if you go with the K-3, then you go to your interview and if he gets approved, he flies here and you adjust after he gets here....

If the I-130 approval comes after that, you just ignore the invoices since you already have your interview and are following the K-3 path.  The I-130 goes nowhere until you pay the invoices.  It's one or the other..

I can only speak about my lawyers office... but I will say in my opinion, an attorney wouldn't suggest filing something if it was pointless. It is free to file and my lawyer is not getting any more money from me. I paid a flat fee.    His job is to get me an approval..

 

I know this is probably technically OT, but LoveMyTico, you have the lawyer, so maybe you can help the rest of us make the decision to proceed in this direction or not....

 

If indeed the I-130s don't get processed until 16months out, then potential my husband could get his K-3 & be in the US before I even see an NOA2 from the I-130....NVC would then get the case for permanent resident, the K-3 becomes void after 30 days of this? I know getting K-3 we should apply for Adjustment of status soon after arrival in the US, but does the AOS close the I-130 petition then? My husband wouldn't have to go back to India if I-130 gets a case # at NVC before we are able to file AOS in the states, right?

 

Its the time frame surrounding submitting multiple petitions that confuses me and what negates what. Maybe you can clear some of it up for us.

Oh boy! You've really got me thinking.

 

I'm also thinking about filing an I-129F after reading what your lawyer told you. I mean there's no harm in filing it, right? Or is there?

 

From what I've been reading on the USCIS it doesn't sound like it would hurt the case at all.  And am I correct in understanding that we don't even have to pay to file the first I-129f since we already paid fees for the I-130?

 

I haven't gotten to the fees yet for the rest of the process once the I-130 DOES get approved, but I'm going to discuss with hubby tonight.  My visa for India will expire soon, so I think he would rather pay the money to be together than suffer and unknown time apart.

 

If lawyers are suggesting it, they must have some inside word on whats going on.

Talked to tier 2 today and they told me 8-9 months and last week they told me 6-9 months. Lol

 

Trying to be positive...at least they are agreeing on 9 months as the last number? At least they're not saying 12 months! dancin5hr.gif   But is that the projected approval range or in addition to what we have already waited? Coz if so I only have 3 more to go before I reach 9 months! I can manage it!....I think.ClockWatch2.gif

Here I was getting all excited that people are being told they might hear something by the end of October and thinking that might mean good news for me too....when our landlord calls and says he wants to sell the flat my husband and I are living in in India!

 

We haven't put this address on any of the I-130 paperwork as I am on a short-term visa and my mail is still coming to where I am staying in the US with my parents, but we were planning to put this address on the paperwork for the NVC packages to show we are indeed living together.  Now I'm afraid moving again is going to hurt us!  And, if we can't find anything, it looks like I'll have to go back to the US.  Really didn't want to have to go back to the US without my husband. :-( Really disliking India AND the US right now.  

 

Could use a little good news. :-(

And the partial government shutdown has begun! :-(

Fox News is reporting that the Department of State is going to continue processing foreign applications for US visas and combined with the info someone posted directly from a USCIS employee, I think we will be okay.  Maybe they will even work faster if they aren't being bothered by any other government agencies contacting them! :-)  

 

Here's hoping for a nice, quiet, productive day at USCIS & NVC.good.gif

I know that many (or most) of you here are living apart from your spouses and that is extremely difficult.  I have been living in India with my spouse for the past 5 (going on 6) months and while the wait is easier being with him, it is still extremely frustrating.  I miss the US, I miss being able to work and do simple things on my own.  Adapting to a new country AND waiting for us to be able to go to the US to start our family and new careers is frustrating.  Even though we are together, everything is STILL on hold.  Luckily, I've been working on cruise ships for 2years prior, so I'm used to missing the major holidays with family, but it doesn't get any easier.  

 

However, the biggest frustration is not being able to make all the phone calls and inquiries that most of you are able to do based in the US. I'm one of those that would be on the phone every other day with USCIS , congressman, etc if I could be.  So I really just wanted to thank all of you that ARE doing that and reporting your information on here.  I'm trying to keep my hope alive based on the info you all report.  Even tho I'm with my husband, I still know how difficult the waiting is.  So thank you all for your persistence in gathering information and keep it coming!

I found a place on MSNBC's website to suggest topics for investigation and news coverage.   Maybe if we all suggest investigating USCIS they will get the message.  You don't have to put images, just skip to the box where you can write up to 3000 characters.  I mentioned VisaJourney and all the conflicting information we receive out of USCIS, how they took our money and now treat us like we don't matter, and how they seem to operate however they see fit.  There is a lot you can say in 3000 characters!

 

But whatever you say, try to sell them on why they should investigate it.  I think thats the trick.

Question:  a lot of people have talked about making InfoPass appointments around the time of their 5th or 6th month mark.....why?  Is it helpful in any way?  I really don't understand what InfoPass is all about.   

 

I'm living in Mumbai with my hubby right now and InfoPass appointments are only at the New Delhi office which is a 2 day trip, so I'm just trying to figure out if it will be worth it.

Is K-3 really not an option any more?  I see plenty of info about it on the USCIS site, so why is that no one does it?  I mean I know its a hassle because its short term and it seems like it contains a lot of fine print, but if the wait time is shorter than applying for this........   

 

Someone just mentioned waiting 2-3yrs above and I can't even IMAGINE having to wait that long.  I don't want to think it would take that long, but if it gets to 1.5yrs waiting, I think I will look at the K3 option.

I wonder if there is a way to alert the national media to what is happening with USCIS?  The news is LITTERED with blah blah blah about all the asylum cases and illegals coming from mexico and the ridiculousness is that work visas for people with pending asylum cases are being processed in weeks while legitimate families are being made to wait months to YEARS!  Its an injustice really.  I wish a media outfit could get inside a processing facility like VSC (who is clearly so swamped that they are shipping off various forms to other facilities according to the memo on the USCIS site).  Maybe if it made national news it would alert the government officials to the problem.  I just feel like we're suffering in silence.

 

I know so many Americans are angry at all the foreigners coming into the country and so help me God, if my husband ever gets hassled in that way, I will go off on that person and explain all the BS we had to go through to get him to the states legally.  To do this the honest way.  Waiting and being jerked around is the "reward" we are all getting for being law-abiding people.  Unfair. mad.gif

Any way we can file for a K-1 now with a I-130 pending?  Or would that be problematic?  I'm living in India with my husband, but I'm eager to get back so I can start earning again. Its all so frustrating...if you aren't living together, later they will ask all sorts of questions about how your marriage actually works if you're not together, but then if you're living together in a different country they ask you to prove domicile and how you expect to support your spouse if you're not earning!  UGH! I really wish I could just ask one of these "OFFICIALS" "please, explain to me the PERFECT solution to meet all your stupid requirements."   Its just ridiculous.  I'm so frustrated.  I'm 30yrs old, we want to start a family, but we want to do that when we know we will all be able to be together as a family with secure jobs.  

 

Do you think I can get expedite status on my case with the reason of "my biological clock is ticking"? hehehe

 

Sorry for venting.  Just hoping for good news for all of us here.

Hi, I'm the petitioner USC in my husband's case.  He is from India and I am currently living there with him.  We have just celebrated our 1yr anniversary last month.  We filed and then decided we couldn't take the time apart.  I was in between jobs at the time, so decided to just join him in India.  Looking back, I'm wishing we had filed from here and done DCF, but now we are stuck waiting.  I'm also a little nervous since I am not working, we are relying on my parents as joint sponsors to meet the financial obligations.  However, I am hoping to apply for a PIO card here in India which would allow me to work.  I would be earning in rupees, but at least it would be something and my husband is also working.  Still waiting for NOA2, coming up on our 5 month mark.   Praying things speed up when they open the new office for processing I-130s in September! :-)

I am sure you know it but thought I will mention it since it occurred to me. Make sure you include Mom's W2, employment letter, pay stubs etc. along with her I-864A. 

Yes, we have included all as per the I-864a instructions.  She does not have employment letter but we have done 6mos previous paystubs, W2s and corresponding tax transcripts along with birth cert, drivers license and marriage certificate to prove relationship to my father, the co-sponsor with I-864 to her I-864a.

 

Hubby does not need appointment to turn in the documents, just says to turn in as soon as possible. So he will submit it as soon as FedEX delivers it. :-)  I'm going to post the interview review as soon as this part is complete so I can do it all at once.

Thanks for sharing!  Urgent question!!!!! Could you please tell me, if I understood correctly, your dad filed I-864a, but now the IO asking your mom to file I-864a too? Do your mom and dad file joint tax return?  I'm asking, because my husband's brother also filed I-864a for me, so does his wife have to file I-864a too?

 
I am the primary, so I filed I-864 and my Dad is co-sponsor so he was required to file I-864 since our incomes are seperate.... we each file our own tax returns.  My dad files joint tax return with my mom so they are now requesting the I-864a from her.  Even though I had asked NVC several times and they told me, "no need".   I would say if a co-sponsor files a joint tax return, the I-864a would be necessary for the spouse on the return.

Well that stinks! But it doesn't sound like too much longer of a wait for you guys. We are scheduled for Mumbai June 18th! What questions did he get asked?

 

Yeah I don't think it will be too much longer.  Just wishing I had listened to my instincts about sending in that I-864a rather than listening to NVC. :-(

 

Hubby's head was kind of reeling after the interview, so I couldn't get clear answers about the questions out of him...But I'll be chatting with him again in the morning so I'll get all the details then once he's had time to process everything and I assure him that we're taking care of things on my end. :-)

 

But so far, my advice is just to practice the sample questions you can find on here...thats all we did and he said it was an easy interview.  Try to think like a scrutinizing embassy officer.  Will be back with more updates soon!

As an update:  My husband just called me after his interview at Mumbai.  He received 221g slip for an I-864a for my mom to complete (Dad is co-sponsor).  Annoyed because NVC told me no need for the I-864a when I spoke to them several times.  They took his PCC & Dad's updated I-864 as requested from our NVC case complete letter.  CO told him his interview went well, and that he would not need to come back for another interview, but to just return with the missing document & his passport.  So approved pending receipt of the missing document I guess?  

 

What should his status in CEAC be?  I'll be searching for other people's experience with returning 221g requested documents to see how long of a time frame we might be looking at.  Anyone have any info on it?

My husbands interview in Mumbai was may 7 after the initial interview my husband was asked for a private interview with an american male who was rude to my husband claimed that because my husband is Hindu and I was raised catholic but I don't belong to a catholic church that our marriage is in valid how can this be the courts in India would have never registered our marriage if it was invalid he is from jetpur we married religious ceremony for respect of his family to me this is discrimination and it says so in the special marriage act of India now we are in ap . Not knowing what's going happen now

This is really frightening me.  I am also Catholic and my husband is Hindu.  However, we did just a standard court marriage in Mumbai under the Special Marriage Act.  

 

I agree, the Special Marriage Act is specifically supposed to ALLOW marriages between people of different religions without either of them having to give up their religion.  What right does the embassy have to say that because I was raised Catholic that I MUST belong to a Catholic church?!  I put that I was Catholic on my app, but I am Non-practicing.  Now I'm terrified that bad things are going to happen because I put a religion down!  This is terrible!

Are you logging in with the beneficiary's email id ?

 

Just an update for anyone that may have this problem in the future or be searching for answers later on.  My husband had previously applied for B2 and was denied, so parts of his information was in their system, but some was no longer current.  Somehow, logging back in with updated information caused 2 accounts to be created under the same email address.  We had to call USTravelDocs directly and they had to manually block one address and any others associated with the account...apparently my husband had tried a different email at another time.  But doing that created problems in sending temporary passwords.

 

So they erased everything and created a whole new user ID and gave him the temp password over the phone.  This finally worked  and we have finally scheduled the appointment.

 

Basically email addresses just get stuck with this account and don't get replaced if you update information through the site...so if there are errors showing, its usually has to do with repeat or stuck information.

I didnt have any problems. I scheduled once and canceled and rescheduled again without any issues.

I forgot about the IE requirement....but just tried it again using IE on a different computer and STILL getting the same error!

I'm having serious trouble with this site. My husband and I can't figure out how to schedule his biometrics. step 5 on the link you provided says to follow instructions as per your category after logging in and clicking "schedule appointment".  However, the only button we see after logging in is  "new application/new appointment" on the left hand column opposite the "dashboard". clicking this leads to more problems.  We select visa type, etc...but then it asks for personal info. Upon completion, it says the details match an ID already in their system.  Get this....its the ONE I"M LOGGED IN AS!  It won't let me continue beyond this.  

 

I'm terrified and confused.

You misinterpret something.  The NBC sends the petitions to local offices to be adjudicated not after they're adjudicated.  Generally after your petition has been at the NBC for 2-3 months they will send it to the local office.  NOw the local office may be having a good month or they might be seriously backed up.  It depends. 

Concerning I-130s it says: "The CSC and the Vermont Service Center (VSC) began shipping stand-alone 

Form I-130, Petition for Alien Relatives, filed for Immediate Relatives, to the NBC. Once NBC adjudicates an I-130 petition, it forwards it to the perspective field office bi-weekly based on the petitioner?s zip code."

 

But then later it says: 

"a) What is the status of the transition of stand-alone I-130s to the NBC? 
Response: NBC continues to receive I-130s and ship them to the appropriate filed office for 
adjudication. Based on staffing, we anticipate being able to adjudicate these in the fall."
 
So are they adjudicated  twice?  Kinda sounds like it.  But then it sounds like they are planning to adjudicate the forms themselves at the new Division 8 place in the fall.  If they aren't already ajudicating first and then sending them elsewhere to be further adjudicated.  huh.png   I'll just keep waiting patiently and try to remind myself that I love the US.

Okay, so I was reading another post about recent meeting notes from the NBC about how they hope to speed up I-130 approvals and it mentions how they currently send ajudicated applications (I'm assuming its the "judged" definition of the word in this case) bi-weekly to local field offices based on applicant's zip code.  So far, so good, I follow and understand.  But then if I go to the USCIS site to check the processing times at my local field office (which is Albany, NY) the I-130 form is not listed to be checked.  :-(  

 

So does this mean that I-130s are not processed in Albany?  What becomes of my processing time once its been "ajudicated" by the NBC and supposedly shipped off to my local field office?  

 

Very frustrating.

I was reading through the directions for the I-864 so that I can figure it all out before I even begin to put pen to paper.  Here is the situation & the problem:

 

I am the Petitioner (USC filing for alien spouse), I filed in the US, but am now on a temporary visa in India while we wait for the whole process to finish.  Domicile is what immediately pops into everyone's head.  Prior to leaving for India my legal permanent residence was my parents' home as I have been working on cruise ships for 2 years and no point in maintaining a personal apartment when your gone 9 months out of the year.  Upon our return to the US we will also reside with my family for about a year since that is also my legal residence. 

 

HOWEVER, my parents have not claimed me in their household size in about a decade as I have been (until the past 2years) living on my own.  Even after moving back in with them, they never claimed me as I filed my own taxes as an individual.  

 

Since I am in India I cannot work here and am not maintaining any sort of job in the US, therefore I have no income.  I know I have to complete the I-864 anyway, but THE QUESTION: what category do my parents fall into for helping to support?  I-864a or just I-864?  They ARE living in my residence (or rather we in their residence), but they are not part of my financial household as deemed by the IRS for tax purposes.   And I was not planning on including them in the size of my household on the I-864 either.

 

Its just the shared residence thing thats really confusing me.  I'm thinking they would just file as a joint sponsor with a I-864.  For sure there is no question whether or not their income meets the requirements.  I am planning to work upon arrival in the US, but currently have no income.

I'm a US citizen who came to India on a 1yr Entry (x) visa immediately after filing the forms in the US for my husband.  I am staying on rent with him in an apartment while we wait out the processes.  I'm not expecting it to take until the expiration of my visa...maybe close though.  I'm trying to figure out this whole domicile thing.  I haven't listed the address of the apartment we are staying at on any of the paperwork.  All correspondence on my end goes to my address in the states and my parents email it to me.  And my husband's correspondence will go to his address at his parents house where he visits frequently.

 

Does this qualify me as "living" in India? Since I'm on a short-term visa with a clear expiration date.  I wish these agencies would define the terms they use.  Like am I considered living here if I'm here for 1 month, 3 months, 1year, 5 years? What differentiates a visit from actually living?  My visa doesn't allow employment, so I'm not even doing that while I'm here.

 

So frustrating not knowing what to expect.

Yes, I did read that thread, its what prompted me to ask my question actually.  Because the OP was a long-term resident of her husband's country. Whereas I won't even complete 1yr staying in the country. I guess I'm just really wondering what these agencies define "living" or "residing" as.  1 month? 1 year?  I mean whats the difference between "visiting" your spouse and "residing" with your spouse.  

 

I came to India immediately after filing (not before) and plan to leave as soon as things look promising. Can it be defined as a visit or as a living situation since i'm on a short-term stay. 

 

I just don't know who else to ask.

I'm on a 1yr Entry (x) visa in India while we wait for my husband's visa process to complete.  We think it will be done close to the expiration of my visa.  Since I am on a short-term visa, as long as I can provide some things (letter from parents stating our intention to reside there, maintained US cellphone number & bill, maintained voter registration & maintained driver's license)  do you think they will fuss much over my domicile?  I HAVE been in India for 6 months so far, but my visa has a clear expiration unlike a PIO card or long term (5+ year) visa.   
 

I'm just wondering how much they will hassle my husband about my domicile.

The K3 timeline option on the board does the I-130 and the i-129F.  You'd simply change it to the IR1/CR1 if the I-129F is closed by the USCIS, the NVC or the embassy/consulate. 

 

Also I know it's persnickety, but you sent and received NOA1 for an I-129F petition, not a K3.  It is the K3 visa route, but not a K3.  I know it's nitpicking to mention it but I'm one of the members here who feels it's important to call things by their appropriate names, as complicated and convoluted as that is sometimes.  smile.png

I got my NOA1 for K3 today saying its on its way to NBC (where my I-130 also is). I'm keeping my I-130 process in my timeline here and the K-3 info in my sig. since I can't keep dual timelines.  If K-3 gets approved I will update my timeline for that info to help the other lists & timelines.

 

Of course I get this, just when I hear the've begun transferring I-130s to the other service centers to help with processing. :-/  We'll see!  Even if it just gets hands on my case I'll be happy!.

I've been waiting on my NOA2 for the I-130 for 6 months now and my hubby and I just decided to file the I-129f this month.  A user on another topic, who has also been waiting 6 months was actually called into the office by her lawyer who advised her to file this I-129f now.  Another person also had a similar experience.  We think the Immi. lawyers have come to know something which has prompted them to suggestion their I-130 clients now file for the K-3 path as well.  

 

I mean, once upon a time the K-3 was originally put in place for this exact scenario...where the wait times for I-130 are ungodly long.  Then things started getting processed faster and thats when the K-3 became obsolete...I-130s were getting processed well before I-129fs, so no point in bothering.  But NOW, its back to moving at a snail's pace with a massive backlog, so it would make sense if they are starting to process the K-3s again.  

 

The general theory I've uncovered from reading millions of posts is that during this waiting period, wherever your I-130 is sitting, filing the I-129f means they have to locate your I-130 to confirm that it exists and check its status.  the K-3 is supposed to be processed while the I-130 is pending, but I think the actually operating procedure is that they just grab the I-130, while they're checking it exists, and processing that instead of the I-129f.  Then you get notification that the I-129f is dropped and that your I-130 is advanced to the next step.  Seems awfully coincidental that it happens in that manner more times than not.  (Which is dumb because if they were smart they'd go ahead with approving the K-3 since that would actually get them more money in the long run).

 

So even if the K3 is dropped, if it means getting hands and eyes on the I-130 then whats the harm?  There is no cost to send the I-129f and it will either help or it won't.  You either move forward or you stay where you are.  No loss.  And it least you take a shot at it.  "You miss 100% of the shots you don't take" so I would say go for it.

I did the stupid thing and filed single because that is what I was told to do.  I want to amend, but I'm running into a huge confusion.  My husband is a mariner (crew member on a passenger ship) and tax laws are slightly different for them.  He is a citizen of India and I of the US.  I want to amend the return to MFS, but when it asks did my husband have any income in 2012, I'm at a loss.  Yes, he had income, yes it was from a US sourced company, but as per his contract, he was responsible for filing taxes on his pay upon returning to his home country as per his country's laws and regulations.  

He never resided in the US as he was on a seamen's visa C1/D....does not permit any time on US land aside from work purposes or a few free hours.

 

He doesn't have a SSN/ITIN and doesn't receive W-2s.  India does not tax mariners, so there is no proof of the income being taxed, because legally it doesn't have to be.  

 

So do I say he had income and will the amendment ask me for proof of it? Or do I say no he had no income since he is a NRA and has no tax obligation to the US since he was following the instructions of his US contract by only reporting the income in his home country?

 

I understand US citizen's have to report income from wherever they are in the world, but he is an NRA with no US visa status currently...he is in the process of IR1/CR1.  

 

We don't care about the refund...we just want to get this done as quickly and efficiently as possible.  I know I shouldn't have filed single, but i followed the advice of a professional...you rarely expect that to get you in trouble.  I'm trying to correct it, but I don't know how to look at his income because of the unique situation as a mariner.  Even a CPA for mariners recently advised me to file as single.  I'm so lost.

Hey Darnell, my interview was in June after a case complete in April (April 15th to be exact)  and I wasn't asked for any updated tax documents or forms from the NVC or the consulate.  I brought a copy of my husband's tax extension approval but it wasn't needed.  Another country's embassy or consulate may need it though, so it is a good idea to have those updated forms and documents for interview day, I agree. 

 

That is good to hear.  I think the best bet is just to be prepared with whatever tax docs I can get if interview happens after April tax deadline.

and you want to delay the tax filing...

Everyone has told me that NVC won't expect 2013 tax docs if I am called to submit the I-864 before April 2014.   We should be close to receiving our case #, so I'm thinking that will be the case.  They can't very well request tax docs for a year the IRS haven't even requested for yet.

 

Seems like we're always just waiting on all these government agencies...USCIS, NVC, IRS, etc etc. :-/

I believe there are qualifications to meet in order to use the I-864EZ, you can check in the NVC January Filers thread...the first & second posts of the thread.

 

From what I've researched now and been advised that I will use 2010. 2011. 2012 tax forms since I will not be able to receive the tax transcripts from 2013 until much later in the year.  I am currently thinking to file for an extension for my 2013 taxes so I can do it when my husband gets to the US, but if the time frame doesn't work out, I will simply file as Married Filing Seperately for 2013,  and then amend once he comes to the US.  If I have filed before his interview, then I will just have him carry a copy of my 1040 with him to show that I have filed, even though the transcripts won't be in considerations for the financial support.  Just to show, I am a law-abiding citizen and including him in my tax filing.  :-)
