We got one too today!! oh yeaaaaahhh! the feeling is AMAZING!

I took a nap for a half an hour.. and when I woke up, I first checked my case status (just clicked refresh) and saw "Post Decision Activity" bubble highlighted!! I couldn't believe my eyes. So I checked my phone and saw the text message. and theeen I checked my email, and the email from USCIS was there.

I am so ready to hug every one right now!!

If you have received your NOA1, head on over to the USCIS website to sign up for notifications on your case. This is the official place to see what is happening with your petition.

Now, start collecting information for the beneficiary's interview. If you can get your hands on a list from the packet you will be sent, you can prep now. Some things take a while to acquire, such as immunization records, birth certificates (long form), etc. I found sample packet on my consulates website for Canada (Vancouver). Also be sure to keep any proof of your relationship from here on out. Phone records, plane ticket stubs, letters, photographs, etc. Start a file with all of this.

In the mean time, update your timeline now that the petition has been sent, and anytime a status changes on your case (new info received) update it here so people can assist you better with questions you might have. You can click on profile, then timeline should be on the left. When you get your NOA1, this will be the first major thing you put on there. Also be sure to change your service centre to the one that the NOA1 says your case has been forwarded to. This will allow you to find out information about estimated time frames for processing. :) Congrats on filing!

Sorry for the multiple responses, but I forgot to mention that immunization records may exist even though the beneficiary doesn't have them handy. Not sure how it works in the Dominican, but in Canada we contact the public health authority and/or schools attended and family doctors for records. It might just be easier to get the shots again, but mention to the doctor administering the shots that it is possible that they might be duplicates.

If the beneficiary doesn't have immunization records you can find out which immunizations he/she needs for the medical and have those prior. Make sure the records are kept for each to bring to the medical. This will be cheaper than having them do it the day of the medical (if the specific office even does it). The immunizations vary for each age group, so you will want to take that into account.

Okay, you should be fine then. You should receive something in the next week or so by mail (NOA1). After that arrives your best bet is to compile the documentation for the interview portion. It won't occur for another 5 months + but some documents take a while to get a-hold of. Packet 3 has a checklist for this and you can find information by looking up your specific embassy here: http://www.visajourney.com/consulates/ . The interview would take place at the appropriate consulate for the beneficiary's country.

The biggest thing that I have found difficulty getting is immunization records.

Other than that, familiarize yourself with the process of K-1, AOS and any forms required along the way. VJ is a great resource for this and the more your read posts (even if they don't pertain to you right this second) the better prepared you will be.

I forgot to mention, USCIS is like any other gov organization and they likely didn't even open the package on Oct 22 (which is a friday) Today is probably the first they have seen of your package and it takes a couple of days to process. Did you send along the email/text notification form as well? If so, you should be hearing something soon.

When did you send them in? Did you send express post or by regular mail? A tracking number would be great. We sent via USPS priority overnight (Cali to Texas)... we had our NOA1 4-5 days later

Does everyone that sends their application to Texas get re-routed to another service center? any ideas why?


As an October filer you won't hear a thing for some time. You should have gotten your NOA1 which states which service centre your petition has been routed to(or should be getting it soon if you filed in the last week or two). It also depends how you send your package - express, regular mail etc.

When you get your NOA1 you can monitor its status at the USCIS website and you can sign up for notifications as well. It will allow you to view what date your case was last touched/scanned in the system. As many people reiterate, *touches* don't mean anything specific and some people do not get any updates from USCIS until receiving their NOA2. Right now processing times vary. Right now the California Service Centre is taking about 5 months to NOA2. Not sure about Vermont or Nebraska at this point. You will likely be one of these as you are filing from the east coast.

Once you get the NOA1, update it in your timeline and at the very bottom of the timeline VJ will show you your estimated processing date based on your date of NOA1 and service centre volume.

I waited a week, then called NVC. Either way, it won't speed things up, but it will give you piece of mind. In the mean-time, get all of your docs ready for the interview :)

Just wanted to send along an update for those waiting for their noa2's, etc. We got our NOA2 email on Feb 2, forwarded to NVC on Feb 3, received Feb 4 and sent on Feb 9 to the Vancouver Consulate. Vancouver processed everything on Feb 15th, and I got the notice to download packet 3 from them on Feb 18 by mail, returned packet 3 on the 18th via fax, and they e-mailed me with my interview date the following day. Will be interviewing March 23, 2011 in Vancouver :D

Scott arrives tomorrow morning for a few days visit, so we are definitely going to be celebrating the smooth process :) I have heard Vancouver is one of the friendliest consulates out there, so it should be relatively smooth sailing from here!

Sending along my best in hope that you all get just as lucky! It is such a relief when you have everything in order and a timeframe to go by for moving. *sigh*

IR-1 / CR-1 Spouse Visa Process & Procedureshow much cost me lawyer
A lawyer is wholly unnecessary, unless you have a lot of issues with your case. We got quotes from 3 lawyers in California over the summer this year and the cheapest was $2250 for basic services and the most expensive was $3500. That will only take you as far as the port of entry and then you are on your own for AOS and naturalization. Either way, you will have to gather all of the documentation for your petition and your case - so the process still takes time and effort. The lawyer simply checks to make sure it is correct. We opted to do our K-1 ourselves and I prepared all of the necessary documentation in about 4 days, including compiling everything, placing tabs on it all, getting photos printed and the package was sent with no issues so far. Of course, I live in a country that is very sim8ilar to the USA so it was easy, but not everyones situation will be the same. If you have the money to spare, look for a credible lawyer that specializes in family based immigration and who knows what they are talking about. Two lawyers I contacted gave me false information about the K-1 process - it seemed I knew the process better than they did! I saved myself $3000 and you can too if you take your time and voice questions on VJ.

We are about to send off our I-129f this week and as my fiance and I are both students, our fees will be paid by his father. I am curious if there will be any issues with my fiance sending a cheque with his petition that contains his fathers name and not his own? Any experience with this and does it matter in the least? He will be handling most of the fees (Interview, Medical, AOS, etc. as a loan to us) and we don't want delays because of something so silly.

Not sure that's the best advice.

There are many reasons to go the K1 route when Cdn - head over to the Canadian forum and you'll see why - not everyone wants to get married and then live apart during the VISA process - some of us preferred to do the waiting upfront while engaged and then move and marry. My husband and I both had teenagers and are well established in our careers so for me to take 4-5 months off and be the homemaker at a very busy time in our lives was just fine.

Not being able to travel to Canada for the 3 months was not the end of the world....little tough, but not bad.

It's really about preference and nothing more



We have chosen the K-1 route as K-1 interviews can be conducted at the Vancouver consulate. I live in Victoria, BC and it would be about a $1000+ flight to Montreal for the interview if we married prior. In addition, I am finishing my undergrad in Victoria and we have until May before I can move to California anyway (almost the exact time estimate for the K-1 process). California is far enough that I doubt I will need to travel back to Canada before the AOS is approved once I am in the US, so no worries there. We plan to do a casual city hall wedding for starters when I come to California and then do a formal event about a year later - pretty standard as far as I see with people in the same boat. Planning a wedding and compiling immigration documentation at the same time doesn't seem like the best match for us (especially with me in school!)

We will be living with my fiance's parents to start so we can get on our feet while I am unable to work and once I start working after receiving the Green card and EAD we will get our own place. So overall, the K-1 process isn't necessarily the harder situation for us. We have done a year of distance thus far with no issues, so waiting is something we have become good at.

As far as I know, the K-1 process doesn't prohibit travel prior to the visa being issued. Can someone verify this? I am under the impression that the travel restrictions occur after entering the USA on the visa only. We would like to visit prior to the process being completed.

If there are any members who have done the process with Canada somewhat recently and have moved to the USA (bringing a vehicle, belongings etc.) that would be willing to give me an overview of the process, feel free to get in touch. Can someone clarify, since we are on the topic... When filing for AOS, do you need to file for EAD as well? I was under the impression that you had to file for both at the same time, and pay the cost of each form. Saving money makes me happy, so if you don't have to file both I will be thrilled! I have just been working out my budget for the whole process as we are both students with little extra money.

Another question... regardless of the answer above, what is the soonest that one can start working given current wait times? We are applying this week for the I-129f and *should* be going through the California Center as my fiancé lives in California. Wait time for the AOS is 4 months currently. I notice that EAD is 3 months, so it seems pointless to do it separately by choice (if you don't have to file both). We are trying to work out the amount of downtime I will have when coming to the US when it comes to work for budget purposes.

Ok, so an other week passed by without sending the I-129f package :crying:
Everything is sooo ready to go, but yet we discovered an other problem. :blink:

My fiance (US citizen) has 2 residences, one in South East Texas, and in Pittsburgh (PA) :whistle:

He is a DD, Directional Driller, and because he has to work all over the place and has to move a lot, can we do the following thing:



Can we use his moms address and fill in her address on all the forms? She is, ofcourse, way more often at home so whenever we receive something about our K-1 package, she can send it to my fiance.

My fiance is never home, but we aren't for sure if we are allowed to fill in his moms home address..


PLEASE LET US KNOW, because I'm getting so frustrated :( not sending out the package since we gathered everything, and so on.

I would also put a sticky on your file stating the situation. The way I look at it, you can never have too much information for USCIS. My I129f was filled with notes explaining ANYthing that seemed unclear. For addresses of residence I would perhaps do a separate sheet (in addition to filling out everything on the actual form for addresses) with clarifications for any periods of time with multiple residences.

I have been looking for information regarding required (not recommended) vaccines for Canadian's for the K-1 Consular Interview.

I am 25 yrs of age, will be 26 by the time of the medical/interview. I want to get my vaccines now so they can be covered by my health provider before going to my medical. I looked on VJ guides for immunization, but the information seems outdated as it still says I would need the HPV shot, which is no longer the case as per other forms.

I am curious if someone can give me an easy rundown of what I need for an interview after Jan 2011 at the earliest. Heading to my family doctor for a physical tomorrow and I would like to get the required info from her and any shots needed.

It was based on which state the USC was living in. That's how it was in May when we filed, but now there's this new fangled lock box. I have heard it's based on which service center is able to take on the petition, based on numbers. It could still be based on the USC's state though. Sorry that wasn't a very decisive answer! Someone more in the know could probably be of better assistance.
And, to be honest... both service centers have their slow/faster periods, so whichever one yours gets sent to will have it's ups and downs. CSC has been slow for the past couple months, and Vermont was slow before that, if memory serves. When we filed, I remember being happy we weren't at Vermont, because they were being slow.... but then, of course, people were getting transferred to Texas if they filed at Vermont and somehow producing light speed approvals, eg: in 3 weeks. So my "happiness" quickly went out the window, haha.
Just remember... they say 5 months for processing, and keep that in mind. I feel a bit impatient now, but we're still 3 weeks away from 5 months, so I am trying to remember that... if you get in the mindset that you will wait 5 months, then anything shorter than that will be a blessing!

Anywho, if you want to check out the progress reports forum, we're all complaining about the slowness, haha... good luck with your process!



I am not sure if they are sending to whichever service centre can handle the petitions... I sent mine a few weeks back and it went to CSC. If they are as busy as people say, it probably would have gone elsewhere. I also read somewhere recently that it is based upon location of the petitioner...

It's sad you haven't been able to physically see your fiancee .... I just keep this in mind and feel lucky that I've been able to be with mine for the last year and a half :)

I heard on here a while back that if you think it might be risky getting into the USA without such ties, it might be a good idea to try and find an airport abroad (wherever you are flying from) that has US customs on site? If you chance it and fly all the way to the USA, only to find that border patrol won't let him in, he is then responsible for the cost of his immediate flight back home. This may or may not be risky for you guys (I am sure some people have extra cash laying around for this).

If I were you guys I would try that, and if that isn't possible I would compile letters from family stating when they expect him to return, provide cell-phone contract (if applicable), and any other ties to his home country. A return ticket would be a good choice as well, along with any documentation of future travel out of his home country (if he is traveling more when he gets back home), and any documentation of future plans if you can come up with them. If he has travelled to the USA before and returned home without any issues, this will also come into play at the border. If this is his first time, you may face difficulties.

AND of COURSE! NOA1! :)

Obviously this depends where you are from. Not every country requires a Tourist Visa to enter the USA. If one isn't required, it is as easy as going to a POE with documentation tying you to your home country in hand (lease documents, phone contract, letter from employer stating date of expected return, etc.) as well as the NOA2. The more the better.

Otherwise, I am not sure how the tourist Visa thing works, so I can't help you there. You should update your info in your profile so people can better assist you with your questions.

Send it to the P.O. Box - they will process your payment. After that they will forward it to either Vermont or California, depending on where you live. Hope that helps - it was a bit confusing when I did it also.


I second Bela. Texas is the correct location to send it. This changed not too long ago from the individual Service Centres. They will forward it on to the applicable centre for processing.

I just wanted to ask for your opinion regarding a travel to the US after NOA2 has been issued. Do you think the fact that we're so close to the K1 will make a difference?

I travelled to the US in June and everything went fine and I still have ties (a job and I'm currently enrolled in college).


Flying through an airport close by with US Immigration and Customs on hand is a good option, as if you end up being denied once arriving in the USA, you are fully responsible for the cost of your immediate trip back. If you bring enough evidence (letter from employer, NOA1, NOA2, lease agreement, phone contract, any other future commitments that can be documented, etc) you should be totally fine. They are usually pretty accommodating if you are honest and prepared.

After consultations with lawyers about the K-1 process, I found that I knew more about the process than every lawyer I spoke with, simply by perusing the forums here at VJ. That being said, our case is very simple and I am from a low-risk country. When dealing with the paperwork, I realized that the work would be the same either way (lawyer or not) because I would still have to compile everything and that is what takes the most time and effort. A Lawyer in a basic case is simply a proof-reader, and there are plenty of those here for free if you need us :) Best of luck!

I'm heartbroken. I don't know what happened. He called it off, says he doesn't want to be with me. Maybe he never loved me, but I sure loved him. My life feels like it's in complete shambles. I wish I could just wake up and this would all have been a bad dream. But unfortunately it's not.

I need to know what I have to do to close my k-1 petition. It's still at VSC waiting to be adjudicated. Please tell me I don't have to wait for my NOA2. I don't think I could stand to see it in the mailbox after all this heartbreak.

I am glad you found this out before marrying him. Sometimes it is hard to tell when you don't have that face time with a person, like you do in most relationships. Long distance is hard, and it is extremely hard to know what the other person is thinking. Be glad that you are no longer with someone who would just end the relationship without trying to make it work. Marriage takes work, and if he bails at the first sign of distress or insecurity, he is not worth your time. You will get through this in time, and find someone so much better for you. Best of luck in your journey, and keep your head up! He is not worth it!

Hi all,

I'm currently getting stuff together for my I-129f packet, and one of the things I'm working on is getting together evidence of our meeting in person when I went to visit Janeth in July of this year. I see a lot of mention of boarding passes as primary evidence, since that shows beyond a reasonable doubt that I was there. However, I in my short-sightedness do not have those boarding passes on me anymore. I DO have passport stamps from my visit with dates, however -- I passes through Panama on my way to San Andres and on my way back, but the dates on the stamps establish that I was in San Andres.

I think I can go on the airline's website and print out a flight receipt from my trip... however, I imagine that isn't the same as a boarding pass and won't count as primary evidence. So my question is... will my passport stamps as primary evidence plus the itinerary as secondary evidence suffice (plus photos and whatever else I can get together) considering that I doubt I'll be able to access boarding passes? I also have a receipt from when I bought my hotel room, but I don't have anything necessarily proving I was THERE.

Passport stamps should help. We included those in our petition. We also did a printout of mileage activity from the airlines website that states all of the flights taken by both of us (separate sheets for each), the dates, and that mileage has been granted - meaning we did in fact fly on those flights. This is all you can get if you don't have the bording passes. Flight receipts in email form or online help as well, but anyone can purchase a flight and then not take it, so try to find evidence that the flight was actually taken if possible. Other evidence will also help, such as photographs of both of you together, in different locations. We included a picture of us at disneyland for ex, and then added the hotel receipt from email, and the flight confirmation from email which had both of our names on it.

Include 6-10 photos, anything else you can scrounge up that proves you have met in the last 2 yrs in person, and if you want, evidence of your relationship (phone records, etc).

The passport stamps are primary evidence. Yes, it would be great to have kept the boarding passes, but what can you do now? Yes, you may include a receipt of the flight or maybe even include a copy of the credit or debit card statement that you used to buy the tickets. Do include pictures, too. Yet, the primary evidence will be the passport stamps, so it is most important that you include them

For other filers, we should note that you might not get a passport stamp every time you cross the border (especially coming from Canada), so try to hold onto any proof possible from the flights. It is hard to do this at first when you do not know that you need them for immigration, but try to be proactive. Any documentation from here on out should be collected and retained for the interview.

Thanks for all this great info! I'll be sending this off by the end of the month! Will I need to attach any documents besides the i129f form? I want her to open a copy of the form for Xmas this is my goal. She will be done with school in april. I guess me handing this paper work is like me asking her to marry me. haha...:) Ill add pictures.She lives in surrey and im currently in seattle so I hope this will be a smooth process. We been together for 3yrs. :)



Most people say it isn't required for the I-129f process, but I would recommend having more info than not enough.

A brief run through of the necessities:
-Cover letter w table of contents
-Check
-I-129f
-G325A for you both, signed and dated
-Passport photos (US size) in colour from you both (2 each I believe)
-A copy of your birth certificate or all pages of passport
-A letter from each of you stating intent to marry (Basically a letter saying you are engaged and will marry within 90 days of her entry into the USA on her K-1 if approved). Signed and dated
-Proof of your meeting in the last two years in person. You will want to have enough here to give your case validity, but not toooo much. I included 6 photographs from varying times within the last 2 yrs, phone records, passport stamps, flight itineraries and boarding passes, emails planning our visit, receipts from a trip to disneyland we took together with both our names on it.

You will definitely need to consult with her about this. I assume you both have talked about taking this step? The asking part is the only thing left to do?

It is a good choice to do the K-1 in your situation, with you in Seattle and her so close to Vancouver. The K-1 is the only visa that the Vancouver Consulate processes for marriage based immigration. If you married first, she would have to fly to montreal for her interview. This way she will be in Vancouver for medical and her interview.

I would check with her to make sure the timing of the petition is okay based on what she has going on in her life. A lot of the work after the 1-129f will be on her hands, not yours, including all of the moving details, and documentation required for the interview and medical. I started preparing mine last month (and we have not even received our NOA1 yet). Moving across the border is a huge task and it requires a lot of prep work. Make sure she can handle the time and pressure if she is finishing up school. I probably would have killed my fiance if he had gone ahead without telling me he had filed out 1-129f! ;) It is just a heavy load to place on her shoulders and she may or may not realize how much work is involved. I would ask her to marry you and discuss this prior to submitting everything just to be sure timing is okay on her end.

Not to mention the cost.... if you aren't able to pay for the whole process of her obtaining the Visa portion and filing for AOS once approved, talk to her about this as well. The overall cost can push past $3000 for just the first year or so of paperwork and other mandatory costs.

Hi All, I'm very excited to find this site and wanted to know the difference between k1 and 129f. Also can I get started on ths proccess and give it as a gift to my GF. We talked about this before but due to the fact that shes so busy with school she doesn't have the knowledge or understanding about how long this proccess takes. You should fill out some of the information about your potential case (K-1 if not yet married, K-3 if married already). It makes it a lot easier for people to give you suggestions, time-frames etc.

That being said, I am from Canada and my fiance and I just did the paperwork together in September. I too am a very busy student and had to arrange the estimated time of approval for the whole process to coincide with my graduation. It can be done, and starting asap if she plans to graduate in the next 6-12 months will help. The whole process will take between 7-12 months generally, depending where you are from and where the beneficiary (the foreign fiance) is from. It is great that you want to help out by assisting with the paperwork. My fiance (petitioner) was too busy with school/work/his band to fill out the I-129f, so I did it for him as a gift of sorts as well. You should both go through the process together, however, as the process can be quite lengthy and time consuming. You should both share those duties as best as possible. There is a LOT of information on this website and you will want to frequent it regularly if doing the process on your own.

As for the I-129f, this is the petition by the petitioner (US Citizen) for the beneficiary (Foreign fiance) to become a K-1 visa applicant. To apply for the visa itself in the beneficiary's country (through their US consulate), you must fill out this I-129f form first. This process takes between 3-6 months at this point in time. I wouldn't wait until x-mas to send the forms though. If at all possible get them done and sent in asap, which will make the waiting game a little easier. If she graduates in over a year from now, don't worry about hurrying the process. The K-1 visa has an expiration date of 6 months once issued I believe (can someone confirm this?) so if she needs more than a year to graduate, it would be best holding off for a while on filing the I-129f.

Also, Colt never suggested LYING to USCIS. I think they are just confused about the classifications for each visa, as I-129f used to be applicable for K-1 and K-3. They would have been eligible for K-3, which I believe is no longer being processed. Someone told me recently that it is now CR-1/IR-1 only with the I130. Could someone clarify this?

Colt, I-130 is unfortunately your ONLY option. This site has a lot of information which can aid you in getting through the interview (and the city) safely. I would recommend being in attendance for your wife's trip, or having someone who is familiar with the city attend with her. In this case, fear is good and it will allow you to plan for the best course of action. Check out the regional forums and you will find some people who have gone through the same process who can advise you on the dangers and how to work around them.
