K1 Petition
I am the 2nd woman to submit a K1 Petition for my Pakistani Fiance'. The first woman had a change of heart and they went there seperatee ways. Two years later we find each other and get engaged. We are in our 21st month of Administration Processing. I realize from the many threads I have read that a long AP from Pakistan is not unusual. But I am wondering if this being his 2nd time as a benefactor will cause this process to take even longer for us. My questions are: Is there anyone that was also the 2nd Petitioner and did you experience a lengthy wait in AP? - and - if there are many people out there that have been in AP since 2008 like us? (I would feel better to know this is "normal")

Thank you for your time!

K-1 Fiance(e) Visa Process & ProceduresWe will call the applicant in a few days

wow that is just sick of them to do that. i was comparing the time frame our paki male here in visajourney were under AP. the minimum was from 2 weeks upto 8 months. i'm here thinking that by April we'll hear something. 2 yrs is alotttttttttt. i dont know how u dealt with that. you tried contacting ur congress person or perhaps the senator while you were in AP????

After about 10 months I wrote to my Congressman. His staff wrote to the State Department and to the Embassy. They would follow up with me every 8 weeks and continue to check on any progress. So from the Congressman I was very happy with his staffs efforts on our behalf. It was actually a Congressional Liason back in October that sent an email saying we should hear in 15 days. When that didn't happen I asked the congressmans staff to ask again. This time her reply was congratulations he is approved. This is when I started writing to the embassy again and being told "a few days". Maybe the Holidays is what made the "few days" turn into 37 so far. Two years IS way too long, and I never went back to see him because we always thought we must be close, only a few more weeks.. save the money for when he comes. No matter where we are in this process; God willing I will see him soon. Tickets are purchased and bags are packed.

K-1 Fiance(e) Visa Process & ProceduresWe will call the applicant in a few days

i've seen people here getting emails from embassy like that. were u under administrative processing or something/??

We were under AP for two years. Now both the State Department and Embassy say we are no longer under AP but no Visa has been issued so we need to wait. So I asked for an appointment at the Embassy because I am going there soon. This is when they said please wait a few days the applicant will be called. A month later I asked again about appointment because no call came. They again asked that we wait a few days applicant will be called. It seems that a few embassy 'days' is really a few months.

K-1 Fiance(e) Visa Process & ProceduresVisa Approved Letter
To help keep anyone reading this who may have a similar experience, I'll add this... Since my email back from the State Department that my fiances visa was approved we have written to the Embassy twice. On November 22nd they wrote back saying he would be called in a few days. On Dec 22nd I wrote to them again, and once again they replied he will be called in a few days. As of this post the few days are 35 and counting. (but lots of Holidays getting in the way of things I think)

K-1 Fiance(e) Visa Process & ProceduresVisa Approved Letter
I have enlisted the help from my cogressman for a little over a year. Every 45 days they would inquire with either the Embassy or the State Department on the status of our K1 pettition. Last month 10/2010 we received a letter from a Congressional Liaison at the State Department that said like all the rest that our case is under going AP, a necessary step...blah blah blah. It concluded with if the petitioner has not heard anything in 15 business days feel free to contact me again. (This was new) So after 5 weeks, (I didn't want to be too pushy) we did ask again about our status. So in 11/2010 the same Cogressional Liaison sent a letter saying "I am pleased to inform you that the Visa for (fiance's name) has been approved. If the Embassy hasn't contacted him than he should contact them for further instructions on the issuence of the Visa. (All sounds great... right?) So I call the State Department the next day to inquire about our status and the woman that answers said our status is unchanged, still on AP, yes we are approved... he was approved after the interview back in 12/2008 and there is nothing in my file showing a Congressional Liaison (who also work for the State Dept.) was poking around in our case. My Fiance' and I sent an email off to the Embassy to try and confirm if our case has moved out of AP, but because of the Holiday there was no response back. (and sometimes they don't respond anyway)

Has anyone else been through or heard of a similar circumstance? I was excited and beside myself after reading the letter but was quickly grounded by the woman I spoke to at the State Dept.

K-1 Fiance(e) Visa Process & ProceduresStarting Over from another Country

Have you contacted your representative (like about three years ago?) You will have to cancel the K-1 and start from scratch, this includes any AP. It doesn't matter where he is living when you file or where he interviews he will have AP based upon the country he is a native/lived in for a number of years.
Much better solution would be to get your representative working on this for you and finding out what the heck is going on with your case. Four years is WAY too long to wait.

My Congressmans office sent letters to the Embassy and State Department for 2.5 years and then called me and said it isn't going anywhere maybe you should get married or something. My Senator recieved the standard they are in AP an intrical and necessary part..blah blah blah. And has yet to respond to my last plea for assistance in April. I emailed Senator number 2 today.

K-1 Fiance(e) Visa Process & ProceduresStarting Over from another Country
In July of 2008 I filed a K1 petition for my fiance. We have been waiting in AP for almost 4 years (Islamabad Embassy) and really are feeling like there is no end in site. We are very tired of waiting and can't stand doing nothing. He plans to go to school in Europe so we can see each other more oftenly and in a safer more free environment. I was wondering if I married him in Europe; we of course would have to start over with a new petition for him as my husband, but how does it work when we reapply? Since he is living in Europe would our case go there for the interview etc.? Would it still go to Islamabad because he is a Paki citizen? Do we mention the 4 years we have already been waiting or will the cases somehow be linked together? It's obvious that the case officer doesn't like something about us so will that follow us or will our case be made stronger by getting married? It is a very scary thing to "start over" after such a long time. But after so many years thinking "maybe they will call tomorrow or next month" we are giving up on the call ever coming and want to do something to move forward and be together. I never imagined we would both have to leave our homes to be together. I would appreciate any information if available on how it works when you reapply form another country. Thanks.

We are hoping my finace will be accepted at a European University and we can marry in Europe and start again. Hopefully our case will be handled by the Embassy of the country he is residing. (we don't want to marry in Pakistan and have our small wedding etc. questioned) We can only pray that AP will not be so long and whatever the reason the case officer could not make a decision before their doubts can be cleared up with our marriage and new petition.

Any of the government officials (Congressman and Senators) that helped me were all met with the same response as me. That we are in AP but of course their response was more polite and formal. I actually have one letter from the Embassy where they tell the Congressman that our case did not fall through the cracks and we were not forgotten.

June 25, 2012, 1302 days in AP, my fiance received a brief letter from the Islamabad Embassy along with his passport saying that our I129F visa petition had expired and was being returned to the USCIS office from which it was originally submitted. I have never heard of a petition expiring and thought that the Embassy would have to make some kind of decision. I thought I'd share in case it is new to anyone else or will be helpful to anyone in the future. We were also told that this can not be appealed (because there was no decision) we will have to reapply.

17. How long have you know your friend? Since what year?
18. How come your fiancé didn’t petition for your friend? (the consular mistaken that my fiancée’s friend is still in Vietnam, my fiancée clarified with the consular)

National Visa Center (Dept of State)How to arrange originals and copies for the interview?
I have a question for those with fiancée interviewed at Ho Chi Minh Embassy regarding arranging documents you turned in to the consulate. My fiancée interview is in two weeks. My question is how did you arrange the originals and copies of the documents were requested by the consulate? Did you put the original in front of the copy and put in the order listed on the instruction or you put the original in another folder and the copies in the order with the other documents. Thanks
