K-1 Fiance(e) Visa Case Filing and Progress Reportsfinally i got an appointment at ciudad juarez mx.

Everyone does not need a waiver. A waiver is needed for someone that gets denied based on ineligibility for the K-1 visa, such as having unlawful presence in the US before. My husband(fiance at the time) needed no waiver as he had never been in the US before and his K-1 visa was approved.

His visa was ready in 2 days. Someone else that was approved on the same day as he was got their visa in 3 days.

K-1 Fiance(e) Visa Process & Procedureshelp please!!!

Yes, have the letter for his new job state his position and how much he earns, whether it be annually, monthly, weekly or hourly. If he makes an hourly wage, his current annual income would be how much he makes an hour times how many hours he works a week, then multiply that by 52 weeks. That would be his current annual income. You do not list only what he has made so far at the job.

You are hung up on his past income. The form is not asking how much he made in the past. You can bring the information from his old job, but that would only be to show he is consistently employed. That income would not be listed on the form. His current income is only what he is currently earning.

He can put daughter's fiance for your fiance's relationship to him.

oh ok sounds great thank you so much yes i asked the lady to please put how much he makes hourly and how many hours he works she put 43,00-60,00 yearly and that he is working 42hrs

and ill just attach the letter from the old company and put that he was laid off due to lack of work and thats it rite

Cari&ChuyFemaleMexico2013-07-10 13:54:00
K-1 Fiance(e) Visa Process & Procedureshelp please!!!

Current annual income is NOT what he has made so far. If he makes $34,000 a year, then THAT is what you list as his current annual income on the I-134. Use the letter from his employer and his recent pay stubs to prove that income amount.

i also have his letter of employment from the other company with the date june 26 can i add this letter and put that he got laid off it shows whats his current income on there or dont

MY FATHER DOES HAVE A BANK ACCOUNT BUT HE ONLY DEPOSITS FOR BILLS AND EVERYTHING AND THE REST OF THE MONEY HE HAS IT SAVED AT HOME LOCKED DOWN DUE TO THAT THEY HAVE STOLD MONEY FROM HIM IN THE PAST FROM THE BANK AND HIS SCARED OF THAT HAPPENING AGAIN SO HE DOSNT HAVE ALOT IN THE BANK IS THAT A PROBLEM?? <--Assets are not required. If his income alone is enough for his household size plus the beneficiary, then how much he has in the bank is a non-issue.

ON THIS PART

IF YOU ARE NOT A US CITIZEN BASED ON YOUR BIRTH IN THE UNITED STATES....

MY FATHER EARN HIS CITZENSHIP AS IN HE APPLIED FOR IT

SO WHAT OPTION SHOULD HE PUT

A. IF A US CITIZEN THROUGH NATURALIZATION GIVE CERTIFICATION OF NATURALIZATION NUMBER

B. IF A US CITIZEN THROUGH PARENT OR MARRIAGE GIVE CERTIFICATE OF CITIZENSHIP NUMBER

C. IF US CITIZEN SHIP WAS DERIVED BY SOME OTHER METHOD , ATTACH A STATEMENT OF EXPLANATION

D. IF A LAWFUL PERMANET RESIDENT OF THE UNITED STATES GIVE A NUMBER

E. IF A LAWFULLY ADMITTED NONIMMIGRANT, GIVE FORM I-94 ARRIVAL DEPARTURE RECORD

Then he checks which one applies to how he gained his citizenship and enters the # from his naturalization or certificate.

ON 2. FOR RESIDING IN THE USA SHOULD I PUT WHEN HE FIRST ENTERD OR WHEN HE GOT HIS CITIZEN SHIP

The date he started residing in the US.

AND ON THE NAMING OF SPOUSE AND CHILDREN IF THERE ISNT ANY SHOULD I PUT N/A

Yes, for #3, if the beneficiary has no spouse or children, you put None, like on the example form> http://www.visajourn.../Form-I-134.pdf

THE HOUSE WE LIVE AT THE MOMENT IS NOT HIS YET BUT WE ARE BUYING THE HOME DOES THAT COUNT UNDER REALESTATE VALUE

No. As I said for the first question though, if his income is enough, no need to list assets. Leave that part of the form blank.

ON SEC. 8

FOR MY FATHERS DEPENDENT IS MY MOTHER AND MY SISTER ARE THE WHOLLY DEPENDENT OR PARTIALLY DEPENDENT

Wholly. His household count will be himself, his wife, any minor children, anyone else he claims on his taxes and the beneficiary. So, it sounds like he needs enough income for a household of 4> http://www.uscis.gov...form/i-864p.pdf

thank you so much

Not sure how long it is taking right now for the NVC to receive the files. Start calling about a week after approval.

Yes. ASC is not needed for the medical. You just need to go really early in the morning to get in line. You only need the invitation/information letter from CDJ and your passport.

thank you jay-kay you have been a great help for me!

one more question for you is there an example page on how my father has to fill out the i-134?

The ASC appointment can be made at these centers> https://usvisa-info....asc_information

Most people just go ahead and schedule the ASC appointment in Juarez too, a day or 2 before their interview. Are you sure the one for 15 days from now is not just the first available? Can you look farther on the calendar to see if there are any later than only 15 days away? You can't see all the dates until you pay the fee.

THANK YOU SO MUCH! I FEEL STUPID I JUST PROGRAMED MY APPOINTMENT TO THE DATE I WANTED (: IM SOOO HAPPY THANK YOU SOOO MUCH!

If it says interview appointment, then it is for the interview. The ASC is not an interview, it is just for taking your picture and fingerprints. The ASC appointment can be made at other consulates besides Juarez, so if it says it is the interview and it does not ask you to select an Applicant Service Center, then that is for the K-1 interview.

its says this

por eso me confundi pokito oh really so he can get that done somewhere else like in gomez palacios??

is because im going to mexico on july 13 so thats the only reason i havent made the appointment because i want to go with him to take him all the paper work im scared of it getting lost so i was planning on making the appointment at least the 15 or 16 17 of july everytime i go on the website it either gives me 15 days or 14 days

I do not know why they are throwing in the I-864A with the I-134 in their instructions. It is wrong and they should stop it. The I-864A is a form used for a household member that you reside with, yes, but it is to go along with an I-864, not an I-134. The forms are not interchangeable.

You fill out your I-134 and supply your documents. Your dad will fill out his own separate I-134 and supply his documents. What you have listed is good. If he works 2 jobs, then he should add up his income from both and list that in the current annual income. His pay stubs and letters from employers are his proof of employment. If the 2nd job is one where he is an independent contractor and self-employed working for a certain person, then he should have received an 1099 for that and his 2012 taxes would reflect that income. He should also include proof of being a USC or LPR with a copy of US birth certificate, naturalization, bio page of US passport or front and back of green card.

After you are married and at the adjustment of status stage, the I-864 will be required. If you still need a joint sponsor, then you and your father will both fill out your own I-864 forms. If he has a qualifying household member he wishes to combine income with, such as a spouse, then his spouse could fill out an I-864A to combine their income with his on his I-864. Those 2 together would then act as your joint sponsorship.

Just focus on the K-1 interview and what you need for that right now though. Here is the example for for the I-134 > http://www.visajourn.../Form-I-134.pdf

hey how are u quick question im done with the ds 260 printed it out did my 156 and made a duplicate copy of it

Almost completely correct. The petitioner/sponsor will not combine incomes for AOS either though. The petitioner/primary sponsor fills out an I-864 and a joint sponsor fills out their own separate I-864. If either the primary or joint sponsor have a qualifying household member, such as a spouse, parent, adult child or sibling that resides with them, then the qualifying household member can fill out an I-864A to combine their income with the primary or joint sponsor that is filling out an I-864. A good example of this is the primary sponsor asking a parent to be their joint sponsor for AOS. If the parent is married, then one can fill out the I-864 as the joint sponsor and the other can fill out an I-864A as a qualifying household member of the joint sponsor. Their incomes would be combined to act as joint sponsorship together.

Replace This Page With Evidence to Support Your Form I-134

All sponsors must submit the following documentation with their Form I-134, Affidavit of Support:
1. Proof of current employment or self employment. A letter from your employer on company
letterhead showing your income is good evidence. You must also include at a minimum your last
four pay stubs.

2. A photocopy or an Internal Revenue Service-issued transcript of your complete Federal income
tax return for your most recent tax year, or an explanation if it is not submitted. If you are selfemployed, you should have completed one of the following forms with your Federal income tax
return: Schedule C (Profit or Loss from Business), Schedule D (Capital Gains), Schedule E
(Supplemental Income or Loss) or Schedule F (Profit or Loss from Farming). You must include each
and every Form 1040 Schedule, if any, that you filed with your Federal tax return.

3. Your W-2s and/or 1099 forms (photocopies only, not originals).

4. You may also, at your option, submit a photocopy or an Internal Revenue Service-issued
transcript of your complete Federal income tax returns for your second and third most recent tax
years if you believe these additional tax returns may help you establish the ability to maintain your
household income at the governing threshold set forth in Form I-864P, Poverty Guidelines. You can
see the Poverty Guidelines here: http://www.uscis.gov...form/i-864p.pdf

5. Occasionally a consulate will ask for your last 6-9 months bank statements, especially if you are
self employed. If possible, you should go ahead and include these bank statements just in case.
The Form I-134 must have your original signature. This means you must sign and mail to the
alien. They will not accept a scanned or faxed signature!

If you are using the income of persons in your household or dependents to qualify as a sponsor,
you must also submit a separate Form I-864A, Contract Between Sponsor and Household Member,
plus all of the evidence listed above for each person whose income you will use.
This placeholder page is in the proper order for submission. Replace with evidence.
Remember to remove this page and all other pages with the
"DO NOT MAIL" border before you mail your package!

For the I-134 it is a co-sponsor. A co-sponsor fills out their own separate I-134, not an I-864A. A joint sponsor for the I-864 does not even fill out an I-864A. The I-864A is used for a qualifying household member of a sponsor/joint sponsor that is filling out an I-864. They are giving you unnecessary misinformation.

You fill out your I-134 and provide your supporting documentation> most recent tax transcript, letter from employer and most recent pay stub(s).

Your co-sponsor fills out their own I-134 and provides their supporting doumentation> most recent tax transcript, letter from employer and most recent pay stub(s), plus proof they are a USC or LPR. The co-sponsor needs to have enough income for their own household size plus the beneficiary.

hey look ive been researching i found this at the cdj website

  • THE PERSON WHO FILED THE PETITION ON MY BEHALF IS NOT WORKING. DOES HE OR SHE STILL NEED TO SUBMIT AN AFFIDAVIT OF SUPPORT?
    • Yes. If you are subject to the I-864 (Affidavit of Support) requirement, as almost all immigrant visa applicants in Mexico are, the petitioner must submit an I-864 for you.  Otherwise, the consular officer will not be able to issue you a visa.  This requirement applies even if the petitioner is not working or is working but does not earn enough money to support you.  In these circumstances, your petitioner may find a joint sponsor who is willing to file an I-864 for you, or he or she may have a household member who is willing to file an I-864A (Contract between Sponsor and Household Member).  Remember that every I-864 and I-864A must be accompanied by proof that the filer is a U.S. citizen or legal permanent resident, and the most recent U.S. tax form as of when the I-864 or I-864A was signed.   If the petitioner is not working, he or she must state this on the I-864.  If the person has not filed a U.S. tax return, regardless of the reason, he or she must explain in writing why not.

Well, they are incorrect. The I-864A is not used with an I-134. They are mixing up two different affidavit of support forms.

I would wait until the case has been received by CDJ, then as long as you have your CDJ case #, invoice # and beneficiary ID # from the NVC, you can fill out the DS-260 and start scheduling things.

its because i have a joint sponsor

No DS-230 for Juarez. You need the DS-260. See the link I posted above in this thread.

Also, I am not sure who are referring to that gave you the info you posted above. No I-864 or I-864A is used for the K-1 interview. If you need a co-sponsor, you will each fill out your own separate I-134 and provide the supporting documentation. There is no combining of incomes. The co-sponsor must qualify on their own for their own household size plus the beneficiary.

RAPID VISA IS THE ONE THAT GAVE ME THIS INFO THEY HAVE BEEN HELPING ME WITH MY PROCESS.

YES I JUST FINISHED SEEING THE LINK YOU POSTED THANK YOU SO MUCH IT WAS A GREAT HELP

SO ITS FINE FOR BOTH OF US TO DO THE DS 260 ASAP! EVEN THOUGH IT HASNT LEFT THE NVC

Gross income yes. Use letter from employer and recent pay stubs to prove current income along with the I-134 and most recent tax transcript.

If self-employed, it is gross income but after business expenses.. line 22 of the most recent 1040, total income.

I think its after it arrives at Juarez. But how are we going to know when that happens? Oh lucky you! Best of luck to you and your fiancée and thank you so much! I would greatly appreciate it! I heard La Playa hotel is pretty cheap and walking distance to the consulate so I guess we will stay there. and well I a little confused too. I have mostly everything ready. I just need my cosponsors paperwork and to do DS156 and DS260. My fiancée hasn't gotten his passport either but they give it the same day so no worries I am making him go soon though. I know I want to schedule the interview already! like ASAP! smile.png

oh thank god you told me rite now me and my fiance are going crazy i think we are just really nervous something goes wrong at the last minute after we have gotten soo far just to mest up thank you same to you best wishes and hopefully everything goes more than good for us! (:

with me i have everything just that i cant do the ds156 because i need the pasaport number but besides that i have the proof of employment (sponsors also) tax returns from 2010 2011 2013 (sponsors also)   w2 forms (sponsors also) and form i-864a

the only thing we are missing is the ds260 and the pasaport and the green light for us to make the appointment they told me to call in 2-3 days to see if my case was sent out already

K-3 Spousal Visa Case Filing and Progress Reportsaddress change while K3 in process

Dear Friends,

I applied for my wife back in Aug 2013 for K3 Visa. During that time, she was staying in Bangalore, India. She received her new passport also there in November 2013.

Now she has moved to Delhi, India.

I recently got an update from USCIS that our case has been transferred to TX Service Center for faster processing.

Please guide me what should be my next step to change her address and what address proof is required for this purpose.

Thanks in advance.

IR-1 / CR-1 Spouse Visa Process & ProceduresSample Form G-325A is filled up wrong

Thanks again.

The second link that you posted is a deadlink. Do you have a current link?

No you wouldn't send the I-864 (AOS - Affidavit of Support) at the I-130 stage.

Once your I-130 has been approved, your case will be sent to the NVC (National Visa Center).

The NVC will contact you to pay the AOS fee and you can then submit the I-864 at that time.

The NVC will also ask you to pay the IV packet fee and submit the DS-230 form

Read up on what happens at the NVC stage and also look up your wife's embassy in India that you will designate for consular processing and read up on their info.

Terry,

Thanks a lot for your response.

I have seen some posts where members have mentioned to send I-864 also along with this packet. Is that advisable as I have not seen in any of the guide.

Welcome to VJ and congratulations on you becoming a United States citizen!

To answer your question - yes the last name should have read Smith instead of Doally at the bottom of the first page.

You (petitioner) and your wife (beneficiary) must each complete a G-325A and both should be included when sending the I-130.

Your G-325A is based on information relative to you and your wife's G-325A would indicate the proper information pertinent to her.

Ensure you sign/date your G-325 and your wife will need to sign/date hers and have it sent back to you.

When my husband submitted the I-130 and our G-325A forms we checked the box OTHER(Specify) and put I-130 instead of what the sample VJ form has checked off.

I would highly suggest sending in all the required supporting documents together with I-130, at the same time, to minimize the need for an RFE (request for evidence).  Take your time when filling out the forms, review all the supporting evidence you need, and have a trusted friend or relative review everything before you mail the package.

There are guides on VJ on how to complete the I-130 for a spouse so take a look at those and feel free to ask specific questions if you cannot find the answer on VJ.  Here is one that may be helpful for you:

IR-1 / CR-1 Spouse Visa Process & ProceduresSample Form G-325A is filled up wrong

Hello all, its my first post and I am new to this website, joined today only.

I just got my citizenship 2 days ago and struggling to get the proper documentation in order to file for the Spouse Visa.

Hello, It seems to me like the form available as a guide on this link http://www.visajourn...-G-325A-aos.pdf is not filled in the right way. Please let me know if I am wrong.

The last block on the 1st page - Applicant: Print your name and Alien Registration Number in the box outlined by heavy border below

The last name should be Smith instead of Doally. Am I correct?

Also, i am confused, is this form is supposed to be filled by both of us. I meant, my wife is in India and one form is required to be filled by her with her information and she needs to sign it and then again, I need to fill the same form with her information and sign it and then send along with the I-130 packet.

Please also let me know if I can send any other documents beforehand to speed up the process.
