Hey all,

 

This is my checklist and if you see the first paragraph it says they have received the requested DS230. We never sent them the 230! Is this a mistake? 

 

Also this is the 2nd checklist we got, the 1st one had a blank in the I864 and we have already submitted that 3 weeks ago but they still say they haven't received it. Weird.

If this were Twitter, I think these NVC errors would be "trending" at this point.

 

Did you send certified copies of your marriage certificate and birth certificates?  What exactly did you include in your DS-260 package?

 

 

I sent all the requested docs. I had certified/notarized copies of birth/marriage certificates along with translations of them and my citizen ship card. I had sent them notarized copy of passport. Original police records. Two photos. 

 

Wouldn't it be cheaper for the NVC to request the originals at the time of the interview? 


Why they did not tell you on your first checklist.. About original birth certificate and marriage certificate .. This is totally unfair..

 

 

Cause they are checklists for two different applications I guess.

My happiness was short-lived :(

 

Yesterday someone named Mike (hispanic accent) told us that our case has been completed and now to wait for the interview email. Upon suggestion of members we gave them a call to inquire about the interview since it would be faster. 

 

Now (today), this rude lady tells us our case was never complete and that our DS260 has been reviewed and I need to submit original birth and marriage certificate. If there's anything I know, it means that once they receive the mentioned documents, we again need to wait for another 30 business days for a possible case complete.

 

This completely sucks. We were already so happy that the journey has finally ended. When submitting IV packages, I did not see any mention of original birth and marriage certificate. Last month our RFE was that the I864EZ did not have a 'N/A' in section 3 (sponsor information). We don't need sponsors and the instruction on the form said to LEAVE IT BLANK.

I've sent everything back and somewhat put it behind me but it still bothers me that this kind of thing happens.

 

The USCIC and the NVC are mandated by U.S. law to provide this service to U.S. citizens.  It isn't optional for them and it is actually a "right" to which you, me and everyone else on here are entitled to - they are not extending a privilege to us.  If you apply for the Visa for your immediate relative and you meet the guidelines for approval, then they are absolutely obligated to provide you that Visa for your immediate relatives.  Their only authority is to exam your case and determine if you meet the approval requirements.  Issuing a Visa to other Visa categories, not involving the immediate relative of a U.S. citizen, is where the discretionary "privilege" comes into play.  A person who is not a citizen of the U.S. and who is not being petitioned as an immediate relative of a U.S. citizen certainly doesn't have a "right" to a Visa, but I believe that if they are willing to contribute to our country, they should be extended that privilege and welcomed.  Regardless, we as U.S. citizens are not being extended a "privilege", the USCIS and the NVC are mandated by Federal Law to provide us this service - which makes it a "right" and not a discretionary privilege.   

 

The process is broken and failing.  I will absolutely go through everything they throw at me, but I won't sit back and allow them to make mistake after mistake and negatively impact my life and others like me.  Even if I get finished with this process in the next few weeks, I will continue applying pressure to right a wrong, if only because it helps someone coming behind me.  The USCIS and the NVC are accountable to U.S. taxpayers.  We can't forget that fact.  They are also accountable to the Legislative Branch of our government - Senate and House.  They know this fact too and that is why my case "magically" starting moving once my U.S. Senator got involved.

 

Listen, I'm not an unreasonable person.  I realize that every process, whether within the government or private sector, has the potential for errors to be made and problems to be created.  There will always be the extraordinary examples of things that went wrong and likewise there will be examples of a perfectly smooth experience.  Mistakes are mistakes.  They happen and we all make them but there is a huge difference between someone at some website messing up your order and someone at the NVC failing to properly review your documents, sending you a checklist, and then telling you that you need to wait another 6 weeks for someone to look at it again.  That isn't acceptable to me, it wasn't acceptable to my U.S. Senator, it wasn't acceptable to the NVC supervisor who apologized and had my documents immediately reviewed again, and it shouldn't be acceptable to you.

 

Long story short, if anyone is reading this and you are filling out the I-864EZ, make sure you put "N/A or none" in any blank sections.  It isn't anywhere in the written instructions for the I-864EZ, but thankfully we have sites like this to help us out and reduce delays.  The thing is though, these sites wouldn't do anything for us without individuals like Saylin, who have helped out countless people on here for no reason other than goodwill.  I know you get many "thank you" messages Saylin but I don't think you get enough gratitude from everyone in the community.  Thank you for all the help you provide here!

It seems there are quite a few of us post-September NVC filers who got a checklist for not putting 'N/A' on the I864EZ. That set us back 1.5 months of unnecessary waiting. But like Saylin says, immigration is a privilege to us (non-citizens) so we have to bear it. 

 

I had told my wife (the petitioner) that "put N/A on blanks or we get checklist.". She's a smart woman, she reasoned that nowhere is it written to put N/A, on the contrary, there are explicit instructions to leave blank if answer is not applicable. I still told her, there are people on this internet board who have a lot of experience and they are saying put N/A or receive checklist. But obviously mine sounded like the weaker argument. But before she mailed it I did say "If we get a checklist and I have to wait 1.5 more months, I'm going to walk to Mt. Everest Base Camp" cause I'm a big fan of trekking while she hates it cause its basically 2-3 weeks of no connection (phone/internet). We did get a checklist, but now I still can't goto Base Camp. Sheesh. 

 

Anyhow, I hope all of us get our case completes and interviews really soon! Hang in there.

It USED to be required to fill out the DS-261 and DS-260, but it seems like they changed that since Sept 1 now that everyone's required to do the form.

 

Can anyone else confirm that they didn't need the BIN to fill out the DS-261 and DS-260?

Wife just came back from infopass. The only significant information she came back was that they were now processing January filers (in Washington, D.C. Field office). Not sure if we should believe them because one month ago in the infopass they said they were on October.

Every time I see activity on this thread I also rush over to uscis.gov to see if we "made it" as well. Nopes. 

 

VJ estimate says my file should be adjudicated by Sep 18. Same estimate had, at one point in time, said no later than April 18th. Yet, here we are. 

 

Out of 102 Jan filers, 19 are still on NOA1. That's ~18% left. God knows how many in that 18% have forgotten to update their timelines. 

 

Think we can get a head count of how many out of that 19 actively check this thread?

It's from Igor's list. So yes it's VJ members. It's the best statistics we have available since this kind of information is not available from the government. However take all numbers w grain of salt.

This whole process is so frustrating. But at least you know where your file is. I'm still waiting for a response to my email that I sent on Apr 3. I have the same NOA1 date as you. So if yours is currently at a field office...I would have to think mine was sent to one by now as well.


I sent on April 7th.

Someone on another thread speculates that the day they reply to your email is the day the petition was transferred, which if its true (i hope not), was 2 days ago and I have 90 more days of waiting!!

They could really help ease so many people's minds by making the process at least a little bit transparent and predictable! :unsure:

My PD was January 30th 2013. The email is dated April 24th.In another 90 days I will probably lose it! :S I was hoping that 4 months would be good for approval.

I called USCIS and they said it was not a typo. Still not totally convinced but I'll go with it for now.
We are not living overseas together. I am the petitioner and I filed from within the U.S.

We sent our package Jan 28th, got text of receipt number (MSCxxxxx) Feb 2nd, and today when I checked on USCIS our case number shows as 'Initial Review'. Still waiting on the NOA1 snail mail letter.

Not sure if our case has been forwarded to local field office, but if it does, its going to be Washington DC (Fairfax,VA). Is there anyone who had their case there? Would love some reviews.

Does getting an MSC number mean it will be processed in Missouri? Or does NBC transfer it to other offices?



I think receipt notices from the National Benefits Center begin with MSC.

Also, since all of our cases are being sent to NBC instead of Vermont or Cali, I am hoping that we wont have to wait too long to get our NOA2. Is it realistic to think I can make it to the US four-five months from now?

I am using James Shortcuts as well.

Hello everyone.

Firstly, best of luck to all of us in our applications. We all share the same anxiety. Waiting.

Secondly, the NOA1 receipt number doesnt seem to be working for me. I goto uscis.gov almost every day and still get the 'case not found' message. I really hope that they are so busy processing our applications that they forgot to update the status on their website :)

Anyone else having this problem?

I can't wait for it to be April 19th! (VJ's estimated NOA2 approval date).

Some say it's a sign that they are working on your case and that you'll be approved soon, some say it's an error in their system, some say it's a normal step in the process.....who knows. <_<
I think they mean you have been assigned your A#, it hasn't been changed.

My fiance filed for us on October 15th 2012.

Case status in uscis.gov gives us the same message (Alien number has been changed).

Is this a sign that our case is in the process of being adjugated right now? Or is this normal? Does everyone who apply have their Alien numbers changed at some point in the application.

I don't think we need to file Adjustment of Status (AOS) because she will be coming to the US with me after she gets her Visa packet from the consular at the embassy. She is not coming on a K visa (non-immigrant visa) she is coming on an immigrant visa, therefore no adjustment of status. I thought that consular processing was automatic if the petitioner and the beneficiary were living overseas and applied from overseas.

What does IV stand for. Can't find a page here for acronyms.

I am curious how do I give NVC my email address for all future correspondence? Do they have a website similar to USCIS where we can track the progress of our case?

I can only answer the first part of your question. Your wife will file her 2012 taxes based on her status on Dec. 31, 2012. If you didn't marry until 2013, then she'll file as single, since that's what she was.

Hello!

My wife and I married this year (2013) so while she fills her 2012 tax, can she go ahead and file as single (because that what she technically was in 2012)?
Also, I was in the US till May 2012 (student on OPT extension), so I had a bit of income. Would I need to file my taxes before receiving my visa or can I do that once I'm in the States?

Hello everyone.

I recently made a call to USCIS and they said my case is at NBC as my receipt number starts with MSC (MSC=NBC, EAC=VM, SRC=TX, WAC=CA, LIN=NE) . I see many cases being transferred to local offices from NBC, but when I check VJ timeline for my local office, I do not see any cases transferred to Newark, NJ(my local immigration office). Do you guys think people fall under Newark, NJ will not get transfer to local office as previously non of the cases being seen there for i130?

Here's a trend chart for Washington Field Office. You can view for the other offices as well. Compared with other offices, we are swamped. About 4000 total applications in Dec 12 contrasted with 250 applications at the Wichita office.

This blows. I hope I dont get transferred to Wasthington.

Also, there are lot of disgruntled Atlanta field office filers here in the forums. If you check Atlanta office trends, its similar to Washington's. I donot mean to discourage, but lets brace ourselves for a wait.
