She still has to have her medical done before the interview. I would let her do the medical, continue to do whats needed at the NVC for the CR1, there is a chance that the CR1 will finish up at the NVC before June 4th then the interview will be for the CR1 and the K3 will be dropped. If you cancel the June 4th now and the NVC finishes up with the CR1 before then, you may not get another interview date for a few months. If by June 3rd the CR1 isn't complete yet then she can either call or go in on the 4th and tell them she would like to drop the K3 and wait for the CR1.

The I-797 Is what you need to send in with the I-129. Shows that you filed for the I-130 and it is being adjudicated at CSC. Not positive but I think you want to send a copy and save the Original for later or vise versa.

(Incidentally we also got wrong information regarding our younger son's travel document needs earlier from the Ukrainian consulate in New York) Fortunately the interview is not until the end of June, and thanks to VJ member Barron555, who's fiancee lives quite close to Sergey's university, she graciously offered to help and he will be in contact with her and direct him to the proper place to get this. (FINDING the correct office and line to stand in is the biggest challenge in Ukraine and Russia)

Two things...

1. I have repeated what was told to me here in these posts. It was incorrect. If you have a K-2 visa in your future and the child is a college student out of his/her home country, plan on getting a police certificate

2. Even the consulate can be wrong. Double check everything before you go and always err on the side of caution. I should have just done it to begin with and had it even if not needed.

3. (I said two, I was wrong) Check on these things with plenty of time to turn the battleship! Waiting until the last minute will burn you!

4. (boy, I was way off!) If the consulate is in error, it will be YOUR problem. Imagine we went to an interview in late June with a K-2 visa issue deadline in early August and get told "Sucks to be you, you don't have what we need!" They will not change the rules because someone sent you the wrong information!

Correct me if I am wrong but wouldn't the safest thing be to get the documents despite what others say? Seems that if there is the slightest chance something may be needed it would be better to spend the time and money to obtain it before hand and have it in the interview and not need it then to not have it and get denied. Better to fight a war with too many weapons then not enough. Tis much better to have and not need then to need and not have.

Lots of partial information here on this subject.

The passport card is "valid only for international land and sea travel between United States, Canada, Mexico, the Caribbean, and Bermuda" (Taken directly from the card.)

If you renew or apply for a passport book, the card is an additional $20 if gotten at the same time. If you only get one of the two now, and then decide to later add the other, then you will pay the full price again. The discount is only when done together on a first time or at renewal.

The card was designed with transportation in mind. ie: trucking. The passport book is always the best option. Even if you drive truck and plan to never go anywhere but Canada and back, say something happened and you crashed your truck or got really sick and couldn't drive, you would not be able to fly home but would have to find land transportation back home. The plane may be the fastest and best route so the book is by far the best bet.

As far as for ID, A driver license or state issued ID is all that is required from any officer in the states. They don't want to see that your from the US they want to see where you live, street, city, state. Any ICE or border check stations I go through (driving truck i go through many) they have never asked for anything more than if i was a US citizen and from what state I live in. If it ever became an issue past that point then the passport book would do the same as the card.

Any US citizen who plans to travel to Canada after June 1st MUST have a passport. US law not Canada. But Canada says, " If the US won't let you return to your own country without a passport then we are not going to let you into our country to get stuck here because you don't have proper clearance to return home"!

To sum it up in two words: Passport Book.

She has a Canada driver license which is sufficient proof for Canada that she is a Canadian citizen. Again, it is the US which requires a passport NOT CANADA. So she can prove to CBSA that she is Canadian and not US thus not needing a passport to return home. It still boils down to what she feels is the right thing to do. She implys the boyfriend is history and she wants to stay here to live and work so the marriage thing is out. tough call.

First off. In spite of all everyone is saying here, relations between the USA and Canada are different than with any other country. All Commercial traffic is logged into Canada and logged into the USA so they can compare notes and see the time spent each place. BUT non commercial traffic of Canadians being logged into the computers when entering into the US is random. and vice versa. If you are in a car and pull up to the inspection booth they may only ask a few questions and let you go. You are not put into the system so there is no record of how long you stayed and the issue of an overstay is irrelevant.

I know of many Canadians in the states and US citizens in Canada who have lived in the other country for years without getting residency. I am not saying it is right or wrong but they have the money to buy a house and live without causing any problems or making a noise about anything.

The passport requirments do go into effect June 1st! BUT, again, Canadian citizens who would be here before June 1st without a passport only need to prove to their government they are Canadian with whatever means they have on them. The US is the ones who require passports. The Canadian Government has said. Any US citizen must have a passport to enter their country because if the US will not let them back without it then they dont want them stuck in Canada.

Any Canadian will need a passport to enter the US after June 1st and I am sure all persons will be entered into the computers and will be trackable after june 1st so overstays and such will be known but as far as them tracking down everyone and escorting them out of the country??? NOT going to happen for a long long time. Unless you are found to be extremely dangerous probably wont be a problem if you keep a low profile. over 20 million known illegals here now! They cant deal with what they know about let alone the unknown.

Even though there are millions already doing it, I don't condone stooping down to their level and being like them. I say do it the right way. whatever that may be, going home and applying, doing an AOS here, just do it legal and you can sleep at night without any worries. Hi All!!
I decided to share and hope that it helps everyone keep in touch cheaper and that yahoo doesn't catch on and change things whistling.gif let me try and explain.

This is for USC with a cell phone and anyone else using a PC. The USC must be the one to have a credit card on a US account. The USC either has to log into the foreign partners yahoo account (or) give his/her card info to to the other.

Sign into (or create a new) yahoo account, Sign up for the "phone in" account. The cost is $2.49 a month if you pay for a years service ($30.00 one time charge, good for a year) Pick a phone number from somewhere close to you or from any area code you like. Most USC phone plans have unlimited night and weekends. When the foreign partner is online and logged into their yahoo account, and their partner (or anyone who calls that number) it will ring to the PC and work like normal. Calling from the US on nighttime minutes is daytime for the Philippines.

If the USC has unlimited text, text messages sent from Yahoo to their cell phone is free and messages sent back are also free. So the foreign partner wakes up, logs into ym, sends a text and says "good evening honey, I'm awake now." then they call the phone in number, it rings to the PC and wahh laahhh!!! kicking.gif Talking for really cheap. dancin5hr.gif

If the PC is off or they are not logged in, it goes to voicemail and will be sent in mp3 format to their email.

Also, The same ym account can sign up for the "phone out" account. The USC can put $10 or $25 on the account and the foreign partner can make calls to the US for 1 cent per minute. Calls made from yahoo via phone out are dialed beginning with a (1) then the area code (XXX) then the number. Ex: 1xxxxxxxxxx Do not try to dial any other way or it may charge more than 1 cent. Every call that is made will show how much it will cost per minute and what the balance is when placing a call. (good way for outside US to call NVC and USCIS cheap.

When signing up for the phone out, it says this is for US only. But if it is the USC using their cc then its not a problem. I hope this helps some of you to be able to stay in touch and save some of that money to spend on your 130's, 129's AOS's and getting your partner here!!!!! If you have any questions on using the services send a PM to tngirl or me and we will be glad to tell you what we know from experience using it since October last year. I drive truck and like to drive at night, so we have logged hundreds of hours talking ohmy.gif I know for a fact that AT&T has a built in disconnect after 3 hours. (I have got 3 hours and 4 minutes before it disconnected)

BTW, Whenever I have signal, the PC is on, the cam is open and she can pop in at anytime. We eat, eb0dfafc.gif shower, devil.gif sleep, sleep.gif walk, yes.gif talk, drive, go to stores, wacko.gif anything and everything we can do together we do. It is just as if she is here with me. People look at me strange in the stores and restaurants when I come in with my PC but I tell them all the same thing. I think you are alright, so long as it is a certified true copy. They will ask the NSO copy again during NVC so there's no need to worry.
If you get an RFE, just email the NSO copy to your husband (or mail it out now) and he can forward the copy to USCIS.
For now, there's really no need to panic or worry. Just keep praying that the NOA2 will come to your mailbox soon.

I find it hard to believe that 3 of them are all involved in a conspiracy to make our K-1 visa fail or delayed, and when someone even from the local registry office which would handle any annulment tells us also that there is no record of marriage on file, then or now, and then an annulment cant be filed because there is nothing to reference TO DO AN ANNULMENT, what am I or my fiance to do? Yes, any government agency in the US would be aware of her first marriage. Yes, they had US marriage license which was used for their AOS. You dont need to state the obvious, but what you must also know NutMagnet and Tnguy is that it is not the Philippine government who decides if a visa is granted. It is the US government. Also, there is no legal requirement for a US marriage to be filed in the Philippines. Again, if it is recognized by the Philippines, great, but without a recorded marriage licence in the Philippines, which anyone would have to apply for and receive, how can anyone apply for an annulment of a marriage if there is no record of it? The US marriage license or certificate proves a marriage happened in the US, not in the Philippines. Also, a US marriage certificate or license cannot be use to file an annulment in the Philippines. Proof of a Philippine marriage is required. All you say and repeat over and over is that we have to have the marriage annuled, BUT HOW? You are not giving any answer to that question. You just repeat Articles and opinion.
Yes I paid for their divorce other wise, Mr Spiteful would still be hanging around making his own troubles. He was never going to file the divorce on his own. He said this to me directly. So I handled it and I really dont care what your opinion is on that matter. According to US law, my fiance and I are free and able to marry in the US....and it is US law that applies here. There is nothing the Philippine government can do about it because THERE IS NOTHING TO DO ABOUT IT. All our paperwork in in order and we have all the required documents. So again NutMagnet, thank you for all your "help"??? but I have talked to enough experienced people on situations like this, in both countries, and I am satisfied with what they tell me. There is no conspiracy happening here by me, my fiance or lawyers in either country which is what it seems you think is going on.

NYDVO, I would take NUTMAGNET's advice if I were you. It is the sanest and most lawful advice you will ever get.

As for the three lawyers, they are giving you really bad advices. I wouldn't trust them with my future, I studied family code in school and no where did it state that recording of marriage done outside the Philippines needs recording in NSO for it to be valid in the Philippines.

If you need better lawyers, send me a PM, I can refer you to one of my former professors or their law firm. There are so many fly by night lawyers in the Philippines, if you want somebody reputable.. you can also go to Integrated Bar of the Philippines for a referal for Family Law pratitioners. You have to get somebody who is practicing Family Law, lawyers have different specialties. Most lawyers you see here in the Philippines practice Business law, that's where the money is.

You are in deep sh*t, sad to say, but you will find a light at the end of the tunnel. Just don't rush things and hope to get a crafty work around the Philippine laws. Trust me, the marriage is recorded in the USCIS and US Embassy, and the COs at the US Embassy Manila studied the Philippine laws and they will apply it without discrimination.

Ours is the same way. The web shows that it was received on the 13th and a notice was mailed out. We never did get the NOA1 so waiting the required 30 days we called yesterday and they told us that the NOA1 was never mailed out because of a "glitch" in the system!! So we asked if anyone was assigned to our case yet and she told us it takes two months and that our file was still in the mailroom. STILL IN THE MAILROOM??????

I am by no means an expert or even imply I know what I am talking about but the relationship between the US and Canada is a little different then with other countries as far a visisting. You do not need a visa to come here and they dont seem to be so strict as to how long you stay. I have gone to Canada and said I would be 2 days then wind up staying a month and have never had a problem getting back to Canada or been questioned as there is no visa stamp to show when I came or went. It seems to be the same for some Canadians I know also. imo.

Pushbrk......for crying out loud, no one is twisting your arm to read these post! It's all done by choice! The guy has gotten conflicting information from many different sources and is trying to get enough information to make an major decision on what to do. Let him ask in as many forums as he feels he needs to make a choice. Better to have to much information then not enough. Sometimes when you get to many different views and you are not sure what is right at least you have a pecentage of a group to go with.

I have not filed for 07 and 08. I have them done and waiting for me to pick them up and mail them if I ever get home. AM trying desperately to do that asap.

I am self employed. I am assuming for the 1040 they want line 22 for gross income and not 1099 gross.

Of course we find as many deductions as we can to get our tax liability down which also lowers our limits close to or below poverty level even though we are not poverty stricken.

My line 22 for 06=$16,561
07=$32,619 kicking.gif

08 Hasn't been sent in yet so I can just pull some of my deductions and raise the income over the limit but that will increase my tax burden that I need to pay.


Any chance they will average them? I will be ok then. High fuel cost last year and lots of maintenance on an old truck is what contributed to the lower number. Should I write a letter and explain this. Or should I just pack up and move over there with her?

There is NO (none-zero-zip-zilch-nada) chance of a co-sponsor. It's Me, Myself and I!!

Please don't guess on this for me. I am looking for someone who has been in a similar situation and would have some SOLID advice that I can run with. I can't spend weeks trying to get the right help only to find out later it was just a ####### shoot guess. No disrespect to anyone here intended. Thanks for any assistance.

I sent her an email and said we fell below the level and didn't have time to say much more as I had to go and she read it and panicked before I had a chance to talk to her. We are not poverty stricken!!!! We are not poor! I am self employed and make plent of money to support both of us and a family. BUT!!!!! when it comes to tax time I collect and claim as many deduction as I can to lower my taxable income SO it looks like I am poor.

VERY WELL SAID!!!!! There are good and bad in all races all over the world. I have learned the ones who cry discrimination and assume everyone else is against them are the most racist. Taj and muslim lady literally attacked tngirl and beat her, screaming racist the whole time not even stopping to check the facts first. We are very new to the whole visa process and all of the terms. Someone said "AP happens in most muslim countries and some others" So she just read that and asked not insinuating that it couldn't happen anywhere but wanting more info, and the dogs attacked!!!! (no people don't get all defensive! I'm not calling you dogs just using a term) She wasn't even around to comment. Then when I tried to explain it was too late they had made up their minds and all they could say was "WHATEVER, SURE, OK, RIGHT!!!! things like that being all smartallecky.

Just before you start name calling and attacking people at least find out first if what was said was the way you took it. I do have to say that at least one of the two apologized to her. I don't know if it was sincere or not but i believe that since it was done by pm it was. Unlike myself, Ivy is a good person inside and out and she harbors no bad feelings or thoughts for ANYONE!!!! I on the other hand have a tendency to not like a lot of people! not because of where they come from or what they believe but from being the way they are. (mainly things like being liars and thieves!!) I just want things to go quickly and smoothly and get my wife here so we can start our life together and enjoy whatever time we have left together.

For CR1 and IR1, the NVC will assign the interview date.
YES, definitely send originals to NVC. (SEE LINGCHE's Shortcut).
Also, get extra copies, coz I sent originals to NVC and yet during the interview they requested another set of originals (BirthCert, Marriage Cert, and Marriage Index).
I don't know what you mean by Appointment Post and Standard post, but I hope the above info is what you are looking for.

I'm just wondering, doesn't the NVC assign interview dates? Why do you need to schedule it with the USE Manila?
If the AVR says August 10, wait for 3-5days before it gets entered into the system. I think they use DHL, and DHL takes 2-3 days from US to Manila.
