US Embassy and Consulate DiscussionMy Dilema
To my VJ friends,

Wow! Thank God things sometimes just work out when your just at your breaking point. I found a job!! and starting this coming Monday and like I said before thank God! it came just at the right time. My fiancee rec'd packet 3 and faxed back forms DS-2100 and the DS-230 just this week and she received acknowledgment from the embassy. That's one less burden.. Thanks to all for your replies and well wishes and i just wanted to give an update. I have another question that would like to get some feedback on , but I'll start a new post, since it's a different topic..

US Embassy and Consulate DiscussionMy Dilema

Just remember that the decision is made solely by the CO at the time of interview. There have been cases when co-sponsors with sufficient income were denied, just as cases when sponsors with sufficient income were denied. The biggest deciding factor seems to be stability (or rather, credibility) - can you support yourself - and THEN however many additional people? Do you have, at least, some skills/education to make a living?

People sweat the income requirement unnecessarily in alot of circumstances. Much like you said, $18,500 for 2 people shouldn't be TOO hard to find if you want it enough. As low as $8.90/hour x 40 hours/week x 52 weeks/year will earn above what is regarded as the requirement.

Thanks M+P you made me feel a little better! I definitely should be able to prove my credibility(lets just say I've been around the block more than a couple of times now)and I happen to be in a field (Telecommunicatons) that is always growing, own a home and have already raised 2 kids of my own, but I definitely think the more you have in place for the CO to see, the less chance of him/her to say "sorry".... Thanks again and much appreciated!

Just throwing my two cents in here...

We went through something similar - our co-sponsor had lost her job right before we were going to send everything off and whilst we had appropriate bank statements, a letter from her employer, pay stubs - everything, really, and at the time - it was true and all that... we simply sought a new co-sponsor where there would be no questions.

My suggestion;
1) co-sponsor or
2) get any job in the mean time... assuming you don't have dependents, etc. I shouldn't think that the nearly $19k income thing is too difficult to meet?

Kristin,

Thank you for your input and yes if that is the criteria it definitely shouldn't be to hard to meet especially in my field of expertise. I honestly can't remember in over 20 years not having a job, but of course this would occur just in the midst of this process. Just one more thing to stress about! I'm just trying to get as much info as possible, just in case something doesn't go my way. Thanks again for your input and good luck in your journey as well..

Sorry to hear about that, I'd be stressing too. Either get a new job as quick as possible, save up a few months of paystubs and see how it goes at the interview - or get a co-sponsor (probably your safest bet). Good luck to you!

Thanks M+P for the reply and the best wishes! Yeah I'm really hoping to find something soon, but I guess having a co-sponser would be a good back up just in case. Thanks again and good luck to you both on your venture. This site really has a lot of good info and being able to reach out to the other members is awesome.. It's a shame we have to go through all of this just to be with the one's we love, but who said the journey of life was every suppose to be easy? :) Thanks again..

US Embassy and Consulate DiscussionMy Dilema
Hi Friends,

I have a dilema that hopefully someone has gone through before and can just educate me on what I can expect. I just received an email stating that my approved NOA2 is being mailed out to me. While I am very excited about that, I am also very nervous because I recently was laid off from my job due to no fault of mine, but it still means am out of work. I am actively looking for employment and I feel confident that I should find something soon (hopefully), but is there anyone that has had a similar situation and wouldn't mind sharing their experience with me. A couple of months before I was laid off my previous manager did give me a letter of employment, but unfortunately I do not have pay stubs for the last 2 months, so I don't how that would work out anyway. I am currently receiving unemployment and I have money saved up, but I'm thinking it's definitely not a good scenario at this point. Any input would be greatly appreciated. Thanking all in advance..

Sincerely,

A little stressed

K-1 Fiance(e) Visa Case Filing and Progress ReportsFiling Fee for K2 child?
Thanks Galenjr! Yeah it's all worth it if they say "Yes" at the interview :), but I would hate to hear the words "No" that day.. I appreciate your reply and was also told the same by someone else, so if that's what it takes then that's what I got to do! Take it easy and thanks for the well wishes.

K-1 Fiance(e) Visa Case Filing and Progress ReportsFiling Fee for K2 child?
Hi VJ friends,

Can someone tell me if there is a separate fee that has to be paid for the application for my fiancee's 5 year old son even though he was included in the original petition to accompany her? We are now awaiting packet 4 and have a scheduled date, but when my fiancee went to prepay for the visa at the bank (Colombia)the person she was dealing with told her we have to pay for him too.. I have been looking at different sites and I'm little confused and would love if someone who already went through this could shine some light on this for me. Thanks in advance for all help!

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding father of my fiancee's son
Kuhio,

Sorry I hit the enter button by accident before I was done with the post in it's entirety..

Your scenario is exactly like mine except for the fact that the father did spend one year with his son when he was still together with my fiancee. We have also just last week sent back packet 3 and awaiting an interview date. I was just recently in Colombia with my fiancee and we went to the Family & Children services there and spoke with one of their representative and was told basically the same scenario that has to be done in order to have her son leave the country with her. What a pain in the butt this part is. Here is a father that doesn't provide support and like I said is probably in jail and you would think especially in your case where he was charged with rape, that the court system would grant sole custody to the mother without getting any permision from him! Oh well I guess that's how things work. This week we are going to try very diligently to locate him and hopefully he is willing to give her permission to take her son. If not, I'll be starting a whole topic! I'll be crossing my fingers and praying hard... Thank you so much for sharing your experience with me. It was very helpful information and we appreciate very much... Good luck at the interview and hopefully all goes well from this point on.. Thanks again

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding father of my fiancee's son
No, we are in the process of trying to locate his whereabouts. We're thinking he might be in the slammer!, so I guess we need to figure that out and then have the document sent to wherever he is and according to what I have read, my fiancee would then have to go along with a lawyer to a notary and she would then sign it. Also she was never married to him. Thank you very much for your reply and we appreciate the input.

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding father of my fiancee's son
Jenny & Danny,
Thanks fo your reply.. Were you able to bring her son also at this time or will he be following at a later date? Just curious to see if you were able to why wasn't it necessary to obtain the permission from the father allowing the child to leave? Thanks

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding father of my fiancee's son
Thanks for your reply Bobby+Umit! Yeah that's also the next problem because we may need to get his approval to have her son leave with her if all goes well. I read under the Colombian law that it's possible if he has not provided support for his son (which he hasn't)and was in jail for over a year or more, that it's possible that she can try to get sole custody. I believe however that could be a long process. Hopefully if his whereabouts are unknown or if he happens to be still in jail that will be a plus for us. I think we might have to acquire a lawyer down there to see if he can be located and if so hopefully he can sign a permission form to let his son leave with his mother. I'll be crossing my finger as this could be a showstopper.. Thanks again your reply is much appreciated.

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding father of my fiancee's son
Hello VJ friends,

My fiancee wanted me to reach out to the community hear to see if anyone had first hand knowledge or is aware of any issues that could pop up if the father of her child was incarcerated in the past and could possibly be in jail at this time. She has not had contact with him in over 4 years, but is just a little nervous that at the interview if they ask about him and she tells them the last she remembers he was in jail that it could possibly effect their decision at the interview. I can't see why they would tie his past with hers if she was not involved in the crime committed and also they were never married. If someone has any information that they could share in regards to this issue. My fiancee and I would both appreciate it. Thank you all in advance.

K-1 Fiance(e) Visa Process & ProceduresQuestion about children included in K1 visa
Thanks to you both Galenjr and Dan for the information. I was kind of worried that could have prevented the visa approval. We finally found out the child's father is in jail currently, so we now have to try and get him to sign the release and i'm not sure how that's going to go, but at least now we can still go to the interview at end of this month and hopefully things will work out well. Thank you

K-1 Fiance(e) Visa Process & ProceduresQuestion about children included in K1 visa
I wanted to join in this discussion as I too am in the process of bringing my K-1 fiancee along with her child to the US. What all the other members are saying is true, but what I would like to know is if the child will be following at a later date, Is the permission letter still needed at the time of the interview or can we get that at the time when the child is ready to come? The letter is solely for the need to travel as I believe, so if we do not have it at the time of the interview does anyone think they would deny my fiancee's visa?
