For you guys that have filed from abroad, do you also live abroad and are planning on returning back to the states? Because that's the case with my husband, he has been living abroad for 7 years. We wer going to file the petition from abroad but then his parents consulted with an attorney who said it was better for him to return home and arrange a job and an address first and then file the petition from the us?

Donkey81 how much do they tax you percentage wise? Kind of concerned as he has been working in both New zeeland and Australia on and off for 7 years.  EmigratingSwede, he had no clue regarding paying tax even though he has been outside of the US, what kind of trouble could he be in?     Cheers again! really appreciate the responses :)

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat should we do?

Long story short, me and my husband meet in Australia where we were both studying and working part time. He is a US citizen and have been living overseas on and off for the last 7 years.Well were shortly after we meet I found out that I was pregnant and we decided that we wanted to move from Australia because we wanted to get a grounding and our visas were just temporary in Australia. We decided to wait with filing the visa until after the baby was born which was only recently. We are currently in Sweden and we want to go to the US next month and stay over Christmas. Well first we don't know if we should apply for the K3 visa or the CR-1. We were thinking of the K3 first because I could be in the us while the visa is getting processed but then we found out that it takes about 8 months for that to happen and that's apparently the same time it takes for the CR-1? My other question is, can I come with him next month to the US and stay over Christmas if we file the application now? I can prove that I'am not going to stay as I have to return to Australia for another semester in school. And last question is that as my husband has been living overseas for the last 7 years, he cant submit any tax returns for the affidiative of support which apparently requires 3 years of tax return, how do we go about this?

Hi! I am about to put together the i-130 petition and i was just wondering if we should also write a letter about our story? like how we meet, when we got married etc or will they require that later on during the intervirew? The reason im wondering is because we meet in Australia and we lived there for a while, we got married in Sweden and we are going to send the petition from here. Should we explain the reason why we are sending it from Sweden or just leave it be? Cheers

IR-1 / CR-1 Spouse Visa Process & ProceduresIn the US while applying for IR-1/CR-1 petition

Me and my husband that is from the US, filed the petion from Portugal when we were there visiting my family. We did this 1 month prior to travelling to the us for the holidays. Anyways, we found out that our petition got lost in the mail and finally a month after they found it and sent it back from Portugal. The only problem is that when this happened we were already in the US, we didnt think it would take more then a month for the letter to appear in the Chicago lockbox. Could this be an issue in the future? The fact that I was in the country when they received the petition? The original dates are still on the paperwork that we sent in October.
