K-1 Fiance(e) Visa Process & ProceduresFinancial Questions Related to the K-1 Visa

Hello everyone,

 

I have just a few questions relating to the financial aspect of the K-1 Visa.

 

* First off, in terms of the qualifying income, right now I am a single man working two jobs, but when my fiance and I apply for the Visa together I am not sure how they will count the size of family unit, either 1 or 2? Will they count it as just my single income which will need to be $11,490 or will they count is as a married couple which will then need to be $14,363?

 

** Secondly, when they count the qualifying income is it my yearly income after taxes or yearly income non taxed?

 

*** Thirdly, last year I only had income from a full calendar year at one of my jobs and had only started my other job for about three months so my income was a bit thrown off. This year I will have income for a full calendar year at both my jobs, how would i present this to whoever I need to turn my paperwork into? Do I show it throw a tax return form next time I pay taxes?

 

**** Fourthly, If I do not meet the income requirements could my parents "co-sign" or help me out if it comes to that situation?

 

***** Lastly, if I happen to change jobs, like quit one job and get a higher paying job, how will that effect the situation?

I would send it to him and let him include it in his packet. You never know if they will misplace it if it's mailed separately; I have little faith in their processes. Best bet: let him include it in the I-129F packet. smile.png Best of luck!

I will be mailing him and let him put it in his packet :) I just now want to make sure which address should I be putting on the letter, since it was require... I guess but since some of you said it's not that huge of the deal then I might just put the address of the USCIS of California onto it, since that will be the one that our paper filing to,

I am recently having problem filling out my fiance letter of intent on the U.S. Citizenship and Immigration Services[ADDRESS OF FILING LOCATION], I don't know which address should I be putting on, my fiance's living in CA and some of Thai girls who's in the same field as me said that I should put the address of the TX uscis onto it, but I want to make sure that I am not doing anything wrong, So I am here asking you guys on which one should I be use to fill it out, and what address will it be.

I was hoping to find some help here.

So how does one keep this brief? I'll try. I lived and worked in the USA for 10 years until 2012 when I had to take a job in Canada. Due to the economic crisis, my work was so slow that I had to move back to my home province of Ontario with my US citizen wife and our two children. I have a greencard based on my first marriage in the united states. I've been thru the whole process once before but now have left the States for over a year. I even did everything but the interview for my citizenship....I had to move during the process, it was very stressful.

Anyways, I've managed to support my family here in Canada....I couldn't anymore in CA, and we had a daughter here as well in 2012. If we decide to move back to the States, I am assuming that I will have to apply for permanent residence again and this time my present wife will be my sponsor. My question is this.....if we start the application, how long do I have to wait until I can work if I am offered a job in the states? The first time I was sponsored, my first wife and I already lived south of the border....I was on a TN visa at the time. Do I have to stay in Canada until I receive my permanent resident card? My wife is a stay-at-home mother, how could she possibly sponsor me financially? I worked for 10 years in California, I heard that due to the fact that I have done this, the affidavit of support could be on me and I could sign and take all financial responsibilities. I haven't been back to the States in over a year. What should I expect if I plan a visit there? I assume my greencard will be taken and I will now be treated like a visitor. This is ok, I would like to check out a few employers and visit some family members.

If anybody could share their thoughts, I would really appreciate it.

I would like to avoid paying a lawyer if at all possible.
Would it be to my advantage to hire an immigration lawyer with my case?
