Don't worry I was just like you and really stressing over it, ask Danyel! lol It's been over a month since you submitted your application you can by rights call them and find out whats going on. They will probably tell you the same thing they told me and that was to wait until 90 days was up, however my check was cashed that night. I sent my application to Chicago and it was received Feb. 5 and apparently California sent out my NOA1 on March 4. So don't worry too much they are taking their own sweet time!

that's why im hoping its the noa1 for our k-3 visas cause we both submitted our i-130 and i-129f applications together and have both had our checks cashed. its either ref's or joining the applications....so basically good or bad news. have you received an noa1 on your i-129f application?

i wouldn't worry too much about it, they were probably just updating the site. that's what happens whenever people update things...just be glad you can get back into your case. hopefully our molesting is them grouping them together and maybe we'll be getting noa1 for our k-3 visas soon. i've heard all this stuff about them cancelling the k-3 visa and how it's probably going to slow things down. but it's basically what i have to hang on to for mine, cody's and our soon to be born daughters sake.

Well "touched" means that the immigration services opens your account and does something. It can be anything from you calling in, them double checking a fact, your case being approved or denied to them just opening it for the hell of it. You never know what it is, it is just them doing something!

Are we sure that when you track your case online and the "last updated" date changes it means your case has been touched?
If so my case has been touched five times in the last seven days.
Could this be a very bad sign?

well my husband and I talked to an immigration officer before we submitted out application and they told us to send both together. there are a couple people who did it that way and so far we haven't had any problems with it. however you are correct, the website and all the forms say that you submit one and then the other.

I got WAC meaning I'm in sunny California with ya'll yes.gif but how is this for odd...they got my application on March 4, cashed my check on March 5 and my case was touched on March 6. I guess they were just making sure my check went through or something.

well i got the number as best as i could off the check but alas nothing online. i emailed my mother-in-law cause she works for the bank and hopefully can get the number and we can make sure i'm trying the right number.

how long after your checks did it take to show up online?

Danyel - its so weird because just him talking to them and knowing that we had done all we could do some how took the pressure off my shoulders. Amazing thing is they told him they couldn't do anything until 90 days had passed and guess who's check got cashed that night? I'M FINALLY ON MY WAY TOWARDS SOMETHING!!! I'm going to try pulling my reciept number off the back of the check and checking it online. I'll let you know what happens!!

i don't know if sending another i-130 would be such a smart idea. my husband called yesterday and spoke to 2 different ladies about our situation. both said that we should not worry they a.) have not cancelled the k-3 visa and it won't happen for a while and b.) shouldn't have caused issues if we sent the applications in together so long as we provided all the needed information. we then asked about having him come out here and doing DCF because apparently it's a lot quicker and they both said that you have to cancel your old applications before you submit any new ones to prevent them putting your case on hold until they find out what the problem is. she said just because we haven't gotten our noa1 or had our check cashed doesn't mean nothing is happening to our case. they handle cases differently if you submit both applications together. so my thinking is if you cancel your old application and submit a new i-130 yes you may get a noa1 sooner but you don't know how it will affect you in the long run. we decided we're just going to wait it out and see what happens. they have to cash the check within 90 because otherwise it is no longer valid. i have read stories about people who wait almost two months for their noa1 and then right after they get it they get their noa2. so just have some faith and all will be sorted out. i know its hard believe me i'm going insane waiting for this and trying to plan the arrival of our first baby but you just have to realise you really don't have any control over the situation so it's not worth stressing yourself out. good luck and keep in touch!

I'll definitely keep you (and everyone else) updated. As for filing, IMHO do it ASAP! (Maybe others would be willing to comment pro/anti?) From our perspective (not to scare you), our wedding ceremony date has moved around a bit due to concerns with immigration - it's still in flux! In fact, we're approaching it from both sides - I'm also applying for the Canadian PR concurrently (yay! I just had my med exam performed by the DMP today!) just in case since the ultimate goal is to be together after the ceremony.

It did take awhile to create the packet (supporting info, etc.), but one concern I had before doing so was whether or not we would even be able to visit each other while the process was pending. I talked to one of the US immigration officers in Ottawa (as well as perusing the forums here) and he assured me that as long as she showed strong ties to Canada (job, lease, bank statements, etc) that it would normally be no problem with US visitations - he actually said, "why would you jeopardize your chances of immigration?" which made sense to me. Likewise for me going the other way - I now have a packet I've "developed" for traveling to see her! Anyways, that talk pretty much sealed the deal for us sending the paperwork through. (Actually, the guy stamped a B-2 visa with an expiration date of Aug-12 on her last visit this month!)

Although after reading some of the posts here, I feel as though I should have included photos in the packet. I included a notarized affidavit, sample mail correspondence, sample travel plans between our two cities, a sample phone bill showing our numbers, beneficiary statements, and receipts and tickets for trips taken together. Maybe I'm just being paranoid?

OK, enough blabbering.

Danyel y Miguel: I also noticed that my case was "last updated" on 2/26/2008...Is this the 'touch' everyone keeps referring to?

Off topic....Now, I'm trying to cope with the tax ramifications for 2007! If you think immigration laws are crazy, wait until you read IRS Pub 519. Oh vay! Anybody dealing with this yet?


I know, we have to file asap. With regards to your ceremony date constantly changing, I think I'm going through that right now. My hubby and I were so clueless and naive when it came to immigration laws and I ended up being denied twice at the border within this past month. Of course, we had planned our whole wedding already...I was planning on going to the POE tomorrow with a bunch of documents (not to cross the border, just to talk to them - called that POE last week and a friendly officer suggested that I come talk to them) - from all of our wedding arrangements, to a letter from my employer & T4, bank account info & a letter from my bank...also, a doctor's note for his great-grandfather, who has several serious illnesses. All I want is to go through with our plans and then come back to Canada.

I still had the tiniest bit of hope...but in the past week, we've been talking to an immigration lawyer in the US - she found out what they had written under my name...no violations or charges (thank God), but they DID list details of my denials. When I was denied, we only said we were engaged, not married (out of fear - in hindsight, not sure if that was a great idea..).

Based on all of that, the lawyer advised AGAINST going to the border. She said that it was a long shot and that if I tried to admit openly that we ARE married, that the officers at the POE might charge me with fraud (for my previous denials, when we said we were only engaged).

I think that's enough to keep me here. I'm completely depressed. I know that we were ignorant of immigration laws, but we are really paying for it now.

Will I get in major trouble for the denials? If I say, "failure to prove non-immgrant intent" and someone looks into it, I just have this sinking feeling that the visa will be denied.

Sorry for venting, but I just got the bad news from the lawyer and am trying not to cry at work (yes, I go on VJ at work...oops)...

I honestly know nothing about the denials and what they can and cant do about it. I would however take the lawyers advice seriously, they don't tend to lie about this kinda stuff. I hope you can figure things out and are able to see your hubby soon, it's been 70 days since I've seen mine so I know how you must be feeling right now. Don't worry about venting on here, that's what we're here for. We're all in this together and if we can't vent to one another who can we vent to? Good luck...you're in my thoughts!!

i wouldn't worry too much it might not have been a "bad" touch. maybe it was just being sorted in california, cause they had to move it from chicago and once it's received in cali they have to make note of it. keep checking your status and if they keep touching it without changes being made then you might have something to worry about. however i know a couple who had their case touched more than 10 times before anything happened on it and never received any bad news. keep us updated on how things are going!

as for the proof that she is our daughter, they have already told us it might be required by the American embassy to prove she's my husbands daughter. they apparently can ask for dna proof in order to establish citizenship. i guess along with problems of people getting married only so they can obtain a green card, they have had problems with people going to other countries and adopting children and them claiming them as their own so they get automatic citizenship.

hahahaha thats where i am but i'm only waiting for my noa1 so i'm going very insane. the only thing that is keeping me busy is the part time work im doing, planning my husbands trip out here in may and the birth of our first baby in june. god alone knows the lenght of the procedure i have to go through to get her american passport and birth certificate. i just found out my husband and i will have to go in for an interview (with our newborn daughter) at the usa embassy here in south africa to prove she's our daughter to get her passport so she can travel with me.

that must be the reason! so just a question....i was doing my daily information search online concerning the k-3 process and i found out that the chicago lock box doesn't actually cash checks. they just send out receipts and pass your file onto which service center is going to process it. however if this is the case some of us could be waiting weeks to get our NOA1 from chicago. has anyone else read anything about this or is it just me?

by the by venkat....did you just get your NOA1 for your I-130 or for both applications?

There is actually hope for us. According to the USCIS Application and Receipting Update website as of Feb 13 they are processing I-130 applications from Feb 3. So maybe we'll start seeing checks cashed and NOA1 arriving soon!!

My husband and I have web cams too the only problem is that we're 10 hours apart and he works the graveyard shift so our times to chat are few and far between sometimes. We mailed Valentines Day things over a month ago just to be sure they would get there on time, plus our one year wedding anniversary was on February 3.

I know how most of you are feeling with checking bank accounts regularly for cashed checks and whatever else you're waiting on. I know personally I look at someone who has already heard SOMETHING and it gives me hope and I'm happy for the person and yes even a little bitter because nothing is happening with my papers. I think it's great that we have each other to talk to on here and get ideas on how long things are going to take.

What are most of you filing for...K-3 for fiances, for spouses or K-1?

We sent ours to Chicago via UPS and since it was going by courier they gave us a non post box address to send it to.

I'm just waiting now for my check to be cashed or for my husband to get something in the mail.

Did anyone else send their I-130 and their I-129F together? We were told to by an immigration officer and to send them together to the Chicago address, but I'm noticing that not many other people did that.

If money isn't an issue for you guys then I would say go with the K-3 visa route. You shouldn't have to wait longer than need be! We were hoping to go the K-3 route but our application disappeared somewhere and our I-130 has been approved so we don't have much of a choice. no don't worry visa numbers are automatically given to husband, wives and children. other relatives like moms, dads, sisters etc have to wait for a number to become available. congratulations on your good news!!

any activity is good news at this point. it means they are actually working on your application and you can use the number off the back of the check to your status online. congrats!!

how come that you guys sent the I-129F along with the I-130, i was reading in the instructions for K-3 and it says clearly that you have to include a copy of the NOA-1 with I-129F package?

Called USCIS told them to put me through to an immigration officer, asked him if I could and told him that my friend filed them both together and he said usually you should wait for the NOA1 for the I-130 but I could file both at the same time if I wanted as with everything going on the rules are a little bit blurred at the moment. He gave me some good advice, he even told me I should try and get my case expedited due to my husband being in the military.

Your best bet is to talk to an IMMIGRATION OFFICER before you send anything off as the people who answer the phones at USCIS as just about as much use as monkey with a handset... they know nothin




It was the same for us! We were told after I got screwed over that we should submit both forms together and contact our State Representative (whom we happened to know personally) and see if he could help us seeing as we are considered to be a unique case.
I wouldn't recommend submitting both at the same time unless you have talked to an official about your case.

I am waiting for my case number. As of today, they don't have any record for my approved petition. They replied me that they already received my approved petition and on the process of assigning a case number and putting it on their computer system. I found this information at USCIS Expedite Criteria

The person above is correct that this is not for an I-129F application. This application, the I-129 application, is for a non-immigrant work visa.

Another option would be to do a civil ceremony in Canada now, file for you CR1, then you can do the church wedding in Canada in September like you plan, and hopefully not too much longer (relative in the visa process) be together in America.

Also, when you start the visa process your fiance will need to be prepared to show ties to Canada when crossing the boarder for weekend visits. Some people have no problems and others have problems, again it is all hit and miss.
