Good day everyone. My fiancée was denied visa after one bogus question. She had all the evidence and paperworks to prove our relationship. The interview was going well until the consulate officer asked my fiancée if during our traditional engagement ceremony, I gave any monetary gift to her parents. My fiancée answered yes. Then the CO declared that that signifies a dowry and according to the Nigerian law, we are married. My fiancée tried to explain to her that it was just a gift for her parents and not a dowry, but the CO insisted that as long as money was paid, it was marriage and I should go back and refile for her as a wife and not a fiancée. We only did an engagement ceremony and not marriage. If I had filed for her as a wife, how would I have provided a proof of marriage when we are not yet married?. Please, I need an advice on what to do because it's been 9 months already and I do not want to have to travel to get married and start this whole process all over again ...gush!

So sorry that your visa was denied. My husband had the infamous Asian lady CO the second time he went for an interview too. We were calling each other husband and wife on our emails, and she tried to pressure my husband into confessing that we were married when indeed we were not. She gave him a 221g requesting all my passports because she believed that we were secretly married. That incident too happened to my step cousin and he was denied the visa as well (his wife gave the pictures from the introduction,he had to refile on a marriage based visa)Put pressure on your senator/congressmen to keep the petition there. The Consular officers are well trained to learn the customs/traditions of the Nigerian culture. They think they know so much when indeed they dont know anything.Good luck and All the Best.

im so sorry to hear that you and your fiancee was denied the visa. i know how you feel. about 2 years ago, i was in the same situation as you, except me and my then fiancee was not married. i contacted my senator the same day, and 1 week later the lagos consulate called my then fiancee to appear for a second interview. dont respond or pay attention to negative comments. yes lagos consulate is a high fraud consulate, but with prayers anything is possible. I got my first RFE and it asked for 3 things.. 2 had to do with the fact that we filed the I-864EZ form.. that didn't go down too well, so they requested that we file the I-864 form, which is fine, so we sent out all the same info again, W2's, employment letter, etc.


BUT


They asked me for evidence of current nonimmigrant status since I didn't supply them with an I-94 number.. but the thing is, I never got one as a Canadian Citizen.. and so I was told to write a letter explaining this.. has anyone else had this RFE? Did you write a letter? This is the letter I wrote... should it be alright?

This is a letter of explanation regarding the RFE H.(1) received on the 5th of October, 2006. I have been asked for evidence of my current nonimmigrant status in the form of an I-94 Arrival/Departure Record, or a copy of the nonimmigrant visa page of my passport showing admission to the United States.

As a Canadian Citizen, I am not required to have my passport stamped when I cross the border into the United States and do not require an I-94 Arrival/Departure Record. I was inspected at the border and showed my passport to the officer, and was allowed to enter the United States. No I-94 was received. I entered as a visitor and my point of entry was Alexandria Bay at the Thousand Islands Bridge in the state of New York on July 4th, 2006.

Furthermore, I consulted with an immigration officer at an InfoPass appointment at the Baltimore District Office on the 11th of September, 2006 at 1pm in the afternoon. The immigration officer my husband and I consulted with advised that I should write “No I-94/Canadian Citizen” on the I-485 form where it asks for the I-94 number. We were told that as a Canadian Citizen, I was not required to have one and she looked over all of my documentation and advised us to write “No I-94/Canadian Citizen” in any place where I was asked for an I-94 number. It was explained that this was common procedure for Canadian Citizens and that it was the correct way to file the I-485.

People should stop giving replies to something they are not sure or have no knowledge of it. Having a traditional ceremony is perfectly fine. It's not a lie, it's for the sake of families, distance, and tradition. The only thing that is missing is the marriage certificate. As long as you don't sign that you are NOT LEGALLY married, and there is no record of your marriage in accordance with the law.

If there are 50 K1's submitted I wonder how many are actually being processed per day. Maybe if this information was available we would have a little better understanding of what we are dealing with. I know Vjer's account for a small portion, but I cannot understand how days go by showing 1 or 2 approvals per day. Not knowing is what sucks the most!

From everything I have read and the people I have met who are from Brazil, the interview process seems to be very fair and well organized. If you have a year before you intend to be together your choices are pretty open. Since you were denied the tourist visa, it could be beneficial for you guys to get married there and file a K3 or CR1. I can only speculate from what I have seen since November of last year. My fiance and I are hoping to receive our NOA2 very soon. Best of luck to you--be prepared for a long and very frustrating process.

Like many others I am waiting and waiting and waiting. Since I am now outside of the 5 month processing time I decided to call the USISC Support line---What a huge waste of time. It was plain to see that she was reading from a script. After pleading my case she said "Well sir, I can see you are outside of the normal processing time so let me take a look" , At this point I was a little optimistic. She came back on the line after 20-30 seconds and said, "Sir, you will need to wait another 28 days before you can contact us because the processing time changes on a daily basis due to the number of petitions received on any given day" ####### does that mean??????? As I sit here and watch case after case after case receive NOA2's in which the NOA1's were received after mine. Do not get me wrong, I am very happy for those who are processed as fast as possible. My main concern is that my case could very well be at the bottem of some stack where the proceessing agent quit or got laid off and felt like hiding a few files. I only want to know what is going on with my case, a simple update so I do not get hit with a RFE in the 6th or 7th month. A little advice--After 5 months, do yourself a favor and bypass the useless customer support hotline, save a little sanity and call your senator or congressman--I am sure you will receive better treatment and positive action. Once you get you NOA2, it's much faster in Brazil. If you expect your NOA2 in a week or two, your interview should be scheduled in about a month (about 3 weeks from NOA2 to interview scheduled), and it's usually about 6 weeks after NOA2 until the interview, and about a week after that for the visa to arrive. Hello all, I have a question concerning my approved petition. So we received the NOA2 on May 7th. I have been calling NVC to see if they received so I could get my case number. After reading many timelines where the NVC received the file in about 4-5 days I decided to call Vermont to see if it had been sent. The USCIS asked me to look on my form I-797. Sure enough , it is telling me that my approved petition was forwarded to the listed consulate in RIO. My question--Does this mean that my petition will not be going to NVC? Does anyone have information to chare? Thanks

I think Vermont has more people working on the I129's. I am not sure how long this will continue. There is a very informational post in the USCIS forum where a member actually recorded a meeting with the Director of Vermont. Petitions are still taking around 5 months on average. I had read before that K1 petitions are handled ONLY at the US Embassy in Ciudad Juarez, Chihuahua and not in Mexico City. Have you tried contacting the visa specialist at the Department of State? I think they could provide you the information of where the packet was sent and also if there is an interview date scheduled.



Regardless of what your 797 says, all cases are routed through the NVC. My said the same thing--forwarded to the nearest consulate. Not true, even USCIS said the same thing. Call the NVC hotline, choose slection 5 and speak to an agent, they will explain the process to you. I know all consulars are different, is better to receive the routing process through the embassy. I do know that my case was only at NVC for 3 days then forwarded to Rio. Best of luck to you

Just went through this same thing. I am sure I was a little impatient. My case arrived at NVC in 8 business days. I kept calling NVC only to get my case number. The case was sent to the Rio Consulate in 3 days. I am waiting for a response from the consulate now to receive our interview date. The best thing to do now is have patience--believe me, I do not have enough. If I know case was sent somewhere I am on the phone the next day. :bonk: :bonk: Don't put yourself through the mill waiting to hear a reponse, take it from me, only makes the wait seem longer. This is actually a discussion? No 2 relationships are the same and what works for one person, might not work for the next. I do not think length of dating plays a very big role in approvals. Sure they want some proof that a relationship exist but if they looked at alot of relationships in a time together sense, half of the people on here would be denied--including myself. I knew my fiance less than a year. Who has the right to say when we have dated long enough to marry? I knew my ex-wife for years before getting married. You figure it out, when you do please let us all know.

Hey Guys,

Me and my fiancée applied for a K1 Visa and I have a few questions regarding the Medical Interview. She lives in Brazil and I don't know if there are any specific medical tests and shots for Brazil. I would like to know what are the required medical exams for the doctor appointment and what are all the required shots. Can my fiancée start all the exams such as pap, x rays, blood test and take them to the visa certified doctor or does she need him to ask for the exams in order to do them? Is it possible to start all of them prior to the certified visa doctor appointment and just take the results with her? If it is, how long are the exams valid for?

We applied for the visa April 19 and She has a medical appointment next Friday, we would like to know if its possible because if so, she may ask the doctor to require everything so she can get everything ready for the future medical visa interview.

I would have to agree with most of the reply's. Taking care of another human being is a very big responsibility. It is not test driving someting with the option of putting it back should things not work out. The K1 journey presents many challanges, these issues include the financial ability to care for your fiance in any situation. If I had to make the choice between a plane ticket or a place for my fiance to eat and sleep, I would definitely choose the latter. You said your fiance is saving money to fly there. If you do not mind me asking, where will you both stay when he arrives? I definitely wish you the best of luck and hope everything works out.

Okay, So I just talked to Miami international airport and they have confirmed that the POE will be Aruba. This is where the international flight transfers to Domestic. Nothing like doing your research--Am still kicking myself :bonk: :bonk: :bonk: . However, the gentleman from Miami told me that he would assist me with the airlines to assure smooth transition. He also told me that I can request an assistant to be onsite who speaks portuguese--I never knew this. After all of this, I better surprise her at Miami and fly to DC together. Take it from me--should definitely research as much as possible.

She will not go through customs twice. She will collect ALL her luggage at whatever her POE is, then go through customs, then recheck the baggage for the remaining flights.


Hmmmm, Okay, Do you think this is worth notifying the Airport to see what the best way to proceed would be? The last thing I want is a stressed out fiance on what should be a very happy day. Even if I meet her in Miami and escort her to DC, It is still a better flight, the others were 23-32 hours travel time. I definitely appriciate the feedback--What a nice site :)

Hello All, We finally have our interview date of 06/14. My fiance is almost 6 months pregnant so the wonderful people at the consulate in Brazil gave us a little help with the date so she would not have to fly deep into her pregnancy. I have a couple of questions concerning the flight to the POE. I have traveled extensively and remember a few times where I have had to literally go from one terminal to the other to catch a connecting flight. I was wondering if anyone ever had this happen during a fiance's flight to the POE? If so, was there any grief while traveling to the POE under a K1. Her layovers are in Paramaribo, Aruba and then Miami. All very short layovers so I am hoping not too much distance between gates. I know-alot of layovers but the ticket was irresistable! Only 16 hours travel time and $670 from Brazil to Washington DC. I paid $560 for a flight from Belem to Rio :). Okay, now for a second question, I will be meeting her at the airport in Washington DC. Will it be possible for me to obtain a gate pass so I can escort her through customs? Thank you all so much for the time and any information you can provide. Best of luck to you all
