I went to visit  my wife she is in the Philippines.

When I visited I arrived 12 midnight Philippine time on NOV.9th 2012

I stayed 2 months with her and we were married Dec.9th 2012.

I left the Philippines midnight Jan.6th 2013.

 

I have only made that one visit to see her because im saving

for her interview trip to manila and for the fees that are about

to come my way. I have also helped support her every since

we have been married and don't have the money to make a

second trip for her interview. She is worried she may fail the

interview because I have only been there once.

 

Is this going to be a problem?

 

 

 

 

 

Nothing wrong gonna happen. Dont sweat it. There r so many cases like u. I m one among them. I wish u n ur wife all the best for interview. I think u have submitted enuf documents for bonafide marriage which wil speak on behalf of u both. honest answers are enuf for interview. It doesnot mean that u should visit ur wife multiple times. Its like a long distance relationship. Anyhow u r committed and having legitimate married status. so no fears. Go ahead n keep rocking.

Also is this the fastest way? I hear that sending it to the beneficiary's consulate in their country is faster? Well for Canada anyways...is that true? And if so where do we send that too?

My Husband sent our I-130 November 5th to the Phoenix Lockbox, up to date we have not received the e-notification.

Anyone knows how long it takes? Deeply appreciated.  

I received enotification in 3 days. seems its been 7 days for u ,make sure it has been delivered to the lockbox from postal serrice.so wait for another couple of days an if not getting any, call USCIS

The below link says to get passport clearance from local office.  My wife lived in 3 different states within last 5 years. I want to know if she will have to get clearance from all three states.

Hi. India matters. States does not matters. So no need to get PCC from all 3 diff states. Jus apply for PCC at the passport office where your wife's passport has been issued. Make sure if your wife is currently living in the address(which has been mentioned in visa papers and the same in the passport). If your wife living in the diff address(which has been mentioned in the visa papers) from the one which s in passport, You should change the address in passport ( by applying passport reissue). In that case, They will make u wait for completing the police enquiry on that particular address, it may take 30 to 60 days to issue the PCC.  

 

My case,, My address in the passport and the address i mentioned in the visa papers are the same. So i jus got a PCC from where my passport has been issued. Police enquiry has done when i applied passport. So It was so easy to get PCC. 

 

Note: I have lived in 2 different Districts in the same state(Tamilnadu). But that doesnot matter.

I am indian wife to a USC husband. so I think i can help u out in this stuff.

 

U and ur wife have to fill out the g325a seperately. In your form, U will have to mention all ur residence and employment for last 5 years and the same for ur wife on her form.

 

My husband and I spent only 9 days during wedding. This was our first and recent meet. So i jus mentioned " We have not lived together yet" in that particular field. Since we dont have a particular address at we lived. He landed in his grandparents home in india and we got married, later he flew off. no long stay so i think you are in the same situation. So u jus put like i did.

I understand being able to attend together makes for a strong case....but in a way it shouldn't matter.  Some embassies (like Mumbai where me & my husband are) simply do not allow it.  And it is absolutely unfair that we do not get that chance to present our case together as a unit like others do, yet are still judged in the same way.  They need to make the rules uniform across the board in order for this to be a fair process.

 

And yes, I've read the sample questions and the embassy interview reviews...I agree that some of the questions contain a lot of ambiguity...which I think is purposeful and sneaky...and so I practice with my husband.  I quiz him on ambiguous questions and explain to him the double meaning if he misses it and we formulate a good response together.  That way, at the time of the interview if a question like that arises, he will already have an idea of how to answers.  I told him not to be afraid to CLARIFY the question...ask the stupid officer what they mean by their ambiguous question. 

 

I wish I could go with him, but instead I will just work with him to prepare him so that at least maybe I will be the voice in his head during the interview.

I don't think Mumbai consulate will let the petitioner inside, though i could be wrong. I am actually thinking of going to the consulate with my wife for the interview. This thread did give me some food for thought about being with my wife during the interview (Even if they don't let me in).

1 - Good question. I wonder if there's a way to choose the characters of your native language on a computer, instead of English letters. Otherwise, maybe there's a way to scan in an image of handwriting. I'm unfamiliar with Tamil characters.

 

2 - As far as I know, one police certificate per country you lived in is sufficient.

 

3 - DS-260 is all about the beneficiary. Use your contact information.

 

4 - Say "yes". You are living at your current mailing address.

 

5 - I think you could reasonably say either. Take your pick, they're both true.

 

6 - I would use the addresses they were at when you worked for them.

 

7 - Who was your direct boss at your previous jobs. Provide their names, last name then first name. (I'm stressed about this one too, since I'm sure I don't remember all their names.)

 

8 - Multilingual people do have it tough here. I would either put both, separated by a comma, or (and I think this is what they're looking for here) the one you use the most.

 

9 - Again, the DS260 is all about you. So if your husband is filling it out, he should be filling it out as if he were you.  So it should probably be your birthdate. Also, the question about "did anyone help you" is referring to professionals (like lawyers) not husbands. So I'd say "no".

 

Please, anyone, if my answers are out to lunch, please feel free to correct me. I haven't actually filled out this form yet, but I'm usually a pretty good "form filler outer" and I can usually decipher legalese pretty well. But I wouldn't swear to any of this - it's my best guess. (Gee, the fact that I'm a lawyer's kid is showing here, isn't it!)

Hello Friends,

 

I am getting ready for DS-260 form with the help of screenshots. Here are my doubts.,

 

1.My native language is Tamil. So How could I write my full name in Tamil? When we filed i130, We just wrote my name and address in Tamil using Pen. But not sure how could I fill it out in electronic form.

 

2. I lived in 4 different addressess from my age 16. One is the present address ,been living for past 8 years. 5 years in previous address. But both the address are in the same town which were street next to each other.not so far tho. During living in the present address, I moved to Chennai for job n lived there for 6 months before wedding and another 6 months after wedding in 2 different addressess which were next flat to each other in the same apartment. jus a single number differs in door number for both. So Do I need to get PCC only from regional passport office for present address thts the one on my passport or Do I need to get Police certificate for Chennai address also? or Do I need to get PCC for all 4 addressess? I am so confused in this part.

 

3.In the present and previous address information page., we were asked for Home phone number or Work phone number or Mobile number. So whose number should i give here. Can I give my husband's work phone number or mobile phone number? or Should I give mine?

 

4.Should I say Yes or No for the "Is your mailing address as same as your present address?" I lives in my present address in India. Should I give my USA address where I intend to live or India address?. For what , They are asking for mailing address? For all future correspondence or only for passport with visa delivery?

 

5.In Present work/Education/Training information page. Should I say Homemaker or Not employed in Primary occupation? Coz I am simply focusing on visa stuffs, not working anywhere currently.

 

6. In previous work/education/training information page., Both my previous employers moved to different locations in the same city. Not in the address where they were located when i was working. So Should I give the current addresses of them or Just Can I give the addresses which has been mentioned in my offer letter or Pay stubs or Experience certificates? If I give the current addressess of both the employers, Then Do I need to get some proof or letter from them?

 

7.What does that mean Supervisor's Surname and Given name? Whose name I should give?

 

8. I can read,write and speak in both English and Tamil. I do speak sourashtra which is my mother tongue. The meaning of native language and mother tongue are the same? coz My native is Tamilnadu, where we communicate with people in Tamil. And We do speak in sourashtra with our relatives, sourashtrian friends and family. So My native language is Tamil or Sourashtra? in No.1 question I mentioned that my native language is Tamil but I m not sure on that too. But when filed i130 petition. I printed my full name and address in Tamil where i was aksed to fill it in native language.

 

9.My husband gonna sign in the form as Petitioner and fill out all. So in Sign and submit page.,Should I say Yes or No to " Did anyone assist you in filling out this application?"  How could we take this question as to petitioner or beneficiary? If it ask to petitioner, Should We say Yes or No? or If the question is for beneficiary, Should I say Yes or No since my husband(Petitioner) gonna fill out this form? and whose DOB we should give?

My name in birth certificate is K.S.Poornima

 

My name in passport is Poornima-Given name  Kothin Selvaraj(K for Kothin and S for Selvaraj)-Surnames. ie.. Full name - Poornima Kothin Selvaraj

 

As per the Mumbai embassy's packet 4, They explained us to submit the secondary evidence for name discrepancies in birth certificate. I am copying the contents from packet 4 here.,

 

 BIRTH CERTIFICATE (Original and photocopy). Each applicant must submit an original and a clear photocopy of his/her birth certificate. The certificate should include the applicant?s name, date and place of birth, the names of both parents, and the seal of the issuing office, i.e. the municipal authorities or the village authorities (gram panchayat or talati-cum-mantri). If your name is not mentioned in the birth certificate and if any details are missing in the birth certificate or if there is a discrepancy regarding your date of birth or name, submit the certificate along with secondary evidence.

?Secondary evidence? can be a baptismal certificate, an adoption decree, a school record, or a notarized affidavit from a close relative, a neighbor or friend who was present at the time of your birth on the appropriate stamp paper and sworn before a First Class Magistrate. The person making this affidavit must state how he/she knows your family and how he/she knows the facts of your birth. Secondary evidence must have your name, date and place of birth; names of both parents; and the seal of the issuing office.
 
 
I feel the names in both my birth certificate and passport are bit different. I can submit the secondary evidence for BC name discrepancy. I have the only document for my full name is my passport. But my questions are.,
 
1. Since we are attaching the biographic pages of my passport in IV packet, will NVC consider the same as secondary evidence for BC? coz My full name, Date and Place of birth,both the parents name would be reflected in my passport or should we attach another copy of biographic pages of my passport along with the BC for secondary evidence?
 
2. If NVC disagree to consider passport as secondary evidence, will I be asked to submit the affidavit to NVC? I am totally ok to submit the affidavits if they request for.
 
3. Can we submit the BC and affidavits for secondary evidence during interview or is that mandatory to submit all to NVC?
 
It would be very helpful in need and appreciated if anyone comes up with the better solution or idea for my situation. Expecting swift responses

Friends!! I have something to say.Before i get familiar with the CR1 process, i misunderstood that PCC is required to file i130. So i applied for PCC before i applied i130. So i hve tht experience in getting PCC in india. I jus fixed up the  appoinment online thru passport seva kendra, Here is the link

Once u done with the fiixing appoinment, U will have to appear at the passport office on time (where ur passport have been issued. ). you wil get clear with the procedures once u get passport office. since u are fixing the appointment prior n appearing on time, u wil get PCC in less than an hr time.  there is a filed in application , asking you for purpose of PCC. So you wont be questioned or asked for any letters or checklist from anyone, you can jus say them tht u r applying for PCC for USA immigrant visa. The pcc wil be in ur hand in 40 mins. Best of luck. Pls Dont listen to any idiotic agent

I think there are a lot of differences between doing a process DIY and doing it with a lawyer. I say this having done it both ways. I successfully filed my first petition 4 yrs ago DIY (the petition was successful, the rest of the process..well...anyway). Filed my second this year with a lawyer because she's handling all aspects of our case, even though I know I could have easily done it myself. I knew exactly what to do, but I followed my lawyer's lead because her office does these petitions like clockwork. And yeah, there were some things that were different than what I would have done, but she knows what she's doing.

Sure, it's a bit impersonal, and it does take a little longer than doing it yourself because everything has to go through the lawyer, get checked over, then sent back, then submitted, etc. On the plus side, they usually have a lot more familiarity with what's going on, and they (should) do a lot of the sorting/assembly and such for you, including writing any cover letter and perhaps even giving you a template or drafted letter of intent to sign. If you wonder about those things, that would be a good thing to try to bring up in the consultation, it's always important to establish who is doing what. This time around, I found it comforting to work with a lawyer during the Affidavit of Support stage because our financial situation has complicated dramatically since I last filed and I had a dozen and a half uncertainties, all of which my lawyer was able to quickly slay, and all I had to do was give her numbers and figures. Next thing I know, a lovely I-864 affidavit of support came in the mail from her office, all filled out and ready to be signed. It was a beautiful thing. There are times when working with a pro who has done all this many times before can be really comforting.

Also, VisaJourney is an AWESOME resource, but you notice that people get RFEs and have glitches in their cases on this forum all the time. Just because a guide says you need something doesn't always mean that's the best thing for your particular case, and sometimes you need something else, or something in a different format, or it's just a crapshoot. Hello embassies like San Salvador, Manila, Bogota. Ideally a lawyer is able to match your situation with the specific requirements at the consulate where you'll end up processing, although I also suspect there aren't many lawyers with significant experience with Moldova. The best indicator is how many cases like yours they deal with on a regular basis. If they're handling dozens of I-129fs a year, I'd trust that this is a reliable attorney. If they mainly handle employment petitions, or deportation cases, or student/visitor visas, then I wouldn't so much trust their guidance.

If you feel unsettled about your attorney, you can always consult with another to verify that what you've been told is correct. If you decide working with an attorney is not a good choice for you, be sure to inform your lawyer right away and be sure any contract you signed is fulfilled, and that you get a full copy of your file from them. If they resist that last part, you can involve the State Bar to ensure your rights as a client are enforced.



GHM - Thank you so much. I guess I had become concerned as things just seemed different in the consultation than I was expecting. I do know that the attorney I met with is a professional and they do a lot of these. However, I believe that many of the cases they handle are related to Mexico and South America. But I do understand what you are saying and appreciate it very much. I'm glad that you are sharing your experience of filing DIY and with an attorney. I think time could be a big issue for me as my fiance's son will turn early next summer. This gives us a 'window' for him and his K-2. I think at this point I am much more concerned about the time factor than any other issue. It sounds as if I use an attorney it will take longer (as you indicated) and I may have little choice than to do this myself as they will want to prepare all the documents themselves.

Again, I appreciate your kind input and I'm sure I'll have more questions as I move forward.

One more thing I wanted to note: Just because an attorney asks for more/different info than the VJ guides doesn't mean you need to immediately call their expertise into question. Because the attorney is taking your case, start to finish, they often want a lot more info and documentation upfront so they can check for and avoid any pitfalls along the way. Also, most attorneys I know get the birth certificate translated no matter what, because sooner or later, there's a chance you'll need it. Personally, I translate my documents myself and then have someone unrelated to the process and competent in both languages check, verify, and sign the certifying statement on them.


Thank you for you input. My problem is that there was not conversation about "cover letter" or original "letter of intent", etc. Not that I expected him to know where Moldova was or anything like that. I went for a consultation and basically got handed a checklist. There was very little interaction, questions, or anything like that. Maybe I expected a little too much? You don't get much for $50 these days. :)

Her divorce decree will need to be translated, yes.

Her birth certificate will not be needed until the interview stage, and unless she'll be interviewing at a different Embassy than the one in her own country, she would not need to have it translated; however, you'll need translations to get a marriage license (most likely) and to apply for Adjustment of Status (AOS) after you guys get married.

For the I-129F petition, the only thing she needs to send you, is a signed copy of the G-325A form with her information--including passport style photo, and a signed letter of intent to marry. If she was married before, then a translated copy of her divorce decree.

Her birth certificate would be needed later on for the interview stage, and not sure about your embassy, but in Colombia it is not required to be translated to English.

Hello everyone and thanks in advance for all your help (I will need it!). I met with an immigration attorney in Dallas today and was not extremely impressed. I had a copy of the VJ Guide with me for reference and what they were asking for "now" was not the same items. Also, I asked the question about translated documents for the I-129F petition. They said that it was required along with a copy (and translated version of her birth certificate which I did not find in the Guide). I was wondering that if the documents my finance sends me per the I-129F guide (e.g. divorce decree) must be translated in english? Also, do I need a copy of her birth certificate and translated version?

1) Correct. Add her maiden name in that other box
2) Standard Roman is acceptable. The only form that asks you to add the name in a native language if the characters are not Roman, is the i-129F

I have a couple of questions about how to fill in certain parts of the G-325A.

1) My fiancé retained her former husband's last name after her divorce. In the box "All Other Names Used (include names by previous marriage)" should I include her full name using her maiden name?

2) The Romanian alphabet uses accents on letters not used in English. Should I include these on the form or are standard Roman letters acceptable?

One observation: Many of the current editable PDF documents that I use currently reduce the font size so that all required information will fit in the space provided. Seems like updated docs should include this feature. Oh well, JMHO.

Mine has moved up, too! I looked at the trends yesterday and again today. CSC time has increased by a couple of days and VSC has decreased by a few days (on both 1-129F and I-130). Maybe that is good news for all of us at VSC!!

You are a very lucky man and I congratulate you both! If you start the process now, with current processing times you should have no problem with her k-1 visa by 8/2013. Also, since Romania is part of the EU her parents should be able to come here with no issues on their passport for 90 days without having to have a visa or anything of that sort. In fact, if your fiancee wanted (or could) visit before her k-1 visa is issued that should be no problem either. Best of luck to you both!!

In the instructions I received from the embassy it indicates a $240.00 fee due before the K-1 visa interview.  However, it does not indicate anything about my fiancee's son who will come with her as a K-2.  Is that another $240.00 fee for him as well?
