Updated my information, does anyone really have an idea what dates VSC are processing currently?

The posted processing time is March 1, 2007. However, as you can see from the list, they had actually been processing petitions with an NOA1 of 6-7 months ago. I say "had" because the recent bulk transfer of about four months of old TSC petitions with NOA1 dates from March - June 2007 will probably make that March 1, 2007 posted time a realistic one now.

Please update the most recent list here, not the first one on the thread. I've put you in the most recent list (which is in chronological order, BTW).

I've changed the bulk TSC transfer dates from 1/31, which is when everyone got email that they were going to be transferred, to the date they received the email saying that their case had been received and was now pending at VSC. It's a more accurate reflection of when the TSC-VSC Invading Losers® were actually thrown into the mix at VSC.

Huh, wonder if yours was already on an adjudicator's desk when the bulk TSC transfers hit or if VSC is going to continue adjudicating those who filed directly with VSC at a six-month clip. I don't see how, unless they treat all the TSC transfers as if they have just been filed.

Here's a sample affidavit for use by those who need/want to use affidavits as evidence supporting their petition. You'll need to change certain obvious things -- the A#/alien number at the top and the names of the joint petitioners (i.e., to those of you and your spouse) and the affiant/person making the affidavit, etc. But this is what a real affidavit should look like. And, of course, as it indicates, it must be notarized.

clarification, i haven't received the ds230 yet so i cannot confirm what exactly is being requested. i am only going by what the state dept website is listing here http://travel.state..../info_3176.html and by what the cs reps have told me on 3 separate calls made to them telling me that the required docs have changed.

also, i cannot confirm the situation with the bogota accepting or not accepting phone calls since i've never made any to them. information about this was posted by someone else and not me

Hmm, note that the info on the state department website, while it initially appears to be country-specific (because of the drop-down list of embassy posts), is actually not country-specific. Also, I wouldn't always trust what the NVC reps say unless it pertains specifically to a question involving one's individual case (e.g., is my I-864 fee in the system?).

The worst that would happen if you self-generate your DS-230 Part I package and send in just the usual passport bio info page, etc., is that you would find out no later than the following week that more is actually needed when you receive the actual DS-230 package from NVC. Then presumably you would just have your spouse DHL the other stuff up to you (which you would have to have done anyway) and you would lose no more time than if you actually had just waited for the actual NVC package to begin with. That, of course, is assuming they are now actually requiring the additional docs, which I'm not convinced is the case.

I'm pretty sure we're going to have to send all those documents to the NVC since it seems they changed the process. Are you guys also sending the certificado migratorio to the NVC along with its translation? Or just the certificado judicial? :huh:

I want to send both to NVC but if we have to wait too long for the "migratorio" I will not send that as I do not want to delay the case by waiting on that. I'll have the certificado judicial and other papers in a few days so I can send in the package when ready... I want a date at the embassy!!!!!!!!!!!!!!! I'm not gonna put off sending in the package only for the "secondary" migratorio document. If NVC really wants its I can send it to them if they ask later...

Can we go to the Embassy yet and get our visas???? Can we? Can we??? :innocent:

If there is a change (and I'm not at all sure that there is), then you're probably not going to know until they send you the DS-230 package when your IV fee bill shows up as being paid in the system (i.e., a good month -- or at least it used to be -- after you pay the IV fee bill you're about to receive).

Given that the embassy does not require English translations, I'd be kind of stunned if all of a sudden one has to send the certificados and DAS stuff to NVC. Much easier for the embassy to assess these things because they're more familiar with them.

Although it has always asked for everything, the most recent packet 4 from the embassy still indicates that they expect the docs to be brought to the appointment as part of packet 4 along with the photos and the medical exam: http://bogota.usemba...ntment_temp.pdf. That might not mean anything since the list includes things that have always been sent to NVC, but again, the only way you will know for sure when NVC sends you the DS-230 package.

I'm still doubtful, though. The anecdotes of people being sent home must have to do with the spouse in Bogota not getting all of his or her ducks in a row -- if one didn't send the required docs with the DS-203 Part I to NVC, they'd never complete the case and send it to the embassy to begin with.

Thanks for the info! Quick question I noticed about these documents...for the various certificates the instructions state something similar to the following:

"Each applicant will need to obtain an original birth record (or a certified copy of the original, obtained from the issuing government authority)."

I want to be sure I know what a certified copy of the original is! We took our "original copies" and took them to be translated at a certified agency. They made a photocopy of the original, attached a translation, and put their stamps on them (this is what makes them certified I'm assuming?) as well as notorized them. Is this all that is required? Or is a certified copy of the original what you would get directly from the respective records office that has the raised seal and all that?

It sounds to me like you're not going to be sending in a certified copy of the original birth certificate. As JK indicates, all certified copies are just that -- copies that are certified, not the original. (The original is kept by the government, so what they photocopied was not an "original" -- it was a certified copy you brought along.) So I can't say for certain, but it seems like you plan to hold on to what you're calling the "original" -- i.e., an original certified copy -- and are just going to send in a regular photocopy of that certified copy as well as a translation that has been certified.

But I'm not sure, of course, what the procedures are for certification of documents in the Ukraine, i.e., maybe this agency has the power to make another certified copy off of a certified copy and provide a certified translation all at the same time.

Normally, one would get a certified copy of the birth certificate from whatever government agency maintains the original, take that certified copy to be translated by some person or entity that will certify the translation itself, and then send in the certified copy and the certified translation. You might have skipped that first step.

It's been positively confirmed that NVC is now requiring more docs to accompany the DS-230 for certain countries for which only a copy of the passport bio information had been previously required. The US embassies in these countries are called "Appointment Posts" by NVC, and what's now required is the same as what has been required for certain countries like Canada, China, and others in North Africa -- including the DS-230 part II. Certain Latin American countries are now being considered Appointment Posts -- there may be others.

The additional documents are things like police certificates that may take a considerable amount of time for your beneficiary to round up. Thus, people should have their beneficiary start collecting these things as soon as possible -- probably before you even get an NVC case number assigned, to be on the safe side.

To find out whether NVC is now requiring more for your country, go to http://travel.state..../info_3176.html Select your embassy post from the drop-down menu and click on Request Instructions. On the page you are "directed" to, click on "Download all the immigrant visa instructions on [Standard/Appointment] NVC Processing Post]." If your embassy/country is Standard, you still only have to send in the passport bio page with the DS-230 Part I. If Appointment, however, read the instructions carefully and note that you will have to send in both DS-203 Parts I and II as well as a bunch of additional docs such as birth, marriage, divorce, and police certificates, all of which must be translated into English for the NVC. (Hence, the need for starting early to round these things up!)

Also, for those of you using the shortcuts, NVC has changed the standard DS-230 cover sheet that it sends out when your IV fee bill is in the system and NVC is ready to accept the DS-230. Although the case number and barcode still comprise the operative content in the cover sheet, it is nevertheless different from the one that's currently posted in the shortcuts. A reasonable facsimile of the new coversheet should be posted here sometime soon. If you can't wait, go to this post in the Colombia Club thread for the work in progress. It will probably serve its purposes for the time being.

IR-1 / CR-1 Spouse Visa Process & ProceduresSix to eight weeks for AoS bill?

We've been waiting for the AoS and Choice of Agent to be generated. As the general rule seems to be that it's generated on the second tuesday after getting a case # I called last tuesday ... nothing.
I read that recently it has taken longer to get them, so I wasn't really worried. Just annoyed :)
Then, my husband called an operator last night and he (operator) said we'll hear something in (now) four to six weeks ... six to eight weeks from having gotten the case #

So, now I am getting worried.
Did my husband just encounter an operator who doesn't know anything?
Is it normal for them to say '6 to 8 weeks'? Just for the AoS?
And if that's the case, how come I see all these timelines where it only took 13 days?

So many questions. Waw!

If your AOS and DS-3032 were generated this past Monday, that would only have been 11 days after getting a case number assigned. More likely, it will be generated this Monday.

But don't hold me to it. :)

IR-1 / CR-1 Spouse Visa Process & ProceduresMy Wacky Dilemma

Ok folks, I have a really strange situation and I just wanted to get some opinions, even if nobody has had this situation before - and I'd be shocked if anyone has!

I found out recently that I probably qualify for derivative US Citizenship through my father. I have already had an interview at the consulate, and applied for a US Passport. Now I am waiting to find out if I'll get one or not. However I have no idea how long it will be before they make a decision, they didn't tell me anything more than that 'they are really backed up right now because of all the backlogged passport applications.'
But since it's not a sure thing and my US Citizen husband and I want to move to the US as soon as possible, we thought he should go ahead and start the application for an I-130 before I find out if I get the US Passport, so that we wouldn't waste time if the passport application was eventually denied.

So my dilemma is: should my husband go ahead and file the I-130? Am I risking screwing anything up by having a US Passport application pending at the same time as an I-130? (Other than losing the non-refundable filing fee, of course, which is not nice, but wouldn't kill us)
How complicated is it to cancel the I-130 if I get the passport?

Any opinions or wild speculations will be welcome!

The passport application is going through State Department channels, while the I-130 goes through the CIS. I don't think filing an I-130 would muck things up for the passport or vice-versa. Why should it? If you're a really a U.S. citizen, you're really a U.S. citizen and you'll get a passport. If not, you're not, and you're entitled to apply for a CR-1 visa as the wife of a U.S. citizen.

As an aside, my vague recollection is that for adults, all you have to show is that your father resided in the U.S. for a certain period of time before your birth, something like 10 years, of which half had to be after he was 14. If you yourself haven't lived in the U.S., however, you probably have lost citizenship -- although I believe that they will restore it if you take an oath or pledge allegiance or rub your tummy and pat your head at the same time, something like that.

I have been a VJ member for at least 2 weeks now and i have noticed that there is not a whole lot of information to help out cuban wifes or husbands maybe its all in old forums but i cant find it. So im asking all Husbands/Wifes of cubans to please put in stuff like questions asked at interview,list of things you have to take to the interview, what is in the superpacket and somemore info on the carta blanca, medical check, police report, military report and proof of shots also please more timeline updates.

I have to tell you, I think you're the first CR-1 I've seen here going through Havana. I seem to recall a few K-1s, but not a CR-1. At least they have been few and far between. How much are the fees for the National Visa Center’s Services?

The Affidavit of Support Fee is $70. The Immigrant Visa Fee is $335 and the Security Enhancement Fee is $45.

Should I arrange 2 cheques - one for $70 and one for $380.00 ? ie is the iv bill always for $380.00 at the moment and is there a chance it will increase in the next month or two ?

It will take a while to get such a check here in the UK but I need advice please from someone who has recently sent these in.....

The AOS fee and the IV fee are two separate fees, sent in at two separate times with the two separate fee bills -- the AOS/I-864 fee bill (the first one, which is generated a couple of weeks after your case number is assigned along with the D'S-3032 choice of agent form) and the IV fee bill. So you will need two separate checks -- one for $70 and one for $380.

Although USCIS (an agency of the Department of Homeland Security) is threatening to raise its fees as early as June 1, I have seen nothing indicating that the Department of State is raising its fees. And, yes, the IV fee check should be made out to the Department of State.


fantastic ! many thanks - i will order the two checks - they are £15 ($30) each from my bank but I will save that the first time I fill my gas tank in Florida ! I reckon they will be valid for 6 months so I might as well order them now then i am on the starting blocks - tested the barcodes etc and worked very well with 'paint' program to get rid of logo before copy/paste.. worried about keeping up to date with word forms for fee bills if they change so i will keep checking on James shortcuts version 2 - excellent - a real life saver - many thanks - alan


You're welcome! And don't count on saving too much on gas here in Florida because prices are at an incredible record high now and are still going up, though of course I suppose they are still relatively lower than the UK.

Also, although you aren't going to get to this point for almost a couple of months, note that the link to the DS-230 coversheet in version 2.0 of the shortcuts is to the old coversheet -- I just provided the link to the current coversheet in the post following version 2.0.

What "paperwork to file your name change" are you talking about? My wife never filed any paperwork to change her name, she just started giving my surname whenever and wherever she was asked for her name.

She is probably referring to the I-90.

My wife's passport had her maiden name on it (still does). We used her maiden name on the I-130 petition and on the DS-230 application. As I recall, the embassy would only issue her CR-1 visa in the name on her passport.

Some time after she received her permanent resident card here, we did what the OP is likely referring to as "paperwork to file your name change": we filed the I-90 (online) to get a replacement card with her married name, and simply brought the marriage certificate to the resulting service center appointment.

IR-1 / CR-1 Spouse Visa Process & ProceduresIV fee generated...can send payment before arrival?

I was just curious. I have read that once an item from the NVC is "generated" that it is officially in the system and therefore, a timesaving method would be to go ahead and send fee (or item) to the NVC immediately.

Anyone know if this is true? I have paid the fee for my 864 and await the bill for my (Thai) wife's DS 230.

Anyone know the amount of the fee?

The IV fee must be sent in with the IV fee bill, which you don't have yet. The IV fee bill has the case number on it as well as a case-specific barcode. It also has to be sent to an address in St. Louis, not to the NVC in NH.

Most things can be sent in as soon as they're generated if you're willing to "self-generate" the barcoded forms yourself, as the shortcuts in this thread demonstrate. However, the IV fee bill is the one document that is as yet incapable of being "self-generated" because of an odd, apparently random check number that is assigned to the case number on the document.

I know this has been asked in other post but way back in september and since things with cuba change every month i think i should ask again.
I want to travel with my husband when he comes from cuba. I was reading that some cubans have traveled through cancun with K-1 visa my husband will be coming on a CR-1 visa and i was wondering if He can come through cancun and if he can how would i get the tickets.

This is only my opinion and maybe someone else has different thoughts, but I don't see why it would raise any questions at the POE if he came via Cancun, particularly since it's a lot easier to arrange for flights from Havana to Cancun to Miami then it is to arrange one directly from Havana to Miami. Mexicana has direct flights from Havana to Cancun and has e-tickets, so you should just be able to buy an e-ticket on their website and list Alain as the passenger. http://www.mexicana.com

The thing is that i dont know if they will let him go into mexico does he need some kind of visa ?

I am sure he would need to get a tourist visa from the Mexican consulate, but I'm not sure how easy or difficult that would be.

I take it you can't go to Havana yourself to get him because of this stupid 3-year rule?

I hear a lot about the term "generated". What does it really mean? Is the document sent out the same day it is generated or few days after it is generated?

It's used to refer to NVC updating your case file in its system and "generating" a particular NVC document to be sent to you. Documents are always "generated" by NVC on a Monday (although one usually doesn't know until the automated recording is updated at oh-dark-hundred the following Tuesday morning). However, the documents actually do not go out in the mail until up to 3 days later.

The term is also used to refer to creating or "generating" one's own version of that document using the shortcuts. This is also called "self-generation," an act which is performed by "self-generators." In the early days of the shortcuts, there were some who expressed fear at NVC discovering they were "self-generators."

hi everybody
my case assigned in nvc on 15th May 2007 we didnt get any paper to nvc to give us our case number or tell us that our case assigned we only got our case number throgh phone auto machine when we called to nvc auto machine give us our case number and tell us to allow 6-8 weeks to get papers into embassy. so i need to know is i receive any paper to nvc tell us that nvc assigned our case? and i want to know how to genarate aos bills nvc will send the insturction or we should need to get these bills and from where? plz if anyone can tell me how to work with NVC...thanks

Two or sometimes even three weeks between the NOA2 and NVC assigning a case number has become pretty much standard. According to your timeline, your NOA2 was issued May 22. Today is June 1, only ten days later. Why worry unnecessarily?

Is the NVC aware of these shortcuts and do they mind it?


No, you can't send anything to NVC until it has been generated. The NVC system is set up to "expect" -- and only accept -- those forms that have been generated.

The DS-3032 and AOS fee bill are always generated a couple of weeks or so after the case number is assigned.

NVC apparently is aware of the shortcuts to some extent. Inasmuch as the shortcuts have been in use for over two years now, however, I would say NVC likely does not mind their use.

Also you CAN email the NVC on your husbands behalf BUT open a new acct for him instead of sending it from your own.

This sounds like one of these things that got started in a superabundance of caution, but without a basis in reality. Can anyone can come up with a single instance of a choice of agent designation being rejected by NVC because the U.S. citizen spouse sent it from his or her own email address?

I would kind of doubt it. Among a number of other things, how would NVC know that the email account belongs only to the U.S. citizen spouse? It's just an email coming in from the ether with a case number. And even if on the off-chance the email address reflected the full name of the U.S. citizen spouse, why would someone at NVC care enough to reject the designation (assuming they could or would)? I don't think they are worried too much about fraud here if someone coughs up the correct case number. Who else would have the case number other than one of the spouses or their lawyer?

This is all only my opinion, but this occasionally repeated bit about having to open a new email account for the non-citizen spouse to email NVC is also only opinion, and does not seem to be a well-founded one.

I did not get any response to my first e-mail for DS3032. However, I did receive a response for my second e-mail and it was accepted. Make sure that you follow the instructions on how to send them e-mail. Write your NVC case number in the subject line. Include your name and date of birth of both the petitioner and the beneficiary. Given this kind of thing that's been happening lately, the original shortcut of having the beneficiary download, sign, and send to the U.S. spouse a DS-3032 well ahead of time seems to be the most surefire way.

it's not fair? are you kidding me? this is coming from someone who got their NOA2 in 7 days while others have been waiting months and you are whinning? you have some nerve.

For better or worse, Cubans occupy a unique, privileged position in the U.S. immigration scheme. All a Cuban has to do is show up in this country, no matter how they get here or whether they are married to a U.S. citizen, and they are entitled to automatically adjust status in a year and a day. Blame all of the Congresses and Presidents over the past 40 years. But don't blame Miriam for marrying a Cuban. Because he is Cuban, he was basically rubber-stamped through the I-130 process.

That said, what happened to Miriam is unfair. She didn't even go with the DS-230 shortcut -- instead, she waited for the cover letter sent to her by NVC and followed its instructions. As you well know, the DS-230 cover letter from NVC directs one to a site that you and I have both repeatedly linked in our posts. That site still indicates that Havana is a Standard Processing post, requiring only Part I and a copy of the passport bio page.

So what happened to Miriam truly sucks, as does NVC and the State Department for screwing up so royally. They are apparently doing the same thing with at least Jamaica, as can be seen from another post today, and who knows how many other countries. These people are total f-ups, as can be seen with the passport debacle that's been in the news. F-them.

But don't criticize Miriam for justly complaining about this. Very bad form, old sport.

The options are probably not the most palatable, and they may eventually have you wondering why you did not think this through beforehand (but who does, particularly when one is 19 and in love?).

1. Your boyfriend has to get a job that pays 125% of the poverty guidelines level. That would be a job earning approximately $17,000 a year, or something like $10.50 an hour full time. He would probably only be able to go to school part time while working.

2. Move back to Peru and visit each other, and then when he is out of school and has a job paying enough to meet the 125% requirement, file the I-130 petition.

3. Find someone in the U.S. who will sponsor you.

I can't think of any others.

From what I understood, when you fill the Choice of Agent thing, unless you have a lawyer or you live in the desert like a nomad, the beneficiary is the Agent. When I got the papers from NVC, there was a scheme with the papers sent to the petitionner and the papers sent to the Agent.

So, I, the French citizen, got the IV fee papers and guess what? You can only pay if you have a bank account in the US. I had to send the papers to my husband in the US because he is the only one who can pay.

Such a loss of time. We already lost a month with this BS.


You should have chosen your husband as the agent on the DS-3032. Otherwise, you run into problems like this, not to mention mail that travels outside of the U.S. by monthly tramp steamer.

I would e-mail NVC and ask to amend your choice of agent, designating your husband.

I was told not even to bother to try, well, I did and I got it. Now, I don't know how the story will be at the POE, but for now I got my visa, I will let you know how it goes.

My wife traveled here on her tourist visa while the I-130 petition and CR-1 application were pending. She had no problem entering in Miami. Of course, she had used that visa often before the petition was ever filed, and was traveling with our then-infant U.S. citizen daughter when she entered. I would bet you'd have no problem coming from Italy, particularly if you go through a major POE (i.e., NY, Miami). But there are no guarantees . . . .

The reason why most people e-mail the DS-3032 is because the paper copy needs a signature from the beneficiary and that would take a while to get from them. So e-mail is faster. But if you were clever enough (most of us weren't at the beginning of the process) and generated the DS-3032 yourself following James' shortcuts, had your spouse sign it and mail it to you before it was generated by the NVC, you'll be way ahead of the game and won't need to e-mail them at all.

For those with nonimmigrant K visas, yes, but that's not "here." We are in IR-1/CR-1 Immigrant Visa Land, where one never has to mess with adjustment of status and where it means an I-864 affidavit of support.
