Thanks for the reply. The only income he made in the UK was in british pounds from a British company. He paid UK taxes every month. I have read about the foreign income exemption but I don't really understand it!

Are you saying that if the income was solely foreign he doesn't have to file?

I'm sure we wouldn't need a joint sponsor purely for tax returns?? He makes almost $40,000 a year now.

Hi guys,

Long story short: husband (USC) been living off GI Bill since 2009 (which isn't considered taxable income), moved to UK on spouse visa December 2011. Worked in UK for UK company February - August 2012. Moved back to USA December 2012.

Hubs didn't file US taxes whilst living/working in the UK. Called IRS and they didn't give a straight answer on whether he needed to or not...so he didn't.

Now we're at the NVC stage and worrying because he doesn't have a tax return for 2012 (he has a great job now and exceeds poverty level etc).

Has anyone got any experience with this kinda issue?
We figure he might aswell just go ahead and file now, but we can't get any good advice from IRS or tax professionals.

Can anyone recommend a company or any advice at all? Would be GREATLY appreciated!!

I've read that they visa is active from you entering the US.
If you enter before 2 year anniversary you get a 2 year green card, if its after your anniversary it will be a 10 year.

So I would probably wait until your anniversary. Hope someone can back me up in saying that?

I'm 90% sure I'm right.

I updated my passport at the NVC stage (still had a few years on it but was a bit OCD about everything being in one name, my married name). I just sent the NVC photocopies of my new AND old passport stating which was which. Also meant in all further contact I was referred to by my married name.

The earliest appointment I could get for it was the same day as my medical on the 16th unfortunately. My baby was premature so hasn't been out of hospital for long so we are only able to be doing this now. 

I've read it will take about 6 weeks...hopefully not longer, the wait for my NOA2 took forever!!

In April of this year me and my American fiancé had a baby who resides with me here in the uk
My fiancé is currently here until August and last month we received our noa2 (FINALLY!!)
I arranged a date for my medical on the 16th of this month and have been asked to send my forms in to the us embassy.
I am wondering where baby slots in!
As he is born to a us citizen we have read he is granted us citizenship already and so on the date of my medical we are also going to the embassy to apply for his passport and to report his birth.
I am wondering if any forms on my k1 visa need to be filed for him even though he will have an American passport?
I'm also wondering whether (as my fiancé returns to the us on the 8th August without me and his son :() whether interviews can be sped up...or how long from sending off the forms and having the medical it takes to get an interview?
Initially planned on returning with my fiancé and baby but doesn't look like this will be the case anymore!

thanks! yeah it took around 9 months, seemed like forever. I was pregnant for most of that too which made it even harder, but luckily we had a few visits in that time :)

Just got back from London where my interview was APPROVED this morning! 

 

Thought I'd go through my experience to help others. 

 

Went down to London from Manchester during the night on a long coach ride so was very tired before my interview! Maybe not the best way, but had no other choice. 

My interview was at 9am so joined the loooong queue at 8.30am. Got it into my head I wouldn't be making my 9am appointment! 

I had a folder full of forms, evidence, I-134's, photos etc. dressed smartly in black pants, smart top and heels...although the majority there were dressed pretty casual! 

 

Eventually, I got through to the embassy. Wasn't sure of the time because I had no phone, but pretty sure I was waiting around an hour! 

NOTE: Take reading material! The wait is long and boring!! 

 

After about another hour and a half, my number was called...finally! I went up to my first window. 

The man there was very welcoming, took my fingerprints, took my birth certificate, police certificate, I-134's and photos...asked some general questions (have i ever been denied entry to the us, do i have a criminal record). I then went and sat down and waited another 20 minutes until I was called to my interview...if you can call it that! 

It was very relaxed. The woman asked me how I was doing, again took my fingerprints and then asked me a couple questions (where did you meet, when did you first discuss marriage, have you met his family and does he have any siblings)... and that was that! She told me with a big smile on her face that I had been approved!!! 

 

Don't know what I was so nervous about now!

Hello, hello...another April filer here - April 4th. Isn't so frustrating and disheartening to see May, June, & July filers get theirs approved while we sit and wait for hell to freeze over...hahaha. Trying to laugh a little at this whole agonizing and painful process. We so desperately want to be with our loved ones but can't due to a very illogical process or system. I don't know or understand the "order" in which they look at or okay the petitions, but to me it seems very wrong. My parents told me that life's not fair.....now I see they were so right. I'm just venting a little and very frustrated right now. When I go to any government agency such as post office line, or drivers license line, they process the people in line and in order. Why doesn't the USCIS process the applicants in line in the order they receive them?? Why do they jump and approve July filers when there's ones from November, December, and January waiting their turn?? I don't understand it.....can someone educate or school me on the process or logic I'm missing. I'm somewhat patiently waiting....HELP!

 

 

I do not understand either... we filed our petition in AUGUST 2012...and received our NOA2 in May 2013... only had my interview last week and still do not have my visa in my hand. 

Keep your fingers crossed that your process does not take as long as ours did, (petitions seem to be processing quicker this year).... but prepare yourself for it to do so!

Yeah, that's what I thought when I read the other user's comment. I have read about a lot of couples where the beneficiary was pregnant, and they tried to expedite the process without success. Sorry OP, you will have to wait.

 

Yeah, we didn't try as we were advised not to. Once your application is taken out of the queue so that they can consider you for expediting, if you're denied your folder is put back...and not in the same place in the queue that you were in. Only things such as a terminal illness or impending deployment are grounds for your application to be expedited. Even in those situations, it's not definite that you'd be eligible for it. 

Saying all of this... from my NOA1 to my NOA2 it still took 9 months!!! Over a year later and I'm still not in the states (almost though).

I'm flying in 10 days on the 11th September. Yes our son is flying with me, he has a US passport and consular report of birth abroad certificate, both which were applied for at the US embassy in London. Your fiance and baby needs to be with you when you apply for these, else you need to file a reason for his absence and consent to the application. My fiance was over here at the time and so attended with me. Once your baby is born, you should make an appointment through your US embassy's website to go to the embassy and apply for your baby's documents. This can be done at any time, although I would advise to do as soon as possible. My baby was a few months old as he spent the first 2 months of his life in hospital and so obviously couldn't go down to London. It's a relatively simple process though.

you're welcome :)

do not try to expedite your process as another user has advised, you will be denied as pregnancy is not a valid reason to do this. Your case will be taken out of the queue, looked at, denied and then put further back than you were to start with. 

Just wait it out, cases are processing more quickly this year, we had an unfortunately long wait! But seems to be much better for people this year. I can't see you having the baby in the states, but you may be able to go over shortly after.

Your fiance can always come over for the birth (or try to)

1) If you are pregnant, you can expedite your case. You can expedite your case by calling USCIS customer service, and letting them you would like to expedite your case (please see link below). Then, you will need to submit proof of pregnancy to the service center.

hi i am dominican my boyfriend applied for a k1 visa on August 14 had five months but every time I go to check my case only says initial review we are to September 1st and we had information of nothing, the problem is that I'm pregnant and my boyfriend and I do not know if we have time to get it and the child is born in the united states pleasee someone who knows more about this and can tell me about how much longer we have to wait. and we would have to do if the baby is born in dominican republic

 

I was also pregnant during our K1 process. We applied in August 2012 and I fell pregnant at the end of September 2012. Our initial plan, based on the promise of a 5 month wait, was for me to have the baby in the US...it didn't happen. Baby was due June 15th 2013, but came 11 weeks early April 3rd 2013. My fiance missed the birth...and we hadn't even received our NOA2 yet. 

When is your due date? The likelihood is, based on the fact you cannot fly after a certain date, your baby will be born in the Dominican. Try and make plans for your Fiance to come over around the due date (we did this... but obviously baby had other ideas) 

I didn't receive my NOA2 until May 13th 2013 and I am still not in the states. I fly Wednesday 11th. Do not worry about your baby's status, he/she will automatically be granted US Citizenship, you will have to make a trip to the US embassy to report their birth and apply for a US passport for them at which point they can fly over with you. It won't affect your visa, and I have heard (and found due to my approval) that your baby works in your favour as far as evidence of relationship goes!

I sent in my application for my fiance on July 17, 2013.  I received my NOA1 on July 25, 2013.  I was ready to wait for 5 months, like the wait time says for the California Service Center.  I just got the NOA2 in the mail the other day (August 27, 2013), saying it was approved and was being sent to the consulate in Tegucigalpa.  I am thrilled that it was so fast!! I am wondering if anyone has any insight into why it was so fast?

Lucky!!!...mine took almost 10 times the length of your wait!! Don't know how they do it, seems like it's a lucky dip when they're working on cases. Does seem to be processing much faster this year though. Congratulations and all the best!

Not yet! My interview was approved a week ago, so I'm hoping to fly in a couple of weeks. 

Luckily, my fiance flew over the very next morning after my son was born and stayed for a couple of days... he then came back a month later and stayed for 3 months which we were fortunate enough to be able to do! He went back home about 3 weeks ago and is missing our baby boy so wanting to get over there quickly!! 

 

I know how difficult the wait is! I can't see you having as long a wait as we did, they seem to be processing a lot faster this year. The average is supposed to be about 5 months and some receive it before then, so hope that you're in that group of people!

I see you're in the UK too, so if you're able to, visit each other whilst you're waiting.

I came through Philadelphia, they were scary!! Been through Chicago airport before and they were a lot more laid back (but this might depend on the person) hopefully they're all that way though.

We haven't put together any yet!) I think you apply for SSN after you're married! I should probably look into all this (have a small baby so getting things done doesn't happen much!) I'm pretty sure it comes after marriage though.

I came to the US on my K1 Visa last month, he just needs the big packet that the embassy gave him and his passport with the visa stamp inside... also, depending on which airport he's flying into, he also needs to be prepared to wait at immigration. I waited a loooong time just for them to stamp me through...and I missed my next flight cos of it :(

Yeah we will look into it further. I'm not sure about elsewhere, but in the UK a woman isn't allowed a C-Section upon request, unless something is wrong with the pregnancy. I'm young and healthy and the pregnancy is low risk and so the chances of being granted one are very slim. I'd also rather not opt for the C-Section. If I can get over there in time, I would much rather try and sort this insurance out. Flying with a newborn from the UK to the middle of the states is not something I'm interested in doing. I'm also currently living with parents in the UK and there isn't enough room to house another person, whether they're big or small! If we can, being there is preferable. But thanks for the advise!

Hey, we applied and received our NOA1 about a month and 10 days before I got pregnant so we were already slightly into the waiting process when it happened. A congressman my fiance met at a military meal offered to help with our case, but when I found out I was pregnant and that they would try to expedite it I refused on the grounds I had read a failed expedite can actually slow things down...and that pregnancy isn't really a valid reason to request an expedite. My Fiance isn't active duty anymore, that ended in September last year, he's now part of the reserves. At the moment I'm just praying the backlog with USCIS gets cleared and we receive our NOA2 soon!! Good luck with your case.

I'm hoping as I'm only 19-20 weeks, I can get over there in time! Fingers crossed. It'll be awkward to have to purchase baby items for both here and there and then to travel with a newborn too. We're covered as far as medical insurance goes and I'm under the impression that once married (which will have to be done immediately) I'll be under his. I am getting anxious as I have read that there is quite a large backlog with the Cali office?? :( I've seen anya service request form on the USCIS website which asks whether or not US citizen is with the military - which my Fiance is - does this help any??

I know many people have probably already mulled over this scenario, but I'm wondering if any stories are similar to mine. I'm currently just over 19 weeks pregnant and almost 5 months and 2 weeks into the K1 process. According to the Cali office, petitions are aimed to be processed within a 5 month timeline (not happened in this case). I'm considering calling the office to find out a little more about where we stand right now. Anyway... I'm from the UK and wondering if, when my visa is sent to London, there is any leg room for pregnancies. I know the process cannot be sped up currently, and a lot of you are likely to criticise me and tell me to wait my turn like everyone else, but where the interview stands, I am wondering if I am able to get in sooner. If not, does anyone have any guidelines as to how long the wait will be? Worrying a lot as I'm already getting way too big, flew to see my fiance over Christmas and plane ride was difficult enough then... not looking forward to waiting longer as I will be HUGE :(. My Fiance is also ex active duty and currently part of the military reserves. Wondering if this does anything for us??

Yes I have tried to pay it online and cannot. 

I have rang about 10 different numbers and spoken to countless people who refuse to give clear instructions on how to pay it... I was under the impression you could pay via phone...tried to do this and was given an automated response informing me there is no outstanding fee to be paid. 

Just spoken to a woman who sounded like she was midway through a nap and told me I have to look for it myself!! 

 

 

I have also been on a website instructing me to fill out a DS160...halfway through this and find that you don't do this with a K Visa... 

so bloody confused by all of this! 

 

Would paying on the day be okay? 

I live in the north of england and so the 5 hour journey in the middle of the night is going to be made even more painful if they refuse me the interview based on this.

Hi 

 

On the I-134 Question 7 regarding employment, what is put in this box if the sponsor is a student, yet receiving BAH from the military? 

Do we just put engaged in studies with whichever college etc? 

Or do we put previous year earnings derived from 2012 tax return? 

My fiance was in the military in 2012 earning way above the 125% poverty line which his most recent tax returns show and which, along with 2011 and 2010, we are submitting with the form, however he is now an unemployed full time student (unemployed due to being over in the UK to help me with our new baby, but receiving around $11,000.00 annually from the military for being in school along with free schooling.) 

We have a co-sponsor too. 

 

I ask the above question because we are basing our co-sponsors annual income on their 2012 tax return. 

 

With regards to Question 8 (dependents of sponsor), would we put our UK born son on my Fiance's form? He is registered now as a US citizen and has a US passport, but has not yet been to or lived in the US. 

 

Finally, I am confused about paying this visa fee!! I rang and was told that the fee of about £150 is paid AFTER the interview. However, I have read elsewhere it is paid before... 

I am also confused as to whether or not it is the same fee that is paid when the I-129F is submitted or not? 

 

My interview is on Monday. I am considering calling the embassy today, but just wanted two answers as to when and where the fee is paid!

Shouldn't be an issue, they do take the 2012 tax return into account, but I think they would take your explanation into consideration. Just make sure to prove your current income properly. 

At this point, you do not need to prove 125% of the poverty line, that comes when your fiance is adjusting status...at which point you will most likely have your 2013 tax returns to hand. 

The interview favours (but does not legally require) you to prove 100% of the poverty line, or that at the very least your fiance will not become a public burden. 

If you are concerned about the financial aspect, then find a co-sponsor, but I do not think you need to worry about it!
