K-1 Fiance(e) Visa Process & ProceduresVisiting during pending K-1 from a VWP country
My situation is a little different: My country still needs tourist visa and i applied for one after we were engaged and knew we will go for K-1 process; but didnt want to separate for so long. So I entered US on tourist visa and soon after that my fiancee filled I-129F.
Entering on tourist visa I've just said I am visiting a friend, didn't say that friend is my fiancee, the officer was suspicious anyways when I say I want to stay 4 months, seemed like he didn't belive I am not gonna work,I feel like if I said I have fiancee in US would be even worst and he wouldn't belive I am gonna go through K-1 process and go back t my country to get this visa. That is my experience, but depends on officer and unfortunetly I like I feel what country You from ( they more suspicious for aliens from countries have a high rate of illigal immigration)

when they schedule YOur interview for K-1, yes you have to go back to Your home country, than since visa is issued you have 6 months to enter US and after entry 90 days to get married and filled for I-485(green card). While Your I-485 is pending You can't leave US unless You have advance parole(You can aplly for it at the same time as I-485: the fee for I-485 now covers also advance parole and work autorization). So most likely You will get advance parole about 3 months after You filled. That is how things are now the hard part is to coordinate it with Your school schedule.
I have problem with that too: I filled for the green card but still waiting for advance parole(I applied for it to late, didn't know that green card fee cover it, if only I found this forum earlier..), I should be in my country march to finish my masters so hoping either GC or AP will be ready by than

Lets say I go to the U.S then, can I apply for all the paper work stuff like green card, ssn and work permit stuff and then go back to Ausi to finish my degree (1.5 year) or do I have to stay in U.S for a certain period of time? I know guys this is confusing and hopefully you guys are following me what I am saying smile.gif

Any suggestions or advices will be very helpful?

Although You never know with the immigration people i would not worry to much if You have strong ties with Your contry(like job, ect.). I feel like they can ask about Your ability to afford frquent visits but as soon as You have left US on time before, they shouldn't have any problems.

I know that every case is different so our is just an example: we sent our petition in February 2007 and had it approved by VSC not even month later! I would have had visa in my hands much sooner but I wanted to be in my country during the summer cause I wanted to attend my 2 brothers' weddings smile.gif We took our time gathering paperwork ect. and still I had my visa in June... our case was so fast and I hope so will be Yours but like I said before You never know with USCIS(now they taking their time with my AOS sad.gif )...best of luck
