Hi everyone. My fiancee just told me that in the Ukraine forum, the girls there told her that for the K-1 visa you have to buy a round trip plane ticket. They will not let you buy a oneway ticket. Is this true. Can someone that lived in Ukraine and came to the USA on a K-1 visa tell me if this is true. My Fiancee is just going on the advise of these girls in her forum. Everyone seemed to jump to the financial aspect of the question and I think missed the point. The Ukranian government nor the US Consulate/Embassy is really interested in the type of ticket.

The issue is, if a person is denied entrance to the USA at the POE by the immigration officials, the airline is responsible for returning that person to the place of origin. Hence the airlines can dictate these rules. I have only read of one case which was written up on the British Expats web-site about 2 or 3 years ago where Garuda, the Indonesian AIrline requires a roundtrip ticket for persons traveling to the USA that do not have citizenship or residency.

So this is an additional case beyond the financial consideration, the governments and the Embassy or Consulate.

I have sent my i-129f with all the evidence I had at the time. Which included:
-Pictures with dates and names
-phone records from my fiance and I(we have a family share plan)

However, we met in US and I didn't visit any other country. Since I sent the i-129f, I have even more evidence because I went to her country. Is there any way to add evidence after the i-129f has been sent? If I do get an RFE does my evidence I send in at the time start the waiting p[rocess all over again or does it go to the person sending the RFE?

Does the Non-citizen fiance(e) have a Visa Entry Stamp in his/her passport proving they were admitted into the USA. What about boarding passes from the airplane flight from their country t the USA. Usually boarding passes and a copy of All pages of the passport including the VISA stamp are helpful if not required.

Evidence from your meetings AFTER submitting the I-129F petition will not be accepted.

My fiance had a passport that he lost, that had a VISA in it that said he was not subject to the condition, but his application said he was, but the actual visa, that was in his passport that he lost said he was not. He is going to call the US embassy in Sweden and see if they have that information and what their records show. Otherwise we are screwed because we will most likely get our NOA2 later this month or next month and that means his interview will happen before his two years is up. So, we are also not sure if we need to apply for a waiver ASAP. I just cannot believe my attorney did not check this and we now have no proof from his passport because it was lost.


J1's used to be impossible to get waivers on 27 years ago when I tried for my now ex-wife. But currently waivers are much easier to obtain. You need to contact the DoS (Department of State) and see if they will issue a No Objection letter. This depends on the country, the area of specialization and degree obtained, etc... It is normally assumed you will get a No Objection letter. Once that is obtained you can then get a waiver of the J1 HRR.

I do not see in the instructions for I-129F or the G325-A, the requirement to submit the birth certificate for the Thai (alien) fiancee. Is this something that should be submitted with the I-129F anyway, or maybe the question was really being asked about documents submitted to the US Embassy in Bangkok for the K-1 interview ?

Su may have been asked to interview in English because I wrote in packet 1 that she was capable of speaking both languages. The interviewer also asked which language she primarily used when communicating with me. Which she replied English. She told the CO that when she got confused I would speak Thai to her. Luckily we practiced the interview many times (all in English), and she was able to answer every question confidently without getting flustered. The CO spoke slowly and clearly for Su, so she was able to understand the questions.


All of this is really good to know. While Audy and I mainly communicate in English, she is trying to teach me reading and writing of Thai. But Audy's understanding of spoken English isn't very advanced. I am sending her to English classes in Bangkok.

Our communication by email is good, but again, she does not write much. If they interview her in Thai, I think that will be a problem for the proof of Relationship or continued Relationship.
