K-1 Fiance(e) Visa Process & ProceduresPlease help us!!!!!!!! POE issue

Houston finally called us back.We had to go to oklahoma city to the U.S. Customs and Border Protection office. The officer there took her passport and I94 and corrected the date on them because it was dated for 6 months.Should have been dated for 90 days.We then followed him in our car to the USCIS office. He turned in our brown envelope and told us everything is good make sure we get married within 90 days and file the I485.It was an easy process just hope they dont make anymore mistakes. Thanks for the replies they helped guide us in the right direction to get this fixed.

You should have stopped by while you were in OKC! :P

K-1 Fiance(e) Visa Process & Proceduresvaccinations for K1 and AOS

1. Are the vaccinations required for the K1 visa interview as for the AOS, or does AOS require more or different shots than K1?

2. Do I need to tell my doctor to fill out the vaccination card in English? Or will the doctor at the medical before the interview give me another English document anyway?

  • The vaccinations aren't actually required until the AOS, but if you have medical coverage in your home country (or your fiance, if you're the USC) then it's a good idea to get them prior to the medical, because then they'll already be on the sealed medical report you're provided with that can be sent with the AOS package. If they're done here, it would require a civil surgeon to re-transcribe this information and cost you a large chunk of change.
  • You'll need your entire medical record translated anyway, so it doesn't really matter. With the international clinics the US seems to use for the visa medical exams, you never know if you'll have a German doctor (though they usually will at least speak the native language of the country they're in, but a translation may be required anyway).

3. When I go to my medical, before the K1 interview, do I need to take Form DS 3025 with me and let the doctor fill it out? If so, where can I find that form? I read that u need it for AOS, but German doctors don’t give it to you???

4. Does it matter when I get my vaccinations? I don’t want them to be out-of-date once I file for AOS? I read that the medical has to be no longer than 12 months before applying for AOS but does that count for the vaccinations too?

  • You will only take the passport photo(s), your medical records, passport, and a copy of your P3 letter from the Embassy. You won't need the form. They'll provide it.
  • Most vaccinations last for 10 years+ most of the vaccinations required in the list were given here to us as children and weren't repeated after age 7 or so. The Tdap has to be repeated I believe every 10 years. Don't worry about those.

5. I am 26 years old. Do I still need the HPV vaccination?

6. Can anybody provide a current list of the vaccinations I need to get? I found so many different ones. I’m confused.

  • No. The HPV is not a REQUIRED vaccination. It's not even required here. Yet. Until the drug companies want more money...
  • Try this link to the USCIS Vaccination Requirements.

7. I don’t understand the whole vaccination requirements based on the age. I’m 26 now. According to the list, a Polio vaccination for instance is only required up to age 17. So lets say I never got that shot, will I still need to get it now or will I only need to have the ones that are age appropriate for me right now? Same for Rotavirus, Hib, and PVC, hepatitis A, meningococcal, pneumoccocal

Age appropriate only. From most countries, it usually only includes Tdap and MMR, possibly Varicella if you've not had chicken pox. I'm not sure from Germany.

8. If my DTP/DTaP/DT or Td/Tdap shot was more than 10 years ago, do I need to get a booster shot? Are there any other shots that might require a booster?

That might be recommended. I've spoken to doctors who say the Tdap should be redone every 5 to 7 years, and some who say they're good for 10. Either way, you're on the tail end of the spectrum, and it's always a better-safe-than-sorry with those things and bureaucrats.

9. Do I need a shot for pertussis? Some charts say yes, some don’t mention it.

Yes. It's on the list in the link I gave you earlier.

Hope this helps. Good luck!

K-1 Fiance(e) Visa Process & Proceduresonce meeting and call me wife
It could. If the CO at your interview thinks you're legitimately married, and you show emails, letters, etc. where he's called you his wife, it could.

I've heard of some CO's trying to trip up an applicant by calling the fiance "wife" or "husband", and the applicant is supposed to politely correct them. Just remember to do this and you'll be fine.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresBest Course of Action?
Unfortunately the K1 or marrying her and filing for a CR-1 are the only options you have. The CR-1 is less expensive than the combined K1 & AOS, but according to most reports, takes slightly longer, but has the added benefit of giving her a green card as soon as she enters the country instead of filing for an AOS after she gets here and you're married, like the K1 does.

Hope that helps.

K-1 Fiance(e) Visa Process & ProceduresWhat form for Affidavit of Support
You'll get your instructions when your case gets to the consulate. The NVC just forwards your case there, so if you get a letter from them (we didn't) it'll just give you the new case number, no instructions.

Hope that helps, and good luck!

K-1 Fiance(e) Visa Process & ProceduresPacket 3 assembly question
I suggest not stapling if you can help it. Here's how I did mine - not saying I'm perfect, just offering a suggestion:

I used a 4 part classification folder. 4 pronged sections. In each section, I put an astrobright between each document, and tabbed the astrobright with the document's name to make them easier to find.

Section 1:

DS-2001 (2 originals, 1 copy)
DS-156 (2 originals, 1 copy)
DS-156K (2 originals, 1 copy)
DS-157 (2 originals, 1 copy)
DS-230 Pt. 1 (2 originals, 1 copy)
Birth Certificate - Copy punched, original folded in punched plastic sleeve
Divorce Decree - Copy punched, original folded in punched plastic sleeve
Police Report - Copy punched.... you get the point
Affirmation of Intent to Marry letter

Section 2:

I-134 - Original
2009 Tax Return
Employer Letters
Pay Stubs
Bank Letter
Bank Statements

(All of this was duplicated by co-sponsor just in case)

Section 3:

Proof of Relationship Section -

Evolution of Relationship letter
Photos
Copies of passport pages (both of us)
Copies of boarding passes and trip itineraries
Copy of wedding dress receipt
Copy of Christmas Card that said "To my Fiancee" on the cover
Copy of shipping receipt for Christmas gifts
38 pages of phone logs (just a sampling of our 2 years on the phone!)

Section 4 -
Copies for HIS records of our I-129F stuff.

I just laid it out in a way that made sense to me. You can do it however you like. The important thing is that they're going to want the forms FIRST, and the documentation when they get to the interview itself.

Hope this helps.

Good luck!

K-1 Fiance(e) Visa Process & Procedureswhile waiting
You can also download the paperwork for your Packet 3 from your embassy/consulate website. This will save you time as you can fill them out in advance.

To fill them out you'll need to put together a CV/Resume, or at least a timeline of where you've lived and worked for the past 5 to 10 years. For some, that takes some thinking and digging for addresses and supervisors' names, etc.

As KC said, be sure to make a visit to your GP and have your shots updated, and see if they can give you the MMR and Tdap shots, and if you haven't had chicken pox, the Varicella as well. It's much cheaper to get them before you get to the official medical exam, because the official examiners will charge you a small fortune for them.

If you've got your police certificate and birth certificate, and any divorce decrees, etc. that will need to be translated, it's a good idea to get that done ASAP.

Talk to your fiance and make sure they're putting together the documentation for her I-134, and arranging for a co-sponsor if necessary. The I-134 has to be an ORIGINAL, so she'll need time to send it to you, along with copies of the documentation, and any divorce decrees, proof of relationship, updated letter of intent to marry, etc.

Hope this helps! Good luck!!

K-1 Fiance(e) Visa Process & Proceduresgathering proof of relationship
You said you just began speaking in April of this year. Have you met in person? That is a requirement of the K1.

You might think about switching from whatever home phone you have to a Vonage plan if you have cable internet at home. Vonage is very inexpensive, with free landline calls to the UK, and you have instant access to your phone records for free online, with very detailed records of all calls (even searchable, which makes retrieving the records for just your fiance's calls very simple.

I have Vonage with the $25/mo unlimited world plan, and for an extra $4.99/mo I got a virtual number in Peter's hometown in England, so he's able to call me unlimited for free as well (it's literally like he's dialing a landline number down the street!). You've also got the added benefit of Simulring, which will allow you to have your number ring on your cell as well as your home phone at the same time, so you'll never miss his call.

K-1 Fiance(e) Visa Process & ProceduresAnnulment Question, as Relates to K-1 Process
So long as she is free to marry, that's all the USCIS cares. She's been free to marry since last year, so that's fine.

It still never hurts to frontload proof of relationship evidence in the petition packet, though.

The petition was just an approval for the non-immigrant fiance (I'm guessing you?) to APPLY for a visa. If none of the application documents have been sent to the embassy, you haven't applied for it. If you drop everything now, the petition simply expires. You shouldn't have any problems.

Sorry to hear things didn't work out. I wish you both the best of luck.

K-1 Fiance(e) Visa Process & ProceduresNOA2 Stolen
I agree with Coconuts.

While people DO need to follow the rules and SHOULD have backup copies of everything, there is NO REASON whatsoever for the kind of attitudes that many of the older members (and even some of the newer ones lately) take regarding many of the newer members and mistakes that are made.

I'm sure she feels bad enough at having lost the laptop and the original. She's just as stressed out as the rest of us who are going through the process, and now is even more stressed out because she's lost so much during her visit to her fiance, which could impact the Interview and AOS in the long run.

Please stop acting like you're the judge and jury of this place. It might not be your intention, but it comes across that way. You're not helping her by issuing your judgments. You're not helping anyone that way. She DID make a digital copy. Most of us know to do that. I've got a digital copy on my laptop at home, my work computer, on a flash drive, in my gmail account, and even on the SD card in my phone just in case, as well as 3 paper copies of everything in my file. I'm a bit OCD about backups. It doesn't mean things don't happen beyond our control.

Please, just try to have some compassion for others, and as your mom probably told you a million times: If you don't have anything nice to say, don't say anything at all. You older members who have been there, done that, got the t-shirt, burned it and are now wisened to the immigration ways seem like you're getting callous to the fact that YOU were once here, YOU were once going through this process and were just as new and scared as we are. You are making the newer members feel very unwelcome and unwanted when you act like this.

Gary & Alla - you are one of the posters here I've actually looked up to when you've given information in the past that has seemed invaluable, but your post here sounds like you're taking a page from the "legacy members" in the UK forum. Please, don't. You're sweet, and considerate and very helpful most of the time. Can we please just keep the peace?

K-1 Fiance(e) Visa Process & ProceduresSSN
According to the SSA website, you should wait at least 10 days before applying to make sure her entry has been recorded in the database and that they'll be able to find her. If you don't they'll likely advise you that they'll have to do a manual search, which will seriously delay the process. If you go too early and they can't find her in the system, ask them to look her up in the SAVE database. If that doesn't work, just tell them to cancel the application and wait a week before trying again.

Hope that helps. Good luck!

I was told the same thing when mine was received there and they sent it on to London the very next day. Don't sweat it yet! You'll have time to sweat while waiting for your P3 to be sent and your forms to be logged back in when you've sent them back.

Additional Processing is just their term for "Sticking it in an envelope" half the time. Apparently they needed to dress up the procedure with technical terms.

I didn't have his original signature on anything. We used a scanned copy of his letter of intent, it wasn't notarized, just signed, and attached a copy of his info page from his passport. My attorney advised me to sign his G-325a with his permission, but others have said they didn't have it signed and were approved. You had an original signature on the one you sent in, so send a COPY of it, just to prove you had her signature and were putting the duplicate together with as much haste as possible.

No need for thanks, honestly. I just wish there were more that the rest of us VJ'ers could do to help. We're all going through this and it's so easy to look at people in awful situations like yours and say, 'Phew.... glad it's not me.' But how does that make you feel? It could so easily have BEEN me, or any of us. Right now I'm lucky and everything is moving along swiftly, but they could drop my case in the bin tomorrow by mistake, or spill their afternoon tea on it and claim it was damaged in shipping. It's a bureaucracy. There's no telling what they'll do.

You're right. This IS ridiculous. Contact your Congressman about this. Provide a copy of the letter. Explain what happened and how long you've waited, how many BAD answers you've been given. Have him or her DEMAND better help and expedition of the duplicated case. You paid the USCIS for a service and they haven't delivered. Complain until you get service.

I'm sorry, I wish I could provide better answers. You DID make a complete copy of your packet before you sent it, right? So you can reconstruct everything?

Unfortunately for K1's there is no way to track it once it leaves the USCIS unless you call them. Once you have the case number, call them in about 2 to 3 days to see if it's been sent to the Embassy/Consulate. Once that's happened, you'll have to check with either the embassy/consulate or DOS to see if/when it's been received. As I said earlier, mine only took 2 days to send on to the Embassy, so hopefully yours will fly out the door very quickly too!

Good luck!

Call the DOS to see if/when it was sent to London.

202-663-1225 (Press 1 for the main menu, then 0 for an operator; if that doesn't work, press 1, 4, 2, 3, 2, 0)

Got through to the NVC. Nothing. They suggested I call the USCIS to see when my packet was sent.

Called the USCIS and was escalated after begging. Then was disconnected. Called back. Rather rude escalation operator told me that they can't even email the NVC to check on things till it's been 30 days, so I need to keep waiting.
