Thanks for all of the replies. I don't have problem proving a Domicile in both countries (Costa Rica and US). I have a house, car and receive all my bills in US and I have a corporation (not active), a car, apartment, utility bills for two years here in Costa Rica. My fiancee and I lived here together in Costa Rica for over a year. If we get married here, Are we qualified for the DCF? I don't understand how the DCF/CR-1 works. Neither of us have residency in Costa Rica. We moved here to see if we liked it enough to live here and we never filed for residency,because we were never sure. Now we decided to get married and want to go back to the states to live. The DCF states that as long as I have resided outside the US for 6 months or more as 'legal residents' i qualify as the petitioner... it is the 'legal resident' thing confuses me. Legally i must leave Costa Rica every three months for 72 hours, which i have done for the last two years, do same with my fiancee for over a year. thanks for any advice.

I don't really know if she can get a tourist visa to the US because the Philppine Consulate closed down in Cosa Rica last year and the closest is in Mexico. Even so, she is concerned she may not qualify. We were told we can file from here (Costa Rica), but i know that our main problem is financial at this point. I am figuring that once we get married in the US and i go back to work that by the time we file for change of status or adjustment, i should be okay financially. My father has agreed to co-sponsor if needed, but i hope i do not have to go that route. I am hoping to repair my finances within the first year of being back stateside.

As far as going back to the states and getting a job before filing for K-1, we don't want to be separated and she does not want to stay here in Costa Rica alone or go back to the Philippines without me. It seems to me that i am putting the cart before the horse, but am hoping for some kind of break i guess. I may be able to have my future employer write me a letter of employment and put money thru my bank account until i can get back stateside, but don't know how in depth the employment check is. I could be considered a consultant so as to explain my being here in Costa Rica, but getting paid in the US. I'm grasping at straws now i think.

You not only have to qualify financially at the embassy interview but when she adjusts status after you guys are married in the US. We're talking about probably over a year before you would also have to qualify to adjust status.
Bankruptcy won't affect anything as long as you qualify finacially.

Question. How did your fiancee get to Costa Rica? Does she qualify for a US tourist visa?

Hello and please excuse me if this has already been addressed, but i am new and using my fiancee's account. We are ready to file for our K-1. My finances are not good, but i think i can squeeze by. My problem is that i need to file for bankruptcy, but am afraid that it will ruin my chances for her visa. The longer i hold off filing the longer i have to wait to put all this behind me. I own my home (mortgaged, but with some equity) and this will not be affected by the bankruptcy. My questions is, should i wait to file until we get the K-1 and get her to the states and get married? Common sense tells me yes, but my 'common' sense is what got me in trouble to begin with lol. Any advice would be greatly appreciated. Also, while i am here.......i have been living abroad with my fiancee for the last year with no work, living off my savings. I have work promised as soon as we move back to the states when we get the K-1......this is another hurdle that is before me. Any advice in this matter would be of immense help as well. I am from the US and my fiancee is Filipina and we are both living in Costa Rica at this time........if this makes any difference at all.

I think her Taiwan Police Clearance still valid ( but I'm not really sure) since she got that before she left Taiwan or the day before she finished her contract in Taiwan. It means she have no conviction records during her stay in Taiwan. She will get another police clearance in her current country where she live now. I'm not really sure but maybe some members here in VJ have an idea.

Hi, I worked in Taiwan for 2 years, year 2005-2007. I got my police clearance in Tainan county before i go back to Philippines. They will give you the police certificate the day you requested it. Just bring your ARC and passport.

You can always call your embassy and expedite your interview. That's what we did mine here in US embassy of Costa Rica, they move it earlier but they can't help you if your package didn't arrive yet in the embassy. So, you need to wait first until your package arrive in the embassy, from there you can request for an earlier interview. They will grant you if they have a slot available. Good luck!

I suggest you to bring her in Costa Rica. Filipinos don't need visa in Costa Rica. She doesn't need to get transit visa if she will take the Europe way. That's what we did (me and my bf). I traveled last Feb.2009 from Philippines to Costa Rica. I flew from Manila-Amsterdam-Ecuador-Panama-Costa Rica through KLM. I bought my ticket in Expedia.com. She doesn't need a visa in Costa Rica for 30 days. What she needs is invitation letter from a friends or family in Costa Rica. Back and forth ticket and yellow fever vaccines. Hi, we try to expedite our interview here in Costa Rica. We sent an expedite letter to the NVC but the next day,they appointed us an interview before they process the expedite (that's the operator said). We keep calling the NVC and tried to push our expedite but they said they can't do anything about it because they already scheduled our interview. We went to the US embassy here in Costa Rica and they told us they can only help us to move the interview earlier when they receive the package already. So, in your case if you don't have appointment yet, send an expedite letter to the NVC with your supporting documents from the doctor and keep calling the NVC for follow up. If your package was arrived already in the consulate,then you can try to visit your consulate and expedite it. Good luck...

When filing the I-130 you are not required to include any info about your chosen co-sponsor. There will be no need to submit any information pertaining to this until your I-130 is approved and is transferred to the National Visa Center. They will then need you and your co-sponsor to fill out form I-864. But you don't need to worry about this for awhile yet :)

Hi Everybody, I posted this under DFC, but not sure it it would work for this section as well...

I want to present a unique case and solicit any advise or comments from experience.

My wife is a US citizen by birth and I'm from the Bahamas. We were both living in Costa Rica and was married here earlier this year. My wife has no legal residence in CR and my residency in being process but still not finalized. We are thinking of moving back to the US.

How should we go about applying for my residency in the US? Should we apply by means of DFC?

If I understand the CR US embassy page (http://sanjose.usemb...v_onbehalf.html) correctly, its seems that they can only process applicants for Legal Residents of CR.

But it also states that "The law requires that a K-3 visa for an applicant who married a U.S. citizen outside the United States be issued by a consular officer in the foreign state in which the marriage occurred."

I already have a travel visa for the US, I can enter the US legally no problem. I'm not sure about this but, can I enter on my tourist visa and then apply for a change of Status (I-485) or should I apply here in Costa Rica for a K-3 visa? Would they process it since neither one of us are bonified legal residence of Costa Rica?

Hi folks, my wife and I just received our NOA1 but seemingly no "Transfer Notice". However the NOA1 includes a note stating the location of where the file would be sent and process, i.e. California.

It seems that the K3 Visa guide on vj (http://www.visajourn...om&page=k3guide) it says that we should include both a copy of the "Transfer Notice" and "NOA1" when filing the I129F form/package.

My questions are: Is the NOA1 and Transfer Notice one and the same? Could I send the 129F package to the address listed on the NOA1 form without having future problems?

If you simply submit the NVC payment for the AOS I-1864 this will trigger the path you want to pursue with the NVC. I had the same issue was approved for both I-130 I-129 but just started the journey for the CR1 and did not have any issues~

Hi VJ crew! We just approved for both our I-130 and I-129F last weekend! Now I imagine things are going to speed up. I realize that:
IR-1/CR-1 is the way to go, as opposed to the K-3 route and
The I-129 papers would get forwarded to embassy for K-3 processing.

I've read both Jame's and LingChe's shortcuts for NVC processing. But I still have a couple of questions:

1. Some post says that in my situation, I should abandon the K-3 route and go for the IR-1/CR-1. How do I go about doing that?

2. It seems to me that the I-129/K-3 application would get to the embassy quicker than the time for approval of the I-130 from NVC. (I could be wrong about that statement). How can I get embassy to process me for an IR/CR visa instead of a K-3 visa?

3. If I was to get a K-3 interview while the I-130 is still being process by the NVC, would the embassy change the interview or would I have to wait until the I-130 is fully completed/approved buy the NVC?

Hope I made questions clear enough. Thanks to anyone who can answer my questions!

So far from what I know NO they cant be . But dont send DS-3032 till NVC tells you to, or otherwise it is useless. They wont have a clue whats case it pertains too. NVC prints all your NVC info. on the form for you. A barcode and the Beneficiarys name.


If I call NVC and update my info (i.e. giving them my email address) would they then email that form to me when its ready? Then I print it, sign, scan and send back to them via email or would I have to mail it?

Hi Folks, I've been reading the NVC shortcuts, and ran across James 2.0 shortcuts and it seems like you can either write in your NVC number or printout the barcode and affix it in the space provide. I'm not sure how old that guide is, thus the question: Does the DS-3032 need to have a Barcode attached or can I write in NVC number in the provided spot then send it in?

When I find out that the DS-3032 form has been generated, I plan on emailing NVC as well as mailing the DS-3032 to them asap. Hence the above question.

Yes, you'll receive the IV bill which you can either pay online using a US bank account or by money order.

You cannot pay by phone or by using a credit card.

Several Chinese Folk have gotten a K-3, then returned to GUZ Consulate for the subsequent I-130 interview.

Usually, a K-3 in the USA has the USC spouse file AOS with I-485 . Perhaps someone else here can identify what the 'nice lady' is talking about?


Hi Darnell, I didn't know that was possible to return for the I-130 interview, how did it work out for them? Did they get their Permanent Residency card without having to do the EAD, etc?

Yeap, stick with the CR-1 then your done with USCIS for 2 years. K3 is not worth it!!!! Just keep moving through NVC with your CR1!!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresGet K-3 visa and continue I-130 in the US??
Hi folks, we just paid our AOS fee, waiting for IV fee to be generated. Got a call from the embassy regarding the approve I-129F (for K-3visa) saying that a packet was ready for me to pickup. I told her that we are already going through the NVC process, and she said something I had never heard before...

The nice lady said that I could get the K-3 visa and then continue with the I-130 process in the states.... Is this something new? Or was she talking about the EAD, etc. process? huh.gif (on a side note, english was not her 1st language, so there may have been something lose in translation).

Any leads would be great thanks!
