This is my first post here. I am gathering all the papers needed for my interview. My husband has Form 1040 and W2 but I think we need a co-sponsor to sign the affidavit of support I-134. We have his job letter, bank letter 1040 but no W2, is his W2 required as well? Please I need your advice... Thank you in advance.

It generally takes 4 to 6 weeks to complete NVC processing using the shortcuts but if you have everything ready with the papers waiting to be mailed, you can accomplish everything from abroad, as long as you have a friend or family member do the actual mailing.

Thank you for your answer to my question and for all the other valuable information, We too wish to wait for CR1, however, my husband is leaving the USA to visit me on 24th of this month, he has paid the 70 AOS Fee, and waiting now for that to post as PAID so he can move to next step. The problem is how can he send them all the requirements in time? If I-130 is fowarded in time to Manila, yes, we will go with CR-1. but if the NVC is lacking information to send it to Manila, what can we do? Just go with the K-3? I am not sure what is my best option for that, as we both want the CR-1. All we can do is pray that the CR-1 is forwarded to Manila.

NVC will request I-864 if you are keeping the I-130 in process through NVC for an immigrant visa.

125% means current income, past years IRS returns are required to show a pattern of income in the past.

I always recommend keeping the I-130 moving through NVC and respond to their packets, in most cases if you do this the I-130 (CR-1) case makes it to the consulate BEFORE K-3 interview, and the K-3 gets dropped and the interview becomes one for a CR-1 visa. This saves TIME, and $$$$ not having to file to adjust status from a K-Visa.

The K-3 is no longer a relevant visa type, it was developed at a time when I-130 for spousal visa was taking a year or longer to process through USCIS, in this case the K-3 allowed entry to the USA to wait for I-130 approval, so that the couple can either adjust status or interview for the spousal visa, since USCIS has begun approving I-129F AND I-130 on the same date, this eliminates the whole reason for K-3 (Entry and waiting for I-130 approval).

CR-1
I-130: $355
NVC I-864: $70
NVC Visa fee: $400 ($355+$45)

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC and USCIS has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

Hello Everyone,

I am a little bit confused with the income requirement for the I-134/I-864. I understand what 125% of the Poverty Guidelines is, but does that mean he has to show 125% or more CURRENTLY in his job letter and pay stubs OR do they require 125% in the 1040 Tax Return / W-2 for the most recent year? My husband is making above the 125% now, but not as of his 2008 W-2, and 1040. Will this be a problem for us at the interview?

Hello Everyone,

We had our interview on July 14, 2009 at 7:00 am. We arrived at 5:20 am and they open the doors at 6:00 am. Shortly after we were inside we were called for the Pre-screening interview with a filipino man. That went smooth. He asked a few questions, I can't remember them all but this is the questions I can remember.

When is my birthday?
When did we meet?
What year did we meet?
where did we meet?
My answer was internet, so he asked what website?
When did we get married?
How many times did your husband visit you?

He asked me for my Birth certificate, marriage certificate, Cemar, NBI, and then he asked for support, (bank statements, job letter, IRS Transcript, bank letter), he asked for marraige pictures and I gave him all the pictures I had. he asked for proof of bonafide marriage so we gave him tickets, boarding passes, and a copy of our call logs. We used Magic jack, PLDT, Smart buddy cards, and phone bills from my husband showing direct calls to my phone number.

He said to sit back and wait to be called by the consul for the final interview.

It took about 1 hour and they called us.
We went to window 28. The consul was very nice and fast.
He asked us only a few questions.

When is my birthday?
where did you meet?
what website?
how many times my husband visit me?
when do we plan to go to usa?
he asked me in Tagalog if i was married before i meet my husband?
If we have any children together?
I was surprised that he asked me how the staff in St. Luke treated me during my medical.

He said YOUR VISA IS APPROVED!

That was 8:45 am.

We thank him for the quick interview and went back out to window 37 to get the pink slip. then we went to the cashier to pay for the delivery of the visa.

We left the Embassy at exactly 9:00 am. We were very happy and excited.

We thank God for the smooth process at the Embassy on our interview day.

Hi! I received a text message today from USCIS, when I checked the status online it shows that they put me in line for interview. Now I have the reason to study the questions and answers for the test. Good luck everyone! :-)

 

Note: They put me in line for interview exactly one month before my 3 year green card anniversary.
