I have read worst here on VJ. The CO says things to rattle the SO so just have to tell yourself that it's not personal. Hard I know but only you and your husband know the extent of your relationship. Outsiders looking in can only assume.

So the paper clearly says it is being sent back with a request to deny? It is weird if the reason is due to your income. I have not heard of this excuse before. But then again in Casa they are pioneers in excuses.

Sorry this happened to you. You should try to go to the MENA section and search for the pinned thread about returned petitions. Quite a few VJ members have had success in getting their SO to the US after a 221(g).

Try to find Kiyah here on VJ she is great asset to VJ and can help guide you.

If possible can you give us the reason for the CO used for the 221(g) and try to have your husband tell you EVERY question asked. Trust me it does matter.

The K-3 has an expiration date and more often than not USCIS will not even contact you for RFE instead they may let it expire. If you have not contacted your elected official do so ASAP. It is likely too late to stop it from being returned but the note will be in your file that they inquired on your behalf and you can use this when you get the chance for round 2 with the CO.

Try to search also for attorney Marc Ellis here on VJ he has helped a few people with compiling their rebuttal packets.

IMO...Do not rush to file the I-130 if yo have not done so already. Let the K-3 expire or wait to see if USCIS contacts you because as Ellis will tell you USCIS will deny the I-130 because you "ignored" the I-129F.

I keep hearing to use Marc Ellis for Denials etc. Has anyone every used him in Ghana for a CR1 denial or anywhere in Africa with good results. I find it kind of odd hes in Asia but I need the best lawyer I can get at this point.



I would not say he is the best lawyer but he has offered advice to a few MENA people. I did not hire him but it was not due to his location. Search for the best lawyer in your area if you want to sit down face-to-face with someone likewise search local immigration organizations in your State for legal assistance. There are some who offer their services free or low cost.

If you were eligible for another type of visa why did not travel to the US prior to the denial? I am keen to learn what method this lawyer devices to get you into the US within 6 months.
You have 2 denials already for the same case, correct? Has your wife traveled back to Nigeria to visit you in between denials? What type of evidence did you guys get together? You really need to understand the reason for the 2 denials because if by chance you do get to the US after divorcing your wife and then remarry her in the hopes of processing your case while in the US you will still have to overcome the 2 denials.

Tell David it is somewhat true. The LSAT, GED and SAT allow you to skip a question without a point deduction. That does not mean you can leave your entire answer sheet blank and pass. LOL The GRE does not allow you to do that. All questions must be answered. I am licensed to teach in NJ and I had to answer the questions on the Praxis exam. I am now studying for the MTEL which is for Massachusetts.

FYI..a few States are moving away from the Praxis and are requiring new educators to take their State exam in its place. Check with your State's DOE to see what exam they require.

Hello all, I have been living in Morocco since August 2008 in the hopes of bringing my husband back home with me to the US. I did not get my Carte de'Nationale which is required to prove Moroccan residency until last week so I am now preparing to go the US Consulate in Casablanca. In reading the US Consulate's website it states that both he and I must be present. What exactly will they ask us? In what language? We speak both Arabic and English at home but I can not read Arabic and he can not read English, is this a problem? We have been married since March 2006 ( In Morocco) So when he arrive in the US will he get a green card immediately or after he files an AOS.

There is a 2 year age difference is this a problem? There is no difference in religion but there is a huge gap in education. I will be working on my Ed.D when we return to the US and he only completed 8th grade. Is this a problem?

What is in the packet 3? Why does only my husband have to appear for the second interview? What is the likelihood that we will be denied? I did send an email to the Consulate asking some of these questions but was met with a generic reply that did not fit so I resubmitted my email and received a phone call for a Consulate employee. Let me state that we will not getting together braiding each others hair anytime soon as I found her to be very very rude and condescending. Will this employee have a say in my interview? Do you think they will remember me? I was quite defensive and a little offensive to be honest.

The State you live in is legally obligated to provide not only transportation for your son but education as well. And that education can be anywhere in the State. He will be placed with other special needs children where qualified educators will work with him. Contact the Department of Education in your city and inquire. Your daughter should not have been removed from daycare.

I know that was not your main point but you should be an informed parent.

Ok on the Riyadh website it says

For cases filed in Saudi Arabia: The U.S. Embassy in Riyadh provides all instructions to the beneficiary and sends the appointment letter.

Once the beneficiary has received the appointment letter--and no sooner--he/she may proceed with the medical exam.

Appointments are scheduled approximately 5–6 weeks in advance.

My fiance sent the DS230 on Monday and he received the interview letter today. It was just one page. My questoin is he took his medical examination before he got the interview letter because when he received the packet 3 it gave him the instructions on the Medical examination. My question is he has opened the sealed envelope, but it will probably be dated before they sent out the interview letter. Is that going to cause any problems or we will be givn a 221g or something? I want to make sure things are done correctly so any advice, please please please help!



Am I understanding it correctly..He opened the sealed envelope from the doctor addressed to the CO? If so then is it possible for him to back to the Dr. and request a duplicate after explaining the error? While the medical is required non compliance can be easily be overcome. Better to be safe than sorry in MENA countries so try to reach out to the doctor and when in true doubt call/email the CO for clarification.

According to the Consulate, you fiance should arrive no more than 30 minutes before the interview. The website has a list of required doc. Check it out and email the Consulate for clarification.

I LIVE in Morocco so I am not upset or waiting for a damn thing. I quit my job before I came to Morocco but I was lucky to have a savings and I am certified teacher and could work here if I wanted to. If you want to make this personal let me know. This is not a correct fact. I married my fiance 2 weeks after my K1 was sent back to the USCIS, and he was here 4mos later. If you pay attention to lawyers your husband will be in Morocco for a very long time. PM me and I will be more then happy to talk with you. Don't let any lawyer capitalize off of your heart ache. A lawyer don't have the power to get your fiance here. Why pay Marc Ellis $200 an hour for something you can yourself? I will be more then happy to give you the names of 3 other people besides myself that was denied around the sametime as I was and we all went and got married. All of our spouses got their visa's the next day after the interview.

Your case is rare you should be wise enough to know that. I told her this. I told her she may be him here on the original K-1 visa BUT lets be real here she may not. Rushing to marry him while the K-1 has not reached USCIS is not wise either. I am sure you did what was best for you and your husband but you are not everyone and you should know by now that Casa is the hardest Consulate to pass through and she MAY very well need to prepare a rebuttal for the original K-1. Simply ignoring it.....

You know what this is flipping ridiculous. Red flags!!!!!!!!! Some of the people that have responded to me have been very helpful and I do appreciate it. I cannot tell you how you have help me through this time when I am unsteady and unsure of my footing. At this point I am unwilling to give any more in depth information about my fiance's past through a public forum. I have given the facts of this case and have stated as plainly as I know how. If I were to meet a man on the street who was married, whose wife had left him, and he was looking for someone to date everything would be cool. And NO I was not married before, it was a trick question through into a series questions to confuse my father-in-law to be!!!!!! If you are not going through the same thing that I am going through or have risen about the odds against you then please keep you thoughts and opinion decent. There has been nothing but less than encourage words from some of you and I find it very hard to believe that you have an answer for each and every type of visa that has ever been filed. I am not an angry black woman and I am not trying to take of the world. I am old enough to know when I am being played and when I am not. There has not been a single avenue in my fiance's life that has not been open to me. I can call, visit, and host anyone in his family at my own will if that is what I choose to do. I simply asked if there was anyone in my shoes that could give me guidance. Unless you work in the Dept of Homeland Security you don't really know what red flags are. This man was crushed and defeated after being spoken to like a peace of #######. I am a US citizen and I have rights and I plan on use them. I will fight for my man to the death because he would do it for me. He did nothing but take care of me in every way possible during my trip there and back. I don't need a Dr. Phil. Truth is there are women who have been successful getting their fiances/husbands here and some who have not. Advising you to marry today is not wise because you MAY get a response from USCIS about the K-1 visa asking for information. Each step you take should be well thought out.

Get the detailed report and allow yourself out of the chair, turn on the light and see the whole inside of the barn. You might find that there are multiple reasons that combined, contributed to the ultimate result. Tied to the chair with the lights off, you'll never be fully informed.

Consular officers are trained and expected to consider the totality of circumstances in evaluating all aspects of granting a visa. Why would you want anything less than the total picture as you try to understand where things stand at the moment.


Words to live by but in Morocco they run against the tide. She in all likelihood will never get a official reason from them. She will have to weigh her relationship against the very tough and long road ahead. Time will be lost and money will be spent.

How early did he arrive? They explicitly asked him not to arrive more than 15 minutes early so I hope it was not much more than that. How was he dressed.

I live in Morocco and I can tell you the cyber cafes are filled with young men trying to get out of Morocco. I AM NOT SAYING YOUR FIANCE IS ONE OF THEM BUT I CAN UNDERSTAND THE CO's POINT OF VIEW. In your chat logs that you presented to the CO did you guys use a online translator like google? How long did you know him before he asked to marry you? Did he ask you via IM or on the phone? In what language?

Follow the guidelines on the MENA thread i.e contact your elected officials and trying to get the Consulate on the phone directly.

Not easy by a long shot but it is possible.

In high fraud countries, the "reasonable person" standard is the sledgehammer in their anti-fraud toolbox. In many cultures, knowledge and consent of the family is considered to be critically important. In some cultures it would be unthinkable for someone to marry without the consent and active participation of their family. When presented with a relationship where there were several possible motives for a person wanting to marry, a "reasonable person" in such a culture would have a hard time believing that someone wanted to marry for traditional reasons if the relationship itself did not conform to tradition.

Something about your case made the CO very suspicious. In order to confirm his suspicions, he pulled out his "sledgehammer" and he used it. Apparently, marrying a divorcee is a big deal in Morocco, and the father of the groom would be expected to know whether his future daughter-in-law had ever been married. He didn't, so the CO concluded that the beneficiary's family doesn't consider this relationship to be serious. If that's enough to set off the "reasonable person" alarms in Morocco, then it's enough to deny the visa"

I have gone to the MENA forum and read everything there is to read. The paper that my fiance was given did not say that he was denied but that it was going back to the USCIS for review. My question is do we start over at the beginning now, or does anyone have that answer? This is my man he loves me and he has given himself to me in the name of God. I know that I will do whatever it takes to live a long life with him but what step should I take. I have written to my senator and will fax, mail, or whatever I have to do with it asap, but what other action can I take. I would appreciate others who were denied to give me some sound advice. I was not the one who had been married before my fiance however has been. I can't believe that are doing this because his father said I don't know if she has been married before.


It is not as simple as starting over. There are people here on VJ who were denied the K visa, went ahead and married there fiance only to be denied again because they ignored the first denial. Now there are some who never received a notice from USICS. Instead USCIS let their cases expire and these people either filed a new application or married their fiance.

If you move this to MENA many of these people will jump in to guide you. There is a lawyer also named Marc Ellis who also tries to assist those who have had petitions returned or denied.

Are you in Casa? Did you seek information from the Consulate? What did they say? Last week another VJer was denied in Casa but was able to secure a second interview for the very next week. But again she was denied. Second interviews are hard to come by but can happen. In the meantime try to dissect the Q &A from the CO's perspective. What "red flags" were raised? How may visits have you had? Is there a huge age difference? His father not knowing about any previous marriages may seem insignificant but in MENA land they know the family structure is very important and all details are expected to be known by the in-laws. IMO I find it a bit strange they called his father. This makes me assume they had already reached a point in the Q &A where they were less then pleased with your fiance.

Did you husband send you a copy of the paper he was given? If so does it say denial or request for review? Small words...big difference. Call the CO or go if you are in Casablanca and see if can talk to someone and in the interim get your elected official involved. There is a pined thread in the MENA section that you should go over. I think you are the 6th or 7th denial in the past 2-3 weeks out of Casablanca.

Hi everybody, I am new to this but not new to the immigration process. what can I do. I am an Haitian citizen recently moved to Dominican Republic due to the earthquake. My Husband and I are now in the NVC process. I have several questions. can I somehow get my interview here in DR and do all the medical exam here since everything is pretty much destroyed where i was and I am scared to miss the interview letter? Do I need a police report for DR too, NVC web said no but our lawyer think we need too.

Also, we knew that we are supposed to file the waiver because I overstayed my visa ,and I heard that it usually takes about 6 months to get a decision but I was wondering if you guys heard anything about it being less than that? I am here in DR alone basically and trust me it is not fun. It is going to destroy me getting deny at the visa interview but I know this usually happends like this unless you are from Mexico. I am really not loking forward to stay here for 6 months but again it is better than Haiti right now. Please help :( Anything at all will be useful

Have you contacted the US Consulate in both Haiti and the DR? If not get that done ASAP. I am not sure about the waiver but I would assume you will able to file that at the time of your interview.

And I have no idea what the sentence referencing Mexico means.

Hello all,

I am planning on doing a DCF with the US Consulate in Casa next month and I will have a co-sponsor in the form of my one of my friends. My question is this:

1. Will she need to supply me with her 2008 or 2009 tax form and W-2?
2. Will a letter from her employer be necessary?
3. Does she need to show enough income for just my husband or for me too? Weird because I cant seem to figure this out.
4. I have been in Morocco since August 2008 and I have no income for 2009 to report on my taxes. Do I still have to file or can I simply write a letter to the Consulate stating where in the US tax code I derived this information from.


And off topic...
6. I speak a moderate amount of Arabic and my husband speaks a moderate amount of English. What language will our interview be conducted in?

The United States Consulate General in Casablanca would like to inform
all American Citizens residing in or traveling to Morocco that our
office hours for American Citizen Services for December 24 will be from
8:30 a.m. to 10:30 a.m. The Consulate General will close at 12:00 p.m.
on Thursday, December 24 for the Christmas holiday. As a reminder, we
will be closed on Friday, December 25. Normal office hours will resume
on Monday, December 28, 2009.
For those non-immigrant or immigrant visas that were approved for
issuance on Wednesday, December 23, 2009 or before, passports with
printed visas will be ready for pickup at 10:30 a.m. on Thursday,
December 24, 2009. Those visas approved on Thursday, December 24, 2009
will be ready for pickup on Monday, December 28, 2009 at 3:00 p.m.

It's good that they only need his BC. I wonder why they just noticed the error. Was the error a big one? I guess it does not matter to them they need it to be perfect.

I know this is hard but you are almost done. Just hang in there.

I am living in Morocco currently and my husband just got his criminal background check. I dont think the US CO has access to expunged records but I could be wrong. I am sure others will correct me here.

Of course its better that I am not with him...if he can treat me in this way that i dont have more years invested in the relationship...but the loss is more than I can bare right now....as I said I lost my parents too in the last 2 years and now my husband Im not sure I want to live


Please try to speak to a professional who can guide you here. I am sure you must be feeling a myriad of emotions but hang close to the knowledge that this life is short for all of us and our actions here will guide our fate in the next life.

The lost of parents is hurtful regardless of the age of the child but you should know your parents would not want you to speak like this.

You had a successful life before him and there is no reason why you can not continue to have a successful life.
May God guide you toward better days.

That's good to know. I've found the pharmacy/medicine process interesting in Morocco. It seemed like prescriptions aren't as necessary as they are here, for some things anyway. What's been your experience with the quality of the medical care and the medicine there, if you have experience with it?


I have been lucky in that I have never been sick here but I have accompanied my husband and kids to the doctor. My dentist speaks perfect English but I speak to her in Arabic. She charges 200 dh for a cleaning which is expensive to my Moroccan friends here. All the medicine that has been prescribed to my family is from American companies like Glaxo. The only thing is that are made in France or here in Morocco. For example my daughter is an asthmatic but she is taking the same meds she was back in the States. The cost is about $10.


The weird thing is that I can renew my families prescriptions here without having to go to the doctor and get a new script.

I brought Tylenol other American OTC drugs with me and I have my sister ship me things I run out of.

I received another call from my senator's office this morning regarding why Ahmed's visa was denied. USCIS did not give out that information. All of you have said that most of the time that information cannot be found out, but I had to try. Also USCIS cannot give a timeline. I was given the advice to wait on USCIS to review my returned petition. I am considering moving to Morocco. Does anyone know if I can get my medications there, one in paticular, Actos?



I have been living in Morocco for 2 years now. The doctors are really cheap and the meds are also. Not sure what Actos is but I will ask this week at the pharmacist.

UPDATE.................wow, my senators office has done such a super job in helping us understand and sort thru this mess as well as getting a quick response....Casa sent an email....some of it as follows.....The visa has not been denied. Rather, Mr. ****** case was returned to the Department of Homeland Security's Bureau of Citizenship and Immigration Services (USCIS) on February **, 2010 for further review......The decision to send the file back was not made because of confusion about her last name. You can let your constituent know that two different officers agreed that the case warranted additional review by the Department of Homeland Security.

Well at least we know it's not an intent to revoke i guess...looks like we're in for a wait...#######!!!!!!!! :wacko:


Save that email. That is great that they dispelled one theory but I just wish for you they would have just finished their sentence.
