Hello All,
My husband and I are in the process for his K3 Visa, he is Finnish and I am American.
We sent in the I-130 and G325A a little over 2 months ago and we just received the I-797C stating that our I-130 has been approved and is now being forwarded to the National Visa Center. Apparently we made the mistake of not sending in the I-129F immediately after we sent in the I-130 as we just got everything together for the I-129F and sent it in only to have it returned for the reason their records indicate the I-130 is no longer pending. According to the Embassy in Finland that means we have to wait the normal 18 month processing time now and we are so frustrated we truly have gone through forums, the directions for the forms, emailed both USCIS and the Embassy and are still lost as to what comes next. Has anyone else been in this situation or could anyone give us advice as to what comes next? My issue is when I have called the appropriate departments to get answers to our questions I am often given the run around, or am just read the same script I'm looking directly at online when it comes to directions for the forms. I understand the directions I just don't understand what comes next.

As far as we are aware we are to wait the 90 day period from when we recieved the I-797C to be contacted with an appointment for his Biometrics exam and then after that some more paperwork and interviews.
I'm just wondering if that will stay the same now that we had our I-129F returned :/

Please take it easy on me as far as any feedback this is my first time posting in any type of forum period and this is all new to me!

p.s. at this point in the process would it even make sense to attempt to get an immigration lawyer?

Hello,

I have a question about the DS-3032. We've been looking into doing the
DS-3032 by email, and the template given on this site recommends appointing
the petitioner in the US to be the agent receiving all correspondence from
the NVC. I am going to be staying in Finland for several months with my
husband, so it would make sense to have all mail from NVC to be sent to him
in Finland as we both will most likely be there for a while. I will keep an
address in the states and the mail could be sent there, my relatives would
just have to forward us the mail to Finland. As most people have appointed
the US citizen as the agent, we are just wondering is it beneficial for the
process to do so? Does it sort of 'look better' to have the US citizen to be
the one receiving the mail from NVC?

At the bottom of the page it says, "Applicant: Print your name and alien registration number in the box outlined..etc"
It gives a space for last, first and middle name and an Alien #.

I am an American citizen, my husband is the one immigrating.
Do I put my name and HIS A number?
Or only my name?

I know if i mess this up they'll send it back, please help ><



When my husband and I did the G325A for that particular question on my form I just filled in my name info. and put none for alien #
for my husbands portion of the form (he is the beneficiary) we did exactly the same as he does not have an alien registration # (none)

Embassy does not care about your CA residency but more about your US domicile.... you might try googling "maintaining US Domicile" FWIW, I would think obtaining a residency permit in Finland would be contrary to what you might be trying to do...

Wonderful I do have proof of the things listed and I know it may prove contrary I guess its so much easier for me to remain in the states during this process for the sake of the process but at the same time it´s so much harder and I know many couples do keep the distance between them but it´s just getting so much more expensive every time we travel and the distance is definitely too much to deal with so we´re working as best as we can together to stay together in the same country until very hopefully we are given the green light on this entire process so we can both be together in the states, thank you smile.gif

Hello all!
Hope all is well with everyone and hope everyone is trying their best to get through all of these processes without stressing TOO much (but if you are stressing TOO much, I feel ya!)
My husband and I are just at the point where we are filling out the I864 Affadavit of Support form and then we will of course wait for the next steps in the process.
My issue is I have just moved to Finland to be with him in the mean time, I am a California resident & have only been here 1 month so far (have visited several times already though) anyway, my passport is currently stamped that I can be here for 3 months although we have an appointment with the embassy here to see about me getting a permit to live here as well (does anyone know if thats something we should avoid doing at this point in the process? we are still waiting for my husbands Biometrics test appointment which will be done here as he is a Finnish Citizen) also, I´m having some issues trying to find out exactly how long a California resident can be away from California without losing residency. I´ve tried the google searches, calls to the embassy (with the always lovely extreme hold times), and at this point I´m just wondering if anyone else on here is a California resident who knows the answer to my question or if anyone on here knows where I can find this information for myself.

p.s. of course we will ask the embassy here when we meet with them but I just want to get a head start on the answers to my questions and am just having some trouble with my google search results and attempted embassy phone calls.

K-3 Spouse Visa Process & ProceduresQuestion regarding for I864
Hello & an early Happy New Year to all!
My husband and I are currently filling out the form I-864 & I am stuck on the answer to one question in particular. Part 5 of the form part G. (optional) If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting form I-864A enter the number below (this is in relation to counting our household size)
My father is filing form I-864A as he is also sponsoring my husband
I live in Finland temporarily with my husband (as we wait out this process) but my home address back in the states is the same as my fathers so technically we do have the same principal residence.
Do I count my father?
I know it says Optional but I guess it helps if the case is that yes my father does have the same principal residence as I do and he is also sponsoring my husband and we count him.
I just want to be absolutely sure and the directions for this part are more related to the spouse & skip details on this optional G. part. helpsmilie.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresFollow up to the Interview
Hello & Happy Spring to all Visa Journey Users!

My husband had his Visa Interview a week and a half ago, he was told he would receive his Passport back with the decision within a week. We haven't had any issues thus far with any of the forms we've sent in, payments, etc. so at this point we are just a bit confused. We have emailed the embassy asking what the status is but have not received a reply. As it has now been a week and a half we are beginning to worry & at this point, wondering if anyone else has been in a similar situation? Also, if this does not work out in our favor what would be the next course of action?
