Me and my husband has been talking with an immigration specialist (she's been doing It I think, for 15 years now), and according to her, in my case, as soon as I get my green card, I could right away apply for naturalization. But since I'd be in Italy before 2007 ends, I file for naturalization there. I suggest that you do what I did. Go to the legal office on your husband's military base and ask for assistance.

You know, don't rely on the informations from USCIS' Military hotline. Because every time I call them, I'm always getting different informations from different agents. So I got really confused too.

If you still want to keep your German citizenship for two years, which is your green card's validity, you should not apply for naturalization. And you can't apply for naturalization if you've been living outside the US in orders, for more than 1 year. So you should submit your application during your 1st year outside the US. If you still want to wait for the expiration of your GC just to keep your German citizenship, you may not be able to expedite your naturalization. You have to wait again for 3 years. Now, if you're in Korea, and your husband is being deployed in Iraq, then that is also a criteria for you to expedite (quick process) your naturalization application before he leaves for Iraq.

If your husband has new orders for overseas duty, you don't need to wait for 2 years or 5 years after you received your GC. You can right away apply for naturalization before you leave the country. This also applies for those spouses whose military husbands are being deployed to Iraq. But of course, applicants should be a permanent resident first (or has GC). Applications for naturalizations should come with a copy of the orders when you submit.

If you weren't able to apply for naturalization, and you left with Green card only, you can actually apply it on the country's USCIS local branch within 1 year of your stay, more than a year of application won't do any good. I hope this info helps.

I've also been researching about this for so many months now...I still don't have my GC and we're leaving for Italy in Nov. crying.gif

As of now, i don't have any. But our legal officer from the legal department here in Sigonella, Italy gave me a letter, which states that if I would apply for my naturalization here, I don't have to go back stateside. And it applies to all military dependents which are sponsored on a military duty orders abroad. The Authorization bill was just signed this Jan '08. Nice huh.

You might want to inquire about this to your legal office. Good luck to us!

Hi! Im traveling late November for Italy because my husband's in the Navy so I should come with him because I'm his dependent. He has his orders already and we should stay there for 3 years. We just got married last May and still in the process of filing AOS. Hopefully I could get my GC after 3 mos without any delays and RFE's.

My questions are,

1.) can I come with him and stay in Italy with my temp green card only?

2.) should I do some paper works also? What else should I do and how do I do it?

3.) Would I be still entitled for Removal of Conditions after 2 years of my GC's expiration date with me living outside US on that period?

I would be entering Italy with a "No-Fee Passport" which will be provided by the Military, so no problem with that, my concern would most likely focus on how can I go back to US after my husband's duty and get a renewed Green Card afterwards.

I hope you guys can help me with whatever knowldge you have, even in the littlest way I would very much appreciate it. Thanks! :help:

Hi Magnolia,

You are right about expediting the AOS application, but it's for those applicants whose military spouses being deployed in Iraq only ( forgot to mention in my post). In my case, new duty station is only based in orders not a deployment to Iraq. So I guess the spouses of the deployed husbands are most likely to have the AOS expedited.

I should leave with him on last week of November this year. My concern is, I've been reading a lot of cases in this website that an application will take us approximately 8 months, the immigrant officer told us too, and she said that it's the ideal time line. Although I'm also aware that a lot of applicants take less than 5 months to receive their GC.

I guess I should just apply for Advance Parole if there's no way of expediting my AOS. And you're right I should call the Military Help Line.

By the way, thanks HJ for your detailed reply on my post, you are a great help and you too Magnolia. My husband and I just finished an Infopass appointment yesterday, and boy, seems that the immigration officer was not helpful enough.

I still have questions:

1) How can I expedite my AOS? what form should I use? Fees? The immigration officer told us that there's no way of doing that.

2) And once in Italy, where should we apply for Sojourners Permit for the length of my stay?

3) How do you request a delay for the I-751 interview? Is it still valid if you delayed it for 1year? I would be returning in the US not until after the 3-year contract in Italy.

We would be staying in Sigonella, Sicily.

Since you've done these things, I think we should get in touch a lot. Please update me on things that I should do next and what problems might I encounter. I hope I'm not bothering you much. Thanks a lot!

Are you on a K-1 visa?

Yeah, bring everything, every document and papers that you have from the start of your application, and hand carry it, it's not that the immigration officer might look for it, but it's better to be prepared. And plus, don't worry about your x-ray might as well keep it in your luggage, Immigration people don't read x-rays, you'd need it for the medical when you adjust your status.

And you don't get work authorization on POE, you'd get that when you apply for work authorization along with your adjustment of status. They would attach an I-94 form at your passport and stamp it with the date at how long would you be able to stay in the US, until you get your green card.

At your POE, they might ask about you and your fiance's love story. You'd do well don't worry. Good luck!

I would appreciate good feedback with this question so when the time comes and I have to send everything back to the consulate or visa center that they get the correct information.

I currently do not have a job, but I do collect VA Disability and I go to school full time. The VA Disability is plenty for me but is not enough for 2 people based on poverty. I am also being reviewed for Vocab Rehab and Upgrade for Disability as well.

I live in with my mother because she is disabled and I am here to help her; therefore, I don't pay for housing and ect. Everything is payed by her. She figures that whether I am there or not. The rent is the going to be the same. It is a perk for being there to help her out throughout the day.

She even offered to do the Co-Sponsorship because she makes well over 37,000 just based on her VA Disability plus Military retirement. That is plenty for the 2 of us alone plus my alien fiancee.

If I include my taxes plus her taxes as the co-sponsor then will the visa center give me any grief?

There has been a lot of issues when it came to paying someone else to do their I-129F packet. When I called to see how much mine packet was going to cost. They told me 1,100 US dollars. I decided to do my own packet. Did anyone else do their own or went through a lawyer?
