I lived in both Australia and New Zealand for over a year each and had to get Police Certificates for both countries. (I am originally a NZ citizen)

 

I got the fingerprint checked version for Australia - I made an appt and went down to Scotland Yard to have my fingerprints taken (which cost £70) completed the application on-line, printed it out with required ID copies and mailed it down to Canberra with a begging cover letter to please process as quickly as possible. They sent it back in about 3-4 weeks iir, it probably took a week to get there, 2 weeks for them to process it and a week to be mailed back to London.

 

I wasn't actually sure if I needed the fingerprint checked version but I didn't want to show up and be told otherwise so I got it to remove all doubt. They accepted it with no probs so I guess it was the right one!

 

You can pay for it with a UK credit card, no need for a Australian dollar bank draft.

I waited to be given an interview while in the US and returned for the scheduled date. Had no issues at POE and was not asked about pending i-129f or anything. (I went in saying we were staying for 3 weeks, it turned out to be 5)

I am would just like to add to this thread that I sucessfully visited my Fiance three times after he filed, once on my own entering via Newark and twice with my two children (included on the petition) entering via Houston, TX. Visits were 2 and 4 mths apart. I did not carry any evidence of ties with the UK (am not currently employed) and the last trip was in order to start my kids at school on time while waiting for our K-1 interview to be scheduled in London. I/we travelled on the VWP program and perhaps I/we simply don't have a profile that is typical in terms of any suspicious or adverse intent (I am in my 40's) but we encountered no issues at Immigration or additional questioning.

 

K1 visas were Approved in London earlier this week and we're now just waiting for the return of our passports.

The first thing you'll need to do is apply for a visitor's visa to the US.  Apply several times, for you alone, with evidence of arrangements to leave your son with someone during your trips, evidence of your job, etc, proving ties back to Philippines.  You are likely to be refused, but if he can't travel, then you must try.  If he can go as far as Canada or Mexico but not on a plane, apply for visitor's visas to those countries as well.  Keep documentation of rejections.

THEN you can apply for a waiver, but not before then, unfortunately.  You have to prove that there is no way for you to meet in person to get that waiver.

Always, always use her name just like it says in her travel passport. That's where the visa is going to go. If you read up on it that is what you will find. 

So use the English letters. 

 

In the section where it says "If your fiance's native alphabet uses other than Roman letters, write his or her name and address abroad in native the native alphabet"

 

In this section you should write her info in Japanese. If you can't do it on the online form than print it and write it in with a black pen, it is ok to do so. 

Speaking as someone who took some Japanese in school and wasn't very good at it, if you don't know any kanji, practice a few times with her kanji name and send pictures back until she says you get it right, before you write it on the form.  A single line out of place can change the whole meaning of a character in kanji and you don't want to accidentally say her name is something completely different.

People here seem to be obsessed with saying 'be grateful, it could be worse.' Don't worry, people will always be like that. This process stresses everyone out and makes everyone snippy.

There isn't a single person here who doesn't know that this process sucks for everyone. Whether it takes six months or twenty years (for some of the sibling categories), everyone here is aching to feel normal, for the time to pass faster, for the process to be something we can actually see passing. For me, that's the insult to the injury. You're waiting, waiting, but there's no progress bar. No notification that anything is moving forward. You just have to trust that your file hasn't fallen behind someone's desk and been lost.

You're just waiting for real life to begin.

For me, I've started ordering things I'll need for my real life, things that aren't worth moving (my move is further than yours, I'd imagine you can bring all your stuff). My wife and I stalk sales, watching for good deals online and snapping them up. We've got all the things my cat will need, sitting in her closet, except for the food.

We're planning several home improvement projects for the time period where I'm newly there and waiting for my ssn to be available, so I won't be able to job hunt yet and even for the days when job hunting is too depressing.

I'm planning out new decor for some parts of the apartment. I'm planning cat boardwalks to have near the ceiling all over the place.

Mostly, it's just planning. I'm terrible at blogging. I start them and wander off. We spend a lot of time talking about next steps. I've got nearly all my paperwork ready for the next stage.

You need to call the NVC and talk to them.  You probably can get it moved, but you should call them now and ask for this to happen, giving them the date that your wife needs to leave Canada.

If I'm reading this right, your wife is Indian, in Canada on a visa that is set to expire at the end of November and you are concerned that she will have to leave Canada before her interview in Montreal?

This is an unusual situation.  If her visa cannot be extended in Canada (and without knowing what visa she's on, I have no idea if it can be), I would suggest that you call NVC and ask them what they suggest.  It is very, very unlikely that she will be getting her interview before the end of November at this point.  

Call NVC, explain the situation and ask what they can do.  The case may be able to be rerouted to India at this point without trouble.

Planning to get married with a tourist visa before he stepped the foot on the US soil is considered a fraud.

Getting married in the US with a tourist visa and having had plans to do so is NOT fraud.

Getting married in the US with a tourist visa and STAYING in the US afterwards, and having planned to do so IS fraud.

Your legal options are thus, djgirl: 

Option 1) You can apply for a K-1 Visa and adjust his status to CR-1 after the wedding.  You must get married within 90 days of activating a K-1.

Option 2) Get married in the US on his tourist visa.  He RETURNS TO HIS COUNTRY and you file for a CR-1.  He must wait IN HIS COUNTRY for the CR-1 (or in another country that is NOT the United States).

Those are your only two options.  Marrying on a tourist visa and him staying in the US is not an option if you plan to do it.  You cannot plan that and do it legally.  And they check for ANY trace that you might have planned it.  So don't commit fraud.

As the others say, you'll be fine with the evidence you've submitted. Most of us have done this entire process without a lawyer (RFE's or not) and you really don't need one - for this kind of visa there is nothing they can do that you can't do yourself, they cannot expedite, they do not have any fast track channels into USCIS, any forms they will out will be dealt with in the same order as everybody elses. Its not going to ruin everything. My fiance was made redundant while we were waiting for NOA2. He got a new job about a month later and we used a letter from his new employer verifying that he was employed by them and his salary and the last 3 payslips at his new job to support the i-134 that i took to the interview.

 

Worst case scenario is that she is still unemployed when it comes to submitting the i-134 in which case she may need to get a co-sponsor or you could look at self-sponsoring as mentioned as London is one of the Embassies that does allow this. For the latter you need to show that you have means - a bank account with a savings*, I know one person around the same time as me just showed proof that he'd sold his house and was due to get x amount from the proceeds of the sale.

 

*How much in savings? Search VJ or ask again in the UK forum, I can't remember the amounts others have said but it wasn't enormous iir

Write in this Cover letter something along the lines of 'Please find enclosed form DS1-160 indicating my readiness for interview. I completed my medical on xxx date. I am travelling out of the country to visit my fiancee for 2 weeks between x & y dates so I would like to request that my interview be scheduled not before x date and as soon as possible after y date. We are planning to get married in the US on z date in August, 2014. Thank you very much, etc.'

London Embassy are really good at trying to accommodate requests - they do what they can and they will work within or around dates you give them IF YOU ASK nicely.

 

Do your medical

Submit your readiness form, tell them the dates you're away and ask for an interview date after your return

I have read on here of people entering with a K1 visa in their passport and NOT USING IT by explaining that they are returning for their wedding at a later date and entering instead temporarily on the VWP (Visa Waiver Program).

 

In your situation I would submit the DS-160 NOW, with a cover letter saying that you are travelling outside the UK during the dates x & y in June and to please schedule your interview immediately after your return in mid-June.

 

If you want until mid-June after you get back to submit the DS-160 you may not get an appt until early August (4-6 weeks from submission of DS-160)  which leaves you biting your fingernails hoping to get your interview and passport back in August just before you're due to get married. Remember that things slow down at the Embassy over the Summer due to vacations and get very busy as well in August due to students needing visa's to start school in Sept.

 

Submit the DS-160 now and ask for the appointment to be schedule for after you get back from your holiday and you're covered.

 

Just a thought, i would also plan on doing your medical before you go to the US in June. London will not schedule an interview appt until they have your Medical so you should complete that sooner rather than later.

Baron555: I have travelled to the US three times since we started the K1 process last year and have had no problem getting through immigration, so was hoping it would be the same in June and thereafter complete the interviews in London once i returned.

 

As far as I can tell from the replies I have received, I will hold off on completing the DS160 in June.

My Fiancee is Japanese and we are getting closer to our interview at the US Embassy in Tokyo for our K-1 Fiance Visa. 

She lived in New Zealand for over 6 months when she was 17. She will be needing a Police Report from her time spent in NZ. I've read some forums on here and visited the Embassy websites and seem to be getting mixed information. 

The US Embassy website says she can get it by mail from the Ministry of Justice in NZ. However, there were several cases on here where it seems that police report is not accepted. It appears we will need to get a form for her at the US Embassy in Tokyo. They will send it to NZ's US Embassy, which will forward it to the NZ Police Headquarters and then it will get forwarded back to the US Embassy in Tokyo. 

 

Does anyone have any recent experience doing this? Any info would be much appreciated, thanks!!

This is exactly correct.

 

I had to do the same thing last August via the US Embassy in London. I sent the request form with a cover letter to them when I completed my DS-160. They obtained the Police Certificate between then and my interview (6 weeks). When I got to my interview it was there in my file. I never got to see it.

You would need a joint sponsor i.e. a parent to provide the financial support. Can you ask a parent or other family member with sufficient income to do this? It means they have to fill out the financial support form that goes with the petition and include evidence proving their income / assets etc.

We did not use an attorney, and we were relatively complicated, both divorced, I brought my two kids with me, and i've lived and worked in 3 other countries previously (including the US). Aside from the initial Petition which my husband did I, as the beneficiary most of the rest of the work, filling out all the forms required by the embassy, ordering police reports, getting the medicals done, etc etc. If both of you can understand how to fill out a form (and all the answers to do it  are available here) and how to gather all the documentation to support it then you certainly do not need a lawyer.

the only possible thing i can think of is....not including ever single page of 2 of my divorce decrees. the i129 instructions say "proof" of divorce. i sent in the page where it said i was divorced, the date, and the judges signature. i did this for both divorces. that should be enough proof, obviously i was divorced or i couldnt have remarried!

 

It might be this as the others said. My husband's divorce agreement is 40 pages long and he photocopied every single page. It seemed like total overkill to give them every page but I guess its what they want. GL

It was quite clear. However, perhaps you missed the part where some people do send copies and they are accepted, but others were not so lucky using copies and received an RFE for original signatures. Just because yours and some others had their copies accepted does not mean everyone will have theirs accepted with no problems.

 

 

I think getting the letter of intent notarized when using a copy is your best bet in having it accepted, since a notary verifies it was indeed you signing it.

 

The G-325A is the one that can be signed at the interview, not the letter of intent. So, if you are sending the letter of intent with original signature and the passport photo, then you might as well just sign the G-325A too. The mail system is ####### in Mexico too, so my husband just paid the higher price for overnight mail to get the documents to me. Most people go that route and pay to mail the required documents. It is not that big of an expense or added extra time in the grand scheme of the expense and waiting times you will have with the immigration process.

I was successful using a signed, scanned, emailed copy of the document, which in this day and age is an entirely normal way to complete documents. However apparently some others were not successful and received an RFE.

 

Given the OP's circumstances and due to the time delay and expense I would do what I did, and take the risk, such that it is (minor, imo). I would get the actual signed document mailed over normally as back up and use it in the unlikely case of an RFE. Its the fastest way forward but entirely up to the Petitioner.

My signed, scanned, emailed documents were accepted with no problems. I signed in blue ink and my husband printed them out in color so you could see the difference in ink color if the appearance of any original signature is important.... Either way, it was accepted. $120 is not an insignificant amount to be sending a few pages of paper around the world.

I've been reading about what vaccinations are required for K1 (although I know these are just required for AOS) and have seen a few different lists floating around. I was checking the London Embassy site and it states that Hep. B vaccination is required "through 18 years of age." Since my fiancé is 26, does he still need to get it? I saw another post on this but didn't get a concrete answer. It's going to cost 75 pounds so if he doesn't need it, we'd rather not spend the money. Thanks!! 

 

 

 

 

Hi, he is not required to have a hep b vaccination as he is over 18.

 

My children did though, as a school attendance requirement here in TX.

it depends entirely on the Embassy you will interview at. The US Embassy in London does not require any further evidence. They don't ask for it, you can take it along but they won't ask to see it so save the some trees and just take they documentation they ask for.

 

Look at the reviews of the Embassy you're going through as sweet cakes advises, this will tell you what you're likely to experience.

So I have a bit of a problem. Basically I was studying in the states from 2007 until 2011 with a f1 visa. During that time I was still resident in Austria (I am Austrian) when I came back from the States I moved to London for 5 months and then went to the states in a visitor visa for all together 7 months (I had no overstay I left after 3 months and came back and so on) after all that I moved back to Austria. My question now is that for that one year I can't get my records from Austria because I didn't officially live there problem is though that I don't have no proof that I stayed in London either. I did rent an apartment but I don't have no receipts or contract anymore. I know this all sounds confusing, I'm just trying to figure out what to do concerning this one year gap in my criminal records from Austria plus do u I need records from when I lived in the US as well?

Maybe somebody can shed some light on this. Would be more than thankful!

 

 

You only need police certificates for countries you have lived in for more than 12 mths after the age of 16. This does not include the USA, USCIS can obtain these records on their own.

 

You don't need one from the UK if you only lived there for 5 mths.

 

Don't worry about the 'gap' for Austria (or any countries), the police certificate is not required to track where you are living, it is required as disclosure for if you have committed any crimes, in any of the countries you have lived in for any significant amount of time.

 

My example: I am from NZ, and lived there until the age of 21. I subsequently lived in the USA, Australia, and the UK for more than a year each time. There is an 18 mth gap inbetween the USA and Australia when i went travelling and wasn't resident anywhere.

 

I had to get Police Certificates for NZ, Australia and the UK only. (NOT the USA)

My guess is that the answer is 'no one' because we are all told very clearly not to open it and that if it is it must be re-sealed by the embassy before entry is attempted. And it says so on the envelope itself.

Thus no one would take the risk and attempt it.

I made 7 visits before moving permanently to the US, twice with my children, my fiance visited me 6 times, once with his kids so everyone could get to know each other. Each visit ranged from 5 days to 3 weeks.

 

Her only issue would be at POE, if they suspect it is not a genuine visit and that she does not intend to go home. So she should carry evidence of a return ticket, letter from an employer, other ties to Brazil that require her to return.

Hello All, I am new to this forum and have come here (as I'm sure many of you have) in search of information.

 

My Fiance and I have been in a relationship for a little over a year now. He is American and I am Canadian. We have decided that my kids and I are going to move down to Georgia. My kid's father has given his permission (on our divorce agreement) that I am able to move with the kids to the United States. My kids are 14 and 12. Next week my fiance is sending away the K1 application...my question is this;

 

What additional forms do I need for my children? I saw that their information was included on the I-129f is this all that is needed?

 

Any advice is so much appreciated.

 

 

I brought my two children (7 & 10) as K2's with me. They were listed on the 129f petition initially.

 

Later on, when you prepare all the required documentation for the Embassy, that's when they fun begins, as they each have their own set of forms that have to be completed, along with photo's etc. The paperwork I sent back to the Embassy was an inch thick... The only other thing that needs to be included is their birth certificates. I also had permission to relocate with them from my ex-H in my divorce agreement. I took a certified copy of this with me (along with divorce certificate) to the interview and showed them the relevant passages giving me permission. They made a copy of this along with everything else to keep with my file.

 

They will also need Medicals (which they had at the same time as me) and be up to date with vaccination requirements and payment for their visa's as well as yours.

 

Definitely check the K2 guide available here and make sure their passports are up to date too.

Did you LIVE (not just have worked) there for 12 months or more?

 

If you were RESIDENT in Australia for 12 months or more then you will need it.

 

Its easy enough, but you have to get the one with fingerprint check unless London say otherwise. I had to have my fingerprints taken at Scotland Yard and thenmailed the application down to Canberra.
